EXPLANATORY MEMORANDUM
1. CONTEXT OF THE PROPOSAL
• Reasons for and objectives of the proposal
Hydrogen is an integral part of the European Union's strategy for achieving climate neutrality
by 2050, as outlined in the EU Hydrogen Strategy1. The strategy positions hydrogen as a
versatile energy carrier capable of decarbonising sectors that are challenging to electrify. By
promoting the production and use of renewable and clean hydrogen, the EU aims to scale
hydrogen technologies, reduce dependency on fossil fuels, and propel sustainable economic
growth. This vision is further supported by the REPowerEU plan2, which aims to reduce
dependency on fossil fuel imports and accelerate the transition to renewable energy sources,
including clean hydrogen production and utilization across various sectors.
The potential of hydrogen to facilitate decarbonisation is acknowledged within the UNECE
framework, where it is considered a viable fuel option for non-road mobile machinery
(NRMM)3. This recognition highlights hydrogen’s environmental benefits and its capacity to
significantly lower emissions from NRMM engines. Despite this international
acknowledgment, hydrogen is not listed as a reference fuel under Article 25 of Regulation
(EU) 2016/1628. The absence of hydrogen in the regulatory framework limits the NRMM
sector's ability to transition to more sustainable technologies, hindering the EU's goals of
reducing carbon emissions and dependence on fossil fuels as outlined in the European Green
Deal4. Without recognizing hydrogen as a reference fuel, the EU risks innovation and market
entry for hydrogen-powered NRMM, thereby missing out on technological advancement
opportunities.
Therefore the proposal aims at:
Closing the Regulatory Gap: The primary objective is to amend Regulation (EU) 2016/1628
to include hydrogen as a reference fuel, ensuring that EU regulations are consistent with
international standards and aligned with the Union's environmental and climate objectives.
Facilitate Decarbonization and Enhance Energy Security: By incorporating hydrogen into the
regulatory framework, the initiative supports the EU's strategy to reduce carbon emissions and
achieve climate neutrality by 2050. It helps reduce reliance on fossil fuels and contributes to a
resilient and sustainable energy system.
Stimulating Innovation and Industrial Competitiveness: Recognising hydrogen as a viable fuel
encourages innovation within the NRMM sector, supporting research, development, and
deployment of hydrogen technologies. It aligns EU regulations with UNECE standards,
facilitating international trade and maintaining the competitiveness of EU manufacturers
globally.
• Consistency with existing policy provisions in the policy area
Article 35 of Regulation (EU) 2016/1628 allows for exemptions for new technologies or new
concepts, thereby paving the way for innovations to be integrated within the NRMM sector. A
manufacturer may apply for an EU type-approval in respect of an engine type or engine
family that incorporates new technologies or new concepts. Following the exemption granted

to the Netherlands under Article 355, Article 36 obliges the Commission to take necessary
steps to adapt the delegated and implementing acts to take account of these technological
developments. The inclusion of hydrogen in the list of reference fuels is a precondition for the
subsequent amendments to the delegated and implementing acts
• Consistency with other Union policies
The proposal is consistent with existing Union policies aimed at sustainability, climate action,
and technological innovation.
The introduction of hydrogen as a fuel for NRMM is integral to advancing the EU’s climate
neutrality goals. The NRMM sector is significantly impacted by the Effort Sharing Regulation
(ESR), which is the primary regulatory driver for their decarbonisation. The ESR mandates
emissions reductions across non-ETS sectors, including transport, construction, agriculture,
and inland navigation, facilitating compliance with EU-wide climate objectives.
The Clean Industrial Deal6 underscores the EU’s commitment to transforming its industrial
base as part of the Green Deal. By supporting the adoption of hydrogen technologies, the
amendment aligns with the objective to transition industries towards low-carbon production
processes, enhancing competitiveness and fostering sustainable growth. It also supports the
EU Climate Law7, which makes climate neutrality by 2050 legally binding and sets a 2030
emissions-reduction target, by helping cut industrial emissions.
The proposal is fully aligned with the EU Hydrogen Strategy8, which positions hydrogen as a
key energy carrier in the EU’s path to climate neutrality. This strategy provides a framework
for scaling up hydrogen production and utilisation across various sectors, including transport
and industry, aligning with the EU’s overarching climate objectives.
The amendment is in line with the EU Industrial Maritime Strategy9, where hydrogen as
reference fuel for NRMM engines is specifically mentioned under Pillar IV - Access to
Innovation.
The amendment is consistent with the Regulation on CO2 emission standards for heavy duty
vehicles10, which aim to reduce emissions from the transport sector and promote the uptake of
zero and low emission vehicles, including hydrogen-powered vehicles. By enabling the use of
existing technologies in the NRMM sector, the proposal ensures consistency in how
decarbonisation is approached across different types of machinery and vehicles, promoting
proven technology for emission reduction.
2. LEGAL BASIS, SUBSIDIARITY AND PROPORTIONALITY
• Legal basis
The legal basis for the proposal is Article 114 of the Treaty on the Functioning of the
European Union (TFEU).

• Subsidiarity (for non-exclusive competence)
The NRMM market involves extensive transnational trade. Without a unified EU approach,
disparate national regulations could lead to market fragmentation, creating technical barriers
to trade and inefficiencies for businesses operating across multiple countries.
An EU-wide regulatory framework is essential to maintain a level playing field. This prevents
fragmentation and facilitates the free movement of goods within the internal market.
The exclusion of hydrogen from the list of possible fuels for use in NRMM could impede
technological innovation and delay the adoption of hydrogen technologies, counteracting
shared EU environmental goals and market integration efforts.
• Proportionality
The proposal aligns EU regulations with already established international standards set by the
UNECE.
The initiative does not impose additional costs or new administrative burdens on stakeholders,
but it removes obstacles for the placing on the market of innovative new technologies that
meet the requirements of international standards. This means any required adjustments are
proportionate to the benefits of environmental sustainability and market competitiveness.
The proposal is designed to facilitate the EU's strategic goals in climate action and
technological innovation without imposing unnecessary burdens on businesses or Member
States. It is focused specifically on closing the regulatory gap in a way that supports the
Union’s broader decarbonization and sustainability objectives.
The proposal maintains proportionality and ensures that regulatory changes are necessary,
suitable, and balanced relative to their anticipated benefits.
• Choice of the instrument
Once the Netherlands have been authorised to grant EU type-approval for hydrogen engines
pursuant to Article 35, the Commission shall adapt the Regulations accordingly as laid down
in Article 36 of the Regulation. However, the inclusion of new reference fuels like hydrogen
is not included in the empowerments granted to the Commission. Therefore, an amendment to
the existing regulation is the necessary instrument to achieve this alignment, ensuring
regulatory coherence and harmonisation within the internal market.
3. RESULTS OF EX-POST EVALUATIONS, STAKEHOLDER

stakeholders at the NRMM expert group meetings in September 2024 and October 2025.

