Subject: Request for a language waiver for the “Commission Implementing
Decision on setting out the rules, including the measures, technical
requirements and guidelines, for the use of the Galileo Public Regulated
Service (PRS) by Member States at Initial Operational Capability
pursuant to Article 8(3) of Decision No 1104/2011/EU of the European
Parliament and of the Council” (PRS CONOPS)
Dear Ambassador, dear Competent PRS Authority (CPA),
Within the activities of the Space Programme, the Commission and the CPA of Member
States have drafted the Decision in subject that represents the Concept of Operations of
Galileo’s Public Regulated Service (PRS) (1), and that is of paramount importance since it
describes the modalities for the access by the different Member States to the common pool
of PRS resources, which has considerable security and operational implications.
Following the successful conclusion of the Inter Service Consultation and of the positive
vote in the Space Programme Committee in Security Configuration, the draft Decision in
subject is ready to be translated in the languages of the Member States that have established
a CPA and, subsequently, to be submitted to the Cabinet for adoption.
Unfortunately, the Commission services have clarified the impossibility of translating the
draft Decision, which includes some n.36 pages classified RESTREINT UE/EU
RESTRICTED and n.57 pages classified CONFIDENTIEL UE/EU CONFIDENTIAL, in

ensured. It must ensure service continuity for its participants, even in the most crisis situations.

the foreseeable future (2). The Council services, which the Commission has consulted on
an extraordinary basis, have also stated the impossibility to meet this need. The
Commission understands that ensuring the availability of the Decision to the Member
States in the shortest possible timeframe is paramount in view of the ongoing PRS uptake
efforts by the Member States, and of the upcoming PRS Initial Operational Capability
(IOC) milestone.
In this context, since the Decision will entry into force by notification to the Member States
and that all translations would have to be available before the submission of the text to the
Cabinet for adoption, the Commission is hereby asking the Estonian government to agree
exceptionally to waive its rights deriving from Article 342 TFEU in conjunction with
Article 3 of the EC Regulation 1/1958 to have the full document translated in Estonian,
and to limit the translation only to the actual Decision (i.e. 3 pages) while leaving its annex
and appendixes (i.e. the technical document itself) adopted and notified to Member
States pursuant to Article 297 of the Treaty only in English.
The language waiver will be considered valid only if agreed by all the Member States to
whom the Decision is addressed.

(2) While translating the RUE part may be considered an ordinary translation effort (even if RUE Decisions
are normally much slimmer), translating the CUE part will require a substantial logistical effort aimed
at ensuring availability in Brussels of both secure areas and of vetted translators.
