Dear Mrs. Minister,

Regarding Poland’s request for the European Commission to initiate proceedings concerning the activities of Meta Platforms under Regulation (EU) 2022/2065 of the European Parliament and of the Council (Digital Services Act – DSA), I would like to seek your support for Poland’s efforts to strengthen and intensify the European Union’s response to online fraud disseminated through very large online platforms (VLOPs).

Poland is observing a significant and growing threat arising from the misuse of social media advertising systems to promote financial fraud, facilitate the theft of personal data, and impersonate public institutions, businesses, banks and public figures. The scale and cross- border nature of this process make it a challenge that cannot be effectively addressed by individual Member States acting in isolation. It affects citizens across the European Union and generates substantial costs not only for individuals who fall victim to fraud, but also for public administrations, law enforcement authorities, cybersecurity institutions and the financial sector.

The rapid development of artificial intelligence increases the sophistication, credibility and scalability of fraudulent content, including advertisements designed to manipulate users, impersonate trusted individuals or institutions, and induce victims to disclose sensitive information or transfer funds. In Poland’s view, the scale and evolving nature of this threat requires a determined, coordinated and adequately resourced response at the European Union level. This is why Poland has called on the European Commission to deepen and, where appropriate, expand its ongoing actions concerning Meta and to conduct a comprehensive assessment of the effectiveness of the measures implemented to detect, prevent, mitigate and remove fraudulent advertisements on Facebook and Instagram.

For the aforementioned reasons, I would greatly appreciate your support for the European Commission to make full and effective use of the instruments available under the DSA. A coordinated position among Member States would provide a strong signal that combating online fraud and protecting European citizens in the digital environment remain key priorities for the European Union.

Poland remains fully committed to close cooperation with other Member States and the European Commission in this area. We stand ready to engage in bilateral and multilateral consultations and to exchange relevant information, data, analyses and best practices among competent authorities. We would also welcome cooperation on identifying and developing practical solutions that can strengthen the protection of citizens against online fraud and enhance the accountability of the largest digital platforms for the integrity and safety of their advertising environments. We are ready to host in-person or hybrid meeting of EU Member States’ leaders to discuss and address this issue.

We are convinced that only through determined and coordinated action by the Member States and the European Commission can the European Union address online fraud at a scale commensurate with the challenges facing Europe’s increasingly digital society.
