Dear Sir or Madam,
I would like to inform you that the Supreme Court of Poland had planned to participate in the colloquium of the Network of Presidents of the Supreme Judicial Courts of the European Union. However, we have recently received an email from the Secretariat of the Network of Presidents, which we have attached below, and in response to this, on behalf of the First President of the Supreme of Poland, Mr Zbigniew Kapiński, I am pleased to forward to you a letter addressed to the President of the Network of the Presidents of the Supreme Judicial Courts of the European Union, Mr Donal O’Donnell, and the Members of the Network’s Board.

Dear Ms Winiarska,
We would like to sincerely thank First President Kapiński for the interest in joining the Network of the Presidents of the Supreme Judicial Courts of the European Union.
We are writing to inform you of a development that has a direct bearing on the handling of First President Kapiński’s application. Following the discussions held by the Board of the Network in March 2026, the Board convened an extraordinary General Assembly on the occasion of the forthcoming Network conference in Limassol. At that General Assembly, the Board will submit to the Members a proposal to amend the Articles of Association of the Network, in particular as regards the conditions for membership.
Should these amendments be adopted by the General Assembly, the conditions for membership would be the following (Article 4 of the Articles of Association): the Members of the Network are the Presidents of the Supreme Judicial Courts within the Member States of the European Union the courts of which meet the conditions required to constitute an independent and impartial tribunal within the meaning of the case law of the European Court of Human Rights and the requirements for effective judicial protection within the meaning of the case law of the Court of Justice of the European Union.
These conditions would be continuing in nature and apply both to applicants and to existing Members. Compliance would be assessed in accordance with the Articles of Association and the Byelaws of the Network, including the procedures they provide.
In light of these forthcoming developments, the Board has decided that First President Kapiński’s application for admission to the Network will be examined after the General Assembly to be held in Limassol and in accordance with the amended framework, should it be adopted.
In the meantime, and pending a decision on the application, it is regretfully not possible to confirm First President Kapiński’s registration for the Limassol conference at this stage.
We shall of course revert in due course following that meeting and remain at your disposal for any further information you may require.
