All Transmission System Operators of synchronous area Continental Europe are taking into account the
following;

(1) This document is a common proposal developed by all Transmission System Operators of 8
synchronous area CE (hereafter referred to as “TSOs”) regarding the development of a proposal for 9
the dimensioning rules for FCR (hereafter referred to as “FCR dimensioning rules proposal”) in 10
accordance with Article 153 of the Commission Regulation (EU) 2017/1485 of 2 August 2017 11
establishing a guideline on electricity transmission system operation (hereafter referred to as “SO 12
GL”). 13

(2) The FCR dimensioning rules proposal takes into account the general principles and goals set in the 15
SO GL as well as Regulation (EC) No 714/2009 of the European Parliament and the Council of 16
13 July 2009 on conditions for access to the network for cross-border exchanges in electricity 17
(hereafter referred to as “Regulation (EC) No 714/2009”). The goal of the SO GL is the 18
safeguarding of operational security, frequency quality and the efficient use of the interconnected 19
system and resources. It sets for this purpose rules to determine the reserve capacity for FCR 20
required for the synchronous area CE, which shall cover at least the reference incident, and also set 21
rules to determine the shares of the reserve capacity on FCR required for each TSO of CE as initial 22
FCR obligation. 23

(3) The scope of the FCR dimensioning rules proposal is to establish rules to dimension the reserve for 25
FCR required, while respecting the requirements set in Article 153(2) of the SO GL. 26

(4) According to Article 6 of the SO GL, the expected impact of the FCR dimensioning rules proposal 28
on the objectives of the SO GL has to be described. It is presented below. The proposed FCR 29
dimensioning rules proposal generally contributes to the achievement of the objectives of the 30
Article 4(1) of the SO GL. 31

(5) In particular, the FCR dimensioning rules proposal responds to the objectives of SO GL to 33
determine common operational security requirements, and to ensure the conditions for maintaining 34
operational security and frequency quality level throughout the Union, by establishing rules for the 35
adequate dimensioning capacity for FCR, which is essential to stabilize the system frequency at a 36
stationary value after any imbalance between generation and consumption. 37

(6) In conclusion, the FCR dimensioning rules proposal contributes to the general objectives of the SO 39
GL to the benefit of all market participants and electricity end consumers. 40

The FCR dimensioning rules as determined in this proposal shall be considered as the common proposal of 46
all TSOs of CE in accordance with Article 153(2) of SO GL. 47

1. For the purposes of the FCR dimensioning rules proposal, terms used in this document shall have the50
meaning of the definitions included in Article 3 of the SO GL, Article 2 of Regulation (EC) 714/2009,51
Article 2 of Directive 2009/72/EC and Article 2 of Commission Regulation (EU) 543/2013.52

2. In this FCR dimensioning rules proposal, unless the context requires otherwise:54
a) the singular indicates the plural and vice versa;55
b) the table of contents and headings are inserted for convenience only and do not affect the56
interpretation of this FCR dimensioning rules proposal; and57
c) any reference to legislation, regulations, directive, order, instrument, code or any other enactment58
shall include any modification, extension or re-enactment of it then in force.59

Dimensioning rules for the TSOs of th synchronous area CE 61
The FCR dimensioning for the synchronous area CE in positive and negative direction is equal to the 62
reference incident of 3000 MW, according to SO GL article 153(2b.i). 63

The shares of the reserve capacity on FCR required for each TSO as initial FCR obligation for a65

Article 4 83
Publication and implementation of the FCR dimensioning rules proposal 84
1. The TSOs shall publish the FCR dimensioning rules proposal without undue delay after all NRAs have85
approved the proposal or a decision has been taken by the Agency for the Cooperation of Energy86
Regulators in accordance with Article 6 (1) and (8) of the SO GL.87

2. The TSOs shall implement the FCR dimensioning rules proposal provided one month after the89
regulatory authorities have approved the proposal in accordance with Article 6(3) SO GL or a decision90
has been taken by the Agency in accordance with Article 6(8) SO GL.91

The reference language for this FCR dimensioning rules proposal shall be English. For the avoidance of 94
doubt, where TSOs need to translate this FCR dimensioning rules proposal into their national language(s), 95
in the event of inconsistencies between the English version published by TSOs in accordance with Article 8 96
of the SO GL Regulation and any version in another language, the relevant TSOs shall, in accordance with 97
national legislation, provide the relevant national regulatory authorities with an updated translation of the 98
FCR dimensioning rules proposal. 99

Explanatory note
An appropriate amount of FCR available in the synchronous area is essential to stabilize the system 1
frequency at a stationary value after any imbalance between generation and consumption. 2
The basic criterion used for FCR dimensioning is to withstand the reference incident in the synchronous 3
area by containing the system frequency within the maximum frequency deviation and stabilizing the 4
system frequency within the maximum steady-state frequency deviation. 5
The reference incident is defined as the maximum expected instantaneous power deviation between 6
generation and demand in the synchronous area for which the dynamic behaviour of the system is designed. 7
This expected instantaneous power deviation includes the losses of the largest power generation modules or 8
loads, loss of a line sector or a bus bar, or loss of a HVDC interconnector. The SO GL (Article 153 (2b.i)) 9
sets the reference incident for CE to 3000 MW in both directions. 10
This criterion assumes a balanced situation when the incident occurs. In order to consider prior imbalances 11
derived from changes in demand, renewable generation or the market-induced imbalances, the 12
dimensioning of FCR capacity can be calculated by combining the probability of forced instantaneous 13
outages with the probability of used FCR due to the already existing frequency deviations (not associated 14
with generation trips). 15
The SO GL (Article 153 2(c)) allows the possibility for the synchronous area CE to define and apply a 16
dimensioning approach to calculate the reserve capacity on FCR that must at least cover the reference 17
incident, and based on the principle of covering the imbalances in the synchronous area that are likely to 18
happen once in 20 years. This probabilistic methodology assumes the following starting hypothesis such as 19
full activation time of automatic FRR, tripping rates of the generation plants, patterns of load, generation 20
and inertia (including synthetic inertia), which are difficult to estimate and have a strong influence on the 21
results. 22
On the other hand, in the recent past, the FCR capacity dimensioned in CE (equal to the reference incident 23
3000 MW in both directions) has proven to be enough to ensure the conditions for maintaining the 24
frequency quality level and respecting the operational security requirements. 25
For all these exposed above, the FCR dimensioning capacity in CE shall be equal to the reference incident 26
for positive and negative directions. 27
According to the Article 153(2) of Commission Regulation (EU) 2017/1485 establishing a guideline on 28
electricity transmission system operation, by 12 months after entry into force of this Regulation, all TSOs 29
of a synchronous area shall jointly develop a common proposal regarding the dimensioning rules for FCR, 30
which shall comply with the following requirement: 31
The reserve capacity for FCR required for the synchronous area shall cover at least the reference32
incident and, for the CE and Nordic synchronous areas, the results of the probabilistic dimensioning33
approach for FCR carried out pursuant to point (c);34
For the CE and Nordic synchronous areas, all TSOs of the synchronous area shall have the right to35
define a probabilistic dimensioning approach for FCR taking into account the pattern of load, generation36
and inertia, including synthetic inertia as well as the available means to deploy minimum inertia in real-37
time in accordance with the methodology referred to in Article 39, with the aim of reducing the38
probability of insufficient FCR to below or equal to once in 20 years.39
This proposal takes into account all the previous requirements. 40
Finally, and according to the Article 6(3) this proposal shall be subject to approval by all regulatory 41
authorities of the synchronous area CE. 42