The amendment is based on established international standards and testing expertise derived
from UNECE Regulation No. 4911 and the recent amendments to Regulation No. 9612 for

mono- and dual-fuel engines, which recognise hydrogen as a potential fuel for NRMM
engines. Additionally, the process follows the Article 35 procedure of Regulation (EU)
2016/1628, as demonstrated by the authorisation granted to the Netherlands to grant EU type-
approval for a hydrogen mono-fuel engine13. The certification tests performed by the
designated technical service verified compliance with the existing environmental protection
standards.
• Impact assessment
The proposal does not require an impact assessment as it is aligned with the existing UNECE
Regulation 96, which already recognises hydrogen as a potential fuel. The proposal follows
the authorisation granted by the Commission to the Netherlands under Article 35 of the
Regulation (EU) 2016/1628 to grant EU type-approval for a hydrogen mono-fuel engine
based on extensive documentation. Article 36 of the Regulation stipulates that where the
Commission authorises the granting of an exemption pursuant to Article 35, it should
immediately take the steps necessary to adapt the delegated or implementing acts concerned
to technological developments. Against this background no further impact assessment is
necessary.

It adds hydrogen to the list of “reference fuels” used in the type-approval/emissions testing
framework.
It removes a CO₂ information/reporting obligation where the engine is operated solely on
hydrogen, because there is no CO₂ of fuel origin from combustion.

THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular
Article 114 thereof,
Having regard to the proposal from the European Commission,
After transmission of the draft legislative act to the national Parliaments,
Having regard to the opinion of the European Economic and Social Committee1,
Acting in accordance with the ordinary legislative procedure,
Whereas:
(1) Regulation (EU) 2016/1628 of the European Parliament and of the Council2
establishes emission limits for air pollutants from engines installed in non-road mobile
machinery.
(2) The Commission, by Implementing Decision C(2025) 1153 final3 of 25 February 2025
authorised the Netherlands under the exemption regime laid down in Article 35 of
Regulation (EU) 2016/1628 to grant EU type-approval for a type of engine for non-
road mobile machinery operating solely on hydrogen fuel. After the granting of that
exemption hydrogen as a reference fuel should be included in Regulation (EU)
2016/1628 to ensure consistency and harmonisation across the Union.
(3) In order to facilitate the market access and ensure the competitiveness of Union
manufacturers in the global market, it is appropriate to align the Union's regulatory
standards with UNECE Regulation No 964, Revision 04, which includes hydrogen as
reference fuel for non-road mobile machinery engines.

(4) Engines operating solely on hydrogen do not emit carbon-dioxide of fuel origin during
combustion. It is therefore appropriate to exempt manufacturers of hydrogen engines
from the obligation to report CO2 emissions as part of the type-approval process, thus
simplifying regulatory requirements for that technology.
(5) Regulation (EU) 2016/1628 should therefore be amended accordingly,
HAVE ADOPTED THIS REGULATION:
Article 1
Amendments to Regulation (EU) 2016/1628
1. Regulation (EU) 2016/1628 is amended as follows:
1. in Article 25(2), the first subparagraph, the following point is added:
‘(g) hydrogen.’;
2. in Article 43, paragraph 4 is replaced by the following:
‘4. Manufacturers shall make available to OEMs the value of the carbon dioxide
(CO2) emissions determined during the EU type-approval process and shall instruct
the OEMs to communicate that information, together with explanatory information
on the test conditions, to the end-user of the non-road mobile machinery in which the
engine is intended to be installed. However, that value is not required for engines
operated solely on hydrogen.’
Article 2
Entry into force
This Regulation shall enter into force on the twentieth day following that of its publication in
the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

1. EXECUTIVE SUMMARY
This Staff Working Document (SWD) accompanies a proposal to amend Regulation (EU)
2016/1628 to include hydrogen as a reference fuel for non-road mobile machinery (NRMM)
engines. By aligning EU regulations with exisiting international standards, the initiative is set
to foster sustainability and boost market competitiveness within the NRMM sector.
1.1. Overview of the initiative
Hydrogen is a key part in the EU's decarbonisation strategy1, offering considerable potential
to reduce CO2 emissions across various sectors, including NRMM. The proposed amendment
addresses the need to harmonise EU standards with those of the UNECE2. This alignment will
ensure the consistent application of rules across the Union, facilitating the seamless
movement of goods within the internal market and strengthening the global competitiveness
of EU industries. By incorporating hydrogen as a reference fuel, the EU is advancing its
commitment to the European Green Deal’s3 climate neutrality goals, transforming the NRMM
sector away from fossil fuel reliance, especially in sectors where electrification is difficult
such as the inland waterway transport (IWT) sector. The IWT is essential for the transport of
goods and passenger in Europe and the modal split is planned to increase in IWT and short
sea shipping by 25% by 2030 and 50% by 2050. The sector is also in a challenging energy
transition towards zero-emission by 2050. The use of alternative fuels such as hydrogen in
internal combustion engines (ICEs) of inland waterway vessels would help to reach the goals
but they are not reference fuels in Regulation (EU) 2016/1628. Without including hydrogen as
reference fuel, the approval of ICEs running on hydrogen is only possible by using the clauses
for innovation (Article 35 of the Regulation (EU) 2016/1628), but that approval is only valid
in the territory of the Member State which issued the approval. The sector needs a harmonised
solution given its international nature. Removing legal bottlenecks would facilitate and
encourage the sector to promote the deployment of sustainable drivetrains including inland
vessels.
1.2. Key objectives and expected outcomes
The primary objective of this amendment is to close existing regulatory gaps, promote
technological advancement, and enhance environmental sustainability. The integration of
hydrogen as a reference fuel is expected to drive significant environmental benefits, including
improved air quality and reduced health risks associated with air pollution. Economically, it
will incentivise innovation, stimulate industrial growth, and foster technological
advancements in hydrogen technology.
The amendment supports the EU’s strategic objectives of sustainability, innovation, and
market harmonisation by ensuring the role of hydrogen within the NRMM sector.

