Thanks for your rapid response. Yes, we are within the ten day timeframe of us being made aware of it. Are you saying that after a tender is awarded there is no option to appeal??? Even if the disqualification is without merit and we submitted the necessary documentation???

I am sorry, but explanations about your tender or about the desison can only be given by the contracting authority.

So if you are interested in better understanding the reasons for rejection, please contact the Ministry of Foreign Affairs. The Review committee does not make any evaluations of the procurement process outside of the dispute procedure. Appeal procedure is held in Estonian anyway, so you might consider looking for a representative to get legal advice.

I don't understand from your e-mail, which public procurement it is, but if it is the open procedure, the request for review must be received by the Review Committee within ten days as of the day when the requester learned or had to learn of the infringement of its rights or harming of its interests, but not after the award of the public contract.

Dear Ms. Angelika Timusk,

We just received notice of our rejection on the Tender 482788 (Israeli export and investment inclusion strategy - Ministry of Foreign Affairs) and are interested in better understanding the reasons for rejection and evaluating our options for appeal. Our offer was in compliance with everything requested, and we outlined both the project manager, the roles undertaken, the many projects we have done to penetrate the local market on behalf of other governmental clients over the past few years that go far beyond the Tender requirements. In addition, the experience our Estonian colleague has at opening additional markets on behalf of her Estonian employer goes beyond the experience required.

Considering this is a project that requires extensive knowledge of the Israeli market, and we are one of the leaders in business development and market penetration in it, I find it hard to understand how we were disqualified. I would like to have a call to understand this better and to decide how to move forward regarding and appeal. When would you have a moment to speak and discuss this in greater depth?
