Thank you all for the good meeting last week. I’m attaching the slides that I’ve shown.
Earlier today we published an update about the status of type-approval process under the Article 39 (EU) 2018/858 exemption process. RDW asked for additional time to be able to read the entire documentation package and now they are telling us to expect the provisional EU type approval around 10 April 2026.
We also managed to have a meeting with them earlier this week on the procedure to recognise the provisional EU type approval. Under Article 39 (4) RDW needs to inform you once the provisional approval is granted, after which rules under Article 39 (5) apply - other approval authorities may accept the provisional approval provided you inform RDW in writing. We will also let you know as soon as the provisional approval gets granted in case this information gets lost.
The plan for TCMV remains the same - 24 March under AOB, RDW will ask to be put on the May agenda. In May we will have the presentation of the proposal and hopefully be able to address all questions by Member States by end June.
As mentioned last week, we know that the Demo wasn’t perfect and we have started additional data collections in Estonia already this week. By mid-April we believe we can have a much more improved system for Estonian roads than what you already tried.
We would be delighted if Estonia would be interested in recognising the provisional EU type-approval and we are open to send over any information and documentation that was included in this type-approval process. Also, we are open to do another demo drive if needed.

It’s been some time since we talked.
In the meantime we did quite some testing across Europe (1.5 million km) and also validation on Estonian roads has been very successful.
I wondered if we could have a short meeting regarding type-approval of our system in Estonia to be deployed to customers?
We are currently finalising our type-approval under the Article 39 procedure of (EU) 2018/858 and we will likely receive provisional EU type-approval limited to Netherlands next month. Under Article 39 (5), other Member States (incl. Estonia) can recognise the provisional EU type-approval almost immediately, without the need to wait for an EU-wide type-approval.
The recognition of the provisional type-approval, but also the process to obtain EU-wide type-approval in the European Commission’s Technical Committee on Motor Vehicles (TCMV) would be our main agenda points. If there’s interest on your side we can also organise a demonstration drive of Tallinn the same day of the meeting.
If the meeting would be online, we can look for a slot in the next 2 weeks. If we opt for an in-person meeting in Tallinn, first half of March looks good in our calendars.
Do let us know if we need to invite additional colleagues on your side for such a meeting.

For the registration of vehicles the both ways are acceptable for us.
If it is registered in other EU country, you should have a registration certificate and a document ( invoice/agreement/confirmation) that confirms the vehicle belongs to you.
If it is new vehicle, you should submit for registration the Certificate of Conformity and a document ( invoice/agreement/confirmation) that confirms the vehicle belongs to you.

Thank you for the information that testing will be possible. The general information about the system can be found here: https://www.youtube.com/watch?v=tJc-ZtO5b_E - I would like to note that in the US the FSD (supervised) system drives over the speed limit as it's common to speed, but in Estonia we would cap the system at 120 kmph. Please find attached also a slide deck that we are showing to policymakers and we can jump on a call next week if needed to clarify.
We would like to test the following situations on public roads (I would like to emphasize that Tesla's drivers will be extremely cautious to take over control immediately to avoid any incident.):
Regarding registration and documentation of vehicles, we are proposing to test on EU type-approved vehicles (Tesla Model S, X, 3, Y), on which we can download FSD (supervised) through an over-the-air-update. We are flexible to bring cars that are already registered with a foreign EU licence plate or to bring a new vehicle to Estonia which we then register with Estonian licence plates. Do let us know what would you prefer.

It is possible to test Level 2 automated driving systems in Estonia.
The testing description mentioned by you satisfies the most of our conditions. Additionally we like to get beforehand the description of the automated driving systems what is planned to test.
And what concern the registration of vehicle, there is also needed documentation of vehicles. Are these vehicles type-approved according European Regulations?
