Privacy Policy
Security and data protection is a very high priority for the management of the AngelEye srl. The use of the AngelEye website does not record or hold visitors personal information or data. If an enquiry form is completed on the website, processing of personal data may become necessary. If the processing of personal data is necessary, the data held will only be used to respond to an enquiry and will not be shared with third parties or used in a mailing campaign unless prior permission is granted.
The processing of personal data, such as the name, address, e-mail address, or telephone number will be compliant with the General Data Protection Regulation (GDPR), and in accordance with the country-specific data protection regulations. Under the rules of GDPR our company would like to reassure the general public of the nature, scope, and purpose of the potential personal data we collect, use and process. Furthermore, data subjects are informed, by means of this data protection declaration, of the rights to which they are entitled.
As the controller, AngelEye srl has implemented numerous technical and organizational measures to ensure the most complete protection of personal data processed through our website. However, Internet-based data transmissions may in principle have security gaps and could be subject to potential hacking, so absolute protection cannot be guaranteed. For this reason, every data subject is free to transfer personal data to us via alternative means, e.g. by telephone.
1. Definitions
The data protection declaration of AngelEye srl is based on the terms used by the European legislator for the adoption of the General Data Protection Regulation (GDPR). Our data protection declaration is legible and understandable for the general public, as well as our customers and business partners. To ensure this, we would like to explain the terminology used.
In this data protection declaration, we use the following terms:
• a) Personal data
Personal data means any information relating to an identified or identifiable natural person (“data subject”). An identifiable person is one who can be identified, directly or indirectly, in particular by reference such as a name, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
• b) Data subject
Data subject is any identified or identifiable natural person, whose personal data is processed by the company’s controller responsible for the processing.

• c) Processing
Processing is any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
• d) Restriction of processing
Restriction of processing is the marking of stored personal data with the aim of limiting their processing in the future.
• e) Profiling
Profiling means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person; in particular to analyse or predict aspects concerning that person's performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location or movements.
• f) Pseudonymisation
Pseudonymisation is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information. This is providing that additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable person.
• g) Controller or controller responsible for the processing
Controller or controller responsible for the processing is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.
• h) Processor
Processor is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
• i) Recipient
Recipient is a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing.

Third party is a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process personal data.
• k) Consent
Consent of the data subject is any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

Any data subject may, at any time, contact our Data Protection Officer directly with all questions and suggestions concerning data protection.
4. Cookies
The Internet pages of the AngelEye srl use cookies. Cookies are text files that are stored in a computer system via an Internet browser.
Many Internet sites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a character string through which Internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This allows visited Internet sites and servers to differentiate the individual browser of the data subject from other Internet browsers that contain other cookies. A specific Internet browser can be recognized and identified using the unique cookie ID.
Through the use of cookies, the AngelEye srl can provide the users of this website with more user-friendly services that would not be possible without the cookie setting.
By means of a cookie, the information and offers on our website can be optimized with the user in mind. Cookies allow us, as previously mentioned, to recognize our website users. The purpose of this recognition is to make it easier for users to utilize our website. The website user that uses cookies, e.g. does not have to enter access data each time the website is accessed, because this is taken over by the website, and the cookie is thus stored on the user's computer system. Another example is the cookie of a shopping cart in an online shop. The online store remembers the articles that a customer has placed in the virtual shopping cart via a cookie.
The data subject may, at any time, prevent the setting of cookies through our website by means of a corresponding setting of the Internet browser used, and may thus permanently deny the setting of cookies. Furthermore, already set cookies may be deleted at any time via an Internet browser or other software programs. This is possible in all popular Internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be entirely usable.
5. Collection of general data and information
The website of the AngelEye srl collects a series of general data and information when a data subject or automated system calls up the website. This general data and information are stored in the server log files. Collected may be (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrers), (4) the sub- websites, (5) the date and time of access to the Internet site, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing system, and (8) any other similar data and information that may be used in the event of attacks on our information technology systems.
When using these general data and information, the AngelEye srl does not draw any conclusions about the data subject. Rather, this information is needed to (1) deliver the content of our website correctly, (2) optimize the content of our website as well as its advertisement, (3) ensure the long-term viability of our information technology systems and website technology, and (4) provide law enforcement authorities with the information necessary for criminal prosecution in case of a cyber-attack. Therefore, the AngelEye srl analyzes anonymously collected data and information statistically, with the aim of increasing the data protection and data security of our enterprise, and to ensure an optimal level of protection for the personal data we process.

The anonymous data of the server log files are stored separately from all personal data provided by a data subject.
6. Registration on our website
The data subject has the possibility to register on the website of the controller with the indication of personal data. Which personal data are transmitted to the controller is determined by the respective input mask used for the registration. The personal data entered by the data subject are collected and stored exclusively for internal use by the controller, and for his own purposes. The controller may request transfer to one or more processors (e.g. a parcel service) that also uses personal data for an internal purpose which is attributable to the controller.
By registering on the website of the controller, the IP address—assigned by the Internet service provider (ISP) and used by the data subject—date, and time of the registration are also stored. The storage of this data takes place against the background that this is the only way to prevent the misuse of our services, and, if necessary, to make it possible to investigate committed offenses. Insofar, the storage of this data is necessary to secure the controller. This data is not passed on to third parties unless there is a statutory obligation to pass on the data, or if the transfer serves the aim of criminal prosecution.
The registration of the data subject, with the voluntary indication of personal data, is intended to enable the controller to offer the data subject contents or services that may only be offered to registered users due to the nature of the matter in question. Registered persons are free to change the personal data specified during the registration at any time, or to have them completely deleted from the data stock of the controller.
The data controller shall, at any time, provide information upon request to each data subject as to what personal data are stored about the data subject. In addition, the data controller shall correct or erase personal data at the request or indication of the data subject, insofar as there are no statutory storage obligations. The entirety of the controller’s employees are available to the data subject in this respect as contact persons.
7. Subscription to our newsletters
On the website of the AngelEye srl, users are given the opportunity to subscribe to our enterprise's newsletter. The input mask used for this purpose determines what personal data are transmitted, as well as when the newsletter is ordered from the controller.
The AngelEye srl informs its customers and business partners regularly by means of a newsletter about enterprise offers. The enterprise's newsletter may only be received by the data subject if (1) the data subject has a valid e-mail address and (2) the data subject registers for the newsletter shipping. A confirmation e-mail will be sent to the e-mail address registered by a data subject for the first time for newsletter shipping, for legal reasons, in the double opt-in procedure. This confirmation e-mail is used to prove whether the owner of the e-mail address as the data subject is authorized to receive the newsletter.
During the registration for the newsletter, we also store the IP address of the computer system assigned by the Internet service provider (ISP) and used by the data subject at the time of the registration, as well as the date and time of the registration. The collection of this data is necessary in order to understand the (possible) misuse of the e-mail address of a data subject at a later date, and it therefore serves the aim of the legal protection of the controller.

The personal data collected as part of a registration for the newsletter will only be used to send our newsletter. In addition, subscribers to the newsletter may be informed by e-mail, as long as this is necessary for the operation of the newsletter service or a registration in question, as this could be the case in the event of modifications to the newsletter offer, or in the event of a change in technical circumstances. There will be no transfer of personal data collected by the newsletter service to third parties. The subscription to our newsletter may be terminated by the data subject at any time. The consent to the storage of personal data, which the data subject has given for shipping the newsletter, may be revoked at any time. For the purpose of revocation of consent, a corresponding link is found in each newsletter. It is also possible to unsubscribe from the newsletter at any time directly on the website of the controller, or to communicate this to the controller in a different way.
8. Newsletter-Tracking
The newsletter of the AngelEye srl contains so-called tracking pixels. A tracking pixel is a miniature graphic embedded in such e-mails, which are sent in HTML format to enable log file recording and analysis. This allows a statistical analysis of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, the AngelEye srl may see if and when an e-mail was opened by a data subject, and which links in the e- mail were called up by data subjects.
Such personal data collected in the tracking pixels contained in the newsletters are stored and analyzed by the controller in order to optimize the shipping of the newsletter, as well as to adapt the content of future newsletters even better to the interests of the data subject. These personal data will not be passed on to third parties. Data subjects are at any time entitled to revoke the respective separate declaration of consent issued by means of the double-opt-in procedure. After a revocation, these personal data will be deleted by the controller. The AngelEye srl automatically regards a withdrawal from the receipt of the newsletter as a revocation.
9. Contact possibility via the website
The website of the AngelEye srl contains information that enables a quick electronic contact to our enterprise, as well as direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a data subject contacts the controller by e-mail or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the data controller are stored for the purpose of processing or contacting the data subject. There is no transfer of this personal data to third parties.
10. Comments function in the blog on the website
The AngelEye srl offers users the possibility to leave individual comments on individual blog contributions on a blog, which is on the website of the controller. A blog is a web-based, publicly-accessible portal, through which one or more people called bloggers or web-bloggers may post articles or write down thoughts in so- called blogposts. Blogposts may usually be commented by third parties.
If a data subject leaves a comment on the blog published on this website, the comments made by the data subject are also stored and published, as well as information on the date of the commentary and on the user's (pseudonym) chosen by the data subject. In addition, the IP address assigned by the Internet service provider (ISP) to the data subject is also logged. This storage of the IP address takes place for security reasons, and in case the data subject violates the rights of third parties, or posts illegal content through a given comment. The storage of these personal data is, therefore, in the own interest of the data controller, so that he can exculpate

in the event of an infringement. This collected personal data will not be passed to third parties, unless such a transfer is required by law or serves the aim of the defense of the data controller.
11. Subscription to comments in the blog on the website
The comments made in the blog of the AngelEye srl may be subscribed to by third parties. In particular, there is the possibility that a commenter subscribes to the comments following his comments on a particular blog post.
If a data subject decides to subscribe to the option, the controller will send an automatic confirmation e-mail to check the double opt-in procedure as to whether the owner of the specified e-mail address decided in favor of this option. The option to subscribe to comments may be terminated at any time.
12. Routine erasure and blocking of personal data
The data controller shall process and store the personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is granted by the European legislator or other legislators in laws or regulations to which the controller is subject to.
If the storage purpose is not applicable, or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data are routinely blocked or erased in accordance with legal requirements.
13. Rights of the data subject
• a) Right of confirmation
Each data subject shall have the right granted by the European legislator to obtain from the controller the confirmation as to whether or not personal data concerning him or her are being processed. If a data subject wishes to avail himself of this right of confirmation, he or she may, at any time, contact any employee of the controller.
• b) Right of access
Each data subject shall have the right granted by the European legislator to obtain from the controller free information about his or her personal data stored at any time and a copy of this information. Furthermore, the European directives and regulations grant the data subject access to the following information:
o the purposes of the processing; o the categories of personal data concerned; o the recipients or categories of recipients to whom the personal data have been or will be
disclosed, in particular recipients in third countries or international organizations; o where possible, the envisaged period for which the personal data will be stored, or, if not
possible, the criteria used to determine that period; o the existence of the right to request from the controller rectification or erasure of personal
data, or restriction of processing of personal data concerning the data subject, or to object to such processing;
o the existence of the right to lodge a complaint with a supervisory authority;

o where the personal data are not collected from the data subject, any available information as to their source;
o the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the data subject.
Furthermore, the data subject shall have a right to obtain information as to whether personal data are transferred to a third country or to an international organization. Where this is the case, the data subject shall have the right to be informed of the appropriate safeguards relating to the transfer.
If a data subject wishes to avail himself of this right of access, he or she may, at any time, contact any employee of the controller.
• c) Right to rectification
Each data subject shall have the right granted by the European legislator to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.
If a data subject wishes to exercise this right to rectification, he or she may, at any time, contact any employee of the controller.
• d) Right to erasure (Right to be forgotten)
Each data subject shall have the right granted by the European legislator to obtain from the controller the erasure of personal data concerning him or her without undue delay, and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies, as long as the processing is not necessary:
o The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
o The data subject withdraws consent to which the processing is based according to point (a) of Article 6(1) of the GDPR, or point (a) of Article 9(2) of the GDPR, and where there is no other legal ground for the processing.
o The data subject objects to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) of the GDPR.
o The personal data have been unlawfully processed. o The personal data must be erased for compliance with a legal obligation in Union or Member
State law to which the controller is subject. o The personal data have been collected in relation to the offer of information society services
referred to in Article 8(1) of the GDPR.

If one of the aforementioned reasons applies, and a data subject wishes to request the erasure of personal data stored by the AngelEye srl, he or she may, at any time, contact any employee of the controller. An employee of AngelEye srl shall promptly ensure that the erasure request is complied with immediately.
Where the controller has made personal data public and is obliged pursuant to Article 17(1) to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other controllers processing the personal data that the data subject has requested erasure by such controllers of any links to, or copy or replication of, those personal data, as far as processing is not required. An employees of the AngelEye srl will arrange the necessary measures in individual cases.
• e) Right of restriction of processing
Each data subject shall have the right granted by the European legislator to obtain from the controller restriction of processing where one of the following applies:
o The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
o The processing is unlawful and the data subject opposes the erasure of the personal data and requests instead the restriction of their use instead.
o The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defense of legal claims.
o The data subject has objected to processing pursuant to Article 21(1) of the GDPR pending the verification whether the legitimate grounds of the controller override those of the data subject.
If one of the aforementioned conditions is met, and a data subject wishes to request the restriction of the processing of personal data stored by the AngelEye srl, he or she may at any time contact any employee of the controller. The employee of the AngelEye srl will arrange the restriction of the processing.
• f) Right to data portability
Each data subject shall have the right granted by the European legislator, to receive the personal data concerning him or her, which was provided to a controller, in a structured, commonly used and machine-readable format. He or she shall have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, as long as the processing is based on consent pursuant to point (a) of Article 6(1) of the GDPR or point (a) of Article 9(2) of the GDPR, or on a contract pursuant to point (b) of Article 6(1) of the GDPR, and the processing is carried out by automated means, as long as the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Furthermore, in exercising his or her right to data portability pursuant to Article 20(1) of the GDPR, the data subject shall have the right to have personal data transmitted directly from one controller to

another, where technically feasible and when doing so does not adversely affect the rights and freedoms of others.
In order to assert the right to data portability, the data subject may at any time contact any employee of the AngelEye srl.
• g) Right to object
Each data subject shall have the right granted by the European legislator to object, on grounds relating to his or her particular situation, at any time, to processing of personal data concerning him or her, which is based on point (e) or (f) of Article 6(1) of the GDPR. This also applies to profiling based on these provisions.
The AngelEye srl shall no longer process the personal data in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defense of legal claims.
If the AngelEye srl processes personal data for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing. This applies to profiling to the extent that it is related to such direct marketing. If the data subject objects to the AngelEye srl to the processing for direct marketing purposes, the AngelEye srl will no longer process the personal data for these purposes.
In addition, the data subject has the right, on grounds relating to his or her particular situation, to object to processing of personal data concerning him or her by the AngelEye srl for scientific or historical research purposes, or for statistical purposes pursuant to Article 89(1) of the GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public interest.
In order to exercise the right to object, the data subject may contact any employee of the AngelEye srl. In addition, the data subject is free in the context of the use of information society services, and notwithstanding Directive 2002/58/EC, to use his or her right to object by automated means using technical specifications.
• h) Automated individual decision-making, including profiling
Each data subject shall have the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her, or similarly significantly affects him or her, as long as the decision (1) is not is necessary for entering into, or the performance of, a contract between the data subject and a data controller, or (2) is not authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, or (3) is not based on the data subject's explicit consent.
If the decision (1) is necessary for entering into, or the performance of, a contract between the data subject and a data controller, or (2) it is based on the data subject's explicit consent, the AngelEye srl shall implement suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and contest the decision.

