MARRAKESH Notification No. 100 MARRAKESH TREATY TO FACILITATE ACCESS TO PUBLISHED WORKS FOR PERSONS WHO ARE BLIND, VISUALLY IMPAIRED OR OTHERWISE PRINT DISABLED Accession by Georgia The Director General of the World Intellectual Property Organization (WIPO) presents his compliments and has the honor to notify the deposit by the Government of Georgia, on November 26, 2024, of its instrument of accession to the Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually Impaired or Otherwise Print Disabled, adopted at Marrakesh on June 27, 2013. The instrument was accompanied by the following declaration:
– “In accordance with paragraph 4 of Article 4 of the Treaty, the limitations and exceptions in Georgia’s copyright law shall be confined to works which, in the particular accessible format, cannot be obtained commercially under reasonable terms for beneficiary persons within the Georgian market.”
The Treaty will enter into force, with respect to Georgia, on February 26, 2025. The list of the States and the intergovernmental organization party to the Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually Impaired or Otherwise Print Disabled (status on November 26, 2024) is attached to this Notification.

1 The Republic of Armenia declares that “[t]he declaration of the Republic of Azerbaijan [as contained in footnote 3], contains unsubstantiated and baseless allegations against the Republic of Armenia and distorts the essence of the Nagorno-Karabakh conflict which was triggered and sustained by the use of force by
Azerbaijan against peaceful demands of the people of Nagorno-Karabakh (Republic of Artsakh) for human rights and self-determination.”

2 With the declaration under Article 4(4). 3 The Republic of Azerbaijan declares that the provisions of the Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually
Impaired or Otherwise Print Disabled shall not be applied by the Republic of Azerbaijan in respect of the Republic of Armenia in the future; and The Republic of Azerbaijan declares that it is unable to guarantee the implementation of the provisions of the Marrakesh Treaty to Facilitated Access to
Published Works for Persons Who Are Blind, Visually Impaired or Otherwise Print Disabled in its territories occupied by the Republic of Armenia
(the Nagorno-Karabakh region of the Republic of Azerbaijan and its seven districts surrounding that region) until the liberation of those territories from the occupation and complete elimination of the consequences of that occupation.
4 The Treaty applies to Hong Kong (China) with the declaration under Article 4(4). 5 The Treaty does not apply to Macao (China). 6 The accession by New Zealand shall extend to Tokelau. 7 Ratification in respect of the United Kingdom, and the Bailiwick of Guernsey, the Bailiwick of Jersey, Gibraltar and the Isle of Man.
Notification MARRAKECH n°100 TRAITÉ DE MARRAKECH VISANT À FACILITER L’ACCÈS DES AVEUGLES, DES DÉFICIENTS VISUELS ET DES PERSONNES AYANT D’AUTRES DIFFICULTÉS DE LECTURE DES TEXTES IMPRIMÉS AUX ŒUVRES PUBLIÉES Adhésion de la Géorgie Le Directeur général de l’Organisation Mondiale de la Propriété Intellectuelle (OMPI) présente ses compliments et a l’honneur de notifier le dépôt par le Gouvernement de la Géorgie, le 26 novembre 2024, de son instrument d’adhésion au Traité de Marrakech visant à faciliter l’accès des aveugles, des déficients visuels et des personnes ayant d’autres difficultés de lecture des textes imprimés aux œuvres publiées, adopté à Marrakech le 27 juin 2013. L’instrument était accompagné de la déclaration suivante :
– “Conformément au paragraphe 4 de l’article 4 du traité, les limitations et exceptions prévues dans la législation géorgienne relative au droit d’auteur se limitent aux œuvres qui ne peuvent pas être obtenues dans le format accessible considéré dans le commerce à des conditions raisonnables pour les personnes bénéficiaires sur le marché géorgien.”
Le Traité entrera en vigueur, à l’égard de la Géorgie, le 26 février 2025. La liste des États et de l’organisation intergouvernementale parties au Traité de Marrakech visant à faciliter l’accès des aveugles, des déficients visuels et des personnes ayant d’autres difficultés de lecture des textes imprimés aux œuvres publiées (situation au 26 novembre 2024) est jointe à la présente notification.

3 La République d’Azerbaïdjan déclare que les provisions du Traité de Marrakech visant à faciliter l’accès des aveugles, des déficients visuels et des personnes ayant d’autres difficultés de lecture des textes imprimés aux œuvres publiées ne seront pas appliquées par la République d’Azerbaïdjan à l’égard de la
République d’Arménie dans l’avenir; et
La République d’Azerbaïdjan déclare qu’elle n’est pas en mesure de garantir la mise en œuvre des dispositions du Traité de Marrakech visant à faciliter l’accès des aveugles, des déficients visuels et des personnes ayant d’autres difficultés de lecture des textes imprimés aux œuvres publiées sur ses territoires occupés
par la République d’Arménie (la région du Nagorno-Karabakh de la République d’Azerbaïdjan et les sept districts entourant cette région) jusqu’à la libération
de ces territoires et l’élimination totale des conséquences de cette occupation.

2 With the declaration under Article 4(4). 3 The Republic of Azerbaijan declares that the provisions of the Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually
Impaired or Otherwise Print Disabled shall not be applied by the Republic of Azerbaijan in respect of the Republic of Armenia in the future; and The Republic of Azerbaijan declares that it is unable to guarantee the implementation of the provisions of the Marrakesh Treaty to Facilitated Access to
Published Works for Persons Who Are Blind, Visually Impaired or Otherwise Print Disabled in its territories occupied by the Republic of Armenia
(the Nagorno-Karabakh region of the Republic of Azerbaijan and its seven districts surrounding that region) until the liberation of those territories from the occupation and complete elimination of the consequences of that occupation.
4 The Treaty applies to Hong Kong (China) with the declaration under Article 4(4). 5 The Treaty does not apply to Macao (China). 6 The accession by New Zealand shall extend to Tokelau. 7 Ratification in respect of the United Kingdom, and the Bailiwick of Guernsey, the Bailiwick of Jersey, Gibraltar and the Isle of Man.