Whereas
(1) This document regards the common additional properties of Frequency Containment Reserves
(hereinafter referred to as “FCR additional properties”) for Synchronous Area Continental Europe
(hereinafter referred to as “Synchronous Area CE”) in accordance with Article 154(2) of Commission
Regulation (EU) 2017/1485 of 2 August 2017 establishing a guideline on electricity transmission
system operation (hereinafter referred to as “SO Regulation”).
(2) With respect to Article 154 of the SO Regulation which determines FCR technical minimum
requirements, all TSOs of a synchronous area have the right to specify, in the synchronous area
operational agreement developed pursuant to Article 118 of the SO Regulation, common FCR
additional properties required to ensure operational security in the synchronous area, by means of a
set of technical parameters and within the ranges set out in Article 15(2)(d) of Commission
Regulation (EU) 2016/631 of 14 April 2016 establishing a Network Code on requirements for grid
connection of generators (hereinafter referred to as “RfG”) and in Articles 27 and 28 of Commission
Regulation (EU) 2016/1388 of 17 August 2016 establishing a Network Code on Demand Connection
(hereinafter referred to as “DCC”). These additional properties as detailed in this document are
subject to approval by the NRAs of the synchronous area according to Article 6(3)(d)(iii) of the SO
Regulation.
(3) For Synchronous Area CE, the Synchronous Area Framework Agreement for Regional Group
Continental Europe (hereinafter referred to as “SAFA”) entered into force on 14 April 2019,
following the approval by NRAs according to Article 6(3)(d) of the SO Regulation. The SAFA at
that time did not include any FCR additional properties.
(4) To reflect the individual needs of the Synchronous Area CE, some common additional properties are
nonetheless needed for FCR providing units and/or FCR providing groups with respect to the
activation of FCR and to FCR availability in a stressed system status posing particular attention to
the new technologies. To this extent particular conditions are specified for FCR providing units or
FCR providing groups which are connected to the grid via inverters. However, the principle of non-
discrimination is still respected since these conditions are based on the distinctive features of this
technology without restricting the provision of FCR.
(5) Once approved, these FCR additional properties shall be included in the SAFA, as an integral part of
this document.
(6) Where references to the RfG are cited, these references shall be intended as reflecting the possible
extreme system status where FCR provision is essential for grid security. They shall not be deemed
to contradict the application of RfG provisions only to new installations.
(7) The FCR additional properties are expected to reduce the risk of inappropriate activation of FCR and
of unavailability of FCR in a stressed system state. With this in mind, these properties will contribute
to system stability and therefore to the achievement of the objectives of Article 4 of the SO
Regulation.
(8) The specification of activation of FCR has the goal to ensure fast response and therefore help to
stabilise the system. Specifications for FCR providing units and/or FCR providing groups with
limited energy reservoir (hereinafter referred to as “LER”) aim at ensuring sufficient availability also
in stressed system status. Specifications for frequency measurement aim at ensuring availability of

independent functionality of FCR providing units and/or FCR providing groups in particular in case
of system split or communication problems. The transition period is defined to avoid too abrupt
change of requirements for already existing FCR providing units and/or FCR providing groups.
(9) In conclusion, the FCR additional properties contribute to the general objectives of the SO Regulation
to the benefit of all market participants and electricity end consumers.

Article 1 Subject matter and scope
1. The FCR additional properties as determined in this document shall be considered as the properties
developed in accordance with Article 154(2) of the SO Regulation and shall establish the requirements
in addition to those foreseen in Article 154 of the SO Regulation for FCR providing units and/or FCR
providing groups.
Article 2 Definitions and interpretation
1. For the purposes of the FCR additional properties, terms used in this document shall have the meaning
of the definitions included in Article 3 of the SO Regulation, Article 2 of Regulation (EU) 2019/943,
Article 2 of Directive (EU) 2019/944, Article 2 of Commission Regulation (EU) 543/2013 and Article 2
of RfG.
2. In addition, the following definitions shall apply:
a) Active Energy Reservoir Management: active charging/discharging of the reservoir depending on the
state of charge which results from FCR activation to avoid a status of a completely full/empty
reservoir;
b) Centralised Frequency Measurement or Centralised FCR Controller: principle of using a single
frequency measurement for activation of a number of decentrally located technical entities forming
a FCR providing unit or providing group. The application of this principle requires the respective
transmission of the frequency signal to the individual FCR providing unit or FCR providing group;
c) Decentralised Frequency Measurement: principle of using independent on-site frequency
measurements at the connection points or below at site of generating units of the technical entities
forming FCR providing units or FCR providing groups and activation of FCR based on this on-site
measurement;
d) Effective Energy Reservoir: the energy reservoir of a storage device which can effectively be used
for energy feed/absorption;
e) LER FCR Providing Units or LER FCR Providing Groups: FCR providing units or groups with
limited energy reservoirs, fulfilling the criteria according to Article 3(5);
f) Normal Mode: activation of FCR depending on the deviation of system frequency;
g) Reserve Mode: activation of active power response depending on short-term frequency deviations in
relation to the mean frequency deviation;
h) Technical Entity: single power generating module or demand unit.
3. In this document, unless the context requires otherwise:
a) the singular indicates the plural and vice versa;
b) the table of contents and headings are inserted for convenience only and do not affect the
interpretation of these common FCR additional properties;
c) references to an “Article” are, unless otherwise stated, references to an Article of this document;
d) references to a “paragraph” are, unless otherwise stated, references to a paragraph included in the
same Article of this document where it is mentioned; and
e) any reference to legislation, regulations, directive, order, instrument, code or any other enactment
shall include any modification, extension or re-enactment of it then in force.

