Accession by Saint Kitts and Nevis
The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify the deposit by the Government of Saint Kitts and Nevis, on July 8, 2024, of its instrument of accession to the Beijing Treaty on Audiovisual Performances, adopted at Beijing on June 24, 2012.
The Treaty will enter into force, with respect to Saint Kitts and Nevis, on October 8, 2024.
The list of the States party to the Beijing Treaty on Audiovisual Performances (status on ./. July 8, 2024) is attached to this Notification.

1 The People’s Republic of China shall not be bound by Article 11(1) and (2) of the Treaty. 2 The Treaty shall not apply for the time being to Hong Kong, China until otherwise notified by the Government of the People’s Republic of China. 3 Pursuant to Article 11(2) of the Treaty, Japan will establish a right to equitable remuneration, instead of the right of authorization provided for in Article11(1) for the broadcasting of a performance by:
(a) a broadcasting organization, using the audiovisual fixation that it made for the broadcasting under the authorization of the person entitled to the right to broadcast the performance;
(b) a person to whom the broadcasting organization referred to in (a) provided the audiovisual fixations referred to in (a), using those audiovisual fixations; or
(c) a person to whom the broadcasting organization referred to in (a) otherwise supplied a broadcasting program pertaining to the authorization referred to in (a), using that broadcasting program;
Pursuant to Article 11(2) of the Treaty, Japan will also establish a right to equitable remuneration, instead of the right of authorization provided for in Article 11(1) of the Treaty, for the simultaneous cablecasting of a broadcast performance and for the “automatic public transmission of unfixed information” made in order that a broadcast performance be received simultaneously with the original broadcasting exclusively in the broadcasting service area pertaining to the original broadcasting;
“automatic public transmission of unfixed information” shall mean transmission by means of inputting information into an automatic public transmission server already connected with a telecommunication line that is provided for use by the public, which is carried out automatically in response to a request from the public and which is intended for direct receipt by the public;
Pursuant to Article 11, paragraph 3 of the Treaty, Japan will not apply the provisions of Article 11 paragraphs (1) and (2) of the Treaty to the communication to the public of a performance fixed in audiovisual fixations done by means other than cablecasting or “automatic public transmission of unfixed information”. 4 In accordance with Article 11(2) of the Treaty, the United Mexican States opts for the right to equitable remuneration for the broadcast and communication to the public of performances fixed in audiovisual fixations, without prejudice to

the provisions of its national legislation on telecommunications with respect to the obligation of restricted television concessionaires to retransmit the broadcast television signal. 5 In accordance with Article 11(2) of the Treaty, the Republic of Peru opts for the right to equitable remuneration for the direct or indirect use of performances fixed in audiovisual fixations for broadcasting or for communication to the public. 6 In accordance with Article 11(3) of the Treaty, the Republic of Korea will apply the provision of Article 11(1) thereof only in respect of the performances fixed in audiovisual fixation for broadcasting or transmission by wire. Transmission by wire does not include transmission over the Internet. 7 Pursuant to Article 11(3) of the Treaty, the provisions under Articles 11(1) and (2) do not apply to the Independent State of Samoa, until such time that the national laws have been reformed. 8 In accordance with Article 11(2) of the Treaty, the Slovak Republic has set conditions in its legislation for the exercise of the right to equitable remuneration. 9 Pursuant to Article 11(2) and (3), instead of the exclusive right of authorization referred to in Article 11(1), Switzerland shall grant a right to remuneration subject to collective management and to the principle of reciprocity for the broadcasting, retransmission or public reception of an audiovisual fixation where it is made from a commercially available audiovisual fixation.

Le Directeur general de !'Organisation Mondiale de la Propriete lntellectuelle (OMPI) presente ses compliments au Ministre des affaires etrangeres et a l'honneur de notifier le depot par le Gouvernement de Saint-Kitts-et-Nevis, le 8 juillet 2024, de son instrument d'adhesion au Traite de Beijing sur les interpretations et executions audiovisuelles, adopte a Beijing le 24 juin 2012.
Le Traite entrera en vigueur, a l'egard de Saint-Kitts-et-Nevis, le 8 octobre 2024.
La liste des Etats parties au Traite de Beijing sur les interpretations et executions ./. audiovisuelles (situation le 8 juillet 2024) est jointe a la presente notification.

