Dear Ms Carly Samuel,
Market entry costs and taxation implications on the importation are under competency of the Estonian Tax and Customs Board ([email protected]).
The Health Board can give an advice on the specific regulations applicable to cosmetical products. They are as follows::
Regulation (EC) N° 1223/2009 on cosmetic products is the main regulatory framework for finished cosmetic products when placed on the EU market.
Commission Regulation (EU) No 655/2013 is laying down common criteria for the justification of claims used in relation to cosmetical products.
Responsible persons shall ensure compliance with Regulation (EC) N° 1223/2009 Articles 3 (safety), 8 (Good manufacturing practice), 10 (Safety assessment), 11 (Product information file), 12 (Sampling and analysis), 13 (Notification), 14 (Restrictions for substances listed in the Annexes) , 15 (Substances classified as CMR substances), 16 (Nanomaterials), 17 (Traces of prohibited substances), 18 (Animal testing), Article 19(1),(2) and (5) (Labelling), as well as Articles 20 (Product claims) , 21 (Access to information for the public), 23 (Communication of serious undesirable effects) and 24(Information on substances).
Regulation (EC) No 1223/2009 (Article 13) requires that the responsible persons and, under certain circumstances, the distributors of cosmetic products submit some information about the products they place or make available on the European market through the CPNP.