If the data subject wishes to exercise the rights concerning automated individual decision-making, he or she may, at any time, contact any employee of the AngelEye srl.
• i) Right to withdraw data protection consent
Each data subject shall have the right granted by the European legislator to withdraw his or her consent to processing of his or her personal data at any time.
If the data subject wishes to exercise the right to withdraw the consent, he or she may, at any time, contact any employee of the AngelEye srl.
14. Data protection for applications and the application procedures
The data controller shall collect and process the personal data of applicants for the purpose of the processing of the application procedure. The processing may also be carried out electronically. The criteria used to determine the period of storage of personal data is the respective statutory retention period. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of the contract or the initiation of a contract.

We clarify that the provision of personal data is partly required by law (e.g. tax regulations) or can also result from contractual provisions (e.g. information on the contractual partner). 35. Video and Images Treatment
1. Reason
AngelEye underwater cameras are placed to acquire underwater pictures of swimming pools. The pictures are real time analyzed by the AngelEye drowning recognition software, to identify dangerous situations with the aim to prevent drownings.
2. Customer Information
Each customer must inform the end users (patrons) about the video surveillance platform and about the aim of the system.

3. Retain
The video and pictures are stored locally on the server and remotely on the AngelEye Cloud, just for the time needed for the analytics, no more than 15 seconds. After this time the video and pictures are automatically erased. The only pictures stored for more than 15 seconds for a maximum time of 72 hours, are the ones needed to generate statistics. In case of customer request, the pictures can be stored for 72 hours as backup of the local storage. After 72 hours the pictures are automatically erased. The pictures related to alarms can be stored for a maximum time of 30 days for being ready to be delivered to any governing bodies if requested.
4. Public Rights
Access Requests for personal data
Any person whose image is recorded on a CCTV system has a right to seek and be supplied with a copy of their own personal data from the video footage.
So, anyone who is captured by any CCTV cameras has the right to request that footage, it is seen as personal data. They must follow a procedure, but are perfectly within their rights. If any other individuals are visible in the footage, a footage redaction service will be provided (i.e. blur out the faces of other individuals).
5. Authority Request
Supply of CCTV images to the Police or other authorities.
The Police or other authorities may request footage, but always followed up by a written request on official headed paper. Police will often just want to view the footage on the premises of the Data Controller or Processor, this action would not contravene data protection laws.
6. Technical Assurance
Responsibilities of the Technical department of AngelEye.
The AngelEye employees cannot access the pictures stored in the Cloud Servers, with the exception of the Managers who are authorized and then only for purposes of system analysis to provide assistance to clients, in these circumstances events are recorded and archived. The pictures access is logged in an archive with all the information: name of the AngelEye employee, time and date of the access, reason. As clarification pictures are not copied and downloaded, with the exception of the explicit requests from the customer or other authorities . AngelEye have in place all the security procedures to inhibit the picture access to the non-authorized users from any of the servers.

Uppumise tuvastamise süsteem toimib selliselt, et basseini (vette ja vee kohale) on paigaldatud kaamerad ja andurid, mis koostöös tuvastavad basseinis olukordi ja liikumisi, mis võivad viidata ohule (võimalikule uppumisohule). Ohuolukorra tuvastamisel süsteem saadab teate instruktori nutikellale – teade on täpp ekraanil oleval basseini kujutisel, kus võimalik ohtlik olukord täpselt on. See võimaldab instruktoril võimalikule ohtlikule olukorrale basseinis kiiresti reageerida. Võimalike vees juhtuvate juhtumite puhul on kiire reageerimine äärmiselt oluline ja võib päästa inimese elu (vee alla vajumine toimub reeglina vaikselt ja kiiresti). Kui ohtlik olukord tekib vees, on märkamiseks ja tegutsemiseks reaalsuses vaid loetud sekundid. Samas on suur veepind koht, kus märkamine on raskem (vee peegeldused, virvendused, erinev valgus, teised ujujad jmt). Seega on tehnoloogia, mis võimaldab erinevaid ohtlikke olukordi basseinivees tuvastada, kasutuselevõtt inimeste elu ja tervise seisukohalt oluline.
Eestis veealust uppumise tuvastamise süsteemi veel kusagil kasutusel ei ole, aga on mujal maailmas, sh paljudes kohtades Euroopas. Tartu Veekeskus poolt kasutusele võetava süsteemi lähimad kasutuskohad on Leedus ja Rootsis.

Security and data protection is a very high priority for the management of the AngelEye srl. The use of the AngelEye website does not record or hold visitors personal information or data. The purpose of this recognition is to make it easier for users to utilize our website. The website user that uses cookies, e.g. does not have to enter access data each time the website is accessed, because this is taken over by the website, and the cookie is thus stored on the user's computer system. 5. Collection of general data and information
The website of the AngelEye srl collects a series of general data and information when a data subject or automated system calls up the website. This general data and information are stored in the server log files. Collected may be (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrers), (4) the sub- websites, (5) the date and time of access to the Internet site, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing system, and (8) any other similar data and information that may be used in the event of attacks on our information technology systems.
When using these general data and information, the AngelEye srl does not draw any conclusions about the data subject. Rather, this information is needed to (1) deliver the content of our website correctly, (2) optimize the content of our website as well as its advertisement, (3) ensure the long-term viability of our information technology systems and website technology, and (4) provide law enforcement authorities with the information necessary for criminal prosecution in case of a cyber-attack. Therefore, the AngelEye srl analyzes anonymously collected data and information statistically, with the aim of increasing the data protection and data security of our enterprise, and to ensure an optimal level of protection for the personal data we process.

The anonymous data of the server log files are stored separately from all personal data provided by a data subject.
6. Registration on our website
The data subject has the possibility to register on the website of the controller with the indication of personal data. Which personal data are transmitted to the controller is determined by the respective input mask used for the registration. The personal data entered by the data subject are collected and stored exclusively for internal use by the controller, and for his own purposes. The controller may request transfer to one or more processors (e.g. a parcel service) that also uses personal data for an internal purpose which is attributable to the controller.
By registering on the website of the controller, the IP address—assigned by the Internet service provider (ISP) and used by the data subject—date, and time of the registration are also stored. The storage of this data takes place against the background that this is the only way to prevent the misuse of our services, and, if necessary, to make it possible to investigate committed offenses. Insofar, the storage of this data is necessary to secure the controller. This data is not passed on to third parties unless there is a statutory obligation to pass on the data, or if the transfer serves the aim of criminal prosecution.
The registration of the data subject, with the voluntary indication of personal data, is intended to enable the controller to offer the data subject contents or services that may only be offered to registered users due to the nature of the matter in question. Registered persons are free to change the personal data specified during the registration at any time, or to have them completely deleted from the data stock of the controller.
The data controller shall, at any time, provide information upon request to each data subject as to what personal data are stored about the data subject. In addition, the data controller shall correct or erase personal data at the request or indication of the data subject, insofar as there are no statutory storage obligations. The entirety of the controller’s employees are available to the data subject in this respect as contact persons.
7. Subscription to our newsletters
On the website of the AngelEye srl, users are given the opportunity to subscribe to our enterprise's newsletter. The input mask used for this purpose determines what personal data are transmitted, as well as when the newsletter is ordered from the controller.
The AngelEye srl informs its customers and business partners regularly by means of a newsletter about enterprise offers. The enterprise's newsletter may only be received by the data subject if (1) the data subject has a valid e-mail address and (2) the data subject registers for the newsletter shipping. A confirmation e-mail will be sent to the e-mail address registered by a data subject for the first time for newsletter shipping, for legal reasons, in the double opt-in procedure. This confirmation e-mail is used to prove whether the owner of the e-mail address as the data subject is authorized to receive the newsletter.
During the registration for the newsletter, we also store the IP address of the computer system assigned by the Internet service provider (ISP) and used by the data subject at the time of the registration, as well as the date and time of the registration. The collection of this data is necessary in order to understand the (possible) misuse of the e-mail address of a data subject at a later date, and it therefore serves the aim of the legal protection of the controller.

The personal data collected as part of a registration for the newsletter will only be used to send our newsletter. In addition, subscribers to the newsletter may be informed by e-mail, as long as this is necessary for the operation of the newsletter service or a registration in question, as this could be the case in the event of modifications to the newsletter offer, or in the event of a change in technical circumstances. There will be no transfer of personal data collected by the newsletter service to third parties. The subscription to our newsletter may be terminated by the data subject at any time. The consent to the storage of personal data, which the data subject has given for shipping the newsletter, may be revoked at any time. For the purpose of revocation of consent, a corresponding link is found in each newsletter. It is also possible to unsubscribe from the newsletter at any time directly on the website of the controller, or to communicate this to the controller in a different way.
8. Newsletter-Tracking
The newsletter of the AngelEye srl contains so-called tracking pixels. A tracking pixel is a miniature graphic embedded in such e-mails, which are sent in HTML format to enable log file recording and analysis. This allows a statistical analysis of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, the AngelEye srl may see if and when an e-mail was opened by a data subject, and which links in the e- mail were called up by data subjects.
Such personal data collected in the tracking pixels contained in the newsletters are stored and analyzed by the controller in order to optimize the shipping of the newsletter, as well as to adapt the content of future newsletters even better to the interests of the data subject. These personal data will not be passed on to third parties. Data subjects are at any time entitled to revoke the respective separate declaration of consent issued by means of the double-opt-in procedure. After a revocation, these personal data will be deleted by the controller. The AngelEye srl automatically regards a withdrawal from the receipt of the newsletter as a revocation.
9. Contact possibility via the website
The website of the AngelEye srl contains information that enables a quick electronic contact to our enterprise, as well as direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a data subject contacts the controller by e-mail or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the data controller are stored for the purpose of processing or contacting the data subject. There is no transfer of this personal data to third parties.
10. Comments function in the blog on the website
The AngelEye srl offers users the possibility to leave individual comments on individual blog contributions on a blog, which is on the website of the controller. A blog is a web-based, publicly-accessible portal, through which one or more people called bloggers or web-bloggers may post articles or write down thoughts in so- called blogposts. Blogposts may usually be commented by third parties.
If a data subject leaves a comment on the blog published on this website, the comments made by the data subject are also stored and published, as well as information on the date of the commentary and on the user's (pseudonym) chosen by the data subject. In addition, the IP address assigned by the Internet service provider (ISP) to the data subject is also logged. This storage of the IP address takes place for security reasons, and in case the data subject violates the rights of third parties, or posts illegal content through a given comment. The storage of these personal data is, therefore, in the own interest of the data controller, so that he can exculpate

in the event of an infringement. This collected personal data will not be passed to third parties, unless such a transfer is required by law or serves the aim of the defense of the data controller.
11. Subscription to comments in the blog on the website
The comments made in the blog of the AngelEye srl may be subscribed to by third parties. In particular, there is the possibility that a commenter subscribes to the comments following his comments on a particular blog post.
If a data subject decides to subscribe to the option, the controller will send an automatic confirmation e-mail to check the double opt-in procedure as to whether the owner of the specified e-mail address decided in favor of this option. The option to subscribe to comments may be terminated at any time.
12. Routine erasure and blocking of personal data
The data controller shall process and store the personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is granted by the European legislator or other legislators in laws or regulations to which the controller is subject to.
If the storage purpose is not applicable, or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data are routinely blocked or erased in accordance with legal requirements.
13. Rights of the data subject
• a) Right of confirmation
Each data subject shall have the right granted by the European legislator to obtain from the controller the confirmation as to whether or not personal data concerning him or her are being processed. If a data subject wishes to avail himself of this right of confirmation, he or she may, at any time, contact any employee of the controller.
• b) Right of access
Each data subject shall have the right granted by the European legislator to obtain from the controller free information about his or her personal data stored at any time and a copy of this information. Furthermore, the European directives and regulations grant the data subject access to the following information:
o the purposes of the processing; o the categories of personal data concerned; o the recipients or categories of recipients to whom the personal data have been or will be
disclosed, in particular recipients in third countries or international organizations; o where possible, the envisaged period for which the personal data will be stored, or, if not
possible, the criteria used to determine that period; o the existence of the right to request from the controller rectification or erasure of personal
data, or restriction of processing of personal data concerning the data subject, or to object to such processing;
o the existence of the right to lodge a complaint with a supervisory authority;

o where the personal data are not collected from the data subject, any available information as to their source;
o the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the data subject.
Furthermore, the data subject shall have a right to obtain information as to whether personal data are transferred to a third country or to an international organization. Where this is the case, the data subject shall have the right to be informed of the appropriate safeguards relating to the transfer.

