Yes, e-cigarettes, e-liquids and devices must be notified through the EU CEG portal 6 months before the placing products on the market.
The assessment of the notification will begin after the statutory fee has been received in the account of the Ministry of Finance.
If a product contains a substance that does not comply with the Tobacco Act and the composition of the product is not changed, the notification may be withdrawn and part of the statutory fee is refunded in accordance with the § 15 of the Statutory Fees Act:
§ 15. Statutory fees subject to refund
(2) Procedural costs arising from consideration of the application may be deducted from the amount subject to refund unless otherwise provided by law. Where the exact amount of procedural costs cannot be determined, 25 per cent of the statutory fee prescribed for the act is deducted as procedural costs upon refund of the statutory fee.
The statutory fee is paid for each notification per EC-ID not under the same notification for each presentation (i.e. the notification contains more than one brand name and brand sub type name).
The fee for the assessment of 240 euros is for each ingredient in an e-liquid, including propylene glycol, glycerol, nicotine/nicotine salt. The Health Board will assess the toxicological data uploaded on the EU CEG portal, including attached files.
The fee for the assessment of emissions of 965 euros is a fixed fee. The Health Board will assess the data uploaded on the EU CEG portal, including the attached emission test.
The Health Board will send an invoice for these fees.

Hello,
Can you please help a little bit?
So still we need to submit products 6 months before the placing product on the market?
Fee is paid before product will be checked?
If product will contain one substance which is not allowed, what happens then?
Each presentation for the product also costs extra fee?
Please explain:
1) the fee for the assessment of one substance in e-liquid is 240 euros;
2) the fee for the assessment of emissions from e-liquids of electronic cigarettes and refill containers is 965 euros.
If we already have all the toxicological information about the each substance we still need to pay 240 eur?
For emissions assesment - what it means? We need to provide Health Board with the samples to make
emission laboratory test?

Informeerime Teid tubakaseaduse ja riigilõivuseaduse muudatustest, mis jõustuvad 01.01.2025.
1. Tubakaseaduse § 104 sätestab järgmist:
§ 104. Riigilõiv teate läbivaatamise, muutmise ning avaldamise ja hoidmise eest ning tasud teabe hindamise eest
(1) Käesoleva seaduse §-des 10–103 nimetatud teate läbivaatamise ja muutmise eest tasub teate esitaja enne teate esitamist riigilõivu riigilõivuseaduses sätestatud määras.
(2) Käesoleva seaduse §-des 10–103 nimetatud teate avaldamise ja hoidmise eest tasub teate esitaja hiljemalt iga aasta 31. märtsiks riigilõivu riigilõivuseaduses sätestatud määras.
(3) Käesoleva seaduse §-des 10–103 nimetatud teate esitamisel tasub teate esitaja selles sisalduvate andmete hindamise eest Terviseametile järgmiselt:
- 1. e-vedelikus ühe aine hindamise tasu on 240 euro;
- 2. elektrooniliste sigarettide ja nende täitepakendite e-vedelikest eralduvate ainete hindamise tasu on 965 eurot.
(4) Tubakatoote ja tubakatootega seonduva toote müügimahtude teate esitamisel tasub teate esitaja Terviseametile teate hindamise eest 240 eurot.
Juhime Teie tähelepanu, et e-vedelikus ühe aine hindamise tasu on e-vedeliku iga koostisaine hindamise eest, kaasa arvatud propüleenglükool, glütserool, nikotiin/nikotiinisool.
Juhime Teie tähelepanu, et tubakaseaduse § 81 kohaselt ei ole elektroonilistes sigarettides ja e-vedelikes lubatud maitsed, välja arvatud tubaka ja mentooli maitse ning lõhn.
2. Riigilõivuseadus § 2984 sätestab järgmist:
§ 2984. Tubakatootest ja tubakatootega seonduvast tootest teavitamine
(1) Tubakatoote ja tubakatootega seonduva toote teate läbivaatamise eest tasutakse riigilõivu 5000 eurot.
(2) Tubakatoote ja tubakatootega seonduva toote teate muudatuse eest tasutakse riigilõivu 740 eurot.
(3) Tubakatoote ja tubakatootega seonduva toote teate avaldamise ja hoidmise eest tasutakse aastas riigilõivu 100 eurot.
3. Tubakaseaduse muudatused puudutavad ka tubakatoote ja tubakatootega seonduva toote müügimahtude teavitamist.
§ 10 (6) Tubakatooteid võõrandamiseks Eestisse toov või Eestis tubakatooteid tootev ettevõtja teatab iga aasta 31. märtsiks Terviseametile andmete esitamiseks ettenähtud ühisportaali kaudu tubakatoodete ja tubakatootega seonduvate toodete müügikogused tootemarkide ja -liikide kaupa eelmise kalendriaasta kohta.
§ 102 (2) Elektroonilisi sigarette või nende täitepakendeid või elektroonilisi sigarette ja nende täitepakendeid võõrandamiseks Eestisse toov või neid Eestis tootev ettevõtja on kohustatud esitama Terviseametile 31. märtsiks eelmise kalendriaasta kohta järgmised andmed:
- 1. toodete müügimahud tootemarkide ja -liikide kaupa;
- 2. teave eri tarbijarühmade, sealhulgas noorte, mittesuitsetajate ja tavakasutajate toote-eelistuste kohta;
- 3. kõnealuste toodete müügiviisid;
- 4. kokkuvõte mis tahes turu-uuringu kohta eespool nimetatud küsimustes ning selle tõlge inglise keelde.
4. Tubakaseaduse § 10 (4), § 101 (3), § 102 (7) ja § 103 (3) sätestavad, et Terviseamet avaldab esitatud andmed oma veebilehel pärast teate nõuetele vastavuse kontrollimist ja esitatud teabe hindamist. Terviseamet ei avalda teadet oma veebilehel, kui see ei vasta tubakaseaduse nõuetele ning tasumata on ettenähtud riigilõivud või tasud. Terviseamet ei avalda ja avaldatud, ent nõuetele mittevastavad teated kustutatakse.