1.3. Necessity of EU action
The proposed EU action provides substantial added value by ensuring regulatory
harmonisation, enhancing market access and competitiveness, achieving collective
environmental objectives, and fostering innovation and economic efficiency across Member
States. These benefits underscore the indispensable role of coordinated EU action in
addressing complex, cross-border challenges within the internal market.
The EU NRMM sector is not only a major global producer but also one of the Union’s most
export-driven industrial segments. Out of the total annual production value, 42% is shipped to
non-EU markets. Production is heavily concentrated in a few Member States, while demand is
dispersed across the EU as well as the global market.4
The nature of the NRMM market, fuel standards, and emissions regulations requires a
harmonised approach across all Member States to ensure a level playing field, prevent
fragmentation, and facilitate the free movement of goods within the internal market. Under
the current rules, Member States only allow the placing on the market of engines that have a
valid EU type-approval, and no other standards can be adapted and applied, therefore the lack
of possibility to type-approve hydrogen fuelled engines may create barriers to trade,
inefficiencies, and compliance challenges for businesses in the sector.
2. INTRODUCTION: POLITICAL AND LEGAL CONTEXT
This SWD outlines the proposal to amend Regulation (EU) 2016/1628 to include hydrogen as
a reference fuel for internal combustion engines used in NRMM. The initiative represents a
significant step to align EU regulations with international standards, particularly those
outlined in UNECE Regulation No. 96, Revision 4, which now includes hydrogen as a
recognised reference fuel.
The amendment follows the application submitted by the Dutch type-approval authority,
RDW, on July 10, 2024, which sought authorisation to grant EU type-approval for hydrogen-
fueled engines5, acknowledging hydrogen's effiency as a decarbonisation technology for the
NRMM sector. Currently absent from Regulation (EU) 2016/1628 as a reference fuel, the
proposal incorporates hydrogen following its recognition under the updated UNECE
Regulation No. 96, Revision 4, as well as UN Regulation No. 49 07 series.
The certification tests conducted by the designated technical service, UTAC, verified
compliance with the environmental protection standards, leading to the EU type-approval
granted by RDW. These advancements necessitate integrating hydrogen within EU regulatory
norms, ensuring consistency with the latest UNECE standards. Correspondingly, the
Commission is undertaking the necessary adjustments to the regulatory framework pursuant
to Article 36 of the Regulation, officially incorporating hydrogen as a reference fuel and
aligning testing and evaluation methodologies with the latest UN standards.

This SWD provides thorough analysis to accompany the Commission’s proposal for
amending the Regulation, highlighting the initiative's importance for fostering innovation,
ensuring regulatory coherence, and advancing the EU's environmental objectives.
3. PROBLEMATIC ISSUES WITH THE CURRENT REGULATION
3.1. Issues the amendment aims to address
The initiative to amend Regulation (EU) 2016/1628 by including hydrogen as a reference fuel
for NRMM addresses several issues, aligning with both EU and international regulatory
developments.
➢ Issue 1: Regulatory Gap for Hydrogen Fuel and inconsistency with international
standards
Currently, Regulation (EU) 2016/1628 does not recognise hydrogen as a reference fuel.
Although hydrogen fueled internal combustion engines are covered by UNECE standards for
both NRMMs and heavy-duty motor vehicles, EU regulations on NRMM, unlike those on
motor vehicles, have not yet incorporated these adjustments. This lack of alignment prevents
the EU from fully recognising and supporting hydrogen engine type-approvals, creating a
barrier to the further uptake of this fuel technology.
As the updated UNECE Regulation No. 96 , Revision 4 now recognises hydrogen as a viable
fuel, EU regulations lag behind, potentially hindering EU manufacturers for accessing the EU
market and thus affecting their global competitivness. Without this amendment Member
States may only grant type-approval with the authorisation of the Commission, after having
followed the exemption procedure as described in Article 35 of Regulation (EU) 2016/1628.
Discrepancies between EU and international standards lead to fragmented regulatory
landscapes, creating hurdles for cross-border trade and market operations. Aligning EU
regulations with UNECE standards ensures uniformity, facilitating smoother market access
for hydrogen technologies within the EU and internationally.
➢ Issue 2: Environmental and Decarbonisation Challenges, Energy Security
The absence of hydrogen as a reference fuel in the EU regulatory framework limits the
NRMM sector's ability to transition towards more sustainable, low-emission technologies.
Addressing this obstaclewill contribute to its full potential to EU's broader goals of achieving
carbon neutrality by 2050 and reducing reliance on fossil fuels, crucial objectives under the
European Green Deal.
Hydrogen is a promising solution to incentivise renewable energy alternatives for industry
and public institutions and to strengthen energy security and independence. Specifically, for
IWT, hydrogen offers a feasible pathway to achieving carbon neutrality, given the sector's
unique constraints that make electrification challenging.

➢ Issue 3: Barriers to Innovation and Market Access
The current regulatory framework restricts the development and market entry of hydrogen-
powered NRMM within the EU, stifling innovation and economic opportunities within the
sector. By not allowing hydrogen to be used as reference fuel for the testing of internal
combustion engines for NRMM, the EU risks missing out on technological advancements and
potential growth in the hydrogen economy.
3.2. Significance for single market harmonisation
The single market is one of the EU's core achievements, aiming to ensure the free movement
of goods, services, capital, and labour across Member States. Harmonisation of regulations is
essential to remove barriers and create a seamless operating environment for businesses and
citizens. The inclusion of hydrogen as a reference fuel within Regulation (EU) 2016/1628 is
significant for several reasons.
➢ Consistency across Member States: By adding hydrogen to the reference fuels, the
amendment ensures that all Member States adhere to a unified regulatory framework.
This eliminates discrepancies that could arise from approvals with limited
geographical validity, providing a consistent set of rules that all manufacturers and
operators must follow, thereby simplifying cross-border transactions and trade.
➢ Facilitating Innovation and Competition: A harmonised approach fosters a level
playing field, encouraging competition and innovation among manufacturers. It
enables companies to develop and market hydrogen-powered NRMM across the entire
EU and fostering competitive expansion within the single market.
➢ Reducing Technical Barriers to Trade and enhancing competitiveness:
Provisional approvals create a fragmented market that impede the movement of goods.
By adopting harmonised requirements for NRMM, the EU facilitates smoother intra-
EU trade. Manufacturers can produce for a single, scalable market rather than multiple
fragmented markets, optimising supply chains and production efficiency. This
facilitates economies of scale, which drive down costs and increase competitiveness of
EU manufacturers.
➢ Boosting Economic Integration: Regulatory harmonisation supports deeper
economic integration by removing internal market barriers, ensuring the free
movement of goods and establishing a more integrated market for NRMM. This is
critical for achieving the EU's broader economic goals, including growth and job
creation.
➢ Legal Certainty and Regulatory Predictability: Uniform technical regulations
provide legal clarity and predictability, reducing uncertainties for businesses planning
investments or R&D in new technologies. This legal certainty is crucial for industries
making long-term strategic decisions regarding the adoption of hydrogen technologies.
➢ Support for Strategic EU Policies: Harmonisation aids in the consistent
implementation of the EU’s strategic policies, such as the Green Deal, Hydrogen

