A tenderer, candidate or economic operator interested in participating in public procurement may contest the actions of the contracting authority or entity by filing a contestation notice with the Public Procurement Review Committee if it finds that an infringement of the Public Procurement Act by the authority or entity infringes its rights or adversely affects its interests.

The rules (and time limits)  for filing a contestation notice in public procurement are in the Public Procurement Act (§ 185, § 189, § 190) (Public Procurement Act–Riigi Teataja)

Appeal procedure, documents included, is held in Estonian. You have to send the contestation notice [email protected]

According to section 186 of the Public Procurement Act, upon filing a request for review, a state fee is paid in accordance with the State Fees Act (SFA).

A state fee in the following amounts shall be paid upon the submission of a request for review (section 258 of the SFA):

• * 640 euros if the estimated value of a public procurement is below the international threshold;

• * 1280 euros if the estimated value of a public procurement equals or exceeds the international threshold.

State fee shall be transferred to the bank account of the Ministry of the Finance:

1. a. Offers from the competitors OÜ ElectroAir (11309002) and Tallinna Elektrotehnika Tehas "Estel" AS (10668696), as the amount of € 216,480.00 stated in your letter is not comprehensible.

2. b. Evidence from competitors OÜ ElectroAir (11309002) and Tallinna Elektrotehnika Tehas "Estel" AS (10668696) demonstrating the required efficiency values under Section 3.7 (coefficient of efficiency of at least 95% at maximum load)

3. c. Evidence demonstrating the most economically advantageous offer in the tender documents of competitors OÜ ElectroAir (11309002) and Tallinna Elektrotehnika Tehas "Estel" AS (10668696), particularly taking into account the efficiency values required under Section 3.7 - – pls also refer to your answer as per below screen shot

4. d. Evidence of the competitors OÜ ElectroAir (11309002) and Tallinna Elektrotehnika Tehas "Estel" AS (10668696), demonstrating the required references.