• c) Right to rectification
Each data subject shall have the right granted by the European legislator to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.
If a data subject wishes to exercise this right to rectification, he or she may, at any time, contact any employee of the controller.
• d) Right to erasure (Right to be forgotten)
Each data subject shall have the right granted by the European legislator to obtain from the controller the erasure of personal data concerning him or her without undue delay, and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies, as long as the processing is not necessary:
o The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
o The data subject withdraws consent to which the processing is based according to point (a) of Article 6(1) of the GDPR, or point (a) of Article 9(2) of the GDPR, and where there is no other legal ground for the processing.
o The data subject objects to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) of the GDPR.
o The personal data have been unlawfully processed. o The personal data must be erased for compliance with a legal obligation in Union or Member
State law to which the controller is subject. o The personal data have been collected in relation to the offer of information society services
referred to in Article 8(1) of the GDPR.

If one of the aforementioned reasons applies, and a data subject wishes to request the erasure of personal data stored by the AngelEye srl, he or she may, at any time, contact any employee of the controller. An employee of AngelEye srl shall promptly ensure that the erasure request is complied with immediately.
Where the controller has made personal data public and is obliged pursuant to Article 17(1) to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other controllers processing the personal data that the data subject has requested erasure by such controllers of any links to, or copy or replication of, those personal data, as far as processing is not required. An employees of the AngelEye srl will arrange the necessary measures in individual cases.
• e) Right of restriction of processing
Each data subject shall have the right granted by the European legislator to obtain from the controller restriction of processing where one of the following applies:
o The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
o The processing is unlawful and the data subject opposes the erasure of the personal data and requests instead the restriction of their use instead.
o The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defense of legal claims.
o The data subject has objected to processing pursuant to Article 21(1) of the GDPR pending the verification whether the legitimate grounds of the controller override those of the data subject.
If one of the aforementioned conditions is met, and a data subject wishes to request the restriction of the processing of personal data stored by the AngelEye srl, he or she may at any time contact any employee of the controller. The employee of the AngelEye srl will arrange the restriction of the processing.
• f) Right to data portability
Each data subject shall have the right granted by the European legislator, to receive the personal data concerning him or her, which was provided to a controller, in a structured, commonly used and machine-readable format. He or she shall have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, as long as the processing is based on consent pursuant to point (a) of Article 6(1) of the GDPR or point (a) of Article 9(2) of the GDPR, or on a contract pursuant to point (b) of Article 6(1) of the GDPR, and the processing is carried out by automated means, as long as the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Furthermore, in exercising his or her right to data portability pursuant to Article 20(1) of the GDPR, the data subject shall have the right to have personal data transmitted directly from one controller to

another, where technically feasible and when doing so does not adversely affect the rights and freedoms of others.
In order to assert the right to data portability, the data subject may at any time contact any employee of the AngelEye srl.
• g) Right to object
Each data subject shall have the right granted by the European legislator to object, on grounds relating to his or her particular situation, at any time, to processing of personal data concerning him or her, which is based on point (e) or (f) of Article 6(1) of the GDPR. This also applies to profiling based on these provisions.
The AngelEye srl shall no longer process the personal data in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defense of legal claims.
If the AngelEye srl processes personal data for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing. This applies to profiling to the extent that it is related to such direct marketing. If the data subject objects to the AngelEye srl to the processing for direct marketing purposes, the AngelEye srl will no longer process the personal data for these purposes.
In addition, the data subject has the right, on grounds relating to his or her particular situation, to object to processing of personal data concerning him or her by the AngelEye srl for scientific or historical research purposes, or for statistical purposes pursuant to Article 89(1) of the GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public interest.
In order to exercise the right to object, the data subject may contact any employee of the AngelEye srl. In addition, the data subject is free in the context of the use of information society services, and notwithstanding Directive 2002/58/EC, to use his or her right to object by automated means using technical specifications.
• h) Automated individual decision-making, including profiling
Each data subject shall have the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her, or similarly significantly affects him or her, as long as the decision (1) is not is necessary for entering into, or the performance of, a contract between the data subject and a data controller, or (2) is not authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, or (3) is not based on the data subject's explicit consent.
If the decision (1) is necessary for entering into, or the performance of, a contract between the data subject and a data controller, or (2) it is based on the data subject's explicit consent, the AngelEye srl shall implement suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and contest the decision.

• i) Right to withdraw data protection consent
Each data subject shall have the right granted by the European legislator to withdraw his or her consent to processing of his or her personal data at any time.
If the data subject wishes to exercise the right to withdraw the consent, he or she may, at any time, contact any employee of the AngelEye srl.
14. Data protection for applications and the application procedures
The data controller shall collect and process the personal data of applicants for the purpose of the processing of the application procedure. The processing may also be carried out electronically. This is the case, in particular, if an applicant submits corresponding application documents by e-mail or by means of a web form on the website to the controller. If the data controller concludes an employment contract with an applicant, the submitted data will be stored for the purpose of processing the employment relationship in compliance with legal requirements. If no employment contract is concluded with the applicant by the controller, the application documents shall be automatically erased two months after notification of the refusal decision, provided that no other legitimate interests of the controller are opposed to the erasure. Other legitimate interest in this relation is, e.g. a burden of proof in a procedure under the General Equal Treatment Act (AGG).
15. Data protection provisions about the application and use of Adobe Analytics (Omniture) / Adobe marketing cloud
On this website, the controller has integrated components of the enterprise Adobe. Adobe Analytics (Omniture) and Adobe Marketing Cloud (hereinafter referred to as "Omniture") is an instrument that allows for more efficient online marketing and web analysis. Omniture is part of Adobe Marketing Cloud. Adobe Marketing Cloud enables real-time analysis of visitor flows on Internet sites. The real-time analysis includes project reports and allows an ad-hoc analysis of site visitors. Customer interactions are presented in such a way as to give the controller a better overview of users' online activities of this website by displaying the data in simple and interactive dashboards and converting them into reports. This enables the controller to obtain information in real-time and to identify problems that occur more quickly.
The operating company for these services is Adobe Systems Software Ireland Limited, 4-6 Riverwalk, Citywest Business Campus, Dublin 24, Republic of Ireland.
Omniture sets a cookie on the information technology system of the data subject (cookies have already been explained in advance, which may be read above). The controller ensures that the tracking data transferred to the Adobe data center is anonymized prior to geolocation. The anonymization is implemented by replacing the last part of the IP address. The controller has made server-sided settings, which are used to anonymize the IP address of the data subject prior to processing for geolocation and range measurement. Adobe will use the data and information obtained via our website to analyze the user behavior of the data subject on behalf of the controller. Adobe will also use the data to create reports on user activity on our behalf, as well as provide other services to our enterprise related to the use of our website. The IP address of the data subject is not merged with other personal data by Adobe.

As stated above, the data subject may, at any time, prevent the setting of cookies through our website by means of a corresponding setting of the Internet browser used, and thus permanently deny the setting of cookies. Such a setting of the Internet browser used would also prevent Omniture from setting a cookie on the information technology system of the data subject. Cookies may also be deleted by Omniture at any time via an Internet browser or other software programs.
The data subject also has the possibility of objecting to and preventing the collection of data generated by the Adobe cookie on the use of this website and the processing of this data by Adobe. For this purpose, the data subject must click on the opt-out button under the link http://www.adobe.com/de/privacy/opt-out.html, which sets an opt-out cookie. 31. The legitimate interests pursued by the controller or by a third party
Where the processing of personal data is based on Article 6(1) lit. of GDPR our legitimate interest is to carry out our business in favor of the well-being of all our employees and the shareholders.
32. Period for which the personal data will be stored
The criteria used to determine the period of storage of personal data is the respective statutory retention period. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of the contract or the initiation of a contract.

AngelEye underwater cameras are placed to acquire underwater pictures of swimming pools. The pictures are real time analyzed by the AngelEye drowning recognition software, to identify dangerous situations with the aim to prevent drownings.
2. Customer Information
Each customer must inform the end users (patrons) about the video surveillance platform and about the aim of the system.

3. Retain
The video and pictures are stored locally on the server and remotely on the AngelEye Cloud, just for the time needed for the analytics, no more than 15 seconds. After this time the video and pictures are automatically erased. The only pictures stored for more than 15 seconds for a maximum time of 72 hours, are the ones needed to generate statistics. In case of customer request, the pictures can be stored for 72 hours as backup of the local storage. After 72 hours the pictures are automatically erased. The pictures related to alarms can be stored for a maximum time of 30 days for being ready to be delivered to any governing bodies if requested.
4. Public Rights
Access Requests for personal data
Any person whose image is recorded on a CCTV system has a right to seek and be supplied with a copy of their own personal data from the video footage.
So, anyone who is captured by any CCTV cameras has the right to request that footage, it is seen as personal data. They must follow a procedure, but are perfectly within their rights. If any other individuals are visible in the footage, a footage redaction service will be provided (i.e. blur out the faces of other individuals).
5. Authority Request
Supply of CCTV images to the Police or other authorities.
The Police or other authorities may request footage, but always followed up by a written request on official headed paper. Police will often just want to view the footage on the premises of the Data Controller or Processor, this action would not contravene data protection laws.
6. Technical Assurance
Responsibilities of the Technical department of AngelEye.
The AngelEye employees cannot access the pictures stored in the Cloud Servers, with the exception of the Managers who are authorized and then only for purposes of system analysis to provide assistance to clients, in these circumstances events are recorded and archived. The pictures access is logged in an archive with all the information: name of the AngelEye employee, time and date of the access, reason. As clarification pictures are not copied and downloaded, with the exception of the explicit requests from the customer or other authorities . AngelEye have in place all the security procedures to inhibit the picture access to the non-authorized users from any of the servers.

1. Üldsätted
1.1 OÜ Tartu Veekeskus jälgimisseadmestiku kasutamise kord (edaspidi kord) reguleerib jälgimisseadmestiku kasutamist OÜ Tartu Veekeskusele (edaspidi Veekeskus) kuuluvas hoones ja selle õuealal (edaspidi ka territoorium).
1.2 Korra eesmärgiks on kehtestada põhimõtted, mis tagavad isikuandmete töötlemise jälgimisseadmestiku kasutamisel vastavuses isikuandmete kaitse seaduse ja muude isikuandmete töötlemist ning kaitset reguleerivate õigusaktidega ning Euroopa Parlamendi ja nõukogu määrusega (EL) 2016/679 füüsiliste isikute kaitse kohta isikuandmete töötlemisel ja selliste andmete vaba liikumise ning direktiivi 95/46/EÜ kehtetuks tunnistamise kohta (edaspidi: üldmäärus).
1.3 Käesoleva korraga kindlaks määramata küsimustes lähtutakse Veekeskuse andmekaitse tingimustest (https://www.aurakeskus.ee/isikuandmete-tootlemine/) ja käesoleva korra punktis 1.2 nimetatud õigusaktidest.
2. Mõisted
2.1 Jälgimisseadmestik on pilti või elektroonilist signaali edastavate ja salvestavate seadmete kogum, mis on ette nähtud territooriumi, isiku, eseme või protsessi jälgimiseks või territooriumi, inimese või eseme asukoha või protsessi toimumise koha kindlaks määramiseks.
2.2 Videovalvesüsteem on jälgimisseadmestik, mis koosneb kaameratest ja salvestusseadmetest, uppumise tuvastamise süsteemi puhul ka ohuteavitus anduritest ja tarkvarast.
2.3 Kaamera on jälgimisseade, mis võimaldab salvestada ja jälgida territooriumi, inimese, eseme või protsessi kujutist ning selle liikumist või muutumist ajas ning saata teavitus ohuolukorras reageerimiseks.
2.4 Kaamera salvestis (edaspidi salvestis) on andmekogum, mida kaamera töö käigus salvestab, sh isiku kujutis, liikumine, tegevus, territoorium, esemed, keskkond, ajafaktorid ja muud andmed. Salvestisi säilitatakse salvestusseadmetes.
2.5 Andmesubjekt on isik, kelle isikuandmeid jälgimisseadmestiku kasutamisel töödeldakse.
2.6 Isikuandmete töötlemine on iga isikuandmetega tehtav toiming, sealhulgas isikuandmete kogumine, salvestamine, korrastamine, säilitamine, muutmine ja avalikustamine, juurdepääsu võimaldamine isikuandmetele, päringute teostamine ja väljavõtete tegemine, isikuandmete kasutamine, edastamine, ristkasutamine, ühendamine, sulgemine, kustutamine või hävitamine, või mitu eelnimetatud toimingut, sõltumata toimingute teostamise viisist ja kasutatavatest vahenditest.
3. Isikuandmete vastutav ja volitatud töötleja
3.1 Isikuandmete vastutav töötleja jälgimisseadmestiku kasutamisel on Tartu Veekeskus.
3.2 Isikuandmete volitatud töötleja võib olla juriidiline isik, millele Veekeskus on teinud lepinguga ülesandeks jälgimisseadmestiku kasutamisest ja jälgimisseadmestiku salvestuste