Strategy6, and the Industrial Maritime Strategy7 across all Member States, aligning
national efforts with broader EU objectives to drive sustainability and innovation.
4. WHY SHOULD THE EU ACT?
The primary objective of amending Regulation (EU) 2016/1628 to include hydrogen as a
reference fuel for internal combustion engines used in NRMM is to close the existing
regulatory gap between the current EU regulations and the UNECE regulations, thereby
facilitating the transition to cleaner energy solutions. The proposal aims to promote
technological advancement and environmental sustainability within the sector. By addressing
the regulatory alignment with international standards, the initiative ensures cohesion and
consistency in the Union's approach to climate change, innovation, and market harmonisation.
Current rules allow a Member State to issue a provisional EU type-approval which is valid
only in the territory of the Member State. After informing the Commission and other Member
States, any Type-Approval Auhority may decide to accept it by informing the Commission
and the relevant Type-Approval Authority.
The Netherlands has been authorised to grant an EU type-approval under the provisions set
out in Article 35 of Regulation 206/16288, which refers to exemptions for new technologies or
new concepts. Given the constraints outlined in Regulation (EU) 2016/1628, it is necessary to
ensure consistency and equity across the EU.
Maintaining the existing regulatory framework without any amendments is not feasible due to
Article 36 of the Regulation, which requires the Commission to adapt delegated or
implementing acts following an exemption under Article 35.
Therefore the only option is to establish the legislative adaptation as this is required by the
legal obligations under Article 36 of Regulation (EU) 2016/1628.
4.1. Legal basis
The present initiative is based on the harmonisation objectives set out in the Treaty on the
Functioning of the European Union (TFEU), in particular on Article 114.
Article 114 TFEU authorises the European Union to adopt measures for the approximation of
national laws and regulations that have as their objective the establishment and proper
functioning of the internal market. This provision serves as the primary legal basis for
initiatives aimed at preventing fragmentation and ensuring uniform market conditions across
all Member States.
The inclusion of hydrogen as a reference fuel addresses existing regulatory gaps by aligning
EU standards with those established at the international level, notably under UNECE
regulations. By creating a harmonised regulatory framework, the amendment ensures that

manufacturers and operators across the EU adhere to a single set of standards, supporting the
free movement of goods and a level playing field.
While Article 114 primarily focuses on market harmonisation, it also supports the inclusion of
complementary environmental policies. This amendment contributes to the EU's
environmental objectives by promoting the adoption of low-emission hydrogen technologies,
thus aligning with the Union's broader decarbonisation goals as specified in strategic policies
like the European Green Deal.
4.2. Subsidiarity: Added value of EU action
In accordance with Article 5 of the Treaty on European Union (TEU), the principle of
subsidiarity ensures that action at the EU level is only taken when objectives cannot be
sufficiently achieved by Member States individually and can be better accomplished at the
Union level. The proposed amendment to Regulation (EU) 2016/1628, which includes
hydrogen as a reference fuel for NRMM, justifies EU-level intervention through the following
considerations:
Given the cross-border nature of the NRMM market9, approvals with different
geographical validity could lead to market fragmentation. Relying on provisional type-
approvals of hydrogen fuelled NRMM engines would create technical barriers to trade and
inefficiencies for companies operating across multiple countries. An EU-wide approach to
include hydrogen as a reference fuel for pollutant emission testing of internal combustion
engines of NRMM is required to uphold the free movement of goods and maintain market
integrity across Member States. An EU-level amendment ensures a uniform regulatory
framework, simplifying compliance and fostering fair competition within the single market.
In summary, the necessity of EU action is clearly justified by the need to harmonise standards
for the effective functioning of the internal market and to enhance environmental outcomes
and technological innovation, thereby maximising benefits for all Member sSates. This
approach aligns with the subsidiarity principle as enshrined in Article 5 TEU, ensuring an
efficient and consistent regulatory framework across the Union.
4.3. Proportionality: Minimised Regulatory Burden
The proposal is aligning EU regulations with established international standards (UNECE),
and aims to promote innovation by creating consistent, predictable regulatory conditions.
The initiative integrates hydrogen fuel within existing processes, leveraging international
standards that have already undergone thorough examination and consensus. This
ensures that any costs or administrative efforts required from businesses are minimised. It
establishes legal certainty for manufacturers and enables benefits in terms of environmental
sustainability and competitiveness.

In summary, the proposal respects the subsidiarity principle by addressing cross-border
regulatory needs that benefit from EU intervention, while proportionality is maintained by
aligning with existing frameworks and applying changes that are necessary and conducive to
achieving strategic EU objectives regarding climate action and technological innovation.
5. LEGISLATIVE CONTEXT
The proposal to amend Regulation (EU) 2016/1628 concerning the inclusion of hydrogen as a
reference fuel for NRMM is rooted in the necessity to align EU regulations with evolving
international standards and to support the Union's environmental goals. The legislative
context is shaped by several legislative acts and related policies:
Regulation (EU) 2016/1628:
This regulation establishes the requirements for pollutant emissions and type-approval
procedures for internal combustion engines in NRMM. It aims to ensure high levels of
environmental protection while facilitating the free movement of NRMM products within the
EU. The proposal seeks to update this regulation to include hydrogen as a reference fuel,
accommodating technological advancements and international regulatory developments.
UNECE Regulation No. 96, Revision 4:
The United Nations Economic Commission for Europe (UNECE) Regulation No. 96 sets
international standards for emission levels in NRMM. Revision 04 now includes hydrogen as
a reference fuel, thus necessitating EU regulations to adapt accordingly to remain in harmony
with global standards. This alignment is crucial to maintaining the competitiveness of EU
manufacturers and promoting consistent regulatory practices.
UNECE Regulation No. 49 07 Series:
This regulation outlines the type-approval requirements for hydrogen combustion engines,
ensuring that emissions and performance standards are met. The EU Member States recognise
these standards when granting type-approvals, as evidenced by the Netherlands’ application
and provisional approvals for hydrogen engines.
Protocol on Ireland/Northern Ireland:
Under the EU - UK Withdrawal Agreement, Northern Ireland remains aligned with a select
set of EU rules to maintain a seamless internal market on the island of Ireland. With both
Northern Ireland, as part of the United Kingdom, and Ireland adhering to UNECE Regulation
No. 96, the inclusion of hydrogen as a reference fuel facilitates a coherent regulatory
landscape. This consistency helps avoid trade disruptions caused by differing standards and
ensures smooth cross-border transactions. By ensuring that Northern Ireland’s regulations
remain aligned with updated EU standards, the potential for trade barriers is minimised,
reinforcing Northern Ireland’s role within the Single Market for goods under the terms of the
Protocol.

Related EU Policies:
The amendment interacts with broader EU policy frameworks, including the European Green
Deal, the EU Hydrogen Strategy, and the EU Industrial Maritime Strategy where hydrogen as
reference fuel for NRMM engines is specifically mentioned under Pillar IV – Access to
innovation. All of them advocate for cleaner technologies and emissions reductions.
6. STAKEHOLDER CONSULTATION PROCESS
The stakeholder consultation process on the proposal included a number of discussions. The
proposal was discussed and supported by Member States and stakeholders at the meetings of
the NRMM Expert Group (GEME) held in September 2024 and October 2025.
It is important to note that the proposal is based on the amendments to UNECE Regulations
Nos 49 and 96 and that the technical elements for the approval of hydrogen-powered internal
combustion engines had been already discussed in detail by the UNECE Working Party on
Pollution and Energy (GRPE) prior to the meetings of GEME. These consultations ensured
that different perspectives were heard and taken into account as EU Member States are
Contracting Parties of the UNECE 1958 Agreement, and industry stakeholders were also
present during the discussions at GRPE.
By actively participating in and supporting the development of international harmonisation at
UNECE level, the EU demonstrated its commitment to collaborative global governance in
environmental policy and technological innovation. The EU’s adoption of UNECE
regulations showcases its role in fostering harmonised standards that enhance sustainability
efforts worldwide. This collaborative approach reinforces the EU's leadership and
encourages alignment with global practices, promoting widespread adoption of sustainable
solutions across regions.
7. EXPECTED OUTCOMES
The amendment is expected to yield positive environmental and economic outcomes,
supporting EU strategic goals in sustainability and market integration. While initial large-
scale application is not expected, long-term benefits in terms of innovation, competitiveness,
and environmental protection are expected, as shown by the fact that two requests have
already been submitted for approval of engines using hydrogen.
Environmental dimension:
The integration of hydrogen as a reference fuel is expected to enable reductions in
greenhouse gases and potentionally pollutants such as nitrogen oxides (NOX) and
particulate matter. By removing obstacles for cleaner fuel technologies, the amendment
supports EU climate goals outlined in the European Green Deal to achieve climate neutrality
by 2050.