Article 3 Additional properties of Frequency Containment Reserves
1. Each TSO shall check the conformity of FCR providing units and of FCR providing groups with the rules
under this Article and with the provisions set in Article 156(9), 156(10) and 156(11) of the SO Regulation
in the course of the prequalification according to Article 155 of the SO Regulation and in addition by
(ex-post) monitoring of activation of FCR according to Article 154(3) of the SO Regulation. Each TSO
shall apply respective monitoring procedures.
2. Each TSO shall ensure that the activation of FCR providing units and FCR providing groups:
a) is not artificially delayed and begins as soon as possible but no later than 2 seconds after a frequency
deviation; and
b) rises at least linearly.
When one of the requirements a) or b) cannot be met, the FCR providing group or FCR providing unit
shall provide technical evidence to the reserve connecting TSO. The reserve connecting TSO assesses
these justifications and decides whether or not the unit or group can be qualified to provide FCR. A
refusal to be qualified shall be duly motivated by the reserve connecting TSO. The motivated decision
shall be communicated to the FCR provider and relevant regulatory authority.
3. According to Article 154(6) of theSO Regulation, each FCR providing unit or group shall be capable of
activating FCR within the frequency range of 47,5 to 51,5 Hz and for time periods defined at national
level by the competent entity according to Articles 7 and 13 of RfG, taking into account the technical
boundary conditions of the respective FCR providing units or FCR providing groups. Each TSO shall, in
coordination with the DSOs, ensure that distributed FCR is not significantly reduced by load shedding
actions.
4. Each TSO shall require that FCR providing units and FCR providing groups continue to provide FCR
and are not allowed to reduce activation in case of a frequency deviation outside the frequency range of
+/- 200 mHz up to the frequency ranges as defined in paragraph 3.
5. FCR providing units or FCR providing groups are deemed as LER FCR Providing Units or LER FCR
Providing Groups in case a full continuous activation for a period of 2 hours in either positive or negative
direction might, without consideration of the effect of an Active Energy Reservoir management, lead to
a limitation of its capability to provide the full FCR activation in accordance with Article 156(8) of the
SO Regulation, due to the depletion of its energy reservoir(s) taking into account the Effective Energy
Reservoir effectively available.
For the avoidance of doubt, FCR providing units or groups that contain technical entities with unlimited
energy reservoirs and technical entities with limited energy reservoirs shall not be considered LER FCR
providing unit or group in case their energy reservoir does not limit the capability to provide FCR
according to Article 156(7) of the SO Regulation.
FCR providing units or groups not deemed as LER FCR providing units or groups that contain technical
entities with limited energy reservoirs shall thus ensure to be able to fully activate their FCR provision
in accordance with Article 156(7) of the SO Regulation.
Technical entities with unlimited energy reservoir of FCR providing units or FCR providing groups shall
not limit their FCR provision in case technical entities with limited energy reservoir (of that FCR

providing group/unit) are already exhausted in either the positive or negative direction according to
Article 156(8) of the SO Regulation.
For prequalification, the TSOs shall require that:
• LER FCR Providing Units or LER FCR Providing Groups shall have an Active Energy Reservoir
management. Active Energy Reservoir management shall ensure a continuous physical activation of
FCR in normal state according to Article 156(9) of the SO Regulation.
• In accordance with Article 156(9) of the SO Regulation, the FCR provider shall ensure that LER
FCR Providing Units or LER FCR Providing Groups have an energy reservoir dimensioned to
guarantee the minimum activation period set in accordance with Article 156(10) of the SO
Regulation, by additionally taking into account possible frequency deviations that might happen
before entering into alert state.
• To enable an Active Energy Reservoir Management, LER FCR Providing Units or LER FCR
Providing Groups may prequalify a power for FCR limited to 0.8 of the rated power (i.e. a ratio of
rated power to prequalified power of at least 1.25:1); a deviation from this requirement is possible in
case an alternative solution with an equivalent effect as in guaranteeing a continuous FCR provision
while applying an Energy Reservoir Management. Any lead time for the charging process needs to
be considered for Active Energy Reservoir management.
• Active Energy Reservoir Management of LER FCR providing units and LER FCR providing groups
shall not rely on over fulfilment of activation.
• Besides ensuring that the energy reservoir is sufficient to continuously activate FCR in normal state
and fully activate FCR in alert state for the time period pursuant to Article 156(9) of the SO
Regulation, LER FCR providing units (either single or belonging to a LER FCR providing group)
that are prequalified for the first time after the entry into force of the methodology and are technically
capable (especially inverter-connected assets) shall ensure that close to the upper or lower bounds of
the energy reservoir the remaining capacity is sufficient for keeping a proper response on short-term
frequency deviations. Therefore, they shall switch from the Normal Mode (reaction to normal
frequency deviation) into a Reserve Mode (reaction to zero-mean frequency deviation). Annex I
provides the standard criteria governing the operation in Reserve Mode and the transition from
Normal Mode to Reserve Mode and viceversa with reference to LER FCR providing units. Each TSO
may decide the relevant criteria to be applied in its control area: if no criteria are defined, the standard
ones referring to LER FCR providing units apply.
6. FCR providing units (either single or belonging to a FCR providing group) shall be equipped with local
frequency measurement at least per connection point or below when it is technically feasible at the
Technical Entity of the FCR providing unit.
7. FCR providing groups shall implement alternatively one of the following approaches:
a) Decentralised Frequency Measurements at least per connection point in analogy to what is foreseen
for FCR providing units in paragraph 6;
b) a Centralised FCR Controller with Decentralised Frequency Measurements per connection point
(based on local frequency measurement) to be used as a fallback solution to ensure an autonomous
function and a proper activation in case of errors in the Centralised FCR Controller itself (e.g. outage
of SCADA, faults of communication lines) or in case of a system split affecting the perimeter of the
group; if the group includes FCR providing units, local frequency measurements available for these
units pursuant to paragraph 6 shall be part of the fallback solution; or

c) an alternative solution with equivalent effect to the fallback solution pursuant to b), as in guaranteeing
a proper activation in case of errors in the Centralised FCR Controller or in case of a system split.
8. In case the Decentralised Frequency Measurements are used as a fallback solution pursuant to paragraph
7(b):
a) an observation function shall detect any kind of errors of the central control or frequency
discrepancies among the technical entities within the perimeter of the group;
b) the FCR provider shall immediately initiate appropriate counter-measures to ensure that the FCR
provision is not significantly negatively impacted by switching to the Decentralised Frequency
Measurements; and
c) the minimum accuracy of the local frequency measurement used as a fallback solution can be reduced
according to the national terms and conditions applicable to the reserve connecting TSO.
9. In case the alternative solution with equivalent effect pursuant to paragraph 7(c) is implemented:
a) if the FCR providing group includes FCR providing units, the local frequency measurements
available for these units pursuant to paragraph 6 may be integrated in the alternative solution;
b) the FCR provider shall demonstrate the effectiveness of the alternative solution with respect to the
decentralised frequency measurements; and
d) the solution may be implemented only if allowed by the national terms and conditions, applicable to
the reserve connecting TSO.
10. For a time period of 4 years after the entry into force of the FCR additional properties, the implementation
of a Centralised FCR Controller non compliant with the requirement set in paragraph 7 is temporary
allowed under the following conditions:
a) To mitigate the risk of misbehavior of technical entities in case of errors of the Centralised FCR
controller (e.g. outage of SCADA, faults of communication lines) and to limit the impact on
frequency, a single non compliant Centralised FCR Controller shall not control a FCR capacity
greater than 1% of the reference incident for Synchronous Area CE according to Article 153(2)(b)(i)
of the SO Regulation .
b) The reserve connecting TSO shall monitor the share of FCR capacity managed by non compliant
Centralised FCR Controllers within the procurement process; in order to ensure operational security
pursuant to Article 154(4) of the SO Regulation, in each LFC Block the amount of FCR capacity
managed by centralised controllers shall not exceed 2.5% of the reference incident for Synchronous
Area CE according to Article 153(2)(b)(i) of the SO Regulation .
After 4 years after the entry into force of the FCR additional properties, Centralised FCR Controllers non
compliant with the requirements set in paragraph 7 are no longer allowed.
Article 4 Publication and implementation of the FCR additional properties proposal
1. The TSOs shall publish the FCR additional properties without undue delay after the approval by the
NRAs of the Synchronous Area CE.
2. The TSOs shall start to implement the FCR additional properties as specified in this proposal immediately
after the approval by all NRAs of the Synchronous Area CE.

