WPPT Notification No. 114 WIPO PERFORMANCES AND PHONOGRAMS TREATY Declaration by the United Kingdom of Great Britain and Northern Ireland The Director General of the World Intellectual Property Organization (WIPO) presents his compliments and has the honor to refer to the deposit by the Government of the United Kingdom of Great Britain and Northern Ireland, on December 14, 2009, of its instrument of ratification of the WIPO Performances and Phonograms Treaty, adopted at Geneva on December 20, 1996. (See WPPT Notification No°78, dated December 14, 2009, for ease reference.) In this respect, the Director General of WIPO has the honor to notify that the Government of the United Kingdom of Great Britain and Northern Ireland has deposited, on March 31, 2025, the following declaration: – “In accordance with Article 3(3), the United Kingdom will not apply the criterion of
fixation. – This declaration is made in respect of the United Kingdom and the territories of the Isle
of Man and Gibraltar.”
The said declaration will enter into force on July 1, 2025.

21. WIPO Performances and Phonograms Treaty

1 Pursuant to Article 15(3), Australia will not apply the provisions of Article 15(1) in respect of: (a) the use of phonograms for (i) radio broadcasting, and (ii) radio communication to the public within the meaning of the first sentence of
Article 2(g), and (b) the communication to the public of phonograms by way of making the sounds of the phonograms audible to the public by means of the operation
of equipment to receive a broadcast or other transmission of the phonograms.
2 In accordance with Article 3(3) of the Treaty, this State has declared that it will not apply the criterion of publication concerning the protection of phonograms.
3 Pursuant to Article 3(3) of the Treaty, Canada will not apply the criterion of fixation with regard to exclusive rights of producers of phonograms. 4 Pursuant to Article 3(3) of the Treaty, Canada will not apply the criterion of publication with regard to the remuneration right of Article 15(1) of the
Treaty. 5 Pursuant to Article 15(3) of the Treaty, Canada will not apply Article 15(1) of the Treaty with regard to the retransmission of phonograms. 6 Pursuant to Article 15, paragraph 3 of the Treaty, the Republic of Chile will apply the provisions of Article 15, paragraph 1 of the Treaty only in respect of
direct uses of phonograms published for commercial purposes for broadcasting or for any communication to the public. Pursuant to Article 15, paragraph 3 of the Treaty, as regards phonograms the producer or performer of which is a national of another Contracting Party which has made a declaration under Article 15, paragraph 3 of the Treaty, the Republic of Chile will apply, notwithstanding the provisions of the preceding declaration, the provisions of Article 15, paragraph 1 of the Treaty to the extent that Party grants the protection provided for by the provisions of Article 15, paragraph 1 of the Treaty.
7 Pursuant to Article 15(3) of the Treaty, the People’s Republic of China will not apply the provisions of Article 15(1). 8 In accordance with the Basic Law of Hong Kong, China, the Government of the People’s Republic of China has decided that the Treaty will apply to
Hong Kong, China, with effect from October 1, 2008. Hong Kong, China, does not consider itself bound by Article 15(1) of the Treaty with regard to the right of the performers. With respect to the right of the producers of phonograms stipulated in Article 15(1) of the Treaty, relevant laws of Hong Kong, China shall apply.
9 In accordance with the Basic Law of the Macao, China, the Government of the People’s Republic of China decides that the Treaty shall apply to Macao, China. Macao, China, shall not be bound by Article 15(1) of the Treaty with regard to the right of producers of phonograms. With respect to the right of performers stipulated in Article 15(1) of the Treaty, relevant laws of Macao, China, shall apply.