töötlemisest tulenevate kohustuste täitmise, uppumise tuvastamise süsteemi kaamerate töökindluse tagamine.
3.3 Veekeskuse basseinidesse paigutatud uppumise tuvastamise süsteemi volitatud töötleja on Euroopa ettevõte AngelEye srl.
4. Jälgimisseadmete kasutamise eesmärk ja õiguslik alus
4.1 Veekeskus kasutab oma territooriumil videojälgimist turvameetmena isikute elu ja tervist ohustavate olukordade ennetamiseks, turvalisuse tagamiseks, ohuolukordadele reageerimiseks ning vara kaitseks, sh uppumise tuvastamise süsteemi spordibasseinis, kus süsteem hindab reaalajas basseinis toimuvat ning saadab võimalikust ohuolukorrast instruktori nutikellale vastava teate.
4.2 Veekeskus kasutab jälgimisseadmeid õigustatud huvi alusel. Isikute või vara kaitseks võib jälgimisseadmeid kasutada, kui sellega ei kahjustata ülemääraselt andmesubjekti õigusi ja huve ning kogutavaid andmeid kasutatakse üksnes nende kogumise eesmärgist lähtuvalt.
4.3 Videovalvesüsteemi kasutamiseks koostatakse õigusliku aluse ja õigustatud huvi aluseks olev analüüs kaamerate kasutamiseks.
5. Videovalvesüsteemi kasutuselevõtt
5.1 Videovalvesüsteemi seadmed valitakse ja seadistatakse minimaalsuse põhimõttest lähtuvalt.
5.2 Kaamera asetuse ja paigutuse valikul lähtutakse järgmistest põhimõtetest:
5.2.1 kaamera paigutatakse selliselt, et selle vaatevälja ulatuksid ainult sellised objektid, mille valve ja kaitse on oluline ja vajalik, jättes välja alad, mille jälgimine ei ole eesmärgipärane ning võib kahjustada isikute privaatsust;
5.2.2 kaameraid ei paigaldata privaatselt kasutatavatesse ruumidesse;
6. Videovalvesüsteemi kirjeldus ja kasutamine
6.1 Veekeskuse videovalvesüsteemis kasutatakse ilma helisalvestuseta videokaameraid.
6.2 Lisaks territooriumi üldvalvele kasutatakse Veekeskuse basseinides uppumise tuvastamise süsteemi kaameraid, mis saadavad ohu korral instruktori nutikellale teate ohuolukorrast.
6.3 Kaamera rikke korral antud kaamera poolt salvestamist ja isikuandmete töötlemist ei toimu ning Veekeskusel puudub vastava ajavahemiku kohta kaamerapilt.
6.4 Läbipääsusüsteemi rikke korral võidakse videokaamera helita salvestust reaalajas jälgida isikute turvalisuse tagamise eesmärgil Veekeskuse väliterrassil olevate isikute pääsemiseks siseruumidesse.
6.5 Videovalvesüsteem jälgib jälgimisseadmetega varustatud territooriumi ööpäevaringselt. Salvestisi hoitakse piiratud ligipääsuga seadmetes, mis asuvad piiratud ligipääsuga ruumis.
7. Juurdepääs videovalvesüsteemi andmetele
7.1 Videovalvesüsteemile juurdepääsu omav töötaja võib töödelda videosüsteemi andmeid üksnes oma tööülesannete täitmiseks punktis 4.1 ning 4.2 toodud eesmärgil. Töötajal on keelatud jagada või võimaldada vaadata kolmandatel isikutel (sh Veekeskuse teistel

töötajatel) õigusliku aluseta videovalvesüsteemi vahendusel saadud salvestisi või reaalajas pilti.
7.2 Veekeskuse kaamerate salvestistele on õigus ligi pääseda Veekeskuse teenindusjuhil, tehnikajuhil, ujulajuhil ja juhatajal.
7.3 Veekeskuse videovalve salvestist võidakse välja anda õigusliku aluse olemasolul õigus- ja korrakaitseorganisatsioonidele nende taotluse alusel.
8. Videovalvesüsteemi salvestiste säilitamise tähtaeg
8.1 Videosalvestiste töötlemise logisid säilitatakse kuni 30 kalendripäeva. Salvestusi võidakse säilitada juhtumi korral selle lõpliku lahenemiseni või kuni nõudeõiguse kehtivuseni.
8.2 Pärast säilitamise tähtaja möödumist salvestised kustutatakse kas andmete kustutamise funktsiooni või andmete üle salvestamisega, sõltuvalt salvesti tehnilistest võimalustest.
9. Videovalvesüsteemi kasutamisest teavitamine
9.1 Videovalvesüsteemi kasutamisest Veekeskuse territooriumil teavitatakse jälgitava ala ette või algusesse nähtavale kohale paigaldatud märgistel, millel on videokaamera kujutis, videovalvesüsteemi andmete vastutava töötleja kontaktandmed ning kodulehe aadress täpsema info jaoks.
10. Jälgimisseadmete andmete edastamine
10.1 Veekeskus ei edasta õigusliku aluseta kaamerasalvestisi (edaspidi jälgimisseadmete andmed) kolmandatele isikutele.
10.2 Jälgimisseadmete andmete väljastamise taotlus peab vastama käesoleva korra punktis 11.1 nimetatud nõuetele. Andmete väljastamisele kohaldatakse käesoleva korra punktides 11.2- 11.7 sätestatut.
10.3 Salvestis edastatakse seadusest tulenevate kohustuste täitmiseks riigiorganile viimase nõudmisel kirjaliku pädeva isiku põhjendatud taotluse alusel, kui riigiorganil on salvestise väljanõude õigus vastavalt seadusele.
10.4 Kui andmete saaja pole loonud andmete edastamiseks turvalist kanalit, edastatakse salvestised krüpteeritult.
10.5 Kõigile väljastatavatele salvestistele ja nende kohta esitatud andmefailidele tehakse edastamisel juurde märge juurdepääsupiirangu kohta.
10.6 Salvestise või selle kohta esitatud andmefaili väljastamine fikseeritakse, lisamata väljastatud salvestist või andmeid selle kohta.
11. Jälgimisseadmete andmete väljastamine andmesubjektile
11.1.Veekeskus väljastab salvestiste andmed andmesubjektile tema enda kohta ainult viimase põhjendatud kirjaliku taotluse alusel, milles on märgitud:
11.1.1 taotleja nimi, isikukood/registrikood ja kontaktandmed;
11.1.2 videovalve salvestusest väljavõtte taotlemise põhjus ja eesmärk;
11.1.3 millisel viisil soovitakse salvestust saada (elektrooniliselt või andmekandjal);

11.1.4 kirjeldus sündmusest, mille kohta soovitakse väljavõtet;
11.1.5 kirjeldatud sündmuse võimalikult täpne aeg ja koht.
11.2 Veekeskusel on õigus jätta andmesubjekti taotlus rahuldamata ja salvestis väljastamata, kui salvestist või andmeid ei ole võimalik väljastada nii, et see ei kahjustataks teiste isikute õigusi ja huve. Nimetatud juhul on andmesubjektil õigus pöörduda salvestise väljanõudmiseks kohtu poole.
11.3 Andmesubjekti esitatud taotlus peab olema allkirjastatud.
12. Andmekaitsealaste rikkumiste menetlemine ja teavitamine
12.1 Jälgimisseadmete kasutamisest tulenevaid andmekaitse rikkumisi menetletakse vastavalt Veekeskuse andmekaitsetingimustele.
12.2 Vara ja isikut ohustavaks teguriks on ka isiku loata liikumine läbipääsupiiranguga ja mitteavalikul alal.
12.3 Juhul, kui salvestis on vajalik väärteo- või kriminaalmenetluses, siis antakse see üle väärteo- või kriminaalasja menetlejale.
12.4 Veekeskus väljastab seaduse rikkumist menetleva või selleks volituse alusel andmeid koguvale isikule salvestise põhjendatud taotluse alusel.

Üldpõhimõtted käsitlevad kliendi isikuandmete kogumist, töötlemist ja kasutamist OÜ Tartu Veekeskus (edaspidi Veekeskus) poolt teenuste osutamisel klientidele.
Isikuandmeid kogutakse:
- ID-kaardil toimivate kuu- ja 10 X kaardi, püsikliendiprogrammi, juriidilise isiku magnetkaardi, kuld- ja hõbekaardi ning sportlaste kuukaardi omanikelt.
- Sauna Yogasse, laste ujumise algõpetusse ja täiskasvanute ujumisõppesse registreerumisel (täiskasvanu/lapse ees- ja perekonnanimi, telefon, e-posti aadress).
- sünnipäeva, gruppide ja muude broneeringute korral (ees- ja perekonnanimi, lapse nimi, lapse vanus, lapsevanema telefon, e-posti aadress).
Isikuandmete kogumise eesmärgid sõltuvad kliendi poolt kasutatavast teenusest ja võivad teenuste lõikes erineda.
Eesmärkideks on koos või eraldi peamiselt kliendile tema nõusolekul soovitud teenuse osutamine, soodustuse andmine, isiku tuvastamine, kliendi turvalisuse tagamine, teenust puudutava olulise informatsiooni edastamine, turunduslike tegevuste teostamine (nt personaalsete pakkumuste tegemine, lisateenuste pakkumine jmt), samuti meie tegevust reguleerivate seadustega meile pandud kohustuste täitmine.
Andmeid kasutatakse ka teenuste analüüsimiseks ja täiustamiseks, uute teenuste loomiseks ning teenuste osutamiseks vajalike protsesside täiustamiseks. Samuti kasutatakse andmeid aruandluse ja statistika eesmärgil. Eeltoodu põhineb Veekeskuse õigustatud huvil täiustada ja/või arendada uusi teenuseid ning tõhustada teenuse osutamiseks vajalikke (tehnilisi) süsteeme.
Isikuandmete kogumine ja töötlemine
Kliendi isikuandmete vastutav töötleja on OÜ Tartu Veekeskus, registrikood 10738741, aadress Turu 10, Tartu, Tartu linn, 51014.
Kogutavate isikuandmete ulatus sõltub konkreetset teenusest. Täpsema info kogutavate isikuandmete kohta leiab Veekeskuse kodulehelt vastavate teenuste kirjelduste juurest või sõlmitud lepingutest (teenuste osutamisel juriidilistele isikutele).
Klientide kohta, kes tasuvad teenuste eest ülekandega, kogume makseandmeid treeningutel osalemiseks tehtud maksete töötlemisel raamatupidamiskohustuste täitmiseks. Makseandmeid säilitame vastavalt raamatupidamise seadusele seitse aastat.
Kogutavad isikuandmed on klientide poolt vabatahtlikult Veekeskusele edastatud. Üldjuhul saame andmed otse klientidelt, kes teevad broneeringu või päringu meie veebilehe kaudu, telefoni teel, e-maili teel või ostetakse teenuseid otse, meie juurde kohale tulles. Meile edastavad kliendi andmeid ka lepingujärgsed koostööpartnerid/äriühingud.
Kogutud isikuandmeid võidakse kasutada turunduslikel eesmärkidel ainult Veekeskuse poolt.
Kliendi õigused
Kliendil on õigus saada informatsiooni, milliseid isikuandmeid Veekeskus tema kohta on kogunud ja kuidas neid töödelnud. Klient võib nõuda enda ja/või lapse/eestkostetava isikuandmete muutmist (parandamist, täiendamist), kustutamist ja töötlemise piiramist.
Klient võib võtta oma nõusoleku isikuandmete töötlemiseks tagasi.
Uudiskirja saav klient, kes seda enam ei soovi, saab igal ajal taotleda enda uudiskirja saajate nimekirjast eemaldamist, kirjutades e-posti aadressil info@aurakeskus.ee või klikkides uudiskirja all oleval uudiskirja eemaldamise teate lingil.
Juhul, kui klient leiab, et tema isikuandmete töötlemine Veekeskuse poolt ei ole kooskõlas kehtivate õigusaktidega on kliendil õigus esitada kaebus Andmekaitse Inspektsioonile või pöörduda kohtu poole.
Isikuandmete kaitse ja säilitamine
Ligipääs kliendi andmetele võib olla, lisaks Veekeskusele, selleks volitatud isikutel, kes osutavad Veekeskusele teenuseid (nt tarkvara arendus-ja hooldusteenuse pakkujad, serveri ja kodulehe teenuse pakkujad, uppumise tuvastamise süsteemi haldusteenuse pakkuja). Volitatud isikutega on sõlmitud lepingud ning nad on kohustatud neile teatavaks saanud isikuandmeid hoidma konfidentsiaalsena.
Ligipääs kliendi andmetele on vajadusel seadusandlusest tulenevatel alustel ka õigus- ja korrakaitseorganisatsioonidel (nt Politsei- ja Piirivalveamet).
Veekeskus säilitab andmeid kuni see on vajalik teenuse osutamiseks, Veekeskuse õiguste kaitsmiseks ja kuni on õigusaktides nõutud.
Isikuandmed videojälgimissüsteemi kasutamisel
Veekeskusesse on isikuid ohustavate olukordade ja ohuolukorrale (nt uppumise tuvastamise süsteem) reageerimiseks, isikute elu kaitseks, vara säilimiseks või vara kahjustamisel kahju tekitaja väljaselgitamiseks paigaldatud õigustatud huvi alusel videojälgimissüsteemid.
Tegemist on Veekeskuse siseruumidesse ja väliterritooriumile ja spordibasseini paigaldatud kaameratega, mis salvestavad ning võimaldavad salvestisi hiljem töödelda ja taasesitada. Videovalvesüsteemiga ei salvestata heli ega jälgita konkreetset inimest, vaid ainult kindlat ala (nt ruumi, koridori) ja seal toimuvat. Veekeskuse videojälgimissüsteemi kasutamisest teavitavad kaamera kujutisega sildid välis- ja siseruumide ustel.
Kaamerate abil saadud andmete töötlemisel kasutab Veekeskus selliseid turvameetmeid, mis kaitsevad kogutud andmeid tahtmatu või ilma loata jälgimise, kopeerimise, muutmise, teisaldamise ja kustutamise eest. Kaamerate salvestistele on õigus ligi pääseda Veekeskuse juhataja määratud isikutel ametikoha põhiselt. Olemasolevaid salvestisi võib Veekeskus edastada
väljapoole Veekeskust või võimaldada neile juurdepääsu ainult juhul, kui selleks on seadusest tulenev alus (nt politseile).
Videojälgmissüsteemi salvestisi säilitatakse maksimaalselt üks kuu või kuni on vajalik probleemi lõpliku lahenduse saavutamiseks. Pärast tähtaja möödumist salvestised kustutatakse kas andmete kustutamise funktsiooni või andmete üle salvestamisega, sõltuvalt kaamera tehnilistest võimalustest.

