EXPLANATORY MEMORANDUM

1. CONTEXT OF THE PROPOSAL

• Reasons for and objectives of the proposal

The proposal concerns a Council Decision on the second instalment of the financial

contributions to the 11th European Development Fund to be paid by parties to the European

Development Fund (‘EDF’) in 2026.

The 11th EDF and other EDF that are still open (the 9th and 10th EDF) are managed under the

following set of rules:

1. the Internal Agreement between the Representatives of the Governments of the

Member States of the European Union, meeting within the Council, on the financing

of European Union aid under the multiannual financial framework for the period

2014 to 2020, in accordance with the ACP-EU Partnership Agreement and on the

allocation of financial assistance for the Overseas Countries and Territories to which

Part Four of the Treaty on the Functioning of the European Union applies(1) (the 11th

EDF ‘Internal Agreement’);

2. Council Regulation (EU) 2018/1877 on the Financial Regulation applicable to the

11th European Development Fund(2) (the ‘11th EDF Financial Regulation’);

3. Council Decision (EU) 2020/2233 concerning the commitment of the funds

stemming from reflows under the ACP Investment Facility from operations under the

9th, 10th and 11th European Development Funds(3);

4. Council Decision (EU) 2022/1223(4) concerning the allocation of funds de-committed

from projects under the 10th and 11th European Development Funds for the purpose

of financing actions addressing the food security crisis and economic shock in

African, Caribbean and Pacific (ACP) countries following Russia’s war of

aggression against Ukraine.

The documents referred to in points (a) to (d) contain multi-annual commitments by the

parties to support the EDF treasury financially. The 11th EDF Financial Regulation provides

for regular contributions to be made by the parties to the EDF treasury against pre-determined

financial commitments. Regular contributions are triggered by technical Council Decisions

that reflect the implementation of financial commitments previously decided.

COUNCIL DECISION

on the financial contributions to be paid by the parties to the European Development

Fund as a second instalment for 2026

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Internal Agreement between the Representatives of the Governments of

the Member States of the European Union, meeting within the Council, on the financing of

European Union aid under the multiannual financial framework for the period 2014 to 2020,

in accordance with the ACP-EU Partnership Agreement and on the allocation of financial

assistance for the Overseas Countries and Territories to which Part Four of the Treaty on the

Functioning of the European Union applies(1) and in particular Article 7(2) in conjunction

with Article 14(3) thereof,

Having regard to Council Regulation (EU) 2018/1877 of 26 November 2018 on the financial

regulation applicable to the 11th European Development Fund, and repealing Regulation (EU)

2015/323(2), and in particular Article 19(3) thereof,

Having regard to the proposal from the European Commission,

Whereas:

(1) In accordance with Article 1 of the Internal Agreement between the Representatives of

the Governments of the Member States of the European Union, the contribution key

for each party to the European Development Fund (EDF) is established(3).

(2) In accordance with Article 46 of Council Regulation (EU) 2018/1877, the European

Investment Bank (‘EIB’) is to send to the Commission its updated estimates of

commitments and payments under the instruments it manages.

(3) In accordance with Article 19(3) of Council Regulation (EU) 2018/1877, the

Commission is to present a proposal by 15 June 2026 specifying the amount of the

second instalment of the contribution for 2026.

(4) Pursuant to Article 20(1) of Council Regulation (EU) 2018/1877 calls for

contributions are to first use up the amounts provided for in previous European

Development Funds (‘EDF’). Therefore a call for funds pursuant to Regulation (EU)

2018/1877, for the EIB and for the Commission should be made.

(5) Council Decision (EU) 2025/2324(4), sets the annual amount of the contribution to be

paid by the parties to the EDF for 2026 at EUR 700 000 000 for the Commission(5).

(6) In order to allow for the prompt application of the measures provided for in this

Decision, this Decision should enter into force on the day of its publication in the

Official Journal of the European Union,

HAS ADOPTED THIS DECISION:

Article 1

The amount of the contributions to be paid by the parties to the European Development Fund

as a second instalment for 2026 is hereby set at EUR 250 000 000 for the Commission.

Article 2

The individual European Development Fund contributions shall be paid by the parties to the

European Development Fund to the European Commission as the second instalment for 2026,

in accordance with the Annex.

Article 3

This Decision shall enter into force on the date of its publication in the Official Journal of the

European Union.

* Further to Art. 153 of the Withdrawal Agreement, the UK formally

requested in March 2023 that the Commission refunds their outstanding

share of the 10th and 11th EDF reserves and net out regularly their

outstanding contribution to the EDF . This net-out will be reflected in the

SELETUSKIRI

1. ETTEPANEKU TAUST

• Ettepaneku põhjused ja eesmärgid

Käesoleva ettepanekuga esitatakse nõukogu otsus 11. Euroopa Arengufondi (edaspidi „EAF“)

osamaksu teise osa kohta, mille EAFi liikmed peavad 2026. aastal tasuma.

