Introduction
This note is submitted in response to the Agency's request (Ref. Ares(2026)6513877 - 29/06/2026) for supporting documentation and information regarding the procurement procedure selected for detailed assessment under the sampling exercise.
The procurement procedure was conducted by the Beneficiary in accordance with the applicable provisions of the Estonian Public Procurement Act and through the Estonian Public Procurement Register (Riigihangete Register – RHR), which is the national e-procurement platform used for conducting public procurement procedures in Estonia.
The purpose of this note is to facilitate the assessment of the procurement procedure by providing an overview of the procurement process and by indicating where the relevant information can be found within the enclosed documentation.
Procurement Procedure
The procurement concerned:
Subject of the contract: Construction of dual carriageway (2+2 lane) sections of National Road No. 4 (E67) Tallinn–Pärnu–Ikla between km 62.2–64.8 (Päädeva–Orgita) and km 68.2–70.2 (Haimre Interchange)
Estimated value: EUR 34,100,000.00
Contract value: EUR 27,786,775.79

The procurement was published and conducted through the Estonian Public Procurement Register. All procurement-related communications, submission of tenders, evaluation activities and award decisions were documented within the procurement file.

Selection Criteria
The selection criteria applicable to economic operators were established in the procurement documents prior to the submission deadline.

No criteria were introduced, modified, or applied after the submission deadline.
Award Criteria
The contract award criteria were established in the procurement documents before tenders were submitted.

The assessment of all tenders was carried out exclusively on the basis of these published criteria.

The attached documentation demonstrates that the evaluation methodology applied by the evaluation committee corresponds to the methodology published in the procurement documents and that all tenderers were treated equally and in a transparent manner.
Evaluation and Selection of the Successful Tenderer
The evaluation committee reviewed all received tenders in accordance with the procurement documents.
The successful tender was selected because it achieved the highest evaluation result under the published award criteria.
The evaluation report identifies:
• all tenders received;
• the prices;
• the application of the award methodology;
• the ranking of the tenderers; and
• the justification for selecting the successful tenderer.

Contract Award
Following completion of the evaluation, the beneficiary concluded the contract with the successful tenderer.

The contract was concluded on the basis of the successful tender and in accordance with the conditions established in the procurement documents.
Compliance Statement
The Beneficiary confirms that:
• the procurement procedure was conducted in accordance with the applicable provisions of Estonian public procurement legislation;
• procurement documents, selection criteria and award criteria were established before the submission deadline;
• all tenderers were assessed on the basis of the same criteria and methodology;
• the evaluation process was documented through formal evaluation reports and decisions;
• the successful tenderer was selected on the basis of the published award criteria; and
• sufficient documentation has been retained to provide a complete audit trail of the procurement procedure.