Potential improvements in air quality resulting from reduced emissions can have positive
effects on ecosystems and public health, diminishing health risks associated with air
pollution and supporting overall environmental sustainability.
Economic dimension:
The transition can catalyse innovation within the NRMM sector, creating opportunities for
new products, jobs, and economic growth. Increased research and development efforts are
expected to enhance the EU's competitive advantage in green technology, which supports
innovation and market growth.
Market and Trade dimension:

kasutamise edendamisega püüab EL vesinikutehnoloogiaid ulatuslikumalt kasutusele võtta,
vähendada sõltuvust fossiilkütustest ja edendada kestlikku majanduskasvu. Seda visiooni
toetab ka kava „REPowerEU“,2 mille eesmärk on vähendada sõltuvust fossiilkütuste
impordist ja kiirendada üleminekut taastuvatele energiaallikatele, sealhulgas saastevaba
vesiniku tootmisele ja kasutamisele eri sektorites.
Vesiniku potentsiaali hõlbustada süsinikuheite vähendamist tunnustatakse ÜRO Euroopa
Majanduskomisjoni (UNECE) raamistikus, kus seda peetakse väljaspool teid kasutatavate
liikurmasinate puhul otstarbekaks kütusevalikuks3. Selline tunnustus rõhutab vesiniku
keskkonnakasu ja võimet vähendada märkimisväärselt väljaspool teid kasutatavate
liikurmasinate mootorite heidet. Sellest rahvusvahelisest tunnustusest hoolimata ei ole vesinik
määruse (EL) 2016/1628 artiklis 25 etalonkütusena loetletud. Vesiniku puudumine
õigusraamistikust piirab väljaspool teid kasutatavate liikurmasinate sektori suutlikkust minna
üle kestlikumatele tehnoloogiatele, takistades saavutamast Euroopa rohelises kokkuleppes4
sätestatud ELi eesmärke vähendada CO2 heidet ja fossiilkütusesõltuvust. Vesinikku
etalonkütusena tunnustamata seab EL ohtu innovatsiooni ja vesinikkütusel töötavate
väljaspool teid kasutatavate liikurmasinate turulesisenemise, jättes seega kasutamata
tehnoloogilise arengu võimalused.
Seetõttu on ettepanekul järgmised eesmärgid.
Kõrvaldada regulatiivne lünk. Peamine eesmärk on muuta määrust (EL) 2016/1628, et lisada
vesinik etalonkütuste loetellu, tagades ELi eeskirjade kooskõla rahvusvaheliste standarditega
ning liidu keskkonna- ja kliimaeesmärkidega.
Hõlbustada süsinikuheite vähendamist ja suurendada energiajulgeolekut. Algatusega lisada
vesinik õigusraamistikku toetatakse ELi strateegiat vähendada CO2 heidet ja saavutada 2050.
aastaks kliimaneutraalsus. See aitab vähendada fossiilkütusesõltuvust ning toetab vastupidava
ja kestliku energiasüsteemi loomist.
Stimuleerida innovatsiooni ja tööstuse konkurentsivõimet. Vesiniku tunnustamine otstarbeka
kütusena soodustab väljaspool teid kasutatavate liikurmasinate sektoris innovatsiooni,
toetades vesinikutehnoloogiate uurimist, arendamist ja kasutuselevõttu. Sellega viiakse ELi
õigusnormid kooskõlla UNECE standarditega, hõlbustades rahvusvahelist kaubandust ja
säilitades ELi tootjate konkurentsivõime kogu maailmas.
• Kooskõla poliitikavaldkonnas praegu kehtivate õigusnormidega
Määruse (EL) 2016/1628 artikli 35 kohaselt on lubatud teha erandeid uute tehnoloogiate või
uute põhimõtete suhtes, luues seeläbi tingimused uuenduste lõimimiseks väljaspool teid

kasutatavate liikurmasinate sektorisse. Tootja võib taotleda ELi tüübikinnitust mootoritüübile
või -tüüpkonnale, milles on kasutatud uusi tehnoloogiaid või uusi põhimõtteid. Pärast
Madalmaadele artikli 35 alusel tehtud erandit5 kohustab artikkel 36 komisjoni võtma vajalikke
meetmeid delegeeritud õigusaktide ja rakendusaktide kohandamiseks, et arvestada seda
tehnoloogia arengut. Vesiniku lisamine etalonkütuste loetellu on delegeeritud õigusaktide ja
rakendusaktide hilisemate muudatuste eeltingimus.
• Kooskõla muude liidu tegevuspõhimõtetega
Ettepanek on kooskõlas liidu kehtivate tegevuspõhimõtetega, mille eesmärgid on tagada
kestlikkus, kliimameetmed ja tehnoloogiline innovatsioon.
Vesiniku kasutuselevõtt väljaspool teid kasutatavate liikurmasinate kütusena on oluline ELi
kliimaneutraalsuse eesmärkide saavutamiseks. Väljaspool teid kasutatavate liikurmasinate
sektorit mõjutab märkimisväärselt jõupingutuste jagamise määrus, mis on nende masinate
süsinikuheite vähendamise peamine regulatiivne tõukejõud. Jõupingutuste jagamise
määrusega on ette nähtud heitkoguste vähendamine HKSi mittekuuluvates sektorites,
sealhulgas transpordi-, ehitus-, põllumajandus- ja siseveetranspordi sektoris, hõlbustades kogu
ELi hõlmavate kliimaeesmärkide saavutamist.
Puhta tööstuse kokkuleppes6 on rõhutatud ELi pühendumust muuta rohelise kokkuleppe
raames oma tööstusbaasi. Muudatus soodustab vesinikutehnoloogiate kasutuselevõttu, olles
seega kooskõlas eesmärgiga minna tööstuses üle vähese CO2 heitega tootmisprotsessidele,
suurendades konkurentsivõimet ja edendades kestlikku majanduskasvu. Sellega toetatakse ka
ELi kliimamäärust,7 millega on kliimaneutraalsuse saavutamine 2050. aastaks muudetud
õiguslikult siduvaks ja kehtestatud 2030. aastaks heitkoguste vähendamise eesmärk, aidates
vähendada tööstusheidet.
Ettepanek on täielikult kooskõlas ELi vesinikustrateegiaga,8 mille kohaselt on vesinik
peamine energiakandja teel ELi kliimaneutraalsuse poole. See strateegia loob raamistiku
vesiniku tootmise ja kasutamise suurendamiseks eri sektorites, sealhulgas transpordis ja
tööstuses, kooskõlas ELi üldiste kliimaeesmärkidega.
Muudatus on kooskõlas ELi merendustööstuse strateegiaga,9 kus vesinikku on väljaspool teid
kasutatavate liikurmasinate mootorite etalonkütusena konkreetselt nimetatud IV sambas –
innovatsioon.
Muudatus on kooskõlas raskeveokite CO2 heite norme käsitleva määrusega,10 mille eesmärk
on vähendada transpordisektori heidet ning edendada heiteta ja vähese heitega sõidukite,
sealhulgas vesinikkütusega sõidukite kasutuselevõttu. Võimaldades kasutada väljaspool teid
kasutatavate liikurmasinate sektoris olemasolevaid tehnoloogiaid, tagatakse ettepanekuga
süsinikuheite vähendamise käsitluste ühtlus eri liiki masinate ja sõidukite puhul, edendades
heitkoguste vähendamisel järeleproovitud tehnoloogiat.