Isikuandmete töötlemise üldpõhimõtete muutmine

Sissejuhatus
OÜ Tartu Veekeskuse (edaspidi nimetatud Veekeskus) territooriumil viibivate isikute tervise, elu ja vara kaitseks kasutatakse ööpäevaringselt töötavat jälgimisseadmestikku. Veekeskuse kliente ohustavate olukordade ja ohuolukorrale (sh uppumise tuvastamise süsteem) reageerimine samuti töötajate turvalisuse tagamine ning vara kaitsmine teenib igakülgselt Veekeskuse huve.
Kaamerate kasutamise õiguslikuks aluseks on IKÜM art 6 lg 1 p f – õigustatud huvi.
Veekeskuses kasutatakse videojälgimist turvameetmena isikute turvalisust ohustavate
olukordade ennetamiseks, turvalisuse tagamiseks, ohuolukordadele reageerimiseks ning vara kaitseks. Veekeskuses on kasutusel tavakaamerad ja uppumise tuvastamise süsteem, mis asub spordibasseinis veel all.
Videojälgimise seadmete abil jälgitakse Veekeskuse õueala, sissepääsualasid, koridore, basseinide territooriume ning saunade üldala (sh väliterrass).
Veekeskuse jaoks on oluline isikuandmete nõuetekohane töötlemine ning isikute põhiõiguste kaitse. Seetõttu on Veekeskus hinnanud videojälgimissüsteemi kasutamisel õigustatud huvi olemasolu. Õigustatud huvi dokumenteerimiseks on Veekeskus läbinud kolmeastmelise testi – huvikontroll ehk eesmärgi test, vajalikkuse test ning tasakaalutest. Testi tulemusena on jõutud järeldusele, et videojälgimissüsteemi Veekeskuses kasutamine õigustatud huvi alusel on seaduslik.
Taust
Videojälgimissüsteem on liikumist piiravate jälgimisseadmete kogum, mis võimaldab salvestada ja jälgida ruumides ja õuealal toimuvat ja ennetada eluohtlikku olukorda uppumise tuvastamise süsteemi kasutamise abil. Videovalvesüsteem koosneb Veekeskuse õuealale, siseruumidesse ja spordibasseini seatud kaameratest. Videojälgimissüsteemi kohta on Veekeskusel kehtestatud kaamerate kasutamise kord. Spordibasseini ohutustingimuste parendamiseks võetakse Veekeskuses kasutusele uppumise tuvastamise süsteem, mis suhtleb instruktoritega andes neile teada ohtlikust või kriitilisi olukorrast basseinis. Uppumise tuvastamise süsteemi tarkvara hindab kaamerate ja andurite abil reaalajas basseinis toimuvat
ning saadab võimalikust ohuolukorrast instruktori nutikellale vastava teate. Instruktor näeb oma nutikellal täpset ohu asukohta spordibasseinis, mis võimaldab ohuolukorrale väga kiiresti reageerida.
Veekeskus kasutab volitatud töötlejat AngelEye srl, kes tagab uppumise tuvastamise süsteemi töö vastavuse andmekaitse põhimõtetele. AngelEye uppumise tuvastamise süsteem koosneb
optilistest ja pildituvastussüsteemidest, mis skaneerivad kogu basseini reaalajas. Tarkvaraüksus suudab tuvastada tavapäratuid liikumisi ja tüüpilisi uppumisolukordi, sealhulgas aeglane inimese liikumine põhja poole, mis on üks uppumise tunnus.
1. Huvikontroll ehk eesmärgi test:
1.1. Tartu Veekeskus kui vastutava andmetöötleja õigustatud huvi
1) Veekeskuse territooriumil viibivate isikute turvalisust ohustavate olukordade
ennetamine, turvalisuse tagamine, ohuolukordadele operatiivne reageerimine ning vara igakülgne kaitse.
2) Veekeskusel on, tulenevalt määruse „Tervisekaitsenõuded ujulatele, basseinidele ja veekeskustele“ § 5 lg 1’st, kohustus osutada vajadusel abi. Üheks meetmeks kohustuse
täitmisel on ööpäevaringselt videojälgimissüsteemi kasutamine.
1. 2.Videovalvega kaasnev isikuandmete töötlemise eesmärk
1) Videovalve kasutamise eesmärk on tagada Veekeskuse territooriumil viibivate isikute ohutus ning vara valve ja kaitse.
2) Samuti Veekeskuses viibivate isikute turvalisust ohustava olukorra ennetamine ning operatiivne olukorrale reageerimine.
1.3.Mida loodetakse videovalvega kaasneva andmetöötlemise tulemusena saavutada?
1) Veekeskuse territooriumil viibivate isikute maksimaalne turvalisus ja efektiivne kaitse

Miks tahetakse isikuandmeid töödelda?

Töödeldavateks isikuandmeteks on isiku kujutis. Salvestusi säilitatakse kuni 30
kalendripäeva. Toimingute logi sisaldab ka mitteisikulisi häireteateid. Kõiki salvestusi võidakse
säilitada juhtumi korral selle lõpliku lahenemiseni või kuni nõudeõiguse kehtivuseni. Volitatud töötleja säilitab
salvestused AngelEye Cloudis kuni 72 tundi. Tähtaja möödudes salvestused kustuvad automaatselt.
Mida loodetakse andmetöötlemise tulemusena saavutada?
1) isiku ohutuse tagamine 2) füüsilise vara kaitse 3) ebaseadusliku tegevuse ennetamine ja avastamine, tuvastamine
Üheks tõsiseks ohuks on tervislikel või oskamatusest tulenevalt põhjustel vees hätta sattumine ja sellega kaasnev uppumisoht. Videojälgimissüsteemi kasutamine võimaldab jälgida Veekeskuse territooriumil nagu õueala (sh väliterrass), siseruumid ning basseinides toimuvat
ning vajadusel tuvastada juhtumi asjaolusid. Veekeskuse territooriumile paigaldatud kaameratega ei
toimu reaalajas jälgimist. Üldaladele paigutatud kaamerapilti kasutatakse ainult tagantjärele juhtumi tuvastamiseks. Uppumise tuvastamise süsteem saadab reaalajas instruktori nutikellale teate võimalikust ohuolukorrast. Erandina toimub reaalajas kaamerapildi jälgimine ainult siis, kui läbipääsusüsteemid ei tööta ning inimeste turvalisuse tagamiseks jälgitakse väliterrassil olevate isikute pääsemist siseruumidesse.
Siseruumides olevad kaaremad aitavad tagada isikute ohutuse ning vara kaitse ning salvestused
võimaldavad tuvastada juhtumi täpsemad asjaolud.
Kes saab isikuandmete töötlemisest kasu?
1) Veekeskus 2) andmesubjekt
Isikute liikumist Veekeskuse aladel ei jälgita reaalajas, salvestusi vaadatakse ainult toimunud juhtumi täpsustamiseks, mis võib olla nii Veekeskuse kui ka teenust saava isiku kaitseks. Uppumisvastase süsteemi kaamerapildiga tagatakse isikute võimaliku ohuolukorra ennetamine.
Kas huvi on seaduslik ning kas töötlus vastaks erireeglitele?
Huvi seaduslikkust hindab käesolev kaalutlusotsus. Andmetöötlus ei vasta erireeglitele.
Veekeskuses on koostatud ja avaldatud andmekaitsetingimused. Uppumise tuvastamise süsteemi volitatud töötleja on Euroopas asuv ettevõte AngelEye srl, kelle isikuandmete töötlemine on kooskõlas isikuandmete kaitse üldmäärusega.
2. Vajalikkuse test
2.1.Kas videovalvega kaasnev andmetöötlus vastab erireeglitele?
1) Ei vasta. Videovalve toimub üksnes videopildi salvestusena ilma helisalvestuseta.
2.2.Võimalikud ohud varale või isikutele VEEKESKUSE territooriumil
1) Veekeskus peab tagama klientidele ohutu keskkonna ning töötajatele vahendid ja võimalused turvalisuse tagamiseks. Turvalisuse tagamine teenib Veekeskuse ja klientide huve. Võimalike, isikute turvalisust ohustavate ohtudena, nähakse eelkõige, kuid mitte ainult:
a) ohud kliendile – basseinis terviserikke kiire tuvastamine (isiku vajumine basseini põhja), uppumisohu ennetamine (häiresüsteem annab instruktori nutikellale teate), hilisem videosalvestuse kasutamine juhtunu asjaolude täpsesmaks tuvastamiseks;
b) ohud varale - vargus, murdvargus, kelmus ja avaliku korra rikkumine, vara mistahes muul viisil kahjustumine (tulekahju jmt);
c) ohud töötajatele ja külalistele – vargus, kelmus, isiku vastane rünne, terrorism, tulekahju jms ohud.
2.3.Varale ja isikutele kirjeldatud ohtude tõsidus ja realiseerumise tõenäosus
1) Kirjeldatud ohtude näol on tegemist võimaliku realiseerumise tõenäosusega ohtudega territooriumil. Need on võimalikud ohud, millega Veekeskusel tuleb just isikute ohutuse, turvalisuse ja vara kaitse vaates arvestada ning vajalikke meetmeid kasutades tegutseda.
2) Uppumise tuvastamise süsteemi kaamerad hindavad territooriumil ohtu reaalajas ning annavad signaali instruktoritele, kes saavad vastavalt vajadusele operatiivselt reageerida ja tegutseda. Reaalajas kaameratega mehitatud videopildi jälgimist ei toimu, kaameras asuv andur annab ohust teada Veekeskuse töötajale käekellal oleva teavitussüsteemi kaudu.
3) Veekeskuse jaoks on oluline kaitsta ettevõtte, kui ka selles viibivate isikute turvalisust, ja vara, mille hävimine toob kaasa majanduslikku kahju.

Kas ja kuidas andmetöötlus aitab saavutada seatud eesmärki?
Uppumise tuvastamise süsteem võimaldab kiiresti reageerida tõsiseimale ohule – uppumisohule spordibasseinis. Töötaja raskus igal
hetkel igasse basseiniosasse ja-põhja näha võib potentsiaalselt viia vajaliku abi hilinemiseni, mille tulemused võivad olla väga tõsised. Valvesüsteemi kasutamine on vajalik Veekeskuse töötajate töö toetamiseks teenust kasutavate klientide turvalisuse tagamisel ning vara säilitamiseks ja õigusrikkumisel selle toimepanija tuvastamiseks ja/või asjaolude selgitamiseks.
Uppumise tuvastamise süsteem jälgib reaalajas spordibasseinis toimuvat ja annab töötajale ohust
kiiresti teada. Reaalajas mehitatud kaamerapildi kaudu isikute jälgimist ei toimu. Salvestuste säilitamise eesmärgiks on õnnetusjuhtumite või õigusrikkumiste toimepanijate tuvastamine, juhtumi asjaolude tuvastamine.
Kas eesmärki saab teisiti saavutada?
Vara ja isikute turvalisuse ning õigusrikkumiste toimepanijate tuvastamise eesmärke ei ole võimalik saavutada ilma, et oht oluliselt kasvaks. Veekeskuses on lisaks kaameratele suures osas reaalajas mehitatud valve – instruktorid jälgivad reaalajas Veekeskuse aladel isikute tegevust korra hoidmise ja ohuolukordade märkamise ja neile reageerimise ja ka ennetamise eesmärgil.
Mehitatud valve basseinides eeldaks instruktorite pidevat viibimist vee all. Basseinide ääres on vee all toimuvat keeruline jälgida (peegeldused, vee virvendus, teised ujujad, erinev valgus, erinevad varjatud nurgad jms). Uppumise tuvastamise süsteem tagab pideva basseinides toimuva jälgimise, mis omakorda aitab ennetada ohuolukordasid. Samuti ei ole võimalik õnnetusjuhtumi korral täpselt välja selgitada juhtunut, kui pole võimalust salvestust vaadata. Isikute ütlused võivad erineda tegelikust olukorrast. Videovalvesüsteem aitab tagada isikute ja vara kaitset ennekõike Veekeskuse üldaladel ja basseinides. Samuti on sellest abi õigusrikkujate tuvastamisel. Videovalvesüsteem ei saa asendada
ainult mehitatud valvega ka seepärast, sest õiguste tuvastamisel tuleks sellisel juhul lähtuda ainult töötaja ja andmesubjekti subjektiivsetest
ütlustest.
Kas andmetöötlus on proportsionaalne loodetava eesmärgiga?
Jah. Soovitud eesmärke ei ole võimalik vähem riivavaid meetmeid kasutades saavutada. Andmeid kogutakse minimaalsuse põhimõtet järgides, pidades silmas, et andmesubjekti õiguste riive oleks võimalikult väike. Ka andmesubjekt ise saab videojälgimissüsteemi kasutamisest kasu, kuivõrd see kaitseb ka teda ennast võimaldades saada kiiret abi ohuolukorras ning kaitseb vara
õigusrikkumiste korral aitab tuvastada õigusrikkumiste toimepanija.
3. Tasakaalutest
3.1.Alternatiivsed meetmed eelkirjeldatud ohtude tõrjumiseks
1) Andmesubjektide kaitse kohustus on sätestatud määruses ning seetõttu võtab Veekeskus kasutuse järelevalve meetmed jälgides ettevõtte territooriumil ja basseinides toimuvat tegevust.
2) Andmesubjekti elu kaitseks kasutusele võetav uppumise tuvastamise süsteem aitab ennetada ohtu inimese elule ja on oluliseks vahendiks Veekeskuse töötajatele kiireks reageerimiseks.
3) Vara kahjustamise ärahoidmise, turvalisust ohustavate olukordade ennetamiseks ning operatiivseks olukorrale reageerimiseks ei ole tõhusamaid viise.
4) Veekeskuses on tagatud ka mehitatud valve, kus basseinide ääres olevad instruktorid jälgivad toimuvat, kuid ka neil ei ole igal võimalikul hetkel ja igas võimalikus kohas jälgimist tagada. Instruktori paigutamine basseini (vette) eeldaks ka nende reaalajas jälgimist, mistõttu ei ole põhjendatud videokaamerate asendamine ainult mehitatud valvega.
5) Uppumise tuvastamise süsteemi kasutamine võimaldab sekkuda kohe, kui on oht inimese elule.
6) Videojälgimissüsteem ja mehitatud valve kombinatsioon tagavad kõige efektiivsema ja kulutõhusama kaitse isikutele turvameetmena, kuivõrd üksnes mehitatud valve kasutamine oleks kulukas ning oma olemuse tõttu (inimlik faktor) ei võimaldaks jälgida mitmeid alasid ja territooriume samaaegselt nagu seda võimaldavad videovalve kaamerate kasutamine.
3.2. Alternatiivseid meetmed, nende kasutamine ja nende kasutamisest tekkiv tulemus
1) Alternatiivse meetmena oleks võimalik minna üle mehitatud valvele. Osaliselt seda ka Veekeskus kasutab.
2) Mehitatud valve ei anna võrreldavat tulemust. Videovalve kaamerate kasutamisega on hõlmatud korraga suurem ala. Videovalve võimaldab jälgida konkreetseid ohualasid reaalajas ning sekkuda kohe kui on näha, et oht võib realiseeruda.
3) Veekeskusel puudub võimalus tagada reaalajas mehitatud valve veel all.
4) Veekeskuses on kasutusel valvesüsteem, mis on seadistatud minimaalsuse põhimõttest lähtuvalt ja ilma helisalvestuseta.
3.3. Milliseid turvameetmeid rakendatakse?
1) Veekeskuses on kehtestatud andmekaitsetingimused ning kaamerate kasutamise kord,
mis kirjeldavad videojälgimise tingimusi.
2) Videojälgimissüsteemi kasutamisest Veekeskuse territooriumil ja ruumides teavitavad vastavasisulised sildid.
3) Veekeskuse töödeldavate isikuandmete turvalisuse tagamiseks välditakse kõrvaliste isikute ligipääsu videojälgimisseadmetele ja -süsteemile, hoidmaks ära salvestiste omavolilise jälgimise, kopeerimise, muutmise, teisaldamise ja kustutamise.
4) Videojälgimissüsteemile pääsevad ligi selleks tööülesannetest tulenevalt õigust omavad töötajad, kellel on õigus isikuandmeid töödelda vaid ulatuses, mis on vajalikud
isikuandmete töötlemise eesmärkide saavutamiseks.
5) Veekeskus edastab olemasolevaid salvestisi üksnes õigusliku aluse olemasolul ja nende nõudmisel õiguskaitseasutustele, riigi- ja kohaliku omavalitsuse asutustele ja ainult õigusrikkumise menetluses õigusrikkumist seaduse kohaselt menetleva asutuse nõudmisel ja salvestiste olemasolu korral.
3.4. VEEKESKUSE territooriumil viibivale andmesubjektile videovalvega kaasnev võimalik mõju
1) Veekeskuses viibivatele isikutele võib kaasneda teatud negatiivne mõju tulenevalt privaatsuse riivest ja teadmisest, et koridorides, basseinide territooriumil, saunade
üldalal ja spordibasseinis kasutatakse videovalvet, mis võib olla häiriv.
2) Samas võib see mõjuda ka vastupidiselt, kuivõrd Veekeskuselt oodatakse mõistlikult teatavat andmesubjekti ohutuste tagamist, turvalisuse tagamist ja abi osutamist. Seeläbi võib videovalve kasutamise fakt ja sellest teadmine mõjuda hoopis rahustavalt ja turvatunnet lisavalt.