10 Applicable to the Faroe Islands as of April 30, 2018. 11 Pursuant to Article 3(3) of the Treaty the Republic of Finland, availing itself of the possibilities provided in Article 5(3) of the Rome Convention, declares
that it will not apply the criterion of publication. 12 In accordance with Article 3(3) of the Treaty, the Republic of India availing itself of the possibilities provided in Article 5(3) of the Rome Convention,
will not apply the criterion of fixation while granting national treatment to phonograms producers. 13 In accordance with Article 15(3) of the Treaty, the Republic of India will not apply the provisions of Article 15(1) relating to a single equitable
remuneration for performers and producers of phonograms. 14 Pursuant to Article 15(3) Japan will apply, as regards phonograms the producer of which is a national of another Contracting Party, the provisions of
Article 15(1) to the extent that Contracting Party grants the protection provided for by these provisions; Japan will apply the provisions of Article 15(1) in respect of the direct or indirect use of the phonograms published for commercial purposes for broadcasting, cablecasting or “automatic public transmission of unfixed information”; and in respect of the direct or indirect use of phonograms made available to the public, by wire or wireless means, in such a way that members of the public may access them from a place and at a time individually chosen by them for broadcasting, cablecasting (wire diffusion) or “automatic public transmission of unfixed information”.
15 In accordance with Article 15(3) of the Treaty, the provision of Article 15(1) will not be applied in New Zealand. 16 The accession by New Zealand shall extend to Tokelau. 17 Pursuant to Article 15(3) of the WPPT, the Republic of Macedonia does not apply the provision on single equitable remuneration for the performers and
for the phonogram producers for direct or indirect use of phonograms published for commercial purposes for broadcasting or for any other communication to the public, in relation to the expressed reservation of the then former Yugoslav Republic of Macedonia on Article 16 (1)(a)(i) of the Rome Convention.
18 In accordance with Article 15(3) of the Treaty, the Republic of Korea will apply the provision of Article 15(1) thereof in respect of the use of phonograms published for commercial purposes for broadcasting or transmission by wire. Transmission by wire does not include transmission over the Internet.
19 In accordance with 15(3) of the Treaty, as regards phonograms the producer or performer of which is a national of another Contracting Party which has made a declaration under Article 15(3) thereof, the Republic of Korea will apply the provisions of Article 15(1) thereof to the extent to which, and to the term for which, the other Contracting Party grants protection to phonograms the producer or performer of which is a national of the Republic of Korea under the provisions of Article 15(1) thereof.
20 In accordance with Article 15(3) of the WPPT, the Russian Federation shall not apply the provisions of Article 15(1) of the said Treaty in relation to phonograms, the producer of which is not a citizen or legal person of another Contracting Party; shall limit the protection granted, in accordance with Article 15(1) of the WPPT, in relation to phonograms, the producer of which is a citizen or legal person of another Contracting Party, within the scope and on the conditions provided for by this Contracting Party for phonograms first recorded by a citizen or legal person of the Russian Federation; and
In accordance with Article 3(3) of the WPPT, the Russian Federation notifies that when it acceded to the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organisations (Rome Convention) of October 26, 1961, the Russian Federation in accordance with Article 5(3) of the Rome Convention, declared that it shall not apply the fixation criterion provided for in Article 5(1)(b) of the Rome Convention.

21 Serbia is the continuing State from Serbia and Montenegro as from June 3, 2006. 22 Pursuant to Article 15(3), Singapore will limit the provisions of Article 15(1) in the following ways: (i) Producers of phonograms have the exclusive right
to make available to the public a sound recording by means of, or as part of, a digital audio transmission; and (ii) Performers can bring an action of unauthorized communication of a live performance to the public (on a network or otherwise) in such a way that the recording may be accessed by any person from a place and at a time chosen by him. In this context, “communication” includes broadcasting, inclusion in a cable programme service and the making available of the live performance in such a way that the performance may be accessed by any person from a place and at a time chosen by him.
23 In accordance with Article 3(3) of WPPT, the Kingdom of Sweden has declared that it will not apply the criterion of publication, with the exception of the reproduction right for phonogram producers.
24 In accordance with Article 3(3) of the Treaty, this State has declared that it will not apply the criterion of fixation concerning the protection of phonograms.
25 The United Kingdom extended the application of the Treaty to the territories of the Bailiwick of Guernsey and the Isle of Man with effect from January 1, 2021.
