on the position to be taken on behalf of the European Union in the General Council of
the World Trade Organization on the European Union request for an extension of the
WTO waiver permitting autonomous trade preferences to the Western Balkans

EXPLANATORY MEMORANDUM
1. SUBJECT MATTER OF THE PROPOSAL
This proposal concerns the decision establishing the position to be taken on the Union's behalf
in the General Council of the World Trade Organization (‘WTO’) in connection with the
envisaged adoption of a decision to extend the WTO waiver permitting the European Union
(‘EU’) to provide autonomous trade preferences to the Western Balkans.
2. CONTEXT OF THE PROPOSAL
2.1. The Marrakesh Agreement establishing the World Trade Organization
The Marrakesh Agreement establishing the World Trade Organization (‘WTO Agreement’)
entered into force on 1 January 1995.
The European Union is a party to the Agreement.
2.2. Ministerial Conference and General Council of the WTO
Pursuant to Article IV(1) of the WTO Agreement, the Ministerial Conference has the
authority to take decisions on all matters under any of the Multilateral Trade Agreements.
Pursuant to Article IV(2) of the WTO Agreement, in the intervals between meetings of the
Ministerial Conference, its functions are conducted by the General Council.
Pursuant to Article IX(1) of the WTO Agreement, the WTO usually takes decisions by
consensus.
2.3. The envisaged act of the General Council of the WTO
Pursuant to Article IX(3) of the WTO Agreement, an obligation imposed on a Member may
be waived in exceptional circumstances.
Further to a request by the EU, the General Council of the WTO may adopt a decision to
extend the existing WTO waiver permitting the EU to provide autonomous trade preferences
to Western Balkans (‘the envisaged act’).
The existing waiver expires on 31 December 2026. Therefore, the purpose of the envisaged
act is to extend the waiver until 31 December 2031.
The envisaged act will become binding on the Members of the WTO in accordance with
Article IX(3), as well as Article II(2) of the WTO Agreement.
3. POSITION TO BE TAKEN ON THE UNION'S BEHALF
On 16 December 2025, the European Parliament and the Council adopted
Regulation (EU) 2025/20141 amending Regulation (EU) 2024/823 on exceptional trade
measures for countries and territories participating in or linked to the Stabilisation and
Association Process. This provided for the extension of the preferential arrangements until 31
December 2030.

The trade preferences were initially granted by Council Regulation (EC) No 2007/20002,
amended and extended several times thereafter.
In the absence of a waiver from the obligations pursuant to Article I(1) of the General
Agreement on Tariffs and Trade 1994 (‘GATT 1994’) and Article XIII of GATT 1994, to the
extent necessary, the treatment provided by the EU through the autonomous trade preferences
would need to be extended to all other Members of the WTO.
Therefore, the EU is required to submit a request to extend the WTO waiver on autonomous
trade preferences granted by the EU to the Western Balkans pursuant to Article IX(3) of the
WTO Agreement for an additional time-period of five years, until 31 December 2031. In
addition to making this request, the EU should support the adoption of this request at the
General Council of the WTO.
This would be the fifth extension of the waiver, initially granted on 8 December 2000 until 31
December 20063, and last extended on 28 July 20214. The reason for the initial waiver and the
extensions thereof is the persistent difficult economic situation in the region and that the
preferential treatment to eligible products the Union affords to these countries is intended to
promote economic development in a manner consistent with the objectives of GATT 1994.
4. LEGAL BASIS
4.1. Procedural legal basis
4.1.1. Principles
Article 218(9) of the Treaty on the Functioning of the European Union (TFEU) provides for
decisions establishing ‘the positions to be adopted on the Union’s behalf in a body set up by
an agreement, when that body is called upon to adopt acts having legal effects, with the
exception of acts supplementing or amending the institutional framework of the agreement.’
The concept of ‘acts having legal effects’ includes acts that have legal effects by virtue of the
rules of international law governing the body in question.
4.1.2. Application to the present case
The General Council of the WTO is a body set up by an agreement, namely the WTO
Agreement.
The act which the General Council would be called upon to adopt constitutes an act having
legal effects. The envisaged act would be binding under international law in accordance with
Article II(2) and Article IX(3) of the WTO Agreement.
The envisaged act does not supplement or amend the institutional framework of the
Agreement.
Therefore, the procedural legal basis for the proposed decision is Article 218(9) TFEU.

5. SUBSTANTIVE LEGAL BASIS
5.1. Principles
The substantive legal basis for a decision under Article 218(9) TFEU depends primarily on
the objective and content of the envisaged act in respect of which a position is taken on the
Union's behalf.
5.2. Application to the present case
The main objective and content of the envisaged act relate to the common commercial policy.
Therefore, the substantive legal basis of the proposed decision is the first subparagraph of
Article 207(4).
6. CONCLUSION
The legal basis of the proposed decision should be the first subparagraph of Article 207(4), in
conjunction with Article 218(9) TFEU.

