EUROPEAN COMMISSION
Brussels, 10.9.2026 COM(2026) 465 final
Recommendation for a
COUNCIL DECISION
authorising the opening of negotiations for a sustainable fisheries partnership agreement
and its implementing protocol between the European Union and the Republic of
Madagascar
{SWD(2026) 272 final} - {SWD(2026) 273 final}
EN 1 EN
EXPLANATORY MEMORANDUM
1. CONTEXT OF THE PROPOSAL
• Reasons for and objectives of the proposal
The Commission recommends negotiating a new sustainable fisheries partnership agreement
and its implementing protocol with Madagascar, which would be in accordance with
Regulation (EU) No 1380/20131 on the Common Fisheries Policy (CFP), to meet the needs of
the EU fleet and contribute to CFP objectives.
• Consistency with existing policy provisions in the policy area
The Sustainable Fisheries Partnership Agreement (SFPA) between the European Union and
Madagascar and its Implementing Protocol2, signed on 30 June 2023 and applied since 1 July
2023, will expire on 30 June 2027. The Protocol currently sets the fishing opportunities
provided to the EU fleet and the corresponding financial contribution paid by the EU to
Madagascar amounting to EUR 1 800 000, of which EUR 1 100 000 for sectoral support, and
the contributions paid by vessel operators.
Access by EU vessels to Madagascar’s fishing zone is authorised for fishing for tuna and
highly migratory species, which concerns four Member States (Spain, France, Italy and
Portugal). The European Union has a network of active bilateral sustainable fisheries
partnership agreements (SFPAs) in West and Central Africa and in the region of the Indian
Ocean. In the region of the Indian Ocean, the tuna fleet has active SFPAs with the Republic of
Mauritius and the Republic of Seychelles.
SFPAs help to promote common fisheries policy objectives internationally by ensuring that
EU fishing activities outside EU waters are based on the same principles and standards as
those applicable under EU law. In addition, SFPAs strengthen the EU’s position in
international and regional fisheries organisations, in particular in the Indian Ocean Tuna
Commission (IOTC), the body for the conservation and management of highly migratory
species in the region, as well as in the Southern Indian Ocean Fisheries Agreement (SIOFA).
Lastly, SFPAs are based on the best available scientific advice and contribute to better
compliance with international measures, including combatting illegal, unreported and
unregulated (IUU) fishing.
• Consistency with other Union policies
Negotiating an SFPA and protocol with Madagascar is in line with the EU’s external action
towards African, Caribbean and Pacific (ACP) countries, and in particular with the EU’s
objectives with regard to respecting democratic principles and human rights.
SFPAs complement other EU instruments, including the Neighbourhood, Development and
International Cooperation Instrument (NDICI), in strengthening national and regional
capacities on fisheries management, and rely on existing opportunities such as the training
offered by the European Fisheries Control Agency (EFCA).
1 Regulation (EU) No 1380/2013 of the European Parliament and of the Council of 11 December 2013 on
the Common Fisheries Policy, amending Council Regulations (EC) No 1954/2003 and (EC)
No 1224/2009 and repealing Council Regulations (EC) No 2371/2002 and (EC) No 639/2004 and
Council Decision 2004/585/EC (OJ L 354, 28.12.2013, p. 22). 2 Current sustainable fisheries partnership agreement: OJ L 182, 19.7.2023, pp. 25-81.
EN 2 EN
The promotion of decent work is ensured by the expected negotiation of a social clause in line
with the 2007 International Labour Organization (ILO) Work in Fishing Convention (No 188)
for partner country workers to be employed by EU vessels.
2. LEGAL BASIS, SUBSIDIARITY AND PROPORTIONALITY
• Substantive legal basis
The substantive legal basis is provided by Article 43(2) of the Treaty on the Functioning of
the European Union (TFEU) in relation to the common fisheries policy.
• Procedural legal basis
Article 218(3) TFEU provides that, where the agreement envisaged does not relate
exclusively or principally to the common foreign and security policy, the Commission shall
submit recommendations to the Council. The Council shall adopt a decision authorising the
opening of the negotiations and nominating the EU negotiator or the head of the EU’s
negotiating team.