Kas isikule võib kaasneda negatiivne mõju?
Jah. Andmesubjekt võib olla häiritud või ärritunud asjaolust, et tema asukohta on võimalik tuvastada ja tema tegevusi teenuste kasutamisel on võimalik jälgida. Isiku õigus privaatsusele on riivatud.
Milliseid turvameetmeid rakendatakse?
1) Salvestisi hoitakse piiratud ligipääsuga seadmetes lukustatud või piiratud ligipääsuga ruumis. 2) Reaalajas logi näevad üksnes vastavate õigustega töötajad.
3) Valvesüsteemi saab siseneda üksnes vastavate õigustega töötajad isikutuvastuse abil. 4) Salvestisi hoitakse kuni 30 päeva, uppumisvastase süsteemi salvestisi kuni 72 tundi ega väljastata kolmandatele isikutele, v.a seaduse alusel. Kõiki salvestusi võidakse säilitada juhtumi korral selle lõpliku lahenemiseni või kuni nõudeõiguse kehtivuseni.
4. Kas Veekeskuse õigustatud huvi videovalve kasutamiseks on seaduslik?
4.1. Jah on. Tartu Veekeskusel on kohustus osutada klientidele vajadusel esmaabi ja soov tagada ohutu keskkond klientidele ning turvaline töökeskkond töötajatele. Tulenevalt
eelkirjeldatust on Veekeskus valinud just sellise kombinatsiooni ja vahendid ning meetmed, et videojälgimissüsteemi kasutamine riivaks minimaalselt territooriumil viibivate isikute põhiõigusi ja – vabadusi, kuid tagaks seeläbi maksimaalse kaitse isikute turvalisusele ja kaitse isikute elule ning varale. Valitud meetmed turvalisuse tagamiseks on õigustatud ja vajalikud.
4.2.Videovalve kaamerate kasutamise õiguslikuks aluseks on IKÜM art 6 lg 1 p f – õigustatud huvi.

1. Üldsätted
1.1 OÜ Tartu Veekeskus jälgimisseadmestiku kasutamise kord (edaspidi kord) reguleerib jälgimisseadmestiku kasutamist OÜ Tartu Veekeskusele (edaspidi Veekeskus) kuuluvas hoones ja selle õuealal (edaspidi ka territoorium).
1.2 Korra eesmärgiks on kehtestada põhimõtted, mis tagavad isikuandmete töötlemise jälgimisseadmestiku kasutamisel vastavuses isikuandmete kaitse seaduse ja muude isikuandmete töötlemist ning kaitset reguleerivate õigusaktidega ning Euroopa Parlamendi ja nõukogu määrusega (EL) 2016/679 füüsiliste isikute kaitse kohta isikuandmete töötlemisel ja selliste andmete vaba liikumise ning direktiivi 95/46/EÜ kehtetuks tunnistamise kohta (edaspidi: üldmäärus).
1.3 Käesoleva korraga kindlaks määramata küsimustes lähtutakse Veekeskuse andmekaitse tingimustest (https://www.aurakeskus.ee/isikuandmete-tootlemine/) ja käesoleva korra punktis 1.2 nimetatud õigusaktidest.
2. Mõisted
2.1 Jälgimisseadmestik on pilti või elektroonilist signaali edastavate ja salvestavate seadmete kogum, mis on ette nähtud territooriumi, isiku, eseme või protsessi jälgimiseks või territooriumi, inimese või eseme asukoha või protsessi toimumise koha kindlaks määramiseks.
2.2 Videovalvesüsteem on jälgimisseadmestik, mis koosneb kaameratest ja salvestusseadmetest, uppumise tuvastamise süsteemi puhul ka ohuteavitus anduritest ja tarkvarast.
2.3 Kaamera on jälgimisseade, mis võimaldab salvestada ja jälgida territooriumi, inimese, eseme või protsessi kujutist ning selle liikumist või muutumist ajas ning saata teavitus ohuolukorras reageerimiseks.
2.4 Kaamera salvestis (edaspidi salvestis) on andmekogum, mida kaamera töö käigus salvestab, sh isiku kujutis, liikumine, tegevus, territoorium, esemed, keskkond, ajafaktorid ja muud andmed. Salvestisi säilitatakse salvestusseadmetes.
2.5 Andmesubjekt on isik, kelle isikuandmeid jälgimisseadmestiku kasutamisel töödeldakse.
2.6 Isikuandmete töötlemine on iga isikuandmetega tehtav toiming, sealhulgas isikuandmete kogumine, salvestamine, korrastamine, säilitamine, muutmine ja avalikustamine, juurdepääsu võimaldamine isikuandmetele, päringute teostamine ja väljavõtete tegemine, isikuandmete kasutamine, edastamine, ristkasutamine, ühendamine, sulgemine, kustutamine või hävitamine, või mitu eelnimetatud toimingut, sõltumata toimingute teostamise viisist ja kasutatavatest vahenditest.
3. Isikuandmete vastutav ja volitatud töötleja
3.1 Isikuandmete vastutav töötleja jälgimisseadmestiku kasutamisel on Tartu Veekeskus.
3.2 Isikuandmete volitatud töötleja võib olla juriidiline isik, millele Veekeskus on teinud lepinguga ülesandeks jälgimisseadmestiku kasutamisest ja jälgimisseadmestiku salvestuste

töötlemisest tulenevate kohustuste täitmise, uppumise tuvastamise süsteemi kaamerate töökindluse tagamine.
3.3 Veekeskuse basseinidesse paigutatud uppumise tuvastamise süsteemi volitatud töötleja on Euroopa ettevõte AngelEye srl.
4. Jälgimisseadmete kasutamise eesmärk ja õiguslik alus
4.1 Veekeskus kasutab oma territooriumil videojälgimist turvameetmena isikute elu ja tervist ohustavate olukordade ennetamiseks, turvalisuse tagamiseks, ohuolukordadele reageerimiseks ning vara kaitseks, sh uppumise tuvastamise süsteemi spordibasseinis, kus süsteem hindab reaalajas basseinis toimuvat ning saadab võimalikust ohuolukorrast instruktori nutikellale vastava teate.
4.2 Veekeskus kasutab jälgimisseadmeid õigustatud huvi alusel. Isikute või vara kaitseks võib jälgimisseadmeid kasutada, kui sellega ei kahjustata ülemääraselt andmesubjekti õigusi ja huve ning kogutavaid andmeid kasutatakse üksnes nende kogumise eesmärgist lähtuvalt.
4.3 Videovalvesüsteemi kasutamiseks koostatakse õigusliku aluse ja õigustatud huvi aluseks olev analüüs kaamerate kasutamiseks.
5. Videovalvesüsteemi kasutuselevõtt
5.1 Videovalvesüsteemi seadmed valitakse ja seadistatakse minimaalsuse põhimõttest lähtuvalt.
5.2 Kaamera asetuse ja paigutuse valikul lähtutakse järgmistest põhimõtetest:
5.2.1 kaamera paigutatakse selliselt, et selle vaatevälja ulatuksid ainult sellised objektid, mille valve ja kaitse on oluline ja vajalik, jättes välja alad, mille jälgimine ei ole eesmärgipärane ning võib kahjustada isikute privaatsust;
5.2.2 kaameraid ei paigaldata privaatselt kasutatavatesse ruumidesse;
6. Videovalvesüsteemi kirjeldus ja kasutamine
6.1 Veekeskuse videovalvesüsteemis kasutatakse ilma helisalvestuseta videokaameraid.
6.2 Lisaks territooriumi üldvalvele kasutatakse Veekeskuse basseinides uppumise tuvastamise süsteemi kaameraid, mis saadavad ohu korral instruktori nutikellale teate ohuolukorrast.
6.3 Kaamera rikke korral antud kaamera poolt salvestamist ja isikuandmete töötlemist ei toimu ning Veekeskusel puudub vastava ajavahemiku kohta kaamerapilt.
6.4 Läbipääsusüsteemi rikke korral võidakse videokaamera helita salvestust reaalajas jälgida isikute turvalisuse tagamise eesmärgil Veekeskuse väliterrassil olevate isikute pääsemiseks siseruumidesse.
6.5 Videovalvesüsteem jälgib jälgimisseadmetega varustatud territooriumi ööpäevaringselt. Salvestisi hoitakse piiratud ligipääsuga seadmetes, mis asuvad piiratud ligipääsuga ruumis.
7. Juurdepääs videovalvesüsteemi andmetele
7.1 Videovalvesüsteemile juurdepääsu omav töötaja võib töödelda videosüsteemi andmeid üksnes oma tööülesannete täitmiseks punktis 4.1 ning 4.2 toodud eesmärgil. Töötajal on keelatud jagada või võimaldada vaadata kolmandatel isikutel (sh Veekeskuse teistel

töötajatel) õigusliku aluseta videovalvesüsteemi vahendusel saadud salvestisi või reaalajas pilti.
7.2 Veekeskuse kaamerate salvestistele on õigus ligi pääseda Veekeskuse teenindusjuhil, tehnikajuhil, ujulajuhil ja juhatajal.
7.3 Veekeskuse videovalve salvestist võidakse välja anda õigusliku aluse olemasolul õigus- ja korrakaitseorganisatsioonidele nende taotluse alusel.
8. Videovalvesüsteemi salvestiste säilitamise tähtaeg
8.1 Videosalvestiste töötlemise logisid säilitatakse kuni 30 kalendripäeva. Salvestusi võidakse säilitada juhtumi korral selle lõpliku lahenemiseni või kuni nõudeõiguse kehtivuseni.
8.2 Pärast säilitamise tähtaja möödumist salvestised kustutatakse kas andmete kustutamise funktsiooni või andmete üle salvestamisega, sõltuvalt salvesti tehnilistest võimalustest.
9. Videovalvesüsteemi kasutamisest teavitamine
9.1 Videovalvesüsteemi kasutamisest Veekeskuse territooriumil teavitatakse jälgitava ala ette või algusesse nähtavale kohale paigaldatud märgistel, millel on videokaamera kujutis, videovalvesüsteemi andmete vastutava töötleja kontaktandmed ning kodulehe aadress täpsema info jaoks.
10. Jälgimisseadmete andmete edastamine
10.1 Veekeskus ei edasta õigusliku aluseta kaamerasalvestisi (edaspidi jälgimisseadmete andmed) kolmandatele isikutele.
10.2 Jälgimisseadmete andmete väljastamise taotlus peab vastama käesoleva korra punktis 11.1 nimetatud nõuetele. Andmete väljastamisele kohaldatakse käesoleva korra punktides 11.2- 11.7 sätestatut.
10.3 Salvestis edastatakse seadusest tulenevate kohustuste täitmiseks riigiorganile viimase nõudmisel kirjaliku pädeva isiku põhjendatud taotluse alusel, kui riigiorganil on salvestise väljanõude õigus vastavalt seadusele.
10.4 Kui andmete saaja pole loonud andmete edastamiseks turvalist kanalit, edastatakse salvestised krüpteeritult.
10.5 Kõigile väljastatavatele salvestistele ja nende kohta esitatud andmefailidele tehakse edastamisel juurde märge juurdepääsupiirangu kohta.
10.6 Salvestise või selle kohta esitatud andmefaili väljastamine fikseeritakse, lisamata väljastatud salvestist või andmeid selle kohta.
11. Jälgimisseadmete andmete väljastamine andmesubjektile
11.1.Veekeskus väljastab salvestiste andmed andmesubjektile tema enda kohta ainult viimase põhjendatud kirjaliku taotluse alusel, milles on märgitud:
11.1.1 taotleja nimi, isikukood/registrikood ja kontaktandmed;
11.1.2 videovalve salvestusest väljavõtte taotlemise põhjus ja eesmärk;
11.1.3 millisel viisil soovitakse salvestust saada (elektrooniliselt või andmekandjal);

11.1.4 kirjeldus sündmusest, mille kohta soovitakse väljavõtet;
11.1.5 kirjeldatud sündmuse võimalikult täpne aeg ja koht.
11.2 Veekeskusel on õigus jätta andmesubjekti taotlus rahuldamata ja salvestis väljastamata, kui salvestist või andmeid ei ole võimalik väljastada nii, et see ei kahjustataks teiste isikute õigusi ja huve. Nimetatud juhul on andmesubjektil õigus pöörduda salvestise väljanõudmiseks kohtu poole.
11.3 Andmesubjekti esitatud taotlus peab olema allkirjastatud.
12. Andmekaitsealaste rikkumiste menetlemine ja teavitamine
12.1 Jälgimisseadmete kasutamisest tulenevaid andmekaitse rikkumisi menetletakse vastavalt Veekeskuse andmekaitsetingimustele.
12.2 Vara ja isikut ohustavaks teguriks on ka isiku loata liikumine läbipääsupiiranguga ja mitteavalikul alal.
12.3 Juhul, kui salvestis on vajalik väärteo- või kriminaalmenetluses, siis antakse see üle väärteo- või kriminaalasja menetlejale.
12.4 Veekeskus väljastab seaduse rikkumist menetleva või selleks volituse alusel andmeid koguvale isikule salvestise põhjendatud taotluse alusel.

