Seminar Venue: Hotel Belle-Vue, 5 Avenue Marie Thérèse, 2132 Luxembourg
Objectives: The EU Succession Regulation sets out a unitary regime applicable to cross border succession cases to as it deals with the whole estate and does not make a differentiation between types of property: moveable and immoveable property. At the same time the Regulation provides uniform rules regarding jurisdiction, applicable law, recognition and enforcement, also establishing the European Certificate of Succession. The objective of the seminar is to provide an update on the case law of the CJEU in relation to the Succession Regulation having an enormous impact on EU judicial cooperation in civil matters. The seminar will revisit the latest case law in relation to Succession Regulation and will particularly discuss latest case law regarding the definition of ‘succession with cross-border implications’, understanding the ‘habitual residence of the deceased’, recognition, jurisdiction in the event of a choice of law, the concept of ‘agreement as to succession’. The seminar will address issues in relation to cooperation between the courts and judicial authorities of the Member States in cross border succession cases.
Target group: The seminar is especially interesting for legal practitioners working in the field of civil law, dealing with cross-border civil litigation cases, but is also of relevance to those having a particular interest in the EU Area of Freedom Security and Justice, based on the principles of mutual recognition and mutual trust.
Participants will have a nuanced understanding of the practical insights about the working structures and functions of the EJN, e-justice portal and the work under the flagship of e-codex as well.
Seminar methodology: Short presentations complemented with practice-oriented discussions led by experts who have an in-depth understanding of cross border succession and the digitalisation of judicial work. Departing from the case law of the Court of Justice of the European Union, the seminar will focus on practical issues arising in the daily administration of the cross-border succession cases.
The seminar also involves a visit to the CJUE and a background explanation on how national courts can refer interpretative requests to the CJEU in the context of the preliminary reference procedure.
Prof. Patrick Wautelet is a professor at the Faculty of Law, Political Science and Criminology of the University of Liège. His teaching and research focus in particular on private international relations and nationality law. In recent years, his research has focused particularly on family and property issues raised by the increasing mobility of citizens. A graduate and doctor of law from the KULeuven, he was a visiting researcher at the University of Illinois and Harvard Law School (1999-2000) and a lawyer at the Brussels Bar for 7 years. He worked at the Hague Conference on Private International Law as an intern and secretary-editor and was a visiting professor in Russia (MGIMO), Burundi (University of Burundi) and France (EDHEC). He is the author of numerous scientific publications focusing on the difficulties posed by the mobility of individuals, families and their assets.
Since November 2024 Dr Carlos Santaló Goris is a Researcher at the Luxembourg Centre for European Law (LCEL) at the University of Luxembourg and Long-term expert at EIPA Luxembourg providing services in the field of European Law. Prior to joining EIPA Luxembourg in 2023, Carlos worked as a Research Fellow at the Max Planck Institute Luxembourg for International, European, and Comparative Procedural Law. Dear colleagues from the Judicial Training Institutes and Bar associations.
I am contacting you regarding another face-to-face seminar in the framework of EU grant 101089772 — UpJudCoop and the second half of this project focuses on civil law.
On this occasion, we are organizing our eighth face-to-face seminar along with a visit to Court of Justice of the European Union (CJEU) on the The Succession Regulation, which will take place in Luxembourg on 21 May 2025 followed by a half day visit of the CJEU on 22 May 2025.
We have a few places available at the price of 350€ (onsite participation) which will cover participation in the seminar and a significant contribution towards travel, accommodation, and subsistence costs as well as access to our learning management platform with all the seminar materials.