2. ÕIGUSLIK ALUS, SUBSIDIAARSUS JA PROPORTSIONAALSUS
• Õiguslik alus
Ettepaneku õiguslik alus on Euroopa Liidu toimimise lepingu artikkel 114.
• Subsidiaarsus (ainupädevusse mittekuuluva valdkonna puhul)
Väljaspool teid kasutatavate liikurmasinate turul toimub ulatuslik riikidevaheline kauplemine.
Ühtse ELi lähenemisviisita võivad erinevad riigisisesed õigusnormid põhjustada turu
killustatust, tekitades tehnilisi kaubandustõkkeid ja ebatõhusaid tingimusi mitmes riigis
tegutsevatele ettevõtjatele.
Kogu ELi hõlmav õigusraamistik on hädavajalik võrdsete tingimuste tagamiseks. See ennetab
killustatust ja hõlbustab kaupade vaba liikumist siseturul.
Vesiniku väljajätmine väljaspool teid kasutatavate liikurmasinate võimalike kütuste loetelust
võib takistada tehnoloogilist innovatsiooni ja aeglustada vesinikutehnoloogiate
kasutuselevõttu, takistades ELi ühiste keskkonnaeesmärkide saavutamist ja turgude
lõimimiseks tehtavaid jõupingutusi.
• Proportsionaalsus
Ettepanekuga viiakse ELi õigusnormid kooskõlla UNECE poolt juba kehtestatud
rahvusvaheliste standarditega.
Algatusega ei nähta sidusrühmadele ette lisakulusid ega uut halduskoormust, vaid sellega
kõrvaldatakse rahvusvahelistele standarditele vastavate uute innovaatiliste tehnoloogiate
turulelaskmise takistused. See tähendab, et vajalikud kohandused on proportsionaalsed
keskkonnasäästlikkusest ja turu konkurentsivõimest saadava kasuga.
Ettepaneku eesmärk on hõlbustada ELi strateegiliste eesmärkide saavutamist kliimameetmete
ja tehnoloogilise innovatsiooni valdkonnas, tekitamata ettevõtjatele või liikmesriikidele
tarbetut koormust. Selles keskendutakse konkreetselt regulatiivse lünga kõrvaldamisele viisil,
mis toetab liidu ulatuslikumaid süsinikuheite vähendamise ja kestlikkuse eesmärke.
Ettepanekus säilitatakse proportsionaalsus ja tagatakse, et regulatiivsed muudatused on
vajalikud, sobivad ja nende eeldatava kasuga tasakaalus.
• Vahendi valik
Kui Madalmaad on saanud loa anda vesinikumootoritele artikli 35 kohaselt ELi tüübikinnitus,
kohandab komisjon vastavalt määrusi, nagu on ette nähtud määruse artiklis 36. Uute
etalonkütuste, näiteks vesiniku lisamine ei kuulu siiski komisjonile antud volituste hulka.
Seetõttu on kehtiva määruse muutmine vajalik vahend selle kooskõla saavutamiseks, tagades
regulatiivse sidususe ja ühtlustamise siseturul.

• Eksperdiarvamuste kogumine ja kasutamine
Muudatus põhineb kehtivatel rahvusvahelistel standarditel ja katsetamist käsitlevatel
eksperditeadmistel, mis tulenevad UNECE eeskirjast nr 4911 ning eeskirja nr 9612 hiljutistest
ühe- ja segakahekütuselisi mootoreid käsitlevatest muudatustest, millega tunnustatakse
vesinikku väljaspool teid kasutatavate liikurmasinate mootorite võimaliku kütusena. Lisaks
toimub protsess vastavalt määruse (EL) 2016/1628 artikli 35 kohasele menetlusele, nagu
näitab Madalmaadele väljastatud luba anda ELi tüübikinnitus ühekütuselisele vesinikkütusega
mootorile13. Määratud tehnilise teenistuse tehtud sertifitseerimiskatsetega kontrolliti
kehtivatele keskkonnakaitsenõuetele vastavust.
• Mõjuhinnang
Ettepanek ei vaja mõju hindamist, kuna see on kooskõlas kehtiva UNECE eeskirjaga nr 96,
milles juba tunnustatakse vesinikku võimaliku kütusena. Ettepanek tehakse pärast seda, kui
komisjon on väljastanud Madalmaadele määruse (EL) 2016/1628 artikli 35 alusel loa anda
ELi tüübikinnitus ühekütuselisele vesinikumootorile, tuginedes ulatuslikule
dokumentatsioonile. Määruse artiklis 36 on sätestatud, et kui komisjon lubab teha erandi
vastavalt artiklile 35, peaks ta viivitamata võtma vajalikud meetmed asjakohaste delegeeritud
õigusaktide või rakendusaktide kohandamiseks tehnoloogia arenguga. Seda arvesse võttes ei
ole täiendavat mõju hindamist vaja teha.

