Definition of EU classified information and EU classification levels
The Commission Decision (EU, Euratom) 2015/444 of 13 March 2015 defines European Union Classified Information (hereafter ‘EUCI’) as “any information or material designated by an EU security classification, the unauthorised disclosure of which could cause varying degrees of prejudice to the interests of the European Union or of one or more of the Member States”;
EUCI is classified at one of the following levels:
(a) TRES SECRET UE/EU TOP SECRET: information and material the unauthorised disclosure of which could cause exceptionally grave prejudice to the essential interests of the European Union or of one or more of the Member States;
(b) SECRET UE/EU SECRET: information and material the unauthorised disclosure of which could seriously harm the essential interests of the European Union or of one or more of the Member States;
(c) CONFIDENTIEL UE/EU CONFIDENTIAL: information and material the unauthorised disclosure of which could harm the essential interests of the European Union or of one or more of the Member States;
(d) RESTREINT UE/EU RESTRICTED: information and material the unauthorised disclosure of which could be disadvantageous to the interests of the European Union or of one or more of the Member States.
Relation between EU classification and the national classification
Member States can introduce classified information bearing a national security classification marking into the structures or networks of the Commission, the Commission shall protect that information in accordance with the requirements applicable to EUCI at the equivalent level, as set out in the table of equivalence of security classifications contained in Annex I to COMMISSION DECISION (EU, Euratom) 2015/ 444 of 13 March 2015 on the security rules for protecting EU classified information.
Purpose of the Survey
This survey concerns the processing of EUCI0 within ECDC in relation to Article 21 (6) of Regulation (EC) No 851/2004 establishing a European centre for disease prevention and control, which stipulates that “the Centre shall develop, deploy and operate an information system capable of exchanging classified and sensitive non-classified information…”. A reference to classified information is also included in Article 7 (4) and (5) of Regulation (EC) 2022/2371 on serious cross-border threats to health in the context of reporting on prevention, preparedness and response planning.
ECDC currently does not receive classified information from the Member States. The objective of this survey is to understand if there are Coordinating Competent Bodies (CCBs) from the Member States which intend to send to ECDC classified information relevant to public health and serious cross-border health threats in the future and through which means. Based on the feedback and the needs, ECDC may adapt and develop internal rules and tools to allow the exchange of classified information.