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular
Article 207(4), first subparagraph, in conjunction with Article 218(9) thereof,
Having regard to the proposal from the European Commission,
Whereas:
(1) The Agreement establishing the World Trade Organization (‘WTO Agreement’) was
concluded by the Union by Council Decision 94/800/EC1 and entered into force on 1
January 1995.
(2) Pursuant to Article II(2) of the WTO Agreement, ‘the agreements and associated legal
instruments included in Annexes 1, 2 and 3 (‘Multilateral Trade Agreements’),
including the General Agreement on Tariffs and Trade 1994 (‘GATT 1994’), are
integral parts of this Agreement, binding on all Members.’
(3) Pursuant to Article IV(1) of the WTO Agreement, the Ministerial Conference may
adopt decisions on all matters under any of the Multilateral Trade Agreements. The
Ministerial Conference is composed of representatives of all the Members and it meets
at least once every two years. Pursuant to Article IV(2) of the WTO Agreement,
during the intervals between meetings of the Ministerial Conference, the General
Council is to conduct its functions. Pursuant to Article IX(1) of that Agreement, the
WTO usually adopts decisions by consensus.
(4) In accordance with Article IX(3) of the WTO Agreement, in exceptional
circumstances, the Ministerial Conference may decide to waive an obligation imposed
on a Member by the WTO Agreement or any of the Multilateral Trade Agreements.
(5) The Union was first granted a waiver of its obligations under Article I(1) of GATT
1994 on 8 December 2000 until 31 December 20062, and last extended on 28 July
2021 until 31 December 20263, to the extent necessary to permit the Union to afford
preferential treatment to eligible products originating in the Western Balkans.
(6) On 16 December 2025, the European Parliament and the Council adopted
Regulation (EU) 2025/2014 amending Regulation (EU) 2024/823 on exceptional trade
measures for countries and territories participating in or linked to the Stabilisation and

Association Process. This provided for the extension of the preferential arrangements
until 31 December 20304.
(7) The request to extend the WTO waiver permitting autonomous trade preferences to the
Western Balkans is justified considering the persistent difficult economic situation in
the region, and that the preferential treatment to eligible products the Union affords to
these countries is intended to promote economic development in a manner consistent
with the objectives of GATT 1994 and not to create barriers for the trade of other
WTO Members. Therefore, the exceptional circumstances justifying the extension of
the waiver from Article I(1) and from Article XIII of GATT 1994 still applies.
(8) It is appropriate to establish the position to be taken on the Union's behalf in the
General Council of the WTO, as the extension of the WTO waiver on autonomous
trade preferences granted by the Union to the Western Balkans will be binding on
Members of the WTO,
HAS ADOPTED THIS DECISION:
Article 1
The position to be taken on behalf of the Union within the General Council of the World
Trade Organization (WTO) shall be to request an extension of the existing WTO waiver on
the autonomous trade preferences granted by the Union to the Western Balkans until 31
December 2031, and to support the adoption of that request.

This Decision is addressed to the Commission.

SELETUSKIRI
1. KAVANDATAV REGULEERIMISESE
Käesolev ettepanek käsitleb otsust, millega määratakse kindlaks liidu nimel Maailma
Kaubandusorganisatsiooni (edaspidi „WTO“) peanõukogus võetav seisukoht seoses sellise
otsuse kavandatud vastuvõtmisega, millega pikendatakse WTO erandit, et lubada Euroopa
Liidul (edaspidi „EL“) teha Lääne-Balkani riikidele ühepoolseid kaubandussoodustusi.
2. ETTEPANEKU TAUST
2.1. Maailma Kaubandusorganisatsiooni asutamisleping (Marrakechi leping)
Marrakechi leping, millega asutati Maailma Kaubandusorganisatsioon (edaspidi „WTO
leping“), jõustus 1. jaanuaril 1995.
Euroopa Liit on lepingu osaline.
2.2. WTO ministrite konverents ja peanõukogu
WTO lepingu IV artikli lõike 1 kohaselt on ministrite konverents volitatud tegema otsuseid
kõigis mitmepoolsete kaubanduslepingutega hõlmatud küsimustes.
WTO lepingu IV artikli lõike 2 kohaselt täidab ministrite konverentsi kohtumiste vahelisel
ajal tema ülesandeid peanõukogu.
WTO lepingu IX artikli lõike 1 kohaselt teeb WTO otsuseid tavaliselt konsensuse alusel.
2.3. WTO peanõukogu kavandatav akt
WTO lepingu IX artikli lõike 3 kohaselt võib erakorralistel asjaoludel peatada liikmele
kehtestatud kohustuse.
ELi taotlusel võib WTO peanõukogu võtta vastu otsuse pikendada kehtivat WTO erandit, et
EL saaks Lääne-Balkani riikidele teha ühepoolseid kaubandussoodustusi (edaspidi
„kavandatav akt“).
Praegune erand kaotab kehtivuse 31. detsembril 2026. Seega on kavandatava akti eesmärk
pikendada erandit kuni 31. detsembrini 2031.
Kavandatav akt muutub WTO liikmetele siduvaks vastavalt WTO lepingu IX artikli lõikele 3
ja II artikli lõikele 2.
3. LIIDU NIMEL VÕETAV SEISUKOHT
16. detsembril 2025 võtsid Euroopa Parlament ja nõukogu vastu määruse (EL) 2025/2014,1
millega muudetakse määrust (EL) 2024/823 erandlike kaubandusmeetmete kohta
stabiliseerimis- ja assotsieerimisprotsessis osalevate või sellega seotud maade ja
territooriumide suhtes. Sellega nähti ette sooduskorra pikendamine kuni 31. detsembrini 2030.
Kaubandussoodustused kehtestati nõukogu määrusega (EÜ) nr 2007/20002; hiljem on neid
mitu korda muudetud ja pikendatud.