EUROOPA PARLAMENDI JA NÕUKOGU MÄÄRUS,
millega muudetakse määrust (EL) 2016/1628 seoses vesiniku lisamisega mootoritüübi
või -tüüpkonna katsetamisel kasutatavate etalonkütuste hulka

EUROOPA PARLAMENT JA EUROOPA LIIDU NÕUKOGU,
võttes arvesse Euroopa Liidu toimimise lepingut, eriti selle artiklit 114,
võttes arvesse Euroopa Komisjoni ettepanekut,
olles edastanud seadusandliku akti eelnõu liikmesriikide parlamentidele,
võttes arvesse Euroopa Majandus- ja Sotsiaalkomitee arvamust1,
toimides seadusandliku tavamenetluse kohaselt
ning arvestades järgmist:
(1) Euroopa Parlamendi ja nõukogu määrusega (EL) 2016/16282 on kehtestatud
väljaspool teid kasutatavatele liikurmasinatele paigaldatud mootoritest eralduvate
õhusaasteainete heite piirnormid.
(2) Komisjon väljastas 25. veebruari 2025. aasta rakendusotsusega C(2025) 1153 final3
Madalmaadele määruse (EL) 2016/1628 artiklis 35 sätestatud erandkorra alusel loa
anda ELi tüübikinnitus üksnes vesinikkütusel töötavate väljaspool teid kasutatavate
liikurmasinate mootoritüübile. Pärast kõnealuse erandi tegemist tuleks vesinik lisada
etalonkütusena määrusesse (EL) 2016/1628, et tagada kooskõla ja ühtlus kogu liidus.
(3) Selleks et hõlbustada turulepääsu ja tagada liidu tootjate konkurentsivõime
maailmaturul, on asjakohane viia liidu regulatiivsed standardid kooskõlla UNECE
eeskirjaga nr 964 (versioon 04), mille kohaselt kuulub vesinik väljaspool teid
kasutatavate liikurmasinate mootorite etalonkütuste hulka.

(4) Üksnes vesinikul töötavad mootorid ei eralda põlemise ajal kütusest pärinevat
süsinikdioksiidi. Seega on asjakohane vabastada vesinikumootorite tootjad kohustusest
teatada tüübikinnitusprotsessi osana CO2 heitest, lihtsustades seega kõnealuse
tehnoloogiaga seotud regulatiivseid nõudeid.
(5) Määrust (EL) 2016/1628 tuleks seetõttu vastavalt muuta,
ON VASTU VÕTNUD KÄESOLEVA MÄÄRUSE:
Artikkel 1
Määruse (EL) 2016/1628 muutmine
1. Määrust (EL) 2016/1628 muudetakse järgmiselt.
1. Artikli 25 lõike 2 esimesse lõiku lisatakse järgmine punkt:
„g) vesinik.“
2. Artikli 43 lõige 4 asendatakse järgmisega:
„4. Tootjad teevad algseadme valmistajale kättesaadavaks ELi tüübikinnituse
andmise menetluses kindlaks tehtud süsinikdioksiidi (CO2) heitkogused ja volitavad
algseadme valmistajat edastama vastavat teavet koos selgitava teabega
katsetingimuste kohta selle väljaspool teid kasutatava liikurmasina lõpptarbijale,
millele on mootor kavas paigaldada. Üksnes vesinikul töötavate mootorite puhul ei
ole nimetatud heitkoguste esitamine siiski nõutav.“

Jõustumine
Käesolev määrus jõustub kahekümnendal päeval pärast selle avaldamist Euroopa Liidu
Teatajas.
Käesolev määrus on tervikuna siduv ja vahetult kohaldatav kõikides liikmesriikides.

1. ETTEPANEKU/ALGATUSE RAAMISTIK
1.1. Ettepaneku/algatuse nimetus
EUROOPA PARLAMENDI JA NÕUKOGU MÄÄRUS,
millega muudetakse määrust (EL) 2016/1628 seoses vesiniku lisamisega
mootoritüübi või -tüüpkonna katsetamisel kasutatavate etalonkütuste hulka
1.2. Asjaomased poliitikavaldkonnad
Muudatus, millega lisatakse vesinik määrusesse (EL) 2016/1628 väljaspool teid
kasutatavate liikurmasinate etalonkütusena puudutab peamiselt mitut olulist
poliitikavaldkonda.
Keskkonna- ja kliimapoliitika. Ettepanek on kooskõlas ELi ulatuslikumate
keskkonnaeesmärkidega, eelkõige nendega, mis on seotud heitkoguste vähendamise
ja kliimamuutuste mõju leevendamisega. Sellega toetatakse selliseid algatusi nagu
Euroopa roheline kokkulepe, mille eesmärk on muuta ELi majandus minimaalse
kasvuhoonegaaside netoheitega kestlikuks majanduseks.
Energiapoliitika. Vesinikkütuse lisamine kajastab ELi strateegilist suunda
mitmekesistada energiaallikaid ning edendada taastuvenergia ja puhta energia
tehnoloogiaid. See on kooskõlas ELi vesinikustrateegiaga, mille eesmärk on kasutada
ära vesiniku potentsiaali mitmekülgse energiakandjana.
Tööstuspoliitika. Vesinikutehnoloogia kasutuselevõtu edendamisega toetatakse
ettepanekuga innovatsiooni ja konkurentsivõimet ELi väljaspool teid kasutatavate
liikurmasinate tööstussektoris. Sellega soodustatakse teadus- ja arendustegevust,
millega kaasneb tehnoloogia areng ja uute turuvõimaluste loomine väljaspool teid
kasutatavate liikurmasinate sektoris.
Ühtse turu poliitika. Liikmesriikide standardite ühtlustamine on äärmiselt oluline ELi
siseturu terviklikkuse säilitamiseks. Ettepanekuga hõlbustatakse kaupade vaba
liikumist, vähendatakse tehnilisi kaubandustõkkeid ning tagatakse tootjatele ja
ettevõtjatele võrdsed tingimused.
Tervisepoliitika. Vähendades saasteainete, näiteks lämmastikoksiidide ja tahkete
osakeste heidet, aitab ettepanek parandada õhukvaliteeti ja saavutada paremaid
tulemusi rahvatervise valdkonnas, mis on kooskõlas ELi eesmärgiga parandada oma
kodanike heaolu.
Need poliitikavaldkonnad toetavad üheskoos selliseid ELi strateegilisi eesmärke
nagu kestlikkus, konkurentsivõime ja turu ühtlustamine, kajastades integreeritud
lähenemisviisi keskkonna- ja majandusprobleemide lahendamisele.
1.3. Eesmärgid
1.3.1. Üldeesmärgid
Määrust (EL) 2016/1628 muudetakse, lisades vesiniku väljaspool teid kasutatavate
liikurmasinate sisepõlemismootorite etalonkütuste loetellu, üldeesmärgiga kaotada
praegune õiguslik lünk kehtivate ELi õigusnormide ja nende UNECE kehtestatud
rahvusvaheliste standardite vahel, millega on vesinikku võimaliku kütusevalikuna
juba tunnustatud. Selle muudatusega edendatakse väljaspool teid kasutatavate
liikurmasinate sektoris tehnoloogia arengut ja keskkonnasäästlikkust, hõlbustades
üleminekut puhtamatele energialahendustele. Õigusnormide kooskõlastamisega