26 The United Kingdom extended the application of the Treaty to the territory of Gibraltar with effect from May 17, 2022. 27 In accordance with Article 3(3) of the Treaty, the United Kingdom has declared that it will not apply the criterion of fixation. This declaration is made in
respect of the United Kingdom and the territories of the Isle of Man and Gibraltar. 28 Pursuant to Article 15(3) of the WIPO Performances and Phonograms Treaty, the United States will apply the provisions of Article 15(1) of the WIPO
Performances and Phonograms Treaty only in respect of certain acts of broadcasting and communication to the public by digital means for which a direct or indirect fee is charged for reception, and for other retransmissions and digital phonorecord deliveries, as provided under the United States law.
29 Pursuant to Article 15(3) of the Treaty, the Socialist Republic of Viet Nam declares to apply Article 15(1) in specific cases as provided for in the Law on Intellectual Property of Viet Nam and its implementing documents.

(Voir la notification WPPT no78, datée du 14 décembre 2009, pour information.) À cet égard, le Directeur général de l’OMPI a l’honneur de notifier que le Gouvernement du Royaume-Uni de Grande-Bretagne et d’Irlande du Nord a déposé, le 31 mars 2025, la déclaration suivante : – “Conformément à l’article 3.3) le Royaume-Uni n’appliquera pas le critère de la fixation. – Cette déclaration est faite à l’égard du Royaume-Uni et des territoires de l’Île de Man et
de Gibraltar.”

1 En vertu de l’article 15.3), l’Australie n’appliquera pas les dispositions de l’article 15.1) à l’égard: a) de l’utilisation des phonogrammes aux fins de (i) la diffusion radiophonique, et de (ii) la radiocommunication au public des phonogrammes au
sens de la première phrase de l’article 2.g), ni b) de la communication au public des phonogrammes en rendant audibles par le public les sons fixés sur les phonogrammes au moyen d’un appareil
destiné à recevoir une émission radiodiffusée ou une autre forme de transmission des phonogrammes. 2 Conformément à l’article 3.3) du Traité, cet État a déclaré qu’il n’appliquera pas le critère de la publication en ce qui concerne la protection des
phonogrammes. 3 En vertu de l’article 3.3) du Traité, le Canada n’appliquera pas le critère de la fixation relativement aux droits exclusifs des producteurs de phonogrammes. 4 En vertu de l’article 3.3) du Traité, le Canada n’appliquera pas le critère de la publication relativement au droit à la rémunération à prévu l’article 15.1) du
Traité. 5 En vertu de l’article 15.3) du Traité, le Canada n’appliquera pas l’article 15.1) du Traité relativement à la retransmission de phonogrammes. 6 Conformément à l’alinéa 3) de l’article 15 du traité, le Chili appliquera les dispositions de l’alinéa 1 de l’article 15 du traité seulement en ce qui concerne

Conformément à l’alinéa 3) de l’article 15 du traité, en ce qui concerne les phonogrammes dont le producteur ou l’artiste interprète ou exécutant est ressortissant d’une autre Partie contractante qui a fait une déclaration conformément à l’alinéa 3) de l’article 15 du traité, la République du Chili appliquera, nonobstant les dispositions de la déclaration précédente, les dispositions de l’alinéa 1 de l’article 15 du traité dans la mesure où cette Partie contractante accorde la protection prévue par les dispositions de l’alinéa 1) de l’article 15 du traité.
7 Conformément à l’article 15.3) du traité, la République populaire de Chine n’appliquera pas les dispositions de l’article 15.1). 8 Conformément à loi fondamentale de Hong Kong (Chine), le Gouvernement de la République populaire de Chine a décidé que le traité s’appliquera à
Hong Kong (Chine) à partir du 1er octobre 2008. Hong Kong (Chine) ne se considère pas liée par l’article 15.1) du Traité en ce qui concerne le droit des artistes et interprètes ou exécutants. À l’égard du droit des producteurs de phonogrammes prévu à l’article 15.1) du Traité, les lois pertinentes de Hong Kong (Chine) s’appliqueront.