OÜ TARTU VEEKESKUS ISIKUANDMETE TÖÖTLEMISE ÜLDPÕHIMÕTTED
Üldpõhimõtted käsitlevad kliendi isikuandmete kogumist, töötlemist ja kasutamist OÜ Tartu Veekeskus (edaspidi Veekeskus) poolt teenuste osutamisel klientidele.
Isikuandmeid kogutakse:
- ID-kaardil toimivate kuu- ja 10 X kaardi, püsikliendiprogrammi, juriidilise isiku magnetkaardi, kuld- ja hõbekaardi ning sportlaste kuukaardi omanikelt.
- Sauna Yogasse, laste ujumise algõpetusse ja täiskasvanute ujumisõppesse registreerumisel (täiskasvanu/lapse ees- ja perekonnanimi, telefon, e-posti aadress).
- sünnipäeva, gruppide ja muude broneeringute korral (ees- ja perekonnanimi, lapse nimi, lapse vanus, lapsevanema telefon, e-posti aadress).
Isikuandmete kogumise eesmärgid sõltuvad kliendi poolt kasutatavast teenusest ja võivad teenuste lõikes erineda.
Eesmärkideks on koos või eraldi peamiselt kliendile tema nõusolekul soovitud teenuse osutamine, soodustuse andmine, isiku tuvastamine, kliendi turvalisuse tagamine, teenust puudutava olulise informatsiooni edastamine, turunduslike tegevuste teostamine (nt personaalsete pakkumuste tegemine, lisateenuste pakkumine jmt), samuti meie tegevust reguleerivate seadustega meile pandud kohustuste täitmine.
Andmeid kasutatakse ka teenuste analüüsimiseks ja täiustamiseks, uute teenuste loomiseks ning teenuste osutamiseks vajalike protsesside täiustamiseks. Samuti kasutatakse andmeid aruandluse ja statistika eesmärgil. Eeltoodu põhineb Veekeskuse õigustatud huvil täiustada ja/või arendada uusi teenuseid ning tõhustada teenuse osutamiseks vajalikke (tehnilisi) süsteeme.
Isikuandmete kogumine ja töötlemine
Kliendi isikuandmete vastutav töötleja on OÜ Tartu Veekeskus, registrikood 10738741, aadress Turu 10, Tartu, Tartu linn, 51014.
Kogutavate isikuandmete ulatus sõltub konkreetset teenusest. Täpsema info kogutavate isikuandmete kohta leiab Veekeskuse kodulehelt vastavate teenuste kirjelduste juurest või sõlmitud lepingutest (teenuste osutamisel juriidilistele isikutele).
Klientide kohta, kes tasuvad teenuste eest ülekandega, kogume makseandmeid treeningutel osalemiseks tehtud maksete töötlemisel raamatupidamiskohustuste täitmiseks. Makseandmeid säilitame vastavalt raamatupidamise seadusele seitse aastat.
Kogutavad isikuandmed on klientide poolt vabatahtlikult Veekeskusele edastatud. Üldjuhul saame andmed otse klientidelt, kes teevad broneeringu või päringu meie veebilehe kaudu, telefoni teel, e-maili teel või ostetakse teenuseid otse, meie juurde kohale tulles. Meile edastavad kliendi andmeid ka lepingujärgsed koostööpartnerid/äriühingud.
Kogutud isikuandmeid võidakse kasutada turunduslikel eesmärkidel ainult Veekeskuse poolt.
Kliendi õigused
Kliendil on õigus saada informatsiooni, milliseid isikuandmeid Veekeskus tema kohta on kogunud ja kuidas neid töödelnud. Klient võib nõuda enda ja/või lapse/eestkostetava isikuandmete muutmist (parandamist, täiendamist), kustutamist ja töötlemise piiramist.
Klient võib võtta oma nõusoleku isikuandmete töötlemiseks tagasi.
Uudiskirja saav klient, kes seda enam ei soovi, saab igal ajal taotleda enda uudiskirja saajate nimekirjast eemaldamist, kirjutades e-posti aadressil info@aurakeskus.ee või klikkides uudiskirja all oleval uudiskirja eemaldamise teate lingil.
Juhul, kui klient leiab, et tema isikuandmete töötlemine Veekeskuse poolt ei ole kooskõlas kehtivate õigusaktidega on kliendil õigus esitada kaebus Andmekaitse Inspektsioonile või pöörduda kohtu poole.
Isikuandmete kaitse ja säilitamine
Ligipääs kliendi andmetele võib olla, lisaks Veekeskusele, selleks volitatud isikutel, kes osutavad Veekeskusele teenuseid (nt tarkvara arendus-ja hooldusteenuse pakkujad, serveri ja kodulehe teenuse pakkujad, uppumise tuvastamise süsteemi haldusteenuse pakkuja). Volitatud isikutega on sõlmitud lepingud ning nad on kohustatud neile teatavaks saanud isikuandmeid hoidma konfidentsiaalsena.
Ligipääs kliendi andmetele on vajadusel seadusandlusest tulenevatel alustel ka õigus- ja korrakaitseorganisatsioonidel (nt Politsei- ja Piirivalveamet).
Veekeskus säilitab andmeid kuni see on vajalik teenuse osutamiseks, Veekeskuse õiguste kaitsmiseks ja kuni on õigusaktides nõutud.
Isikuandmed videojälgimissüsteemi kasutamisel
Veekeskusesse on isikuid ohustavate olukordade ja ohuolukorrale (nt uppumise tuvastamise süsteem) reageerimiseks, isikute elu kaitseks, vara säilimiseks või vara kahjustamisel kahju tekitaja väljaselgitamiseks paigaldatud õigustatud huvi alusel videojälgimissüsteemid.
Tegemist on Veekeskuse siseruumidesse ja väliterritooriumile ja spordibasseini paigaldatud kaameratega, mis salvestavad ning võimaldavad salvestisi hiljem töödelda ja taasesitada. Videovalvesüsteemiga ei salvestata heli ega jälgita konkreetset inimest, vaid ainult kindlat ala (nt ruumi, koridori) ja seal toimuvat. Veekeskuse videojälgimissüsteemi kasutamisest teavitavad kaamera kujutisega sildid välis- ja siseruumide ustel.
Kaamerate abil saadud andmete töötlemisel kasutab Veekeskus selliseid turvameetmeid, mis kaitsevad kogutud andmeid tahtmatu või ilma loata jälgimise, kopeerimise, muutmise, teisaldamise ja kustutamise eest. Kaamerate salvestistele on õigus ligi pääseda Veekeskuse juhataja määratud isikutel ametikoha põhiselt. Olemasolevaid salvestisi võib Veekeskus edastada
väljapoole Veekeskust või võimaldada neile juurdepääsu ainult juhul, kui selleks on seadusest tulenev alus (nt politseile).
Videojälgmissüsteemi salvestisi säilitatakse maksimaalselt üks kuu või kuni on vajalik probleemi lõpliku lahenduse saavutamiseks. Pärast tähtaja möödumist salvestised kustutatakse kas andmete kustutamise funktsiooni või andmete üle salvestamisega, sõltuvalt kaamera tehnilistest võimalustest.

Isikuandmete töötlemise üldpõhimõtete muutmine
Veekeskus on õigus käesolevaid üldpõhimõtteid muuta. Teave muutuse kohta postitatakse Veekeskuse kodulehel. Kehtivad üldpõhimõtted on alati ettevõtte kodulehelt leitavad.

Sissejuhatus
OÜ Tartu Veekeskuse (edaspidi nimetatud Veekeskus) territooriumil viibivate isikute tervise, elu ja vara kaitseks kasutatakse ööpäevaringselt töötavat jälgimisseadmestikku. Veekeskuse kliente ohustavate olukordade ja ohuolukorrale (sh uppumise tuvastamise süsteem) reageerimine samuti töötajate turvalisuse tagamine ning vara kaitsmine teenib igakülgselt Veekeskuse huve.
Kaamerate kasutamise õiguslikuks aluseks on IKÜM art 6 lg 1 p f – õigustatud huvi.
Veekeskuses kasutatakse videojälgimist turvameetmena isikute turvalisust ohustavate
olukordade ennetamiseks, turvalisuse tagamiseks, ohuolukordadele reageerimiseks ning vara kaitseks. Veekeskuses on kasutusel tavakaamerad ja uppumise tuvastamise süsteem, mis asub spordibasseinis veel all.
Videojälgimise seadmete abil jälgitakse Veekeskuse õueala, sissepääsualasid, koridore, basseinide territooriume ning saunade üldala (sh väliterrass).
Veekeskuse jaoks on oluline isikuandmete nõuetekohane töötlemine ning isikute põhiõiguste kaitse. Seetõttu on Veekeskus hinnanud videojälgimissüsteemi kasutamisel õigustatud huvi olemasolu. Õigustatud huvi dokumenteerimiseks on Veekeskus läbinud kolmeastmelise testi – huvikontroll ehk eesmärgi test, vajalikkuse test ning tasakaalutest. Testi tulemusena on jõutud järeldusele, et videojälgimissüsteemi Veekeskuses kasutamine õigustatud huvi alusel on seaduslik.
Taust
Videojälgimissüsteem on liikumist piiravate jälgimisseadmete kogum, mis võimaldab salvestada ja jälgida ruumides ja õuealal toimuvat ja ennetada eluohtlikku olukorda uppumise tuvastamise süsteemi kasutamise abil. Videovalvesüsteem koosneb Veekeskuse õuealale, siseruumidesse ja spordibasseini seatud kaameratest. Videojälgimissüsteemi kohta on Veekeskusel kehtestatud kaamerate kasutamise kord. Spordibasseini ohutustingimuste parendamiseks võetakse Veekeskuses kasutusele uppumise tuvastamise süsteem, mis suhtleb instruktoritega andes neile teada ohtlikust või kriitilisi olukorrast basseinis. Uppumise tuvastamise süsteemi tarkvara hindab kaamerate ja andurite abil reaalajas basseinis toimuvat
ning saadab võimalikust ohuolukorrast instruktori nutikellale vastava teate. Instruktor näeb oma nutikellal täpset ohu asukohta spordibasseinis, mis võimaldab ohuolukorrale väga kiiresti reageerida.
Veekeskus kasutab volitatud töötlejat AngelEye srl, kes tagab uppumise tuvastamise süsteemi töö vastavuse andmekaitse põhimõtetele. AngelEye uppumise tuvastamise süsteem koosneb
optilistest ja pildituvastussüsteemidest, mis skaneerivad kogu basseini reaalajas. Tarkvaraüksus suudab tuvastada tavapäratuid liikumisi ja tüüpilisi uppumisolukordi, sealhulgas aeglane inimese liikumine põhja poole, mis on üks uppumise tunnus.
1. Huvikontroll ehk eesmärgi test:
1.1. Tartu Veekeskus kui vastutava andmetöötleja õigustatud huvi
1) Veekeskuse territooriumil viibivate isikute turvalisust ohustavate olukordade
ennetamine, turvalisuse tagamine, ohuolukordadele operatiivne reageerimine ning vara igakülgne kaitse.
2) Veekeskusel on, tulenevalt määruse „Tervisekaitsenõuded ujulatele, basseinidele ja veekeskustele“ § 5 lg 1’st, kohustus osutada vajadusel abi. Üheks meetmeks kohustuse
täitmisel on ööpäevaringselt videojälgimissüsteemi kasutamine.
1. 2.Videovalvega kaasnev isikuandmete töötlemise eesmärk
1) Videovalve kasutamise eesmärk on tagada Veekeskuse territooriumil viibivate isikute ohutus ning vara valve ja kaitse.
2) Samuti Veekeskuses viibivate isikute turvalisust ohustava olukorra ennetamine ning operatiivne olukorrale reageerimine.
1.3.Mida loodetakse videovalvega kaasneva andmetöötlemise tulemusena saavutada?
1) Veekeskuse territooriumil viibivate isikute maksimaalne turvalisus ja efektiivne kaitse

