15TH TERM
557th
RESOLUTION OF THE SENATE
Adopted on the 31st session held on 21 October 2026
on the Proposal for Regulation of the European Parliament and of the Council on the European
Union Agency for Law Enforcement Cooperation (Europol), amending Regulation (EU)
2018/1726 and Regulation (EU) 2024/982, and repealing Regulation (EU) 2016/794 /Senate Print
no. N 195/15, COM(2026) 580/
The Senate
I.
1. Supports
the strengthening of Europol’s technological and analytical support, but insists that the
Agency must remain a support platform, and rejects steps that would lead to disproportionate
centralisation or weaken the decisive role of the Member States;
2. Strongly supports
the development of capabilities in the areas of artificial intelligence and digital forensics, but
calls for clear mechanisms to ensure that these innovations primarily respond to the real needs
of investigators in the Member States;
3. Welcomes
the deepening of relations with Schengen associated countries and third countries, but warns
against the politicisation of such cooperation through its excessive linkage with the Union’s
broader external policies;
4. Expresses fundamental reservations
regarding provisions that would enable Europol to have direct access to national databases
(Article 9); considers such a step to be a breach of the principle of subsidiarity, as Member
States must retain control over the information provided;
5. Takes a sceptical stance,
in line with the Government’s position, on the establishment of Europol support offices in the
Member States (Article 26); considers that their added value has not been sufficiently
demonstrated and that there is a risk of duplication with existing cooperation structures;
6. Considers problematic
the power of the Europol Management Board to establish operational, technical or
administrative functions, capacities or facilities in the territory of the Member States (Article
72(2)(j)), as this model undermines the autonomy of Member States and interferes with
territorial sovereignty, particularly if such capacities were to be established without the prior
consent of the Member State concerned;
15071/26 4
JAI.1 EN/CS
7. Disagrees
with strengthening the influence of the European Commission and the European Parliament
on the Europol Management Board, as, given the implications for internal security, a strong
link with the Member States must be maintained; at the same time, it is also critical of the
creation of an excessively extensive administrative structure, including a new Executive
Board;
8. Points out
the high estimated implementation costs (a one-off cost of CZK 230 million and
approximately CZK 300 million over the period 2028–2034), and therefore supports the
Government’s efforts to limit the administrative obligations of the Member States so as to
keep the impact on the State budget as low as possible;
II.
1. Requests
the Government to inform the Senate in the course of the first half of 2027 of how it has taken
this Resolution into account and of the further progress of deliberations;
2. Authorises
the President of the Senate to forward this Resolution to the European Commission.