9 Conformément à la loi fondamentale de Macao (Chine), le Gouvernement de la République populaire de Chine décide que le traité s’appliquera à Macao (Chine). Macao (Chine) ne sera pas liée par l’article 15.1) du Traité en ce qui concerne le droit des artistes interprètes ou exécutants. À l’égard du droit des producteurs de phonogrammes prévu à l’article 15.1) du Traité, les lois pertinentes de Macao (Chine) s’appliqueront.
10 Applicable aux îles Féroé à compter du 30 avril 2018. 11 Conformément à l’article 15.3) du Traité de l’OMPI sur les interprétations et exécutions et les phonogrammes, les États-Unis d’Amérique n’appliqueront
les dispositions de l’article 15.1) dudit traité qu’à l’égard de certains actes de radiodiffusion et de communication au public par des moyens numériques pour lesquels une redevance directe ou indirecte est perçue au titre de la réception, ou pour d’autres retransmissions et communications sur phonogramme numérique, comme le prévoit la loi des États-Unis d’Amérique.
12 Conformément à l’article 15.3) du WPPT, la Fédération de Russie n’appliquera pas les dispositions de l’article 15.1) du WPPT en relation avec les phonogrammes dont le producteur n’est pas citoyen ou personne morale d’une autre Partie contractante; qu’elle limitera la protection accordée, conformément à l’article 15.1) du WPPT, en relation avec les phonogrammes dont le producteur est citoyen ou personne morale d’une autre Partie contractante, dans le cadre et aux conditions prévues par cette Partie contractante pour les phonogrammes enregistrés pour la première fois par un citoyen ou une personne morale de la Fédération de Russie, et
Conformément à l’article 3.3) du WPPT, la Fédération de Russie notifie que lorsqu’elle a adhéré à la Convention internationale sur la protection des artistes interprètes ou exécutants, des producteurs de phonogrammes et des organismes de radiodiffusion (Convention de Rome) du 26 octobre 1961, la Fédération de Russie a déclaré, conformément à l’article 5.3) de la Convention de Rome, qu’elle n’appliquerait pas le critère de la fixation prévu à l’article 5.1)b) de la Convention de Rome.
13 Conformément à l’article 3.3) du traité, la République de Finlande faisant usage de la faculté prévue à l’article 5(3) de la Convention de Rome, déclare qu’elle n’appliquera pas le critère de la publication.
14 Conformément à l’article 3.3) du traité, la République de l’Inde, faisant usage de la faculté prévue à l’article 5.) de la Convention de Rome, n’appliquera pas le critère de la fixation dans l’application du traitement national au producteurs de phonogrammes.
15 Conformément à l’article 15.3) du traité, la République de l’Inde n’appliquera pas les dispositions relatives à la rémunération équitable et unique aux artistes interprétés ou exécutants et aux producteurs de phonogrammes.
16 Conformément à l’article 15.3), le Japon appliquera à l’égard des producteurs de phonogrammes qui sont ressortissants d’une autre partie contractante, les dispositions de l’article 15.1) dans la mesure où cette partie contractante accorde la protection prévue par ces dispositions ; le Japon appliquera les dispositions de l’Article 15.1) à l’égard de l’utilisation directe ou indirecte des phonogrammes publiés à des fins de commerce pour la radiodiffusion, la distribution par câble ou pour la “transmission automatique au public de l’information non fixée” ; et à l’égard de l’utilisation directe ou indirecte des phonogrammes mis à la disposition du public, par fil ou sans fil, de manière que chacun puisse y avoir accès de l’endroit et au moment qu’il choisit individuellement pour la radiodiffusion, la distribution par câble (diffusion par fil) ou pour la “transmission automatique au public de l’information non fixée”.
17 Conformément à l’article 15.3) du Traité de l’OMPI, la République de Macédoine du Nord n’applique pas la disposition relative à la rémunération équitable unique pour les artistes interprètes ou exécutants et les producteurs de phonogrammes lorsque des phonogrammes publiés à des fins de commerce sont utilisés directement ou indirectement pour la radiodiffusion pour une communication quelconque au public, sur les interprétations et exécutions et les phonogrammes, en relation avec la réserve exprimée à l’époque par l’ex-République yougoslave de Macédoine au sujet de l’article 16.1)a)i) de la Convention de Rome.