3. The transitional period for the implementation of additional properties of FCR by the existing affected
FCR providers shall be two years as of the NRAs’ approval: one year for TSOs to adapt their national
Terms and Conditions and one additional year for FCR providers to implement the FCR additional
properties.
4. Each TSO may recommend to extend the provisions of the Reserve Mode to existing LER FCR providing
units which are connected to the grid by means of inverters: in this case the rules for the application of
requirements to existing units reported in Article 4(1)(b) of RfG apply and the deadline for the
implementation is set accordingly.
Article 5 Language
1. The reference language for these FCR additional properties shall be English. For the avoidance of doubt,
where TSOs need to translate these FCR additional properties into their national language(s), in the
event of inconsistencies between the English version published by TSOs in accordance with Article 8
of the SO Regulation and any version in another language, the relevant TSOs shall, in accordance with
national legislation, provide the relevant national regulatory authorities with an updated translation of
the FCR additional properties.

Annex I – Normal vs Reserve Mode
LER FCR Providing Units (either single or belonging to a LER FCR Providing Group) that are prequalified
for the first time after the entry into force of the methodology and are technically capable (e.g. inverter-
connected assets) shall be able to switch from Normal Mode to Reserve Mode when upper (socmax) or lower
(socmin) state of charge limits are exceeded. These limits are defined by the amount of energy necessary to

All Transmission System Operators of synchronous area Continental Europe are taking into account the
following;

(1) This document is a common proposal developed by all Transmission System Operators of 9
synchronous area CE (hereafter referred to as “TSOs”) regarding the development of the limits on 10
the amount of exchange and sharing of FRR between synchronous areas involving Continental 11
Europe (hereafter referred to as “FRR exchange and sharing limits between synchronous areas”) in 12
accordance with Articles 176(1) and 177(1) of Commission Regulation (EU) 2017/1485 13
establishing a guideline on electricity transmission system operation (hereafter referred to as “SO 14
GL”). This proposal is hereafter referred to as “FRR limits on exchange and sharing between SA 15
proposal”. 16

(2) The FRR exchange and sharing limits between synchronous areas proposal takes into account the 18
general principles and goals set in the SO GL, as well as Regulation (EC) No 714/2009 of the 19
European Parliament and of the Council of 13 July 2009 on conditions for access to the network for 20
cross-border exchanges in electricity (hereafter referred to as “Regulation (EC) No 714/2009”). The 21
goal of the SO GL is the safeguarding of operational security, frequency quality and the efficient 22
use of the interconnected system and resources. For this purpose, it sets requirements for limits on 23
the amount of exchange as well as sharing of aFRR and mFRR between synchronous areas. 24

(3) The FRR limits on exchange and sharing between synchronous areas proposal takes into account 26
the load-frequency control structure of each synchronous area in accordance with Article 139 of SO 27
GL. The operation of load-frequency control processes is based on operational areas, where every 28
area has their individual responsibilities with respect to the LFC structure. The superior structure is 29
the synchronous area in which frequency is the same for the whole area. 30

(4) Article 176(1) and 177(1) of SO GL require all TSOs of each synchronous area to define a method 32
to determine limits for the exchange and sharing of FRR with other synchronous areas in the 33
synchronous area operational agreement. In particular: 34
In accordance with Article 176(1), the method to determine limits for the exchange of FRR 35
shall take into account the operational impact between the synchronous areas; the stability of 36
the FRP of the synchronous area; the ability of the synchronous area to comply with the 37
frequency quality target parameters defined in accordance with Article 127 and the FRCE 38
target parameters defined in accordance with Article 128 of SO GL; and the operational 39
security. 40
In accordance with Article 177(1), the method for determining the limits for sharing of FRR 41
shall take into account: the operational impact between the synchronous areas; the stability of 42
the FRP of the synchronous area; the maximum reduction of FRR that can be taken into 43
account in the FRR dimensioning rules in accordance with Article 157 as a result of the FRR 44
sharing; the ability of the TSOs of the synchronous area to comply with the frequency quality 45
target parameters defined in accordance with Article 127 and the ability of the LFC blocks to 46
comply with the FRCE target parameters defined in accordance with Article 128; and the 47
operational security. 48

(5) The scope of the FRR limits on exchange and sharing between synchronous areas proposal is to 50
establish the limits on the amount of exchange and sharing of FRR between synchronous areas in 51

order to respect operational security. This proposal does not apply to exchange or sharing of FRR 52

(6) According to Article 6(2)(d)(ix) of the SO GL, it requires all TSOs to develop methodologies, 55
conditions and values included in the synchronous area operational agreements in Article 118 56
concerning the definition of limits on the amount of exchange of FRR between synchronous areas 57
in accordance with Article 176(1) SO GL and limits on the amount of sharing FRR between 58
synchronous areas in accordance with Article 177(1) SO GL. The hereafter presented exchange 59
and sharing between synchronous areas proposal shall define the requested methodologies, 60
conditions and values. 61

(7) The FRR limits on exchange and sharing between synchronous areas proposal is to respond to the 63
objective of SO GL pursuant to Article 4(1) to ensure the conditions for maintaining a frequency 64
quality level of all synchronous areas throughout the Union, by permitting exchange and sharing 65
between synchronous areas under certain limits in order to avoid detrimental effect on each 66
synchronous area. 67

(8) In conclusion, the FRR limits on exchange and sharing between synchronous areas proposal 69
contributes to the general objectives of the SO GL to the benefit of all market participants and 70
electricity end consumers. 71

Limits on the amount of exchange and sharing of FRR between synchronous 95
1. A reserve receiving TSO of a LFC block involved in the exchange of aFRR and mFRR between 96
synchronous areas, where synchronous area of Continental Europe is the reserve receiving synchronous 97
area, shall ensure that at least 50 % of its total combined FRR capacity resulting from the aFRR and 98
mFRR dimensioning rules according to the Article 157 of the SO GL and before any reduction due to 99
the sharing of aFRR and mFRR according to Article 157(2) of the SO GL remains located within its 100
LFC block. 101

