Notification regarding changes in legislation
Reference is made to the Agreement between the Republic of Estonia and Australia on Social Security, signed on 14 September 2015.
The Republic of Estonia hereby informs the Australian side that, as of 1 October 2026, Estonia will replace the survivor’s pension for children with a new survivor’s benefit under the Family Benefits Act.
The new survivor’s benefit is a flat-rate family benefit intended to provide financial support to a child who has lost one or both parents. It will no longer depend on the deceased parent’s previous insurance record and will be financed from general tax revenues.
As part of the same reform, Estonia will also discontinue granting new survivor’s pensions to widows and widowers.
For persons residing in Australia, any survivor’s pensions awarded before the reform will continue to be paid. In addition, applications will continue to be accepted and processed where the entitlement arose before 1 October 2026. In such cases, the pension will be awarded and paid under the rules applicable before the reform, provided that the statutory conditions are met.
As of May 2026, however, there are no survivor’s pensions currently in payment to persons residing in Australia.
For information, the main features and conditions of the new survivor’s benefit are as follows:
• entitlement arises for children residing in Estonia, irrespective of their nationality and irrespective of the country in which the parent died, provided that the statutory conditions are met;
• it requires a prior connection with Estonia. This condition is met if the eligible child, the person applying for the benefit, or the deceased parent has lived in Estonia for at least 36 months during the 48 consecutive months preceding the application or the death of the parent.
• it is granted until the child reaches the age of 19, or until the age of 21 if the child continues in education, and it is paid as a uniform flat-rate amount for all beneficiaries,
Suur-Ameerika 1 I 10122 Tallinn / ESTONIA / +372 626 9301 / [email protected] / www.sm.ee I Reg no 70001952
irrespective of contributions or insurance periods. The amount of the benefit in 2026 will be EUR 345 per child and will be subject to annual indexation;
• it cannot be paid simultaneously with a survivor’s pension for the same child; if a child is entitled to a survivor’s pension from another state, the amount of that pension is deducted from the amount of the Estonian survivor’s benefit.
Yours sincerely,
Leili Eenlo Head of Social Security Policy

Subject: RE: Upcoming changes to Estonian survivor's pensions - ref 03.07.2026 No 1.4-2/1695-1 [SEC=OFFICIAL]
Dear Kate,
Thank you for your prompt response. Please find below our replies to your questions.
1. Coverage of the new survivor's benefit under the Agreement
Your understanding is correct. The new survivor's benefit for children is a residence-based family benefit and does not fall within the scope of the Agreement between Australia and the Republic of Estonia on Social Security.
2. Changes to Services Australia's claim form
With regard to your second question, we agree that, in the longer term, references to survivor's pensions and related sections of the claim form will likely need to be removed or adjusted to reflect the legislative changes introduced on 1 October 2026.
However, Estonia is currently in a transitional phase. While no new survivor's pensions can be awarded in respect of deaths occurring on or after 1 October 2026, applications for survivor's pensions may still be submitted where the provider died before that date. Such claims may be lodged after 1 October 2026 and will continue to be examined and decided under the previous legislation.
Survivor's pensions granted under the previous legislation will continue to be paid in accordance with the transitional provisions of Estonian law. These pensions remain part of the mandatory state pension insurance scheme and therefore continue to fall within the material scope of the Agreement.
As an interim solution, we would therefore suggest retaining the existing survivor's pension section in the form and adding a note such as:
"Applies only where the deceased provider died before 1 October 2026."
Does this approach seems reasonabvle to you? We may then do updates on the form at a later stage.
We would also like to note that the contact details of the Estonian Social Insurance Board should be updated, as the institution has relocated:

Dear Leili
I refer to your letter of 3 July 2026 (your ref 03.07.2026 No 1.4-2/1695-1 attached). Thank you for providing information on the new survivor’s benefit for children and the cessation of new grants of survivor’s pensions for widows and widowers. The Department of Social Services has taken this time to review the information provided, in consultation with our competent institution, Services Australia, and has the following two questions.
The new benefit as described in your letter appears to be a non-contributory, residence-based payment that is not linked to personal contributions or the deceased parent’s periods of insurance and is paid under the Family Benefits Act. For these reasons, we understand the new benefit will not be in scope under Article 2(1)(b)(i) of the Agreement, which applies to “the legislation governing mandatory state pension insurance in case of old‑age and loss of provider except pension rights provided to persons repressed and payment of mandatory funded pensions.” However, we would welcome your confirmation.
We note that any payments of this new benefit will be classified as foreign income for the purposes of Australia’s domestic social security law and assessed under the income test when determining entitlement to an Australian benefit (whether paid under the Agreement or otherwise).
The claim form for an Estonian benefit (attached) maintained by our competent institution, Services Australia, currently allows for individuals to claim a survivor’s pension. Please advise if any changes to this form are required as a result of the changes outlined in your letter.
Please reach out should you want any additional information on the questions provided above.
Thank you again for notifying us of these changes. We look forward to continued collaboration in relation to the Agreement.
Kind regards
