Ad “A” item 44: Hamilton II Declaration on marine conservation collaboration and

cooperation in the Sargasso Sea on behalf of the EU and its Member States

Authorisation to sign a non-binding instrument

STATEMENT BY FRANCE

“Se référant au Paragraphe 3 du projet de Déclaration Hamilton II ci-dessus référencé, la France

souhaite rappeler qu’elle appuie pleinement la Déclaration des Nations unies sur les droits des

peuples autochtones adoptée le 13 septembre 2007 en ce qu’elle marque une avancée essentielle

dans la protection des droits de l’Homme des populations autochtones et locales.

Se référant à la déclaration interprétative qu’elle a formulée lors de l’adoption de la Déclaration des

Nations Unies sur les droits des peuples autochtones, la France tient à rappeler qu’en vertu des

principes constitutionnels d’indivisibilité de la République, d’unicité du peuple français et d’égalité

des citoyens devant la loi, chaque citoyen français dispose par la Constitution des mêmes droits et

obligations quelle que soit son origine.

Afin d’assurer la cohérence avec la législation en vigueur et la sécurité juridique des utilisateurs,

l’interprétation des paragraphes de la Déclaration Hamilton II relatives aux connaissances

traditionnelles détenues par les communautés d’habitants se fera ainsi dans le respect de nos

principes constitutionnels./.”

Mediterranean Aviation Agreement with the Kingdom of Morocco, to take

account of the accession of Croatia