2. Each TSO of a LFC block shall have the right to perform sharing of aFRR and mFRR with a LFC block 103
in an adjacent synchronous area. In particular: 104
a) where the synchronous area CE is the reserve receiving synchronous area, the sharing of aFRR and 105
mFRR is possible within the limits set by the aFRR and mFRR dimensioning rules in Article 106
157(1), Article 157(2)(j, k) and Article 158 of the SO GL. 107
i. In case of sharing and pursuant to Article 157(2)(j, k) of the SO GL, the reduction of the 108
positive (resp. negative) reserve capacity on FRR of a LFC block shall be limited to the 109
difference, if positive, between the size of the positive (resp. negative) dimensioning incident 110
and the reserve capacity on FRR required to cover the positive (resp. negative) LFC block 111
imbalances during 99 % of the time, based on the historical records referred to Article 112
157(2)(a). Additionaly, the reduction of the positive reserve capacity shall not exceed 30 % of 113
the size of the positive dimensioning incident; 114
b) where synchronous area CE is the reserve connecting synchronous area, no limits shall apply. 115
Article 4 116
Publication and implementation of the FRR limits on exchange and sharing between 117
synchronous areas proposal 118
1. The TSOs shall publish the FRR limits on exchange and sharing between synchronous areas proposal 119
without undue delay after all NRAs have approved the proposal or a decision has been taken by the 120
Agency for the Cooperation of Energy Regulators in accordance with Article 6(8) of the SO GL. 121

2. The TSOs shall implement the FRR limits on exchange and sharing between synchronous areas 123
proposal provided one month after the regulatory authorities have approved the proposal in accordance 124
with Article 6(3) SO GL or a decision has been taken by the Agency in accordance with Article 6(8) 125

shall be English. For the avoidance of doubt, where TSOs need to translate this FRR limits on exchange and 130

Explanatory note
Regarding Article 3: 1
The exchange and sharing of aFRR and mFRR between synchronous areas is a process TSOs do not foresee 2
to be implemented, at least before the implementation of the corresponding balancing platform performing 3
cross-border activation of aFRR and mFRR, according to EB GL. In this sense, TSOs at a first stage are not 4
able to perform security assessment of such exchange or sharing. TSOs’ intention is not to block any kind 5
of initiative in future, this is why the only rules considered for exchange or sharing of aFRR or mFRR, 6
where receiving synchronous area is synchronous area CE, are the same rules applied to LFC Blocks within 7
the synchronous area CE itself: i.e. at least 50% of the FRR capacity resulting from the FRR dimensioning 8
rules shall remain located in the LFC block in case of exchange. For the avoidance of doubt this limit is 9
applicable to the sum of sharing and exchange with TSOs from within and outside the synchronous area. 10
When synchronous area CE is the reserve connecting synchronous area, no limits are foreseen at this stage. 11
This proposal relies on the fact that if such an exchange or sharing of aFRR and mFRR is going to be 12
implemented in the future, specific security analysis studies will be needed in any case. Respective 13
requirements and a corresponding notification process among TSOs as well as procedures for reservation of 14
cross-border transmission capacities will have to be elaborated. Particularly, the ability of the synchronous 15
area to comply with the frequency quality target parameters defined and the FRCE target parameters 16
defined in accordance to Articles 176 and 177 of SO GL shall be considered. In this context additional 17
requirements in terms of limited amount of mFRR might be necessary, leading to amendments of this 18
proposal. In such a case, TSOs’ concerns would be as anticipated as possible with national regulatory 19
authorities. 20

(5) The scope of the RR limits on exchange and sharing between synchronous areas proposal is to 50
establish the limits on the amount of exchange and sharing of RR between synchronous areas in 51
order to respect operational security. 52

(6) According to Article 6(2)(d)(x) of the SO GL, it requires all TSOs to develop methodologies, 54
conditions and values included in the synchronous area operational agreement in Article 118 55
concerning the definition of limits on the amount of exchange of RR between synchronous areas in 56
accordance with Article 178(1) SO GL and limits on the amount of sharing FRR between 57
synchronous areas in accordance with Article 179(1) SO GL. The hereafter presented exchange and 58
sharing between synchronous areas proposal shall define the requested methodologies, conditions 59

(7) The RR limits on exchange and sharing between synchronous areas proposal responds to the 62
objective of SO GL to ensure the conditions for maintaining a frequency quality level of all 63
synchronous areas throughout the Union, by permitting exchange and sharing between synchronous 64
areas under certain limits in order to avoid detrimental effects on each synchronous area. 65

Limits on the amount of exchange and sharing of RR between synchronous areas 93
1. A reserve receiving TSO of a LFC block involved in the exchange of RR between synchronous areas, 94
where synchronous area CE is the reserve receiving synchronous area, shall ensure that at least 50 % of 95
its total RR capacity resulting from the RR dimensioning rules according to the Article 160 of the SO 96
GL and before any reduction due to the sharing of RR according to Article 160(5) of the SO GL, 97
remains located within its LFC block. 98

2. Each TSO of a LFC block shall have the right to perform sharing of RR with a LFC block in an 100
adjacent synchronous area. In particular: 101
a) in case the synchronous area CE is the reserve receiving synchronous area, the sharing of RR is 102
performed within the limits set by the RR dimensioning rules in Article 160(4,5) and in Article 161 103
of the SO GL. 104
b) in case the synchronous area of CE is the reserve connecting synchronous area, no limits shall 105

1. The TSOs shall publish the RR limits on exchange and sharing between synchronous areas proposal 110
without undue delay after all NRAs have approved the proposal or a decision has been taken by the 111
Agency for the Cooperation of Energy Regulators in accordance with Article 6(8) of the SO GL. 112

2. The TSOs shall implement the RR limits on exchange and sharing between synchronous areas proposal 114
provided one month after the regulatory authorities have approved the proposal in accordance with 115
Article 6(3) SO GL or a decision has been taken by the Agency in accordance with Article 6(8) SO GL. 116

Regarding Article 3: 2
The exchange and sharing of RR between synchronous areas is a process TSOs do not foresee to be 3
implemented at least before the implementation of the corresponding balancing platform performing cross-4
border activation of RR according to EB GL. In this sense TSOs, at a first stage are not able to perform 5
security assessment of such exchange or sharing. TSOs’ intention is not to block any kind of initiative in 6
future, this is why the only rules considered for exchange or sharing of RR where receiving synchronous 7
area is synchronous area CE are the same rules applied to LFC blocks within the synchronous area CE 8
itself: i.e. at least 50% of the RR capacity resulting from the RR dimensioning rules shall remain located in 9
the LFC block in case of exchange. 10
When synchronous area CE is the reserve connecting synchronous area, no limits are foreseen at this stage. 11
This proposal relies on the fact that if such an exchange or sharing of RR is going to be implemented in the 12
future, specific security analysis studies will be needed in any case and respective requirements and a 13
corresponding notification process among TSOs as well as procedures for reservation of cross-border 14
transmission capacities will have to be elaborated. Particularly, the ability of the synchronous area to 15
comply with the frequency quality target parameters defined and the FRCE target parameters defined in 16
accordance to articles 178 and 179 of SO GL shall be considered. In this context, additional requirements in 17
terms of limited amount of RR might be necessary leading to amendments of this proposal. In such a case, 18
TSOs’ concerns would be as anticipated as possible with national regulatory authorities. 19

