Your Excellency,

Article 11 of Directive (EU) 2020/2184 of the European Parliament and of the Council on

the quality of water intended for human consumption (1) the Drinking Water Directive,

established a framework for EU minimum hygiene requirements for materials that come

into contact with water intended for human consumption.

The Commission Delegated Regulation (EU) 2024/370 (2) (hereafter “the Regulation”)

supplementing the Directive by laying down conformity assessment procedures for

products that come into contact with water intended for human consumption and the rules

for the notification of conformity assessment bodies involved in those procedures,

entered into force on 13 May 2024. The provisions of the Regulation relating to notification

and notifying authorities apply from 31 December 2026. Member States may notify

conformity assessment bodies to the European Commission under the Regulation from that

date. This notification must be carried out by a designated national notifying authority.

In addition, Article 11(7) of the Drinking Water Directive establishes that Regulation

(EU) 2019/1020 on market surveillance and compliance (3) shall apply to products

covered by the Article 11 of the Directive. Article 10(2) of Regulation (EU) 2019/1020

requires that each Member State shall inform the Commission and the other Member States

of its market surveillance authorities and the areas of competence of each of those

authorities.

To date, the Commission has not received information concerning the designation of the

national notifying authority and market surveillance authority and would therefore

urge the competent authorities of your Member State to take the necessary measures to

ensure implementation as soon as possible by the end of the year. This follows from the

Commission call on the Member States to take urgent action during the Water and Marine

Directors’ meeting on 18 and 19 June.

I would like to point out that Article 11 of the Drinking Water Directive is important both

for health protection and for the Single Market, as it seeks to replace fragmented national

systems for materials in contact with drinking water with a harmonised EU framework.

Relevant information on the upcoming implementation of the Regulation and the

competent authorities in the Member States, can be consulted on the Commission’s

Drinking Water Directive’s implementation website. Should any support or guidance be

required in this regard, the Commission services remain at your disposal.

I would be grateful if you could inform me on the state of play regarding the designation

of a national notifying authority and market surveillance authority in your Member State

as soon as possible, given that the date of application (31 December 2026) is approaching.

Euroopa Parlamendi ja nõukogu direktiivi (EL) 2020/2184 olmevee kvaliteedi kohta1

(joogivee direktiiv) artikliga 11 on ette nähtud raamistik olmeveega kokkupuutuvate

materjalide suhtes kehtivate ELi minimaalsete hügieeninõuete jaoks.

Komisjoni delegeeritud määrusega (EL) 2024/370,2 mis jõustus 13. mail 2024. aastal, on

täiendatud seda direktiivi ning kehtestatud olmeveega kokkupuutuvate toodete suhtes

kohaldatavad vastavushindamismenetlused ja neis menetlustes osalevate

vastavushindamisasutuste määramise eeskirjad. Kõnealuse määruse sätteid teavitavate

asutuste määramise ja määratud teavitavate asutuste (teada antud asutused) kohta

kohaldatakse alates 31. detsembrist 2026. Liikmesriigid võivad kõnealuse määruse

kohaselt määratud vastavushindamisasutused Euroopa Komisjonile teada anda alates

sellest kuupäevast. Määramine peab toimuma vastava riikliku teavitamisasutuse kaudu.

Lisaks on joogivee direktiivi artikli 11 lõikes 7 sätestatud, et kõnealuse direktiivi artikliga

11 hõlmatud toodete suhtes kohaldatakse määrust (EL) 2019/1020 (turujärelevalve ja

toodete vastavuse kohta)3. Vastavalt määruse (EL) 2019/1020 artikli 10 lõikele 2 peab iga

liikmesriik teavitama komisjoni ja teisi liikmesriike oma turujärelevalveasutustest ning

iga kõnealuse asutuse pädevusvaldkondadest.

Praegu ei ole komisjon saanud Teie riigi kohta teavet ei riikliku teavitava asutuse ega

turujärelevalveasutuse määramise kohta ning sooviks seega Teie riigi pädevatele

asutustele tungivalt meelde tuletada, et nad võtaksid joogivee direktiivi rakendamise

tagamiseks vajalikud meetmed niipea kui võimalik ja hiljemalt aasta lõpuks. See on

kooskõlas komisjoni sooviga, et liikmesriigid võtaksid viivitamata meetmeid kooskõlas

vee- ja merenduspoliitikaga tegelevate direktorite koosolekul (18. ja 19. juunil) räägituga.

Ma juhin tähelepanu, et joogivee direktiivi artikli 11 kohaselt on see tähtis nii tervisekaitse

kui ka ühtse turu seisukohast, kuna nii püütakse asendada joogiveega kokkupuutuvaid

materjale käsitlevad killustatud riiklikud eeskirjad asjakohase ELi ühtse raamistikuga.

Asjakohane teave kõnealuse määruse tulevase rakendamise ja liikmesriikide pädevate

asutuste kohta on leitav komisjoni joogivee direktiivi rakendamise veebisaidil. Komisjoni

talitused on Teie käsutuses, kui peaksite vajama selles osas tuge või nõustamist.