18 Conformément à l’article 15.3) du Traité, la disposition prévue par l’article 15.1) ne sera pas appliquée en Nouvelle-Zélande. 19 L’adhésion de la Nouvelle-Zélande s’étend à Tokélaou.

20 Conformément à l’article 15.3) du Traité, la République de Corée appliquera la disposition de l’article 15.1) dudit traité en ce qui concerne l’utilisation de phonogrammes publiés à des fins de commerce pour la radiodiffusion ou la transmission par câble. La transmission par câble n’inclut pas la transmission sur l’Internet.
21 Conformément à l’article 15.3) du Traité, en ce qui concerne les phonogrammes dont le producteur ou l’artiste interprète ou exécutant a la nationalité d’une autre Partie contractante qui a fait une déclaration en vertu de l’article 15.3) dudit traité, la République de Corée appliquera les dispositions de l’article 15.1) dudit traité dans la mesure où, et à la condition que, cette autre Partie contractante accorde une protection aux phonogrammes dont le producteur ou l’artiste interprète ou exécutant a la nationalité de la République de Corée conformément aux dispositions de l’article 15.1) dudit traité.
22 Le Royaume-Uni a étendu l’application du Traité aux territoires de Bailliage de Guernesey et de l’Île de Man avec effet au 1er janvier 2021. 23 Le Royaume-Uni a étendu l’application du Traité au territoire de Gibraltar avec effet au 17 mai 2022. 24 Conformément à l’article 3.3) du Traité, le Royaume Uni a déclaré qu’il n’appliquera pas le critère de la fixation. Cette déclaration est faite à l’égard du
Royaume-Uni et des territoires de l’Île de Man et de Gibraltar. 25 La Serbie est l’État assurant la continuation de la Serbie-et-Monténégro à compter du 3 juin 2006. 26 Conformément à l’Article 15.3), Singapour limitera l’application des dispositions de l’Article 15.1) de la manière suivante : (i) les producteurs de
phonogrammes ont le droit exclusif de mettre à la disposition du public un enregistrement sonore au moyen ou dans le cadre d’une transmission audionumérique; et (ii) les artistes interprètes ou exécutants peuvent intenter une action en cas de communication au public non autorisée d’une interprétation ou exécution vivante et en cas de mise à la disposition du public non autorisée de l’enregistrement d’une interprétation ou exécution (sur un réseau ou d’une autre manière) de manière que chacun puisse y avoir accès de l’endroit et au moment qu’il choisit individuellement. Dans ce contexte, le terme “communication” englobe la radiodiffusion, l’inclusion dans un service de câblodistribution et la mise à disposition de l’interprétation ou exécution vivante de manière que chacun puisse y avoir accès de l’endroit et au moment qu’il choisit individuellement.
27 Conformément à l’article 3.3) du WPPT, le Royaume de Suède a déclaré qu’il n’appliquera pas le critère de publication à l’exception du droit de reproduction de producteurs des phonogrammes.
28 Conformément à l’article 3.3) du Traité, cet État a déclaré qu’il n’appliquera pas le critère de la fixation en ce qui concerne la protection des phonogrammes.
29 Conformément à l’article 15.3) du Traité, la République socialiste du Viet Nam déclare appliquer l’article 15.1) dans les cas particuliers prévus par la loi sur la propriété intellectuelle du Viet Nam et ses documents d’application.