Mandri-Euroopa sünkroonala põhivõrguettevõtjate metoodikate, vastavalt Komisjoni
määrus (EL) 2017/1485 artiklile 118 ning Komisjoni määrus (EL) 2017/2195 artikkel 50
lõikele 3 ja artikkel 51 lõikele 1, kooskõlastamise kohta
1. Haldusmenetluse alustamine
Elektrituruseaduse (edaspidi ELTS) § 93 lõige 6 punkti 1 kohaselt kontrollib Konkurentsiamet
Euroopa Parlamendi ja nõukogu määruses (EL) 2019/943 ning selle alusel kehtestatud
komisjoni määrustes sätestatud tingimuste täitmist.
ELTS § 93 lõige 6 punkti 6 kohaselt Konkurentsiamet väljastab ELTS-is sätestatud juhul
kooskõlastamise otsuseid.
Euroopa Komisjoni Määrusega (EL) 2017/1485 kehtestati elektri ülekandesüsteemi
käidueeskiri (edaspidi ka SOGL või SOGL määrus)1.
SOGL artikkel 6 lõike 1 kohaselt kiidab iga reguleeriv asutus või vajaduse korral koostööamet
heaks tingimused või meetodid, mis põhivõrguettevõtjad on lõigete 2 ja 3 kohaselt koosatanud.
Liikmesriigi määratud asutus kiidab heaks lõike 4 kohased põhivõrguettevõtjate väljatöötatud
tingimused või metoodika. Kui liikmesriik ei ole sätestanud teisiti, on määratud asutus
reguleeriv asutus. Enne tingimuste ja meetodite heakskiitmist vaatab reguleeriv asutus,
koostööamet või määratud asutus pärast asjaomaste põhivõrguettevõtjatega konsulteerimist
vajaduse korral ettepanekud läbi, et tagada nende kooskõla käesoleva määruse eesmärgiga ning
aidata kaasa turgude lõimimisele, mittediskrimineerimisele, tõhusale konkurentsile ja turu
nõuetekohasele toimimisele.
SOGL artikkel 6 lõige 3 punkti d kohaselt peavad kõigi vaatlusaluse piirkonna reguleerivate
asutuste heakskiidu saama artikkel 118 kohased sünkroonala talitluslepingutes sisalduvad
meetodid, tingimused ja suuruste väärtused vastavalt järgmisele:
i) sageduse kvaliteedi määramise näitajad ja sageduse kvaliteedi sihtnäitaja vastavalt
artiklile 127;
ii) sageduse hoidmise reservi (ingl frequency containment reserve ehk FCR) suuruse määramise
eeskirjad vastavalt artiklile 153;
iii) FCRi täiendavad omadused kooskõlas artikkel 154 lõikega 2;
iv) Suurbritannia (GB) sünkroonala ja Iirimaa/Põhja-Iirimaa (IE/NI) sünkroonala jaoks
meetmed energiamahutite taastamiseks vastavalt artikkel 156 lõige 6 punktile b;

v) Mandri-Euroopa sünkroonala ja Põhjamaade sünkroonala jaoks vähim käivitamisaeg, mille
peavad tagama FCRi pakkujad vastavalt artikkel 156 lõikele 10;
vi) Mandri-Euroopa sünkroonala ja Põhjamaade sünkroonala jaoks eeldused ja meetodid
tasuvusanalüüsi tegemiseks vastavalt artikkel 156 lõikele 11;
vii) muude sünkroonalade jaoks, välja arvatud Mandri-Euroopa, kui see on asjakohane,
piirnormid FCRi vahetamiseks põhivõrguettevõtjate vahel vastavalt artikkel 163 lõikele 2;
viii) GB sünkroonala ja IE/NI sünkroonala jaoks metoodika sünkroonalade vahel jagatava FCRi
reservide vähimpakkumise normi kindlaksmääramiseks vastavalt artikkel 174 lõige 2 punktile
b;
ix) piirnormid sünkroonalade vahel vahetatava sageduse taastamise reservi (ingl frequency
restoration reserve ehk FRR) kindlaksmääramiseks vastavalt artikkel 176 lõikele 1 ning
piirnormid sünkroonalade vahel jagatava FRRi kindlaksmääramiseks vastavalt artikkel 177
lõikele 1;
x) piirnormid sünkroonalade vahel vahetatava asendusreservi (ingl replacement reserve ehk
RR) kindlaksmääramiseks vastavalt artikkel 178 lõikele 1 ning piirnormid sünkroonalade vahel
jagatava RRi kindlaksmääramiseks vastavalt artikkel 179 lõikele 1.
SOGL artikkel 6 lõike 1 kohaselt, iga reguleeriv asutus või vajaduse korral koostööamet kiidab
heaks tingimused või meetodid, mis põhivõrguettevõtjad on lõigete 2 ja 3 kohaselt koostanud.
Liikmesriigi määratud asutus kiidab heaks lõike 4 kohased põhivõrguettevõtjate väljatöötatud
tingimused või metoodika. Kui liikmesriik ei ole sätestanud teisiti, on määratud asutus
reguleeriv asutus. Enne tingimuste ja meetodite heakskiitmist vaatab reguleeriv asutus,
koostööamet või määratud asutus pärast asjaomaste põhivõrguettevõtjatega konsulteerimist
vajaduse korral ettepanekud läbi, et tagada nende kooskõla käesoleva määruse eesmärgiga ning
aidata kaasa turgude lõimimisele, mittediskrimineerimisele, tõhusale konkurentsile ja turu
nõuetekohasele toimimisele.
SOGL artikkel 6 lõike 7 kohaselt, kui tingimuste või metoodika heakskiitmiseks vastavalt
lõikele 3 või nende muutmiseks vastavalt artiklile 7 on vaja rohkem kui ühe reguleeriva asutuse
otsust vastavalt lõikele 3, peavad pädevad reguleerivad asutused kokkuleppele jõudmiseks
omavahel konsulteerima, tegema tihedat koostööd ja kooskõlastama oma tegevuse. Kui
koostööamet esitab oma arvamuse, võtavad pädevad reguleerivad asutused seda arvesse.
Reguleerivad asutused või vajaduse korral koostööamet teevad lõigete 2 ja 3 kohaselt esitatud
tingimuste ja meetodite kohta otsuse kuue kuu jooksul pärast seda, kui koostööamet või
reguleeriv asutus või asjakohasel juhul viimane asjaomane reguleeriv asutus on tingimused või
meetodid kätte saanud. Ajavahemik algab järgmisel päeval pärast seda, kui ettepanek esitati
koostööametile vastavalt lõikele 2 või viimasele asjaomasele reguleerivale asutusele vastavalt
lõikele 3.
SOGL artikkel 6 lõike 8 kohaselt, kui reguleerivad asutused ei ole jõudnud kokkuleppele lõikes
7 osutatud ajavahemiku jooksul või nende ühise taotluse korral või koostööameti taotlusel
vastavalt määruse (EL) 2019/942 artikkel 5 lõike 3 kolmandale lõigule, võtab koostööamet
kuue kuu jooksul vastavalt määruse (EL) 2019/942 artikkel 5 lõikele 3 ja artikkel 6 lõike 10
teisele lõigule vastu otsuse tingimuste või meetodite ettepanekute kohta.
SOGL artikkel 7 lõike 1 kohaselt, kui koostööamet nõuab või kõik pädevad reguleerivad
asutused ühiselt nõuavad vastavalt artikkel 6 lõigete 2 ja 3 kohaselt esitatud tingimuste või
meetodite muutmist nende heakskiitmiseks, esitavad asjaomased põhivõrguettevõtjad
muudetud tingimuste või meetodite ettepaneku heakskiitmiseks kahe kuu jooksul pärast
koostööameti või reguleerivate asutuste sellekohast taotlust. Koostööamet teeb või pädevad