Oleksin väga tänulik, kui saaksite mulle võimalikult kiiresti teada anda, mis seisus on Teie

liikmesriigis riikliku teavitamisasutuse ja järelevalveasutuse määramine, sest määruse

kohaldama hakkamise aeg (31. detsember 2026) on varsti käes.

liikmesriik teavitama komisjoni ja teisi liikmesriike oma turujärelevalveasutustest ning

iga kõnealuse asutuse pädevusvaldkondadest.

Praegu ei ole komisjon saanud Teie riigi kohta teavet ei riikliku teavitava asutuse ega

turujärelevalveasutuse määramise kohta ning sooviks seega Teie riigi pädevatele

asutustele tungivalt meelde tuletada, et nad võtaksid joogivee direktiivi rakendamise

tagamiseks vajalikud meetmed niipea kui võimalik ja hiljemalt aasta lõpuks. See on

kooskõlas komisjoni sooviga, et liikmesriigid võtaksid viivitamata meetmeid kooskõlas

vee- ja merenduspoliitikaga tegelevate direktorite koosolekul (18. ja 19. juunil) räägituga.

Ma juhin tähelepanu, et joogivee direktiivi artikli 11 kohaselt on see tähtis nii tervisekaitse

kui ka ühtse turu seisukohast, kuna nii püütakse asendada joogiveega kokkupuutuvaid

materjale käsitlevad killustatud riiklikud eeskirjad asjakohase ELi ühtse raamistikuga.

Asjakohane teave kõnealuse määruse tulevase rakendamise ja liikmesriikide pädevate

asutuste kohta on leitav komisjoni joogivee direktiivi rakendamise veebisaidil. Komisjoni

talitused on Teie käsutuses, kui peaksite vajama selles osas tuge või nõustamist.

Oleksin väga tänulik, kui saaksite mulle võimalikult kiiresti teada anda, mis seisus on Teie

liikmesriigis riikliku teavitamisasutuse ja järelevalveasutuse määramine, sest määruse

kohaldama hakkamise aeg (31. detsember 2026) on varsti käes.

Article 11 of Directive (EU) 2020/2184 of the European Parliament and of the Council on

the quality of water intended for human consumption (1) the Drinking Water Directive,

established a framework for EU minimum hygiene requirements for materials that come

into contact with water intended for human consumption.

The Commission Delegated Regulation (EU) 2024/370 (2) (hereafter “the Regulation”)

supplementing the Directive by laying down conformity assessment procedures for

products that come into contact with water intended for human consumption and the rules

for the notification of conformity assessment bodies involved in those procedures,

entered into force on 13 May 2024. The provisions of the Regulation relating to notification

and notifying authorities apply from 31 December 2026. Member States may notify

conformity assessment bodies to the European Commission under the Regulation from that

date. This notification must be carried out by a designated national notifying authority.

In addition, Article 11(7) of the Drinking Water Directive establishes that Regulation

(EU) 2019/1020 on market surveillance and compliance (3) shall apply to products

covered by the Article 11 of the Directive. Article 10(2) of Regulation (EU) 2019/1020

requires that each Member State shall inform the Commission and the other Member States

of its market surveillance authorities and the areas of competence of each of those

authorities.

To date, the Commission has not received information concerning the designation of the

national notifying authority and market surveillance authority and would therefore

urge the competent authorities of your Member State to take the necessary measures to

ensure implementation as soon as possible by the end of the year. This follows from the

Commission call on the Member States to take urgent action during the Water and Marine

Directors’ meeting on 18 and 19 June.

I would like to point out that Article 11 of the Drinking Water Directive is important both

for health protection and for the Single Market, as it seeks to replace fragmented national

systems for materials in contact with drinking water with a harmonised EU framework.

Relevant information on the upcoming implementation of the Regulation and the

competent authorities in the Member States, can be consulted on the Commission’s

Drinking Water Directive’s implementation website. Should any support or guidance be

required in this regard, the Commission services remain at your disposal.

I would be grateful if you could inform me on the state of play regarding the designation

of a national notifying authority and market surveillance authority in your Member State

as soon as possible, given that the date of application (31 December 2026) is approaching.

Euroopa Parlamendi ja nõukogu direktiivi (EL) 2020/2184 olmevee kvaliteedi kohta1

(joogivee direktiiv) artikliga 11 on ette nähtud raamistik olmeveega kokkupuutuvate

materjalide suhtes kehtivate ELi minimaalsete hügieeninõuete jaoks.

Komisjoni delegeeritud määrusega (EL) 2024/370,2 mis jõustus 13. mail 2024. aastal, on

täiendatud seda direktiivi ning kehtestatud olmeveega kokkupuutuvate toodete suhtes

kohaldatavad vastavushindamismenetlused ja neis menetlustes osalevate

vastavushindamisasutuste määramise eeskirjad. Kõnealuse määruse sätteid teavitavate

asutuste määramise ja määratud teavitavate asutuste (teada antud asutused) kohta

kohaldatakse alates 31. detsembrist 2026. Liikmesriigid võivad kõnealuse määruse

kohaselt määratud vastavushindamisasutused Euroopa Komisjonile teada anda alates

sellest kuupäevast. Määramine peab toimuma vastava riikliku teavitamisasutuse kaudu.

Lisaks on joogivee direktiivi artikli 11 lõikes 7 sätestatud, et kõnealuse direktiivi artikliga

11 hõlmatud toodete suhtes kohaldatakse määrust (EL) 2019/1020 (turujärelevalve ja