Article 218(4) TFEU provides that the Council may address negotiating directives to the
negotiator and designate a special committee to be consulted by the negotiator.
The Commission recommends opening negotiations between the European Union and the
Republic of Madagascar so as to conclude an international sustainable fisheries partnership
agreement and its implementing protocol. The Commission is to be nominated as negotiator.
The procedural legal basis for the proposal for a decision to authorise the opening of
negotiations for the envisaged agreement is Article 218(3) and (4) TFEU.
• Choice of negotiator
Given that the envisaged agreement covers exclusively matters other than the common
foreign and security policy, the Commission should be nominated as negotiator in accordance
with Article 218(3) of the Treaty on the Functioning of the European Union.
• Union competence
The subject matter covered by the recommendation concerns the common fisheries policy, for
which the Union exercises exclusive competence.
• Proportionality
The proposed decision is proportional to the objective of establishing a legal, environmental,
economic and social governance framework for fishing activities carried out by EU vessels in
third-country waters, in accordance with Article 31 of Regulation (EU) No 1380/2013 on the
Common Fisheries Policy.
• Choice of instrument
This recommendation for a Council decision is submitted in accordance with Article 218(3)
and (4) TFEU, which envisage the adoption by the Council of a decision authorising the
opening of negotiations and nominating the Union negotiator. The Council may also address
negotiating directives to the negotiator. No other legal instrument exists that could be used in
order to achieve the objective expressed in this recommendation.

3. RESULTS OF EX-POST EVALUATIONS, STAKEHOLDER
CONSULTATIONS AND IMPACT ASSESSMENTS
• Ex-post evaluations / fitness checks of existing legislation
In 2026, the Commission carried out an ex-post evaluation of the current protocol to the
SFPA with Madagascar and an ex-ante evaluation of a possible new agreement and protocol.
The report of that evaluation is public3.
The evaluation report concluded that the EU tuna fishing sector has a strong interest in an
agreement on fishing activities in Madagascar. The evaluation report also highlights a
continued discrepancy between the number of fishing opportunities offered and their use. Any
future protocol should reduce the number of fishing opportunities offered, which should result
in a reduction in the financial contribution under the Protocol. Furthermore, the renewal of the
Protocol would help strengthen monitoring, control and surveillance, and would contribute to
improved governance of the fisheries in the region. The evaluation shows that renewing the
protocol would also bring benefits for Madagascar in view of the significant financial
contribution to be paid towards development of the fisheries sector.
• Consultation of interested parties
The parties consulted during the evaluation were the Member States, fisheries representatives
and international civil society organisations, in addition to EU and Malagasy fisheries
administrations and civil society. Consultations also took place in the framework of the Long
Distance Fleet Advisory Council.
• Collection and use of expertise
The evaluations carried out involved independent experts in the field.
• Impact assessment
Not applicable
• Regulatory fitness and simplification
Not applicable
• Fundamental rights
The negotiating directives set out in the annex to the proposal for a decision recommend
including a clause on the consequences of infringements of human rights and democratic
principles.
4. BUDGETARY IMPLICATIONS
The budgetary impact of a new protocol will derive from the payment of a financial
contribution to Madagascar. The related budgetary allocations (commitments and payment
appropriations) need to be included each year in the budget line for SFPAs (08 05 01) and be

compatible with the financial programming of the Multiannual Financial Framework4 for
2021-2027 and for 2028-2034. The annual amounts for commitments and payments are
established in the yearly budgetary procedure including the reserve line for protocols that had
not entered into force at the beginning of the year5.
5. OTHER ELEMENTS
• Implementation plans and monitoring, evaluation and reporting arrangements
The negotiations should begin in the fourth quarter of 2026 in order to limit the period
between the two SFPAs following the expiry of the current agreement on 30 June 2027.
• Detailed explanation of the proposal's specific provisions
The Commission recommends that:
- the Council authorise it to open and conduct negotiations for the conclusion of a new
sustainable fisheries partnership agreement with Madagascar and an implementing protocol.

ANNEX
Negotiating directives
– The aim of the negotiations is to conclude a sustainable fisheries partnership agreement
(SFPA) and its implementing protocol between the European Union and the Republic of
Madagascar in accordance with Regulation (EU) No 1380/2013 on the Common
Fisheries Policy.