reguleerivad asutused teevad muudetud tingimuste või meetodite kohta otsuse kahe kuu jooksul
pärast nende esitamist.
SOGL artikkel 7 lõike 3 kohaselt, kui pädevad reguleerivad asutused ei ole jõudnud
kokkuleppele artikkel 6 lõigetes 2 ja 3 osutatud tingimuste või meetodite osas kahe kuu pikkuse
tähtaja jooksul või nende ühise taotluse korral või koostööameti taotlusel vastavalt määruse
(EL) 2019/942 artikkel 5 lõike 3 kolmandale lõigule, võtab koostööamet kuue kuu jooksul
vastavalt määruse (EL) 2019/942 artikkel 5 lõikele 3 ja artikkel 6 lõike 10 teisele lõigule vastu
otsuse muudetud tingimuste või meetodite kohta. Kui asjaomased põhivõrguettevõtjad ei esita
ettepanekut muudetud tingimuste või meetodite kohta, kohaldatakse artikkel 5 lõikes 9
kirjeldatud menetlust.
Euroopa Komisjoni Määrusega (EL) 2017/2195 kehtestati elektrisüsteemi tasakaalustamise
eeskiri (EBGL)2.
EBGL artikkel 5 lõige 3 punkti j kohaselt peavad kõigi asjaomase piirkonna reguleerivate
asutuste heakskiidu saama, sellise geograafilise piirkonna jaoks, mis hõlmab kõiki
põhivõrguettevõtjaid, kes vahetavad kavatsuslikult energiat sünkroonala piires,
põhivõrguettevõtjate omavahelise arveldamise eeskirjad kavandatud energia vahetamisel
vastavalt artikkel 50 lõikele 3.
EBGL artikkel 5 lõige 3 punkti l kohaselt peavad kõigi asjaomase piirkonna reguleerivate
asutuste heakskiidu saama iga sünkroonala jaoks põhivõrguettevõtjate omavahelise
arveldamise eeskirjad kavatsematu energiavahetamise kohta vastavalt artikkel 51 lõikele 1.
EBGL artikkel 5 lõike 6 kohaselt, kui tingimuste või metoodika heakskiitmiseks vastavalt
käesoleva artikli lõikele 3 või nende muutmiseks vastavalt artiklile 6 on vaja rohkem kui ühe
reguleeriva asutuse otsust, peavad asjaomased reguleerivad asutused kokkuleppele jõudmiseks
omavahel konsulteerima, tegema tihedat koostööd ja kooskõlastama oma tegevuse. Kui
koostööamet esitab oma arvamuse, võtavad asjaomased reguleerivad asutused seda arvesse.
Reguleerivad asutused või vajaduse korral koostööamet peavad lõigete 2, 3 ja 4 kohaselt
esitatud tingimuste ja meetodite kohta tegema otsused kuue kuu jooksul pärast seda, kui
koostööamet või asjaomane reguleeriv asutus või asjakohasel juhul viimane reguleeriv asutus
on tingimused või meetodid kätte saanud. Ajavahemik algab järgmisel päeval pärast seda, kui
ettepanek esitati koostööametile vastavalt lõikele 2, viimasele asjaomasele reguleerivale
asutusele vastavalt lõikele 3 või vajaduse korral asjaomasele reguleerivale asutusele vastavalt

EBGL artikkel 6 lõike 1 kohaselt, kui koostööamet nõuab, kõik asjaomased reguleerivad
asutused ühiselt nõuavad või asjaomane reguleeriv asutus nõuab artikkel 5 lõigete 2, 3 ja 4
kohaselt esitatud tingimuste või meetodite muutmist nende heakskiitmiseks, peavad
asjaomased põhivõrguettevõtjad esitama muudetud tingimuste või meetodite ettepaneku
heakskiitmiseks kahe kuu jooksul pärast koostööameti või asjaomaste reguleerivate asutuste
taotlust. Koostööamet või asjaomased reguleerivad asutused teevad muudetud tingimuste või