Dear Sir/Madam,
This is to inform you about upcoming changes in legislation from 1st January 2025.
1. § 104 of the Tobacco Act is amended, as follows
§ 104. State fee for review, amendment, publication and storage of notification, and fees for assessment of information
- 1. The person submitting a notification specified in §§ 10–103 of this Act pays a state fee for the review and amendment of the notification according to the rate provided in the State Fees Act before submitting the notification.
- 2. The person submitting a notification specified in §§ 10–103 of this Act pays a state fee for the publication and storage of the notification according to the rate provided in the State Fees Act by 31 March each year.
- 3. Upon submission of a notification specified in §§ 10–103 of this Act, the person submitting the notification pays the Health Board for the assessment of the information contained therein as follows:
1) the fee for the assessment of one substance in e-liquid is 240 euros;
2) the fee for the assessment of emissions from e-liquids of electronic cigarettes and refill containers is 965 euros.
- 4. Upon submission of a notification on the sales volumes of tobacco products and products related to tobacco products, the person submitting the notification pays the Health Board 240 euros for the assessment of the notification.
Please, note, the fee for the assessment of one substance in e-liquid applies to each substance in an e‑liquid, including propylene glycol, glycerol, nicotine/nicotine salt.
Please, note, no flavourings, except for the taste and smell of tobacco and menthol are permitted in e‑cigarettes and e-liquids accordance with § 81 of The Tobacco Act.
2. Please, find below unofficial translation of the amendments in the State Fees Act.
§ 2984 of the State Fees Act stipulates
(1) State fee of 5000 euros shall be paid before verification of the compliance of a notification of a tobacco product and a tobacco product related product (incl. e-cigarettes).
(2) State fee of 740 euros shall be paid for amendment of the notification of a tobacco product and a tobacco product related product.
(3) State fee of 100 euros shall be paid annually for the publication and maintaining of a notification of a tobacco product and a tobacco product related product.
3. The Tobacco Act sets out amended rules on notification of tobacco products and products related to tobacco products, as follows
§ 10 (6) Undertakings importing tobacco products into Estonia for transfer or undertakings manufacturing tobacco products in Estonia must notify the Health Board of the sales volumes of tobacco products and products related to tobacco products per brand and type through the common entry gate by 31 March each year.
§ 102 (2) Undertakings importing electronic cigarettes or refill containers or electronic cigarettes and refill containers into Estonia for transfer or undertakings manufacturing these in Estonia are required to submit to the Health Board by 31 March the following information concerning the previous calendar year:
1) data on sales volumes, by brand name and type of the product;2) information on the product preferences of various consumer groups, including young people, non-smokers and current users;
3) the mode of sale of the products concerned;
4) executive summaries of any market surveys carried out in respect of the above, including an English translation thereof.
4. Furthermore, the amendment of Tobacco Act stipulates that notifications that do not comply with the requirements of this Act are not published on the website of the Health Boards, and notifications that have been published but do not comply with the requirements are deleted.