WPPT Notification No. 114 WIPO PERFORMANCES AND PHONOGRAMS TREATY Declaration by the United Kingdom of Great Britain and Northern Ireland The Director General of the World Intellectual Property Organization (WIPO) presents his compliments and has the honor to refer to the deposit by the Government of the United Kingdom of Great Britain and Northern Ireland, on December 14, 2009, of its instrument of ratification of the WIPO Performances and Phonograms Treaty, adopted at Geneva on December 20, 1996. (See WPPT Notification No°78, dated December 14, 2009, for ease reference.) In this respect, the Director General of WIPO has the honor to notify that the Government of the United Kingdom of Great Britain and Northern Ireland has deposited, on March 31, 2025, the following declaration: – “In accordance with Article 3(3), the United Kingdom will not apply the criterion of
fixation. – This declaration is made in respect of the United Kingdom and the territories of the Isle

1 Pursuant to Article 15(3), Australia will not apply the provisions of Article 15(1) in respect of: (a) the use of phonograms for (i) radio broadcasting, and (ii) radio communication to the public within the meaning of the first sentence of
Article 2(g), and (b) the communication to the public of phonograms by way of making the sounds of the phonograms audible to the public by means of the operation
of equipment to receive a broadcast or other transmission of the phonograms.
2 In accordance with Article 3(3) of the Treaty, this State has declared that it will not apply the criterion of publication concerning the protection of phonograms.
3 Pursuant to Article 3(3) of the Treaty, Canada will not apply the criterion of fixation with regard to exclusive rights of producers of phonograms. 4 Pursuant to Article 3(3) of the Treaty, Canada will not apply the criterion of publication with regard to the remuneration right of Article 15(1) of the
Treaty. 5 Pursuant to Article 15(3) of the Treaty, Canada will not apply Article 15(1) of the Treaty with regard to the retransmission of phonograms. 6 Pursuant to Article 15, paragraph 3 of the Treaty, the Republic of Chile will apply the provisions of Article 15, paragraph 1 of the Treaty only in respect of
direct uses of phonograms published for commercial purposes for broadcasting or for any communication to the public. Pursuant to Article 15, paragraph 3 of the Treaty, as regards phonograms the producer or performer of which is a national of another Contracting Party which has made a declaration under Article 15, paragraph 3 of the Treaty, the Republic of Chile will apply, notwithstanding the provisions of the preceding declaration, the provisions of Article 15, paragraph 1 of the Treaty to the extent that Party grants the protection provided for by the provisions of Article 15, paragraph 1 of the Treaty.
7 Pursuant to Article 15(3) of the Treaty, the People’s Republic of China will not apply the provisions of Article 15(1). 8 In accordance with the Basic Law of Hong Kong, China, the Government of the People’s Republic of China has decided that the Treaty will apply to
Hong Kong, China, with effect from October 1, 2008. Hong Kong, China, does not consider itself bound by Article 15(1) of the Treaty with regard to the right of the performers. With respect to the right of the producers of phonograms stipulated in Article 15(1) of the Treaty, relevant laws of Hong Kong, China shall apply.
9 In accordance with the Basic Law of the Macao, China, the Government of the People’s Republic of China decides that the Treaty shall apply to Macao, China. Macao, China, shall not be bound by Article 15(1) of the Treaty with regard to the right of producers of phonograms. With respect to the right of performers stipulated in Article 15(1) of the Treaty, relevant laws of Macao, China, shall apply.
10 Applicable to the Faroe Islands as of April 30, 2018. 11 Pursuant to Article 3(3) of the Treaty the Republic of Finland, availing itself of the possibilities provided in Article 5(3) of the Rome Convention, declares
that it will not apply the criterion of publication. 12 In accordance with Article 3(3) of the Treaty, the Republic of India availing itself of the possibilities provided in Article 5(3) of the Rome Convention,
will not apply the criterion of fixation while granting national treatment to phonograms producers. 13 In accordance with Article 15(3) of the Treaty, the Republic of India will not apply the provisions of Article 15(1) relating to a single equitable
remuneration for performers and producers of phonograms. 14 Pursuant to Article 15(3) Japan will apply, as regards phonograms the producer of which is a national of another Contracting Party, the provisions of
Article 15(1) to the extent that Contracting Party grants the protection provided for by these provisions; Japan will apply the provisions of Article 15(1) in respect of the direct or indirect use of the phonograms published for commercial purposes for broadcasting, cablecasting or “automatic public transmission of unfixed information”; and in respect of the direct or indirect use of phonograms made available to the public, by wire or wireless means, in such a way that members of the public may access them from a place and at a time individually chosen by them for broadcasting, cablecasting (wire diffusion) or “automatic public transmission of unfixed information”.
