Riigiabi suuniste asjakohased
meetmed

Euroopa Komisjon (edaspidi komisjon) võttis 16. märtsil 2026 vastu kaks maismaa- ja
mitmeliigilise transpordi riigiabi käsitlevat õigusakti:
1) Komisjoni määrus (EL) 2026/562, millega tunnistatakse teatavat liiki abi raudtee- ja
siseveetranspordi ning mitmeliigilise transpordi sektoris Euroopa Liidu toimimise lepingu
artiklite 93, 107 ja 108 kohaldamisel siseturuga kokkusobivaks (ELT L, 2026/562, 30.03.2026)
2) Komisjoni teatis Suunised maismaa- ja mitmeliigilise transpordi sektoris antava riigiabi
kohta (ELT C, C/2026/1656, 30.03.2026) (edaspidi suunised).
Seoses suunistega saatis komisjon kirja (lisatud, i.k), milles tuletatakse meelde, et vastavalt
suuniste punktile 264 tuleb komisjonile teatada asjakohastest meetmetest:
„264. Komisjon paneb aluslepingu artikli 108 lõike 1 alusel liikmesriikidele ette alljärgnevaid
asjakohaseid meetmeid.
a) Vajaduse korral muudavad liikmesriigid olemasolevaid abikavasid, mis on heaks kiidetud
2008. aasta raudteesuuniste alusel või vahetult aluslepingu artikli 93 alusel, et viia need
käesolevate suunistega kooskõlla hiljemalt 1. märtsiks 2027.
b) Liikmesriigid annavad oma sõnaselge ja tingimusteta nõusoleku punkti 264 alapunktis a)
esitatud asjakohasteks meetmeteks (kahe kuu jooksul alates käesolevate suuniste avaldamisest
Euroopa Liidu Teatajas). Kui liikmesriik ei vasta, siis eeldab komisjon, et asjaomane liikmesriik
ei ole kavandatud meetmetega nõus.“
Meile teadaolevalt ei ole Eestis suuniste punkti 264 alapunktis a nimetatud abikavasid, kuid
palume Teil seda kinnitada.

Palume hiljemalt 26. juuniks ka Teie kinnitust, et Eesti võib nõustuda komisjoni pakutud
asjakohaste meetmetega. Vastava kirja saadab komisjonile Rahandusministeerium.

Subject: Actions to take to comply with the new State aid Land and Multimodal
Transport Guidelines (LMTG) and Transport Block Exemption Regulation (TBER)
Dear Madam, dear Sir,
On 16 March 2026, the following two new State aid instruments in the sustainable land transport sector were adopted by the Commission and apply since 30 March 2026:
– Communication from the Commission – Guidelines on State aid for land and multimodal
transport1 (hereinafter the ‘LMTG’);
– Commission Regulation (EU) 2026/562 of 16 March 2026 declaring certain categories of aid in the rail, inland waterways and multimodal transport sector compatible with the internal market in application of Articles 93, 107 and 108 of the Treaty on the Functioning of the European Union2 (hereinafter the ‘TBER’).
In accordance with Article 108(1) of the Treaty, under point 264 (a) of the LMTG, the Commission proposes that Member States amend their existing aid schemes to bring them in line with the LMTG by 1 March 2027 at the latest. This encompasses all existing State aid schemes which have not expired by that date. Given the entry into force of also the TBER, Member States can also choose to bring existing schemes in line with the TBER instead of the LMTG.
Under point 264 (b) of the LMTG the Commission invites the Member States to give their explicit unconditional agreement to the proposed appropriate measures within two months from the date of publication of the LMTG in the Official Journal of the European Union, i.e. this should have been done by 30 May 2026. In line with such agreement, Member States will have to amend their existing aid schemes in order to align them with the LMTG (or TBER) by 1 March 2027.
1. If your authorities have not yet given their explicit unconditional agreement to these appropriate measures, we would like to invite you to do so. Please confirm in your reply the situation applicable to your Member State, i.e. that:
(a) no State aid scheme supporting the sustainable land transport sector is currently in force, or all such aid schemes will expire before 1 March 2027; or
(b) State aid schemes supporting the sustainable land transport sector are in force and do not expire by 1 March 2027: in this case, please provide an exhaustive list of those State aid schemes, and confirm that your authorities give their explicit unconditional agreement to the proposed appropriate measures, i.e. to bring them in line with the LMTG (or TBER).
In the absence of a reply, the Commission will assume that the Member State in question does not agree with the proposed measures.
If a Member State does not agree to the proposed appropriate measures, the Commission would have to proceed in accordance with Article 23(2) of Regulation (EU) 2015/1589, and may have to open a formal investigation procedure.

list of your State aid schemes supporting the sustainable land transport sector currently in force and which will not have expired by 1 March 2027.