Töödeldavateks isikuandmeteks on isiku kujutis. Salvestusi säilitatakse kuni 30
kalendripäeva. Toimingute logi sisaldab ka mitteisikulisi häireteateid. Kõiki salvestusi võidakse
säilitada juhtumi korral selle lõpliku lahenemiseni või kuni nõudeõiguse kehtivuseni. Volitatud töötleja säilitab
salvestused AngelEye Cloudis kuni 72 tundi. Tähtaja möödudes salvestused kustuvad automaatselt.
Mida loodetakse andmetöötlemise tulemusena saavutada?
1) isiku ohutuse tagamine 2) füüsilise vara kaitse 3) ebaseadusliku tegevuse ennetamine ja avastamine, tuvastamine
Üheks tõsiseks ohuks on tervislikel või oskamatusest tulenevalt põhjustel vees hätta sattumine ja sellega kaasnev uppumisoht. Videojälgimissüsteemi kasutamine võimaldab jälgida Veekeskuse territooriumil nagu õueala (sh väliterrass), siseruumid ning basseinides toimuvat
ning vajadusel tuvastada juhtumi asjaolusid. Veekeskuse territooriumile paigaldatud kaameratega ei
toimu reaalajas jälgimist. Üldaladele paigutatud kaamerapilti kasutatakse ainult tagantjärele juhtumi tuvastamiseks. Uppumise tuvastamise süsteem saadab reaalajas instruktori nutikellale teate võimalikust ohuolukorrast. Erandina toimub reaalajas kaamerapildi jälgimine ainult siis, kui läbipääsusüsteemid ei tööta ning inimeste turvalisuse tagamiseks jälgitakse väliterrassil olevate isikute pääsemist siseruumidesse.
Siseruumides olevad kaaremad aitavad tagada isikute ohutuse ning vara kaitse ning salvestused
võimaldavad tuvastada juhtumi täpsemad asjaolud.
Kes saab isikuandmete töötlemisest kasu?
1) Veekeskus 2) andmesubjekt
Isikute liikumist Veekeskuse aladel ei jälgita reaalajas, salvestusi vaadatakse ainult toimunud juhtumi täpsustamiseks, mis võib olla nii Veekeskuse kui ka teenust saava isiku kaitseks. Uppumisvastase süsteemi kaamerapildiga tagatakse isikute võimaliku ohuolukorra ennetamine.
Kas huvi on seaduslik ning kas töötlus vastaks erireeglitele?
Huvi seaduslikkust hindab käesolev kaalutlusotsus. Andmetöötlus ei vasta erireeglitele.
Veekeskuses on koostatud ja avaldatud andmekaitsetingimused. Uppumise tuvastamise süsteemi volitatud töötleja on Euroopas asuv ettevõte AngelEye srl, kelle isikuandmete töötlemine on kooskõlas isikuandmete kaitse üldmäärusega.
2. Vajalikkuse test
2.1.Kas videovalvega kaasnev andmetöötlus vastab erireeglitele?
1) Ei vasta. Videovalve toimub üksnes videopildi salvestusena ilma helisalvestuseta.
2.2.Võimalikud ohud varale või isikutele VEEKESKUSE territooriumil
1) Veekeskus peab tagama klientidele ohutu keskkonna ning töötajatele vahendid ja võimalused turvalisuse tagamiseks. Turvalisuse tagamine teenib Veekeskuse ja klientide huve. Võimalike, isikute turvalisust ohustavate ohtudena, nähakse eelkõige, kuid mitte ainult:
a) ohud kliendile – basseinis terviserikke kiire tuvastamine (isiku vajumine basseini põhja), uppumisohu ennetamine (häiresüsteem annab instruktori nutikellale teate), hilisem videosalvestuse kasutamine juhtunu asjaolude täpsesmaks tuvastamiseks;
b) ohud varale - vargus, murdvargus, kelmus ja avaliku korra rikkumine, vara mistahes muul viisil kahjustumine (tulekahju jmt);
c) ohud töötajatele ja külalistele – vargus, kelmus, isiku vastane rünne, terrorism, tulekahju jms ohud.
2.3.Varale ja isikutele kirjeldatud ohtude tõsidus ja realiseerumise tõenäosus
1) Kirjeldatud ohtude näol on tegemist võimaliku realiseerumise tõenäosusega ohtudega territooriumil. Need on võimalikud ohud, millega Veekeskusel tuleb just isikute ohutuse, turvalisuse ja vara kaitse vaates arvestada ning vajalikke meetmeid kasutades tegutseda.
2) Uppumise tuvastamise süsteemi kaamerad hindavad territooriumil ohtu reaalajas ning annavad signaali instruktoritele, kes saavad vastavalt vajadusele operatiivselt reageerida ja tegutseda. Reaalajas kaameratega mehitatud videopildi jälgimist ei toimu, kaameras asuv andur annab ohust teada Veekeskuse töötajale käekellal oleva teavitussüsteemi kaudu.
3) Veekeskuse jaoks on oluline kaitsta ettevõtte, kui ka selles viibivate isikute turvalisust, ja vara, mille hävimine toob kaasa majanduslikku kahju.
Küsimused Vastus Märkused
Kas ja kuidas andmetöötlus aitab saavutada seatud eesmärki?
Uppumise tuvastamise süsteem võimaldab kiiresti reageerida tõsiseimale ohule – uppumisohule spordibasseinis. Töötaja raskus igal
hetkel igasse basseiniosasse ja-põhja näha võib potentsiaalselt viia vajaliku abi hilinemiseni, mille tulemused võivad olla väga tõsised. Valvesüsteemi kasutamine on vajalik Veekeskuse töötajate töö toetamiseks teenust kasutavate klientide turvalisuse tagamisel ning vara säilitamiseks ja õigusrikkumisel selle toimepanija tuvastamiseks ja/või asjaolude selgitamiseks.
Uppumise tuvastamise süsteem jälgib reaalajas spordibasseinis toimuvat ja annab töötajale ohust
kiiresti teada. Reaalajas mehitatud kaamerapildi kaudu isikute jälgimist ei toimu. Salvestuste säilitamise eesmärgiks on õnnetusjuhtumite või õigusrikkumiste toimepanijate tuvastamine, juhtumi asjaolude tuvastamine.
Kas eesmärki saab teisiti saavutada?
Vara ja isikute turvalisuse ning õigusrikkumiste toimepanijate tuvastamise eesmärke ei ole võimalik saavutada ilma, et oht oluliselt kasvaks. Veekeskuses on lisaks kaameratele suures osas reaalajas mehitatud valve – instruktorid jälgivad reaalajas Veekeskuse aladel isikute tegevust korra hoidmise ja ohuolukordade märkamise ja neile reageerimise ja ka ennetamise eesmärgil.
Mehitatud valve basseinides eeldaks instruktorite pidevat viibimist vee all. Basseinide ääres on vee all toimuvat keeruline jälgida (peegeldused, vee virvendus, teised ujujad, erinev valgus, erinevad varjatud nurgad jms). Uppumise tuvastamise süsteem tagab pideva basseinides toimuva jälgimise, mis omakorda aitab ennetada ohuolukordasid. Samuti ei ole võimalik õnnetusjuhtumi korral täpselt välja selgitada juhtunut, kui pole võimalust salvestust vaadata. Isikute ütlused võivad erineda tegelikust olukorrast. Videovalvesüsteem aitab tagada isikute ja vara kaitset ennekõike Veekeskuse üldaladel ja basseinides. Samuti on sellest abi õigusrikkujate tuvastamisel. Videovalvesüsteem ei saa asendada
ainult mehitatud valvega ka seepärast, sest õiguste tuvastamisel tuleks sellisel juhul lähtuda ainult töötaja ja andmesubjekti subjektiivsetest
ütlustest.
Kas andmetöötlus on proportsionaalne loodetava eesmärgiga?
Jah. Soovitud eesmärke ei ole võimalik vähem riivavaid meetmeid kasutades saavutada. Andmeid kogutakse minimaalsuse põhimõtet järgides, pidades silmas, et andmesubjekti õiguste riive oleks võimalikult väike. Ka andmesubjekt ise saab videojälgimissüsteemi kasutamisest kasu, kuivõrd see kaitseb ka teda ennast võimaldades saada kiiret abi ohuolukorras ning kaitseb vara
õigusrikkumiste korral aitab tuvastada õigusrikkumiste toimepanija.
3. Tasakaalutest
3.1.Alternatiivsed meetmed eelkirjeldatud ohtude tõrjumiseks
1) Andmesubjektide kaitse kohustus on sätestatud määruses ning seetõttu võtab Veekeskus kasutuse järelevalve meetmed jälgides ettevõtte territooriumil ja basseinides toimuvat tegevust.
2) Andmesubjekti elu kaitseks kasutusele võetav uppumise tuvastamise süsteem aitab ennetada ohtu inimese elule ja on oluliseks vahendiks Veekeskuse töötajatele kiireks reageerimiseks.
3) Vara kahjustamise ärahoidmise, turvalisust ohustavate olukordade ennetamiseks ning operatiivseks olukorrale reageerimiseks ei ole tõhusamaid viise.
4) Veekeskuses on tagatud ka mehitatud valve, kus basseinide ääres olevad instruktorid jälgivad toimuvat, kuid ka neil ei ole igal võimalikul hetkel ja igas võimalikus kohas jälgimist tagada. Instruktori paigutamine basseini (vette) eeldaks ka nende reaalajas jälgimist, mistõttu ei ole põhjendatud videokaamerate asendamine ainult mehitatud valvega.
5) Uppumise tuvastamise süsteemi kasutamine võimaldab sekkuda kohe, kui on oht inimese elule.
6) Videojälgimissüsteem ja mehitatud valve kombinatsioon tagavad kõige efektiivsema ja kulutõhusama kaitse isikutele turvameetmena, kuivõrd üksnes mehitatud valve kasutamine oleks kulukas ning oma olemuse tõttu (inimlik faktor) ei võimaldaks jälgida mitmeid alasid ja territooriume samaaegselt nagu seda võimaldavad videovalve kaamerate kasutamine.
3.2. Alternatiivseid meetmed, nende kasutamine ja nende kasutamisest tekkiv tulemus
1) Alternatiivse meetmena oleks võimalik minna üle mehitatud valvele. Osaliselt seda ka Veekeskus kasutab.
2) Mehitatud valve ei anna võrreldavat tulemust. Videovalve kaamerate kasutamisega on hõlmatud korraga suurem ala. Videovalve võimaldab jälgida konkreetseid ohualasid reaalajas ning sekkuda kohe kui on näha, et oht võib realiseeruda.
3) Veekeskusel puudub võimalus tagada reaalajas mehitatud valve veel all.
4) Veekeskuses on kasutusel valvesüsteem, mis on seadistatud minimaalsuse põhimõttest lähtuvalt ja ilma helisalvestuseta.
3.3. Milliseid turvameetmeid rakendatakse?
1) Veekeskuses on kehtestatud andmekaitsetingimused ning kaamerate kasutamise kord,
mis kirjeldavad videojälgimise tingimusi.
2) Videojälgimissüsteemi kasutamisest Veekeskuse territooriumil ja ruumides teavitavad vastavasisulised sildid.
3) Veekeskuse töödeldavate isikuandmete turvalisuse tagamiseks välditakse kõrvaliste isikute ligipääsu videojälgimisseadmetele ja -süsteemile, hoidmaks ära salvestiste omavolilise jälgimise, kopeerimise, muutmise, teisaldamise ja kustutamise.
4) Videojälgimissüsteemile pääsevad ligi selleks tööülesannetest tulenevalt õigust omavad töötajad, kellel on õigus isikuandmeid töödelda vaid ulatuses, mis on vajalikud
isikuandmete töötlemise eesmärkide saavutamiseks.
5) Veekeskus edastab olemasolevaid salvestisi üksnes õigusliku aluse olemasolul ja nende nõudmisel õiguskaitseasutustele, riigi- ja kohaliku omavalitsuse asutustele ja ainult õigusrikkumise menetluses õigusrikkumist seaduse kohaselt menetleva asutuse nõudmisel ja salvestiste olemasolu korral.
3.4. VEEKESKUSE territooriumil viibivale andmesubjektile videovalvega kaasnev võimalik mõju
1) Veekeskuses viibivatele isikutele võib kaasneda teatud negatiivne mõju tulenevalt privaatsuse riivest ja teadmisest, et koridorides, basseinide territooriumil, saunade
üldalal ja spordibasseinis kasutatakse videovalvet, mis võib olla häiriv.
2) Samas võib see mõjuda ka vastupidiselt, kuivõrd Veekeskuselt oodatakse mõistlikult teatavat andmesubjekti ohutuste tagamist, turvalisuse tagamist ja abi osutamist. Seeläbi võib videovalve kasutamise fakt ja sellest teadmine mõjuda hoopis rahustavalt ja turvatunnet lisavalt.

Milliseid isikuandmeid töödeldakse?
Töödeldavad isikuandmed on: isiku kujutis salvestusel.
Kas isik saab mõistlikult eeldada, et selline huvi on olemas?
Jah. Videovalvesüsteemi kasutamist isikute ja vara kaitseks on mõistlik eeldada antud teenuse osutamisel ja saamisel.
Milline on õiguslik suhe andmesubjektiga?
1) töö- või käsunduslepingu põhine (töötajad) 2) teenust kasutavad kliendid
Kas isikule võib kaasneda negatiivne mõju?
Jah. Andmesubjekt võib olla häiritud või ärritunud asjaolust, et tema asukohta on võimalik tuvastada ja tema tegevusi teenuste kasutamisel on võimalik jälgida. Isiku õigus privaatsusele on riivatud.
Milliseid turvameetmeid rakendatakse?
1) Salvestisi hoitakse piiratud ligipääsuga seadmetes lukustatud või piiratud ligipääsuga ruumis. 2) Reaalajas logi näevad üksnes vastavate õigustega töötajad.
3) Valvesüsteemi saab siseneda üksnes vastavate õigustega töötajad isikutuvastuse abil. 4) Salvestisi hoitakse kuni 30 päeva, uppumisvastase süsteemi salvestisi kuni 72 tundi ega väljastata kolmandatele isikutele, v.a seaduse alusel. Kõiki salvestusi võidakse säilitada juhtumi korral selle lõpliku lahenemiseni või kuni nõudeõiguse kehtivuseni.
4. Kas Veekeskuse õigustatud huvi videovalve kasutamiseks on seaduslik?
4.1. Jah on. Tartu Veekeskusel on kohustus osutada klientidele vajadusel esmaabi ja soov tagada ohutu keskkond klientidele ning turvaline töökeskkond töötajatele. Tulenevalt
eelkirjeldatust on Veekeskus valinud just sellise kombinatsiooni ja vahendid ning meetmed, et videojälgimissüsteemi kasutamine riivaks minimaalselt territooriumil viibivate isikute põhiõigusi ja – vabadusi, kuid tagaks seeläbi maksimaalse kaitse isikute turvalisusele ja kaitse isikute elule ning varale. Valitud meetmed turvalisuse tagamiseks on õigustatud ja vajalikud.
4.2.Videovalve kaamerate kasutamise õiguslikuks aluseks on IKÜM art 6 lg 1 p f – õigustatud huvi.