Kui 1994. aasta üldise tolli- ja kaubanduskokkuleppe (GATT 1994) I artikli lõike 1 ja GATT
1994 XIII artikli kohaseid kohustusi vajalikus ulatuses ei peatataks, peaks EL ühepoolsete
kaubandussoodustustega ette nähtud kohtlemist laiendama kõigile WTO liikmetele.
Seetõttu peab EL esitama taotluse pikendada veel viie aasta võrra, kuni 31. detsembrini 2031
liidu poolt Lääne-Balkani riikidele antud ühepoolsete kaubandussoodustustega seotud erandit
vastavalt WTO lepingu IX artikli lõikele 3. Lisaks nimetatud taotluse esitamisele peaks EL
toetama selle vastuvõtmist WTO peanõukogus.
See oleks viies kord, kui pikendatakse algselt 8. detsembril 2000 kestusega kuni 31.
detsembrini 20063 võimaldatud ja viimati 28. juulil 20214 pikendatud erandit. Algse erandi ja
selle kehtivusaja pikendamise põhjuseks on piirkonna jätkuvalt raske majanduslik olukord
ning see, et liidu poolt kõnealustele riikidele võimaldatav sooduskohtlemine
sooduskohtlemisele kuuluvate toodete suhtes on ette nähtud majandusarengu toetamiseks
vastavalt GATT 1994 eesmärkidele.
4. ÕIGUSLIK ALUS
4.1. Menetlusõiguslik alus
4.1.1. Põhimõtted
Euroopa Liidu toimimise lepingu (edaspidi „ELi toimimise leping“) artikli 218 lõikega 9 on
ette nähtud võtta vastu otsused, millega „kehtestatakse lepingus sätestatud organis liidu nimel
võetavad seisukohad, kui asjaomasel organil tuleb vastu võtta õigusliku toimega akte, välja
arvatud õigusaktid, millega täiendatakse või muudetakse lepingu institutsioonilist
raamistikku.“
Mõiste „õigusliku toimega aktid“ hõlmab akte, millel on õiguslik toime asjaomase organi
suhtes kehtiva rahvusvahelise õiguse normide alusel.
4.1.2. Kohaldamine käesoleval juhul
WTO peanõukogu on lepinguga, st WTO lepinguga ettenähtud organ.
Akt, mille peanõukogu peaks vastu võtma, on õigusliku toimega akt. Kavandatav akt on
rahvusvahelise õiguse alusel siduv vastavalt WTO lepingu II artikli lõikele 2 ja IX artikli
lõikele 3.
Kavandatava aktiga ei täiendata ega muudeta lepingu institutsioonilist raamistikku.
Seega on kavandatava otsuse menetlusõiguslik alus ELi toimimise lepingu artikli 218 lõige 9.
5. MATERIAALÕIGUSLIK ALUS
5.1. Põhimõtted
ELi toimimise lepingu artikli 218 lõike 9 kohase otsuse materiaalõiguslik alus sõltub eelkõige
selle kavandatava akti eesmärgist ja sisust, mille kohta liidu nimel seisukoht võetakse.
5.2. Kohaldamine käesoleval juhul
Kavandatava akti peamine eesmärk ja sisu on seotud ühise kaubanduspoliitikaga.
Seepärast on esildatud otsuse materiaalõiguslik alus ELi toimimise lepingu artikli 207 lõike 4
esimene lõik.