– The SFPA and its implementing protocol should define the general framework for the
fishing activities of EU vessels in Madagascar’s fishing zone and for the EU’s fisheries
cooperation with Madagascar.
– To promote sustainable and responsible fishing while ensuring mutual benefits for the
EU and Madagascar, the Commission’s negotiating objectives should be based on the
following aspects:
• ensuring access to Madagascar’s fishing zone and the necessary authorisations
for EU vessels to fish in that zone, thereby inter alia developing the network of
sustainable fisheries partnership agreements available to EU operators in the
Indian Ocean;
• fully implementing the relevant management plans adopted by regional
fisheries management organisations (RFMOs) on the basis of the best available
scientific advice to ensure the environmental sustainability of fishing activities
and promote ocean governance internationally. The fishing activities of EU
vessels should exclusively target the surplus of available resources, taking
account of the local fleet’s fishing capacity, while paying special attention to
the highly migratory nature of the stocks concerned. In this respect, the
available surplus in Madagascar’s waters of highly migratory species covered
by the fisheries partnership agreement is defined through the conservation and
management measures in the Indian Ocean adopted by the Indian Ocean Tuna
Commission (IOTC).
• seeking an appropriate share of the fisheries resources, commensurate with the
EU fleet’s interests;
• obtaining a clause on non-discrimination between fleets and transparent
information about fishing activities authorised in Madagascar to ensure that the
same technical conditions are applied to all foreign fleets in Madagascar’s
fishing zone;
• ensuring that access to the fishing zone is based on the EU fleet’s historical and
expected future activity in the region, taking into consideration the most up-to-
date and reliable scientific assessments available and the interests of the EU’s
outermost regions;
• establishing a dialogue to strengthen sectoral policy with a view, on the one
hand, to encouraging the implementation of a responsible fisheries policy in
line with Madagascar’s development objectives, in particular as regards
fisheries governance, the fight against illegal, unreported and unregulated
fishing, the control, monitoring and surveillance of fishing activities, the
provision of scientific advice, and fishermen’s social rights, and, on the other
hand, to fostering economic activity;
EN 2 EN
• including a clause on the consequences of any infringements of human rights
(including social rights) and democratic principles;
• ensuring that the protocol will contribute to promoting sustainable growth and
decent work in relation to fishing activities, taking into account relevant
International Labour Organization (ILO) conventions.
– In particular, the protocol should establish:
• the fishing opportunities to be granted to EU vessels;
• the financial compensation and the conditions for its payment; and
• the mechanisms for implementing sectoral support.

COMMISSION STAFF WORKING DOCUMENT
EXECUTIVE SUMMARY OF THE EVALUATION
of the 2023-2027 Sustainable Fisheries Partnership Agreement and its implementing
Protocol between the European Union and the Republic of Madagascar
accompanying the document
Recommendation for a
COUNCIL DECISION
authorising the opening of negotiations on a Sustainable Fisheries Partnership
Agreement and its implementing Protocol between the Union and the Republic of
Madagascar
{COM(2026) 465 final} - {SWD(2026) 272 final}
1
The EU negotiates and implements Sustainable Fisheries Partnership Agreements (SFPAs) with
third countries as foreseen by the common fisheries policy’s1 external dimension. The EU uses
SFPAs to create a legal, environmental, economic, and social governance framework for fishing
activities of EU fishing fleets in third-country waters. In return, the EU gives the partner country
both financial compensation for that access and financial support for implementing national
policies on sustainable fisheries and blue economy. The EU’s contribution is supplemented by fees
paid by EU vessel owners.
In accordance with Article 31(10) of the CFP Basic Regulation, the European Commission must
ensure independent ex ante and ex post evaluations of each protocol to a sustainable fisheries
partnership agreement, before submitting a recommendation to the Council to authorise the
opening of negotiations for a new implementing protocol.
This Staff Working Document provides:
➢ an evaluation of the protocol’s application between July 2023 and May 2026 (although the
SFPA will end in June 2027) focusing on effectiveness, efficiency and coherence,
relevance, and added value. It examines whether the initiative has met its objectives in
terms of environmental sustainability, economic benefits for the EU fleet, and support for
the development of Madagascar’s fisheries sector;
➢ an ex ante evaluation, which considers options for a possible new SFPA and implementing
protocol.
