VAIDLUSTUSE TÄPSUSTAMINE
Vaidlustaja soovib täpsustada või konkretiseerida oma vaidlustust alljärgnevas.
1) Kolmanda isiku pakutud lisaseadmete mittevastavus (Monitor klass 5) 1.1. Nagu juba vaidlustuse punktides 17-18 välja toodud esineb põhjendatud kahtlus, et Kolmanda isiku pakutud
lisaseadmed ei vasta riigihangete alusdokumentide nõuetele ka positsioonis: 21. Monitor klass 5 (34" Ultrawide monitor USB-hubiga.
1.2. Vastavustabeli jrk 180 kohaselt peab kõnealune 34 tolline (34") monitor vastama muuhulgas järgmisele nõudele: „monitori jalg peab olema kinnitatud monitori külge FDMI liidesega (Vesa mount 100x100).“ Kolmanda isiku pakutud 34 tolline monitor (täpsemalt monitori jala kinnitatus monitori külge) ei vasta nimetatud hankenõudele.
1.3. Kolmas isik on pakkunud tõenäoliselt tootja HP 34" monitori, konkreetsemalt ilmselt mudelit „HP E34m G4
WQHD Curved USB-C Conferencing Monitor“ [lisa 1]1 või muud sarnast 34 tollist monitori. HP 34" monitoride puhul ei ole aga monitori jalg kinnitatud monitori külge Vesa mount 100x100 nagu on käesolevas hankes nõutav.

1.4. Tootja HP 34 tolliste monitoride puhul ei ole monitori jalg kinnitatud monitori külge Vesa mount 100x100
(nagu hankes nõutud), vaid tootja HP poolt arendatud kinnitusmehhanismiga.
Illustreeriv pilt, kuidas on HP 34" monitori puhul monitori jalg kinnitatud monitori külge
Nagu ka toodud illustreerivalt pildilt2 näha, siis HP 34 tolliste monitoride puhul ei ole monitori jalg kinnitatud monitori külge Vesa mount 100x100 (nagu on hankenõudena sätestatud), vaid monitori jala kinnitus on tootja HP arendatud omapoolne lahendus.
Tõsi, HP monitoridel on korpuse sees küll iseenesest olemas Vesa 100x100 augud3, kuid 34 tolliste monitoride
puhul HP neid monitori jala kinnitamiseks ei kasuta ega rakenda. Nagu öeldud, 34 tollise (ehk ülisuure monitori) puhul on HP monitori jalg kinnitatud monitori külge tootja omapoolse lahendusmehhanismiga, milline ei ole hankes nõutud Vesa mount 100x100.
1.5. See, et HP 34 tollise monitori puhul ei ole monitori jalg kinnitatud monitori külge Vesa mount 100x100 on vastava valdkonna spetsialistidele (kelleks on ka IT hangete kohustuslik keskne hankija RIT) teada.
1.6. Hankenõue on siinkohal ühene ja konkreetne: „monitori jalg peab olema kinnitatud monitori külge FDMI liidesega (Vesa mount 100x100).“ Argielus saame väita, et mis see monitori jala kinnituse erinevus (kas Vesa 100x100 või tootja arendatud kinnituslahendus) olulist muudab, kuid riigihangetes tuleb kinni pidada hanke alusdokumentide nõuetest. Riigihankeõiguse tähenduses on hankenõudele „läbi sõrmede vaatamine“ õigusvastane.

2) Pakutud sülearvuti HP mudel
Nagu juba vaidlustuse punktis 9 selgitatud, siis sõltumata sellest, millist konkreetset sülearvuti HP EliteBook mudelit on pakutud (HP EliteBook 840, HP EliteBook 845 vm), igal juhul on Kolmas isik pakkunud tootja HP sülearvutit. Kõik vaidlustuses esitatud mittevastavused ja minetused esinevad Kolmanda isiku pakkumuse vastavuse, vastavuse kontrolli ning pakkumuste hindamise (hindepunktide andmine) puhul ka juhul, kui Kolmas isik on pakkunud HP EliteBook mingit muud mudelit. Sama kehtib Kolmanda isiku pakutud lisaseadmete puhul.
Vaidlustaja täpsustab, et Kolmanda isiku pakutud sülearvuti võimalikuks konkreetseks mudeliks võib olla ka „HP EliteBook 645 14 inch G10 Notebook PC“ [lisa 2].4
Kordame, et kõik vaidlustuses toodud võimalikud mittevastavused Kolmanda isiku pakkumuses (sülearvuti Eesti paigutusega klaviatuur; USB-saatja kaugus arvuti korpusest mitte rohkem kui 0,7cm; ekraani heledustugevus; aku mahutavus) kui ka pakkumuste hindamisel kehtivad täies mahus ka juhul, kui pakutud sülearvuti konkreetseks mudeliks on hoopis HP EliteBook 645 [lisa 2].
3) Lisaseadmetena pakutud klaviatuurid
Täieliku eksaktsuse huvides täpsustame, et vaidlustuse punktis 24 („Neljandaks“, lk 4-5) viidatud lauarvutite klaviatuuride all pidas ja peab Vaidlustaja silmas lisaseadmetena pakutud järgmiste tootekomplektide hulka kuuluvaid klaviatuure:

Neid klaviatuure saab kasutada ja kasutatakse õigupoolest nii lauarvutite kui sülearvutite puhul. Asja lihtsustamise ja kergema jälgitavuse huvides nimetas Vaidlustaja neid üldistavalt lauarvutite klaviatuurideks. Ei saa eeldada, et Vaidlustuskomisjon oleks IT valdkonna süvaasjatundja, mistõttu on teatud üldistused vajalikud. Täpsuse huvides loetleme siinkohal kõik vastavad punktid üle, kus on lisaseadmetena pakutud klaviatuuri puhul Vastavustabelis „K3 Lisaseadmed“ nõutud „Eesti paigutusega klaviatuur“:

Hankes lisaseadmetena pakutud klaviatuurid (nimetame neid siis lihtsustatult lauarvuti klaviatuurideks või lihtsalt klaviatuurideks) on asja lahendamisel ja „Eesti paigutusega klaviatuuri“ tähenduse mõistmisel olulise tähtsusega, kuna ka nende klaviatuuride puhul kehtib hankes nõue Eesti paigutusega klaviatuur. Esitame pildi Kolmanda isiku poolt hanke Osas 4 lisaseadmetena pakutud klaviatuurist (HP 235 Wireless and Keyboard Combo):