tagab algatus liidu kliimamuutuste, innovatsiooni ja turu ühtlustamise käsitluse
ühtsuse ja kooskõla, toetades seeläbi ELi tootjate konkurentsieelist ülemaailmsetel
turgudel.
1.3.2. Erieesmärgid
Erieesmärk nr 1. Hõlbustada süsinikuheite vähendamist, keskkonnasäästlikkust ja
energiajulgeoleku suurendamist
Vesinik on tunnustatud kütus ELi strateegias vähendada CO2 heidet ja saavutada
2050. aastaks kliimaneutraalsus. Vesiniku lisamisega väljaspool teid kasutatavate
liikurmasinate õigusraamistikku aitab käesolev algatus otseselt kaasa
traditsiooniliselt fossiilkütustest sõltuva sektori süsinikuheite vähendamisele.
Energiaallikate mitmekesistamine vesiniku lisamise teel aitab vähendada ELi
fossiilkütusesõltuvust. Selliste algatuste kaudu nagu ELi vesinikustrateegia
toetatakse selle meetmega kestliku ja turvalise energiasüsteemi arendamist, aidates
kaasa ELi energiavarustuse üldisele vastupanuvõimele.
Erieesmärk nr 2.Stimuleerida innovatsiooni ja tööstuse konkurentsivõimet
Vesiniku tunnustamisega etalonkütusena soodustatakse muudatusega innovatsiooni
väljaspool teid kasutatavate liikurmasinate sektoris, stimuleerides teadus- ja
arendustegevust uute tehnoloogiate valdkonnas. See algatus toetab ELi
tööstusstrateegia eesmärke, milleks on rakendada ja edendada uusi
tehnoloogialahendusi.
Algatusega tagatakse ELi õigusnormide ühtlus UNECE eeskirjaga nr 96
(versioon 04), edendades väljaspool teid kasutatavate liikurmasinate ja
mootorsõidukite heitkoguseid käsitlevate õigusnormide terviklikku käsitlust. Selline
kooskõlastamine on oluline, et hõlbustada rahvusvahelist kaubandust ja säilitada ELi
tootjate konkurentsivõime ülemaailmsel tasandil.
1.3.3. Oodatavad tulemused ja mõju
Märkige, milline peaks olema ettepaneku/algatuse oodatav mõju
toetusesaajatele/sihtrühmale.
Ettepanek peaks tooma märkimisväärset kasu mitmes valdkonnas, toetades ELi
eesmärke saavutada kliimaneutraalsus, turuintegratsioon ja ülemaailmne
juhtpositsioon puhta tehnoloogia valdkonnas.
Erieesmärk nr 1. Keskkonnamõju
Vesiniku kasutamine aitab vähendada kasvuhoonegaaside ja saasteainete heidet,
parandada õhukvaliteeti ning toetada ELi kliimaneutraalsuse eesmärkide
saavutamist.
Algatusega toetatakse üleminekut puhtamatele energialahendustele, edendades
väljaspool teid kasutatavate liikurmasinate sektoris pikaajalist üleminekut kestlikele
tööstustavadele.
Erieesmärk nr 2. Majanduslik mõju
Väljaspool teid kasutatavate liikurmasinate väärtusahelas osalevad ELi tootjad ja
tarnijad peaksid saama kasu juurdepääsust ühtlustatud õigusraamistikule, mis on
kooskõlas rahvusvaheliste standarditega, suurendades konkurentsivõimet nii
riigisisestel kui ka ülemaailmsetel turgudel.

Määrusega soodustatakse tehnoloogilist innovatsiooni, edendades
vesinikutehnoloogiate uurimist ja arendamist, mis võib luua rohelises majanduses
uusi ärivõimalusi, töökohti ja majanduskasvu.
Erieesmärk nr 3. Mõju turule ja kaubandusele
Algatusega tagatakse, et väljaspool teid kasutatavate liikurmasinatega saab tõrgeteta
kaubelda kõigis ELi liikmesriikides, vähendades tehnilisi tõkkeid ja edendades
integreeritumat siseturgu.
Rahvusvaheliste standarditega kooskõlastamine hõlbustab sujuvamat juurdepääsu
ülemaailmsetele turgudele, tugevdades ELi ekspordipotentsiaali.
Erieesmärk nr 4. Regulatiivne mõju
Muudatusega tagatakse keskkonnanormide järjepidev kohaldamine kõigis
liikmesriikides, vähendades erinevusi ja lihtsustades ettevõtjate jaoks nõuete täitmise
protsesse.
See on kooskõlas ulatuslikuma ELi poliitikaga, nagu Euroopa roheline kokkulepe ja
vesinikustrateegia, ning tugevdab seda, integreerides need eesmärgid
reguleerimistavadesse.
Erieesmärk nr 5. Mõju sidusrühmadele
Tootjad ja tarnijad saavad kasu selgest regulatiivsest keskkonnast ja väljaspool teid
kasutatavate liikurmasinate heidet käsitlevatest ühtlustatud õigusnormidest, mis
suurendavad nende konkurentsivõimet.
Kodanikud saavad kaudset kasu paremast õhukvaliteedist ja rahvatervisest, kuna
väljaspool teid kasutatavatest liikurmasinatest tuleneva heite vähenemine aitab
tagada puhtamat ja tervislikumat keskkonda.

3.2.5. Hinnanguline mõju digitehnoloogiaga seotud investeeringutele – ülevaade
Kohustuslik: järgmises tabelis tuleks esitada parim hinnang ettepanekust/algatusest tulenevate digitehnoloogiaga seotud investeeringute
kohta.
Erandkorras, kui see on vajalik ettepaneku/algatuse rakendamiseks, tuleks rubriigi 7 assigneeringud esitada selleks ettenähtud
eelarvereal.
Rubriikide 1–6 assigneeringuid tuleks kajastada „tegevusvaldkonna IT-kuludena, mis on eraldatud rakenduskavadele“. Nende kulud
kuuluvad tegevuseelarvesse, mida kasutatakse otseselt algatuse rakendamisega seotud IT-platvormide/vahendite
taaskasutamiseks/ostmiseks/arendamiseks ja nendega seotud investeeringuteks (nt litsentsid, uuringud, andmete säilitamine jne). Selles
tabelis esitatud teave peaks olema kooskõlas 4. jaos „Digimõõde“ esitatud üksikasjadega.

4. DIGIMÕÕDE
4.1. Diginõuded
Kui leitakse, et käesoleva poliitikaalgatuse suhtes ei tule kohaldada diginõudeid, tuleb esitada selgitus selle kohta, miks digivahendeid ei
kasutata.
Ettepanekuga ei kaasne diginõudeid, kuna sellega ei kehtestata digikohustusi, -tehnoloogiaid ega andmetega seotud nõudeid. Selle ainus
eesmärk on lisada vesinik määruse (EL) 2016/1628 etalonkütuste loetellu, võimaldades seega vesinikul töötavate väljaspool teid
kasutatavate liikurmasinate mootorite tüübikinnitust kehtiva õigusraamistiku alusel. Meede on tegelikult vabatahtlik, luues pigem
regulatiivse võimaluse kui kehtestades uusi tehnilisi või diginõudeid.