Both evaluations are based on findings of an independent evaluation study by an external
consultant2.
The SFPA has generally succeeded in effectively providing fishing opportunities for EU fishing
vessels in important fishing areas while ensuring the conservation and sustainable exploitation of
fishery resources; while in return giving Madagascar the financial means for its own actions.
EU fishing activities were subject to an appropriate framework of reporting obligations, including
fishing logbooks, vessel monitoring systems and on-board observers.
Access to Madagascar’s fishing zone has been particularly important for two categories of vessels:
purse seiners (flying the flag of France, Spain and Italy) and surface longliners based in La Réunion
(France). However, the available fishing opportunities appear too high for the number of vessels
authorised, with an average utilisation rate of 48%, suggesting a gap between the fleet's actual
needs and the expectations reflected in the implementing protocol.
The conditions imposed on the EU tuna fleet largely converge with those Madagascar imposes on
other foreign operators. The EU fleet is nevertheless subject to a shark catch limit not imposed on
other foreign fleets which is discriminatory.
The evaluation also finds that the implementing protocol supports market supply and economic
interaction. The activity of EU tuna vessels in Madagascar’s fishing zone creates a business climate
1 Regulation (EU) No 1380/2013 of the European Parliament and of the Council of 11 December 2013 on the

2
conducive to economic exchanges between those vessels and Madagascar’s fisheries sector,
generating indirect economic benefits for the country.
In terms of efficiency, the evaluation judges the protocol to provide good value for money for the
EU. Because catches in 2024 and 2025 exceeded the reference tonnage, the EU financial
contribution for access was exactly proportionate to the cost foreseen in the protocol at the time of
the evaluation, thereby making the public contribution for access profitable.
The EU's contribution, particularly for sectoral support, is also considered aligned with
Madagascar’s needs and absorption capacity. For EU shipowners, the protocol is likewise seen as
cost-effective, since their financial contribution is proportionate to effective catches and benefits
compared with operating costs and total revenues. Compared with the previous protocol, the
current one introduced a new source of funding for ecosystem protection activities, although its
use should be more closely aligned with that purpose.
As regards coherence, the evaluation finds the agreement and protocol broadly consistent with the
EU's common fisheries policy and its external dimension. They contribute to the regional network
of sustainable fisheries agreements in the Indian Ocean (with Mauritius and Seychelles), as well
as with other EU actions and those of Member States at bilateral and regional levels, particularly
the ongoing regional ocean cooperation programme.
In terms of relevance, the evaluation also finds that the protocol broadly corresponds to the needs
of both the EU fleet and of Madagascar. The species covered are of interest to the EU fleet and the
available fishing opportunities are acceptable when considering all fleets active in the same waters
at national and regional level. However, the level of authorised fishing opportunities in vessel
numbers appears higher than actual use would justify.
Finally, concerning EU added value, the evaluation states that EU intervention through the
conclusion of the agreement and its 2023-2027 protocol generates added value compared with the
situation in the absence of such an agreement and protocol, where it would not have been possible
to secure common access for Member States’ fleets.
For Madagascar, the EU contributes to raising governance standards through the good practices
implemented under the protocol. More generally, the agreement delivers benefits in terms of
access, governance, support to sectoral policies and regional fisheries cooperation that could not
have been achieved with the same efficiency without EU-level intervention
The ex ante evaluation analyses the relevant objectives of a possible new agreement and
implementing protocol, considering the current and future needs of this intervention. It examines
the lessons learned and the results of the ex post evaluation of the current implementing protocol.
Based on this analysis, it examines three options:
• no negotiation with a view to concluding a new SFPA and implementing protocol
• negotiation of an identical SFPA and implementing protocol (status quo)
• negotiation of a new SFPA and implementing protocol with some amended provisions
(evolution).
3
According to the ex ante evaluation, the preferred option is the negotiation of a new Sustainable
Fisheries Partnership Agreement and implementing protocol eliminating some elements which did
not prove to meet parties and stakeholders’ needs.