6. JÄRELDUS
Esildatud otsuse õiguslik alus peaks olema ELi toimimise lepingu artikli 207 lõike 4 esimene
lõik koostoimes artikli 218 lõikega 9.

NÕUKOGU OTSUS
Euroopa Liidu nimel võetava seisukoha kohta Maailma Kaubandusorganisatsiooni
peanõukogus seoses Euroopa Liidu taotlusega pikendada Lääne-Balkani riikidele
ühepoolseid kaubandussoodustusi võimaldavat erandit
EUROOPA LIIDU NÕUKOGU,
võttes arvesse Euroopa Liidu toimimise lepingut, eriti selle artikli 207 lõike 4 esimest lõiku
koostoimes artikli 218 lõikega 9,
võttes arvesse Euroopa Komisjoni ettepanekut
ning arvestades järgmist:
(1) Liit sõlmis Maailma Kaubandusorganisatsiooni asutamislepingu (edaspidi „WTO
leping“) nõukogu otsusega 94/800/EÜ1 ja see jõustus 1. jaanuaril 1995.
(2) WTO lepingu II artikli lõikes 2 on sätestatud, et lisades 1, 2 ja 3 sisalduvad lepingud
ning neile lisanduvad õigusaktid (edaspidi „mitmepoolsed kaubanduslepingud“),
sealhulgas 1994. aasta üldine tolli- ja kaubanduskokkulepe (GATT 1994), on
käesoleva lepingu lahutamatu osa ja siduvad kõigile liikmetele.
(3) WTO lepingu IV artikli lõike 1 kohaselt võib ministrite konverents võtta vastu
otsuseid kõigis mitmepoolsete kaubanduslepingutega hõlmatud küsimustes. Ministrite
konverents koosneb kõigi liikmete esindajatest ja see tuleb kokku vähemalt kord kahe
aasta jooksul. WTO lepingu IV artikli lõike 2 kohaselt täidab ministrite konverentsi
kohtumiste vahelisel ajal tema ülesandeid peanõukogu. WTO lepingu IX artikli lõike 1
kohaselt teeb WTO tavaliselt otsuseid konsensuse alusel.
(4) Vastavalt WTO lepingu IX artikli lõikele 3 võib ministrite konverents erakorralistel
asjaoludel teha otsuse peatada liikmele WTO lepingus või mis tahes mitmepoolses
kaubanduslepingus kehtestatud kohustus.
(5) Algselt tehti liidule erand GATT 1994 I artikli lõikest 1 tulenevatest kohustustest 8.
detsembril 2000 kehtivusega kuni 31. detsembrini 20062; viimati pikendati erandit 28.
juulil 2021 kehtivusega kuni 31. detsembrini 20263 ulatuses, mis võimaldab liidul
kohaldada sooduskohtlemist Lääne-Balkani riikidest pärit sooduskohtlemisele
kuuluvate toodete suhtes.
(6) 16. detsembril 2025 võtsid Euroopa Parlament ja nõukogu vastu määruse (EL)
2025/2014, millega muudetakse määrust (EL) 2024/823 erandlike kaubandusmeetmete
kohta stabiliseerimis- ja assotsieerimisprotsessis osalevate või sellega seotud maade ja

territooriumide suhtes. Sellega nähti ette sooduskorra pikendamine kuni 31.
detsembrini 20304.
(7) Taotlus pikendada WTO erandit, et võimaldada Lääne-Balkani riikidele ühepoolseid
kaubandussoodustusi, on põhjendatud, kuna piirkonna majanduslik olukord on
jätkuvalt raske ning liidu poolt kõnealustele riikidele võimaldatav sooduskohtlemine
sooduskohtlemisele kuuluvate toodete suhtes on ette nähtud majandusarengu
toetamiseks vastavalt GATT 1994 eesmärkidele, mitte aga teiste WTO liikmete
kaubanduse takistamiseks. Erakorralised asjaolud, mis õigustavad GATT 1994 I artikli
lõike 1 ja XIII artikli kohast erandi pikendamist, kehtivad seega endiselt.
(8) Kuna liidu poolt Lääne-Balkani riikidele antavate ühepoolsete
kaubandussoodustustega seotud erandi pikendamine on WTO liikmetele siduv, on
asjakohane kindlaks määrata liidu nimel WTO peanõukogus võetav seisukoht,
ON VASTU VÕTNUD KÄESOLEVA OTSUSE:
Artikkel 1
Liidu nimel Maailma Kaubandusorganisatsiooni (WTO) peanõukogus võetav seisukoht on
taotleda liidu poolt Lääne-Balkani riikidele antavate ühepoolsete kaubandussoodustustega
seotud kehtiva WTO erandi pikendamist kuni 31. detsembrini 2031 ja toetada selle taotluse
vastuvõtmist.

Käesolev otsus on adresseeritud komisjonile.
