OPINIA
Komisji Spraw Zagranicznych i Unii Europejskiej Senatu RP
dotycząca projektu rozporządzenia Parlamentu Europejskiego i Rady w sprawie
Agencji Unii Europejskiej ds. Współpracy Organów Ścigania (Europol), zmieniającego
rozporządzenie (UE) 2018/1726 i rozporządzenie (UE) 2024/982 oraz uchylającego
rozporządzenie (UE) 2016/794
COM(2026)580
przyjęta na posiedzeniu w dniu 27 października 2026 r.
1. Komisja Spraw Zagranicznych i Unii Europejskiej (KSZUE) popiera działania zmierzające
do wzmocnienia zdolności operacyjnych Europolu i możliwości skutecznego wspierania
przez Europol państw członkowskich jak również przyznanie Europolowi kompetencji do
budowania własnych narzędzi analitycznych.
2. KSZUE z zadowoleniem przyjmuje stworzenie jasnych i przejrzystych podstaw prawnych
do współpracy i wymiany informacji pomiędzy Europolem a innymi Agencjami Unii
Europejskiej działającymi w obszarze Przestrzeni Współpracy, Bezpieczeństwa
i Sprawiedliwości.
3. Istotne zastrzeżenia KSZUE budzi konieczność uzyskania zgody Komisji Europejskiej na
dokumenty programowe i działania podejmowane przez Europol. Zdaniem KSZUE Europol
Europolu.
4. KSZUE krytycznie ocenia zaproponowaną zmianę sposobu zarządzania Agencją oraz
wprowadzenie osobnej Rady Zarządzającej oraz Zarządu. Istotne wzmocnienie roli Komisji
Europejskiej w zarządzaniu Europolem, poprzez zwiększenie liczby członków Komisji do

OPINION
of the Foreign and European Union Affairs Committee of the Senate of the Republic of
Poland
on the proposal for a Regulation of the European Parliament and of the Council on the
European Union Agency for Law Enforcement Cooperation (Europol), amending Regulation
(EU) 2018/1726 and Regulation (EU) 2024/982, and repealing Regulation (EU) 2016/794
COM(2026) 580
adopted at the meeting of 27 October 2026
1. The Foreign and European Union Affairs Committee (FEUAC) supports measures aimed at
strengthening Europol’s operational capabilities and its capacity to support Member States
effectively, as well as granting Europol the competence to develop its own analytical tools.
2. The FEUAC welcomes the creation of clear and transparent legal bases for cooperation and
information exchange between Europol and other European Union agencies operating in the Area of
Freedom, Security and Justice.
3. The FEUAC has significant reservations regarding the requirement to obtain the European
Commission’s approval for programming documents and actions undertaken by Europol. The
FEUAC is of the view that Europol should remain an agency whose primary objective is to support
Member States. Consequently, Member States and their representatives should continue to have a
decisive influence over programming documents adopted by Europol and the establishment of
support units for Member States. In the opinion of the FEUAC, the establishment, closure and
restructuring of Europol’s Centres should also remain within the competence of the Management
Board of Europol.
4. The FEUAC takes a critical view of the proposed change to the Agency’s governance model and
of the introduction of a separate Management Board and Executive Board. In the assessment of the
FEUAC, the significant strengthening of the European Commission’s role in the governance of
Europol, by increasing the number of Commission representatives on the Management Board to two
and granting the Commission a permanent seat on the Executive Board, is excessive and may lead to
a weakening of the Member States’ influence over governance and, consequently, on the usefulness
of Europol in meeting the needs of combating crime in the Member States. Moreover, the draft
Regulation lacks provisions governing the selection of the Member States to be represented on the
Executive Board of Europol, which may increase uncertainty and constitute a factor limiting the
influence of certain Member States on the Agency’s governance.