As regards access and the technical component, the new protocol would aim to align negotiated
fishing opportunities with current capacities and to better protect fishers on board the fishing
vessels by updating the social clause and reducing constraints on their employment.
As regards the sectoral support component, the emphasis would be placed on supporting the
implementation of Madagascar fisheries policy to improve impact for coastal communities and
food security, to reinforce scientific capacity, as well as monitoring, control and surveillance
needed to combat illegal fishing.

toetust.
• Konsulteerimine sidusrühmadega
Hindamise käigus konsulteeriti liikmesriikidega, tootmisharu esindajatega ja rahvusvaheliste
kodanikuühiskonna organisatsioonidega ning liidu ja Madagaskari kalandussektori
haldusasutuste ja kodanikuühiskonna esindajatega. Konsultatsioonid toimusid ka kaugpüügi
nõuandekomisjoni raames.
• Eksperdiarvamuste kogumine ja kasutamine
Hindamiste käigus konsulteeriti valdkonna sõltumatute ekspertidega.
• Mõju hindamine

4. MÕJU EELARVELE
Uue protokolli mõju eelarvele tuleneb rahalise toetuse maksmisest Madagaskarile.

aspektidel:
• kindlustada juurdepääs Madagaskari kalapüügipiirkonnale ja tagada liidu
kalalaevadele selles piirkonnas vajalikud kalapüügiload ning laiendada liidu
ettevõtjate jaoks muu hulgas selliste India ookeani äärsete riikide võrgustikku,
kellega on sõlmitud säästva kalapüügi partnerluslepingud;
• rakendada täies ulatuses asjakohaseid majandamiskavasid, mille piirkondlikud
kalandusorganisatsioonid on parimate kättesaadavate teaduslike nõuannete
alusel vastu võtnud, et tagada püügitegevuse keskkonnasäästlikkus ja edendada
ookeanide majandamist rahvusvahelisel tasandil. Liidu kalalaevade
püügitegevus peaks olema suunatud üksnes olemasolevatele kalavarudele ja
arvestama kohaliku laevastiku püügivõimsust; ühtlasi tuleks pöörata erilist
tähelepanu sellele, et tegemist on varudega, kuhu kuulub pika rändega liike.
Kalandusalase partnerluslepinguga hõlmatud liikide puhul määratakse
Madagaskari vetes olemasolev ülejääk kindlaks India Ookeani Tuunikomisjon
(IOTC) poolt vastu võetud liikide kaitse- ja majandamise meetmetega India
ookeanis;
• eesmärgiks tuleks seada omandada neist kalavarudest liidu laevastiku huvidele
täielikult vastav asjakohane osa;
• tagada, et kõigi Madagaskari kalapüügivööndis asuvate välisriikide laevastike
suhtes kohaldataks samu tehnilisi tingimusi, lisades lepingusse klausli eri
laevastike diskrimineerimise keelu ja Madagaskaris lubatud püügitegevuse
läbipaistvuse kohta;
piirkondade huve;
• alustada dialoogi valdkondliku poliitika tugevdamiseks, et toetada
vastutustundliku kalanduspoliitika rakendamist kooskõlas Madagaskari
arengueesmärkidega, eelkõige seoses püügitegevuse juhtimisega, võitlusega
ebaseadusliku, teatamata ja reguleerimata kalapüügi vastu, seoses
püügitegevuse kontrollimise, seire ja järelevalvega ja teaduslike nõuannetega,
kalameeste sotsiaalõigustega, ning teisest küljest edendada majandustegevust;
• lisada lepingusse säte inimõiguste (sh sotsiaalõiguste) ja demokraatia
põhimõtete rikkumise tagajärgede kohta;
ET 2 ET
• tagada, et protokolliga soodustataks kalandustegevusega seotud kestlikku
majanduskasvu ja inimväärset tööd, võttes arvesse asjakohaseid
Rahvusvahelise Tööorganisatsiooni konventsioone.
– Protokollis tuleks eelkõige kindlaks määrata järgmised aspektid:
• ELi laevadele tagatavad kalapüügivõimalused,
• rahaline hüvitis ja selle maksmise tingimused,
• valdkondliku toetuse rakendamise viisid.