meetodite kohta otsuse kahe kuu jooksul pärast nende esitamist.
EBGL artikkel 6 lõike 2 kohaselt, kui asjaomased reguleerivad asutused ei ole jõudnud
tingimuste või meetodite osas kokkuleppele kahe kuu pikkuse tähtaja jooksul või nende ühise
taotluse korral või koostööameti taotlusel vastavalt määruse (EL) 2019/942 artikkel 5 lõike 3
kolmandale lõigule, võtab koostööamet kuue kuu jooksul vastavalt määruse (EL) 2019/942
artikkel 5 lõikele 3 ja artikkel 6 lõike 10 teisele lõigule vastu otsuse muudetud tingimuste või
meetodite kohta. Kui asjaomased põhivõrguettevõtjad ei esita ettepanekut muudetud tingimuste
või meetodite kohta, kohaldatakse artiklis 4 kirjeldatud menetlust.
Vastavalt SOGL artiklile 118 ning EBGL artikkel 50 lõikele 3 ja artikkel 51 lõikele 1, on kõik
Mandri-Euroopa sünkroonala põhivõrguettevõtjad koostanud asjaomastele riiklikele
reguleerivatele asutustele ettepaneku järgmiste metoodikate kohta (edaspidi Metoodikad):
1. FCRi suuruse määramise eeskirjad vastavalt SOGL artikkel 153 lõikele 2 (Lisa 1)
2. FCRi täiendavad omadused kooskõlas SOGL artikkel 154 lõikega 2 (Lisa 2)
3. Piirnormid sünkroonalade vahel vahetatava FRRi kindlaksmääramiseks vastavalt
SOGL artikkel 176 lõikele 1 ning piirnormid sünkroonalade vahel jagatava FRRi
kindlaksmääramiseks vastavalt SOGL artikkel 177 lõikele 1 (Lisa 3)
4. Piirnormid sünkroonalade vahel vahetatava RRi kindlaksmääramiseks vastavalt
SOGL artikkel 178 lõikele 1 ning piirnormid sünkroonala vahel jagatava RRi
kindlaksmääramiseks vastavalt SOGL artikkel 179 lõikele 1 (Lisa 4)
5. Sellise geograafilise piirkonna jaoks, mis hõlmab kõiki põhivõrguettevõtjaid, kes
vahetavad kavatsuslikult energiat sünkroonala piires, põhivõrguettevõtjate vahelise
arveldamise eeskirjad kavandatud energia vahetamisel vastavalt EBGL artikkel 50
lõikele 3 (Lisa 5)
6. Iga sünkroonala jaoks põhivõrguettevõtjate vahelise arveldamise eeskirjad
kavatsematu energiavahetamise kohta vastavalt EBGL artikkel 51 lõikele 1 (Lisa 6)
19.09.2024 esitas Elering AS (edaspidi Elering) Konkurentsiametile kooskõlastamiseks kõikide
Mandri-Euroopa sünkroonala põhivõrguettevõtjate ühised Metoodikate ettepanekud.

3. Asjaolud ja menetluse käik
19.09.2024 esitatud Metoodikate kooskõlastustaotluses selgitab Elering, et Metoodikad on juba
varasemalt heaks kiidetud Mandri-Euroopa sünkroonala riikide reguleerivate asutuste poolt.
Seoses asjaoluga, et Eesti elektrisüsteem talitleb Venemaa ja Valgevene (IPS/UPS)
sünkroonalas, ei ole Metoodikad Eesti elektrisüsteemile rakendatavad. Samas, seoses Eesti ja
teiste Balti riikide elektrisüsteemide eelseisva sünkroniseerimisega on üheks sünkroniseerimise
eelduseks nende Metoodikate kooskõlastamine Eesti ja teiste Balti riikide reguleerivate asutuste
poolt ning Metoodikate rakendamine Balti põhivõrguettevõtjate poolt alates Mandri-Euroopa
sünkroonalaga sünkroniseerimise hetkest 09.02.2025.
02.10.2024 pöördus Konkurentsiamet Läti ja Leedu riiklike reguleerivate asutuste poole seoses
Metoodikate kooskõlastusprotsessiga.
02.10.2024 vastas Leedu riiklik reguleeriv asutus Konkurentsiametile, tuues vastuskirjas välja,
et Leedu riiklik reguleeriv asutus on Metoodikad kooskõlastanud 29.08.2024.

02.10.2024 vastas Läti riiklik reguleeriv asutus Konkurentsiametile, selgitades vastuskirjas, et
ka Läti reguleeriv asutus kavatseb Metoodikad kooskõlastada.
4. Konkurentsiameti seisukoht
Võttes arvesse asjaolu, et Metoodikad on juba varasemalt heaks kiidetud Mandri-Euroopa
sünkroonala riikide riiklike reguleerivate asutuste poolt ning seoses asjaoluga, et üheks
Baltikumi sünkroniseerimise eelduseks Mandri-Euroopa sünkroonalaga on Metoodikate
kooskõlastamine Eesti ja teiste Balti riikide riiklike reguleerivate asutuste poolt ja Metoodikate
rakendamine Balti põhivõrguettevõtjate poolt alates Mandri-Euroopa sünkroonalaga
sünkroniseerimise hetkest, tervitab Konkurentsiamet Metoodikate ettepanekut.
Vastavalt SOGL artikkel 6 lõikes 7 ja EBGL artikkel 5 lõikes 6 sätestatule on Balti riiklikud
reguleerivad asutused Metoodikate ettepaneku osas kokkuleppele jõudmiseks konsulteerinud,
teinud tihedat koostööd ning kooskõlastanud oma tegevust. Balti riiklikud reguleerivad
asutused on seisukohal, et Metoodikate ettepanek vastab SOGL ja EBGL sätetele ning et seda
ettepanekut on võimalik kõikidel asjaomastel reguleerivatel asutustel siseriiklikult
kooskõlastada. Asjaomased reguleerivad asutused annavad selle kohta välja siseriiklikud
otsused.
Kokkuvõte
Konkurentsiamet töötas läbi 19.09.2024 Eleringi poolt ametile kooskõlastamiseks esitatud
kõikide Mandri-Euroopa sünkroonala põhivõrguettevõtjate Metoodikate ettepanekud ning asub
seisukohale, et nimetatud Metoodikad arvestavad kehtivast seadusandlusest tulenevate
alusetega ning ei ole vastuolus SOGL-st ja EBGL-st tuleneva regulatsiooniga.
SOGL artikli 8 kohaselt tingimuste või meetodite väljatöötamise eest vastutavad
põhivõrguettevõtjad peavad need internetis avaldama pärast pädevatelt reguleerivatelt
asutustelt saadud heakskiitu või, kui heakskiitu ei ole vaja, siis pärast nende tingimuste või
meetodite väljatöötamist, välja arvatud juhul, kui selline teave on artikli 12 kohaselt
konfidentsiaalne.
EBGL artikkel 7 kohaselt tingimuste või meetodite väljatöötamise eest vastutavad
põhivõrguettevõtjad peavad need internetis avaldama pärast asjaomastelt reguleerivatelt
asutustelt saadud heakskiitu või, kui heakskiitu ei ole vaja, siis pärast nende tingimuste või
meetodite väljatöötamist, välja arvatud juhul, kui selline teave on artikli 11 kohaselt
konfidentsiaalne.
Arvestades eeltoodut ja tuginedes ELTS § 93 lõige 6 punktile 6, SOGL artikkel 6 lõige 3
punktile d) ning EBGL artikkel 5 lõige 3 punktidele j) ja l)
otsustan:
kooskõlastada Elering AS poolt Konkurentsiametile esitatud kõikide Mandri-Euroopa
sünkroonala põhivõrguettevõtjate metoodikad, vastavalt Komisjoni määrus (EL) 2017/1485
artiklile 118 ning Komisjoni määrus (EL) 2017/2195 artikkel 50 lõikele 3 ja artikkel 51 lõikele
1.
Käesoleva otsusega mittenõustumise korral on õigus esitada kaebus otsuse tühistamiseks
Tallinna Halduskohtule. Kaebuse halduskohtule võib esitada 30 päeva jooksul arvates

käesoleva otsuse teatavaks tegemisest.