15 In accordance with Article 15(3) of the Treaty, the provision of Article 15(1) will not be applied in New Zealand. 16 The accession by New Zealand shall extend to Tokelau. 17 Pursuant to Article 15(3) of the WPPT, the Republic of Macedonia does not apply the provision on single equitable remuneration for the performers and
for the phonogram producers for direct or indirect use of phonograms published for commercial purposes for broadcasting or for any other communication to the public, in relation to the expressed reservation of the then former Yugoslav Republic of Macedonia on Article 16 (1)(a)(i) of the Rome Convention.
18 In accordance with Article 15(3) of the Treaty, the Republic of Korea will apply the provision of Article 15(1) thereof in respect of the use of phonograms published for commercial purposes for broadcasting or transmission by wire. Transmission by wire does not include transmission over the Internet.
19 In accordance with 15(3) of the Treaty, as regards phonograms the producer or performer of which is a national of another Contracting Party which has made a declaration under Article 15(3) thereof, the Republic of Korea will apply the provisions of Article 15(1) thereof to the extent to which, and to the term for which, the other Contracting Party grants protection to phonograms the producer or performer of which is a national of the Republic of Korea under the provisions of Article 15(1) thereof.
20 In accordance with Article 15(3) of the WPPT, the Russian Federation shall not apply the provisions of Article 15(1) of the said Treaty in relation to phonograms, the producer of which is not a citizen or legal person of another Contracting Party; shall limit the protection granted, in accordance with Article 15(1) of the WPPT, in relation to phonograms, the producer of which is a citizen or legal person of another Contracting Party, within the scope and on the conditions provided for by this Contracting Party for phonograms first recorded by a citizen or legal person of the Russian Federation; and
In accordance with Article 3(3) of the WPPT, the Russian Federation notifies that when it acceded to the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organisations (Rome Convention) of October 26, 1961, the Russian Federation in accordance with Article 5(3) of the Rome Convention, declared that it shall not apply the fixation criterion provided for in Article 5(1)(b) of the Rome Convention.

21 Serbia is the continuing State from Serbia and Montenegro as from June 3, 2006. 22 Pursuant to Article 15(3), Singapore will limit the provisions of Article 15(1) in the following ways: (i) Producers of phonograms have the exclusive right
to make available to the public a sound recording by means of, or as part of, a digital audio transmission; and (ii) Performers can bring an action of unauthorized communication of a live performance to the public (on a network or otherwise) in such a way that the recording may be accessed by any person from a place and at a time chosen by him. In this context, “communication” includes broadcasting, inclusion in a cable programme service and the making available of the live performance in such a way that the performance may be accessed by any person from a place and at a time chosen by him.
23 In accordance with Article 3(3) of WPPT, the Kingdom of Sweden has declared that it will not apply the criterion of publication, with the exception of the reproduction right for phonogram producers.
24 In accordance with Article 3(3) of the Treaty, this State has declared that it will not apply the criterion of fixation concerning the protection of phonograms.
25 The United Kingdom extended the application of the Treaty to the territories of the Bailiwick of Guernsey and the Isle of Man with effect from January 1, 2021.
26 The United Kingdom extended the application of the Treaty to the territory of Gibraltar with effect from May 17, 2022. 27 In accordance with Article 3(3) of the Treaty, the United Kingdom has declared that it will not apply the criterion of fixation. This declaration is made in
respect of the United Kingdom and the territories of the Isle of Man and Gibraltar. 28 Pursuant to Article 15(3) of the WIPO Performances and Phonograms Treaty, the United States will apply the provisions of Article 15(1) of the WIPO
Performances and Phonograms Treaty only in respect of certain acts of broadcasting and communication to the public by digital means for which a direct or indirect fee is charged for reception, and for other retransmissions and digital phonorecord deliveries, as provided under the United States law.
29 Pursuant to Article 15(3) of the Treaty, the Socialist Republic of Viet Nam declares to apply Article 15(1) in specific cases as provided for in the Law on Intellectual Property of Viet Nam and its implementing documents.