1 La République populaire de Chine ne sera pas liée par les articles 11.1) et 2) du traité. 2 Le traité ne s’appliquera pas, pour le moment, à Hong Kong (Chine) et ce jusqu’à notification du contraire par le Gouvernement de la République populaire de Chine. 3 Conformément à l’article 11.2) du traité, le Japon établira un droit à rémunération équitable en lieu et place du droit d’autorisation visé à l’article 11.1) du traité pour la radiodiffusion d’une interprétation ou exécution par:
a) un organisme de radiodiffusion au moyen de la fixation audiovisuelle qu’il a réalisée aux fins de la radiodiffusion en vertu de l’autorisation conférée par la personne investie du droit de diffuser l’interprétation ou exécution; b) une personne à laquelle l’organisme de radiodiffusion visé à l’alinéa a) a remis une fixation audiovisuelle visée à l’alinéa a), qui utilise cette fixation audiovisuelle; ou c) une personne à laquelle l’organisme de radiodiffusion visé à l’alinéa a) a fourni un programme de radiodiffusion relevant de l’autorisation visée à l’alinéa a), qui utilise ce programme de radiodiffusion;
Conformément à l’article 11.2) du traité, le Japon établira également un droit à rémunération équitable en lieu et place du droit d’autorisation visé à l’article 11.1) du traité, pour la distribution simultanée par câble d’une interprétation ou exécution radiodiffusée et pour la “transmission automatique au public d’informations non fixées” effectuée afin qu’une interprétation ou exécution radiodiffusée soit reçue simultanément à l’émission originale exclusivement dans la zone de desserte de l’émission originale;
“La transmission automatique au public d’informations non fixées” s’entend d’une transmission effectuée au moyen de l’introduction de données dans un serveur automatique de transmission au public déjà connecté à une ligne de communication mis à la disposition du public, qui s’effectue automatiquement en réponse à une demande du public et qui est destinée à être reçue directement par le public;
Conformément à l’article 11.3) du traité, le Japon n’appliquera pas les dispositions des alinéas 1) et 2) de l’article 11 du traité à la communication au public d’une interprétation ou exécution fixée dans des fixations audiovisuelles effectuée par d’autres moyens que la distribution par câble ou la “transmission automatique au public d’informations non fixées. 4 Conformément à l'article 11.2 du traité, les États-Unis Mexicains opte pour le droit à une rémunération équitable lorsque des interprétations ou exécutions fixées sur fixations audiovisuelles sont radiodiffusées ou communiquées au public, sans préjudice des dispositions de sa législation nationale en matière de télécommunications, relatives à l’obligation des concessionnaires de télévision restreinte de retransmettre le signal de télévision diffusé.

5 Conformément à l’article 11.2) du traité, la République du Pérou opte pour un droit à rémunération équitable lorsque des interprétations ou exécutions fixées sur fixations audiovisuelles sont utilisées directement ou indirectement pour la radiodiffusion ou pour la communication au public. 6 Conformément à l’article 11.3) du traité, la République de Corée appliquera la disposition de l’article 11.1) uniquement à l’égard des interprétations ou exécutions fixées sur fixations audiovisuelles à des fins de radiodiffusion ou de transmission par fil. La transmission par fil ne comprend pas la transmission sur l’Internet. 7 Conformément à l’article 11.3), les dispositions des articles 11.1) et 2) ne s’appliquent pas à l’État indépendant du Samoa jusqu’à ce que la législation nationale ait été réformée. 8 Conformément à l’article 11.2) du traité, la République slovaque a prévu dans sa législation les conditions d’exercice du droit à rémunération équitable. 9 Conformément à l’article 11.2) et 3), la Suisse accorde, en lieu et place du droit exclusif d’autorisation visé à l’article 11(1), un droit à rémunération soumis à la gestion collective et au principe de réciprocité pour la diffusion, la retransmission ou la réception publique d’une fixation audiovisuelle lorsque celle-ci est faite à partir d’une fixation audiovisuelle disponible sur le marché.