11. EAFi ja teiste seni avatud EAFide (9. ja 10. EAFi) vahendite haldamisel kehtivad

järgmised õigusnormid:

1. sisekokkulepe nõukogus kokku tulnud Euroopa Liidu liikmesriikide valitsuste

esindajate vahel Euroopa Liidu abi rahastamise kohta mitmeaastase finantsraamistiku

(2014–2020) alusel vastavalt AKV-ELi partnerluslepingule ning finantsabi

eraldamise kohta nendele ülemeremaadele ja -territooriumidele, mille suhtes

kohaldatakse Euroopa Liidu toimimise lepingu(1) neljandat osa (edaspidi „11. EAFi

sisekokkulepe“);

2. nõukogu määrus (EL) 2018/1877, mis käsitleb 11. Euroopa Arengufondi suhtes

kohaldatavat finantsmäärust(2) (edaspidi „11. EAFi finantsmäärus“);

3. nõukogu otsus (EL) 2020/2233, mis käsitleb AKV riikide investeerimisrahastu

raames 9., 10. ja 11. Euroopa Arengufondi rahastamistoimingutest tagasisaadavate

vahendite sidumist kulukohustustega(3);

4. nõukogu otsus (EL) 2022/1223,(4) mis käsitleb 10. ja 11. Euroopa Arengufondi

projektidest vabanenud vahendite eraldamist, et rahastada Aafrika, Kariibi mere ja

Vaikse ookeani piirkonna (AKV) riikides meetmeid toiduga kindlustatuse kriisi ja

majandusšoki leevendamiseks, mille on põhjustanud Venemaa agressioonisõda

Ukraina vastu.

Punktides a–d osutatud dokumendid sisaldavad liikmete mitmeaastaseid kohustusi EAFi

sularahahalduse finantsiliseks toetamiseks. 11. EAFi finantsmääruse kohaselt tasuvad liikmed

korrapäraselt osamakse EAFi sularahahaldusele vastavalt eelnevalt kindlaks määratud

finantskohustustele. Korrapärased osamaksud tasutakse vastavalt nõukogu tehnilistele

otsustele, mis kajastavad eelnevalt kindlaks määratud finantskohustuste rakendamist.

11. EAFi finantsmääruse artikli 19 lõike 3 kohaselt peab nõukogu tegema käesoleva

ettepaneku kohta otsuse hiljemalt 21 kalendripäeva jooksul pärast seda, kui Euroopa

Komisjon, kes tegutseb Euroopa Liidu nimel, on käesoleva ettepaneku esitanud.

Ettepanek:

NÕUKOGU OTSUS,

mis käsitleb Euroopa Arengufondi liikmete osamaksu teist osa 2026. aastaks

EUROOPA LIIDU NÕUKOGU,

võttes arvesse Euroopa Liidu toimimise lepingut,

võttes arvesse sisekokkulepet nõukogus kokku tulnud Euroopa Liidu liikmesriikide valitsuste

esindajate vahel Euroopa Liidu abi rahastamise kohta mitmeaastase finantsraamistiku (2014–

2020) alusel vastavalt AKV-ELi partnerluslepingule ning finantsabi eraldamise kohta nendele

ülemeremaadele ja -territooriumidele, mille suhtes kohaldatakse Euroopa Liidu toimimise

lepingu neljandat osa,(1) eriti selle artikli 7 lõiget 2 koostoimes artikli 14 lõikega 3,

võttes arvesse nõukogu 26. novembri 2018. aasta määrust (EL) 2018/1877, mis käsitleb 11.

Euroopa Arengufondi suhtes kohaldatavat finantsmäärust ning millega tunnistatakse

kehtetuks määrus (EL) 2015/323,(2) eriti selle artikli 19 lõiget 3,

võttes arvesse Euroopa Komisjoni ettepanekut

ning arvestades järgmist:

(1) Euroopa Arengufondi (EAF) iga liikme osamaksude panustamispõhimõte on

kehtestatud vastavalt Euroopa Liidu liikmesriikide valitsuste esindajate

sisekokkuleppe(3) artiklile 1.

(2) Euroopa Investeerimispank (EIP) edastab komisjonile oma hallatavate

rahastamisvahendite kohta kulukohustuste ja maksete ajakohastatud prognoosi

vastavalt nõukogu määruse (EL) 2018/1877 artiklile 46.

(3) Vastavalt nõukogu määruse (EL) 2018/1877 artikli 19 lõikele 3 esitab komisjon 15.

juuniks 2026 ettepaneku, millega nähakse ette 2026. aasta osamaksu teise osa summa.

(4) Nõukogu määruse (EL) 2018/1877 artikli 20 lõike 1 kohaselt tuleb osamaksunõuetega

kustutada kõigepealt varasemate Euroopa Arengufondide (EAFide) raames ette nähtud

summad. Seepärast tuleks vastavalt määrusele (EL) 2018/1877 esitada nõue tasuda

osamaks EIP-le ja komisjonile.

(5) Nõukogu otsusega (EL) 2025/2324(4) on EAFi liikmete 2026. aasta osamaksu

summaks määratud komisjoni puhul 700 000 000 eurot(5).

(6) Selleks et käesolevas otsuses sätestatud meetmeid oleks võimalik viivitamata

kohaldada, peaks see jõustuma Euroopa Liidu Teatajas avaldamise päeval,

ON VASTU VÕTNUD KÄESOLEVA OTSUSE:

Artikkel 1

Euroopa Arengufondi liikmete osamaksu teise osa suurus 2026. aastal on komisjoni puhul

250 000 000 eurot.

Artikkel 2

Euroopa Arengufondi liikmete poolt komisjonile makstava Euroopa Arengufondi 2026. aasta

osamaksu teise osa summad on esitatud lisas.

Artikkel 3

Käesolev otsus jõustub selle Euroopa Liidu Teatajas avaldamise päeval.

* Vastavalt väljaastumislepingu artiklile 153 esitas Ühendkuningriik

2023. aasta märtsis ametliku taotluse, et komisjon maksaks tema

järelejäänud osa 10. ja 11. EAFi reservist tagasi tema EAFi tasumata

osamaksu korrapärase tasaarveldamise kaudu. Seda tasaarveldust

kajastatakse vastavates maksejuhistes.
