Please note that the amendments to the Tobacco Act (§ 10⁴) and the Statutory Fees Act (§ 298⁴) entered into force on 01.01.2025.

§ 298⁴  of the Statutory Fees Act stipulates:

(1) A statutory fee of 5000 euros is paid for consideration of a notification of tobacco products and products related to tobacco products.

(2) A statutory fee of 740 euros is paid for amendment of a notification of tobacco products and products related to tobacco products.

(3) A statutory fee of 100 euros per year is paid for publication and storage of a notification of tobacco products and products related to tobacco products.

In accordance with the Tobacco Act, products containing e-liquids are subject to the following fees:

1) the fee for the assessment of one substance in e-liquid is 240 euros;

2) the fee for the assessment of emissions from e-liquids of electronic cigarettes and refill containers is 965 euros.

Note the fee for the assessment of one substance in e-liquid applies to each substance in e‑liquid, including propylene glycol, glycerol, and nicotine/nicotine salt.

In accordance with clause 5 of subsection 2 of § 8¹ of the Tobacco Act, the use of flavourings other than tobacco and menthol is not allowed in e-cigarettes and e-liquids.

The information submitted on the basis of § 10² (1) of the Tobacco Act is published on the website of the Health Board after verifying the compliance of the notification with requirements and assessing the submitted information. A statutory fee of 100 euros per year must be paid for publication and storage of a notification of tobacco products and products related to tobacco products in accordance with § 298⁴ (3) of the Statutory Fees Act. The need to protect trade secrets related to the composition of products is taken duly into account when making that information publicly available.
