against Women and Domestic Violence: Report on the implementation of recommendations addressed to state parties by the Committee of the Parties
Dear Ms Kruusement, At its 13th meeting, the Committee of the Parties to the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence adopted its recommendation on the implementation of the Convention by Estonia set out in document IC- CP/Inf(2022)9. The Committee of the Parties set a deadline of three years to report on its implementation which is due to expire on 4 December 2025. In view of the Committee’s decision to use a standardised reporting form to report on the implementation of the recommendation, taken at its 9th meeting in December 2020, your authorities are thus invited to use the attached reporting form which focuses on eight priority areas. Please note that questions related to recommendations which were not addressed to your authorities do not need to be answered. As a result, your authorities do not need to answer the following questions in the reporting form:
- 14, 16, 19 and 20 In addition, and in line with the decision taken by the Committee of the Parties to select two priority areas in relation to each state party, your authorities are requested to report on the following two recommendations in the space provided at the end of the reporting form:
- Recommendation to reform all sexual offences contained in the Estonian Penal Code to fully incorporate the notion of freely given consent as required by Article 36 of the Istanbul Convention and to ensure appropriate sanctions for all sexual acts without the consent of the victim, including where the circumstances of the case preclude valid consent (Recommendation A.13, IC-CP/Inf (2022)9);

- Recommendation to ensure that vulnerability, particularly related to sexual violence and other forms of gender-based violence against women, is formally assessed and identified at the earliest possible opportunity within the asylum procedure to inform decisions relating to accommodation and support services and to ensure procedural fairness and gender sensitivity in the conduct of the asylum interview (Recommendation A.18, IC-CP/Inf (2022)9).
The form should be answered in one of the official languages of the Council of Europe (English or French) and submitted to the Secretariat by 4 December 2025. The information provided by your authorities will be made available to the Committee of the Parties in view of the adoption of conclusions on the implementation of the recommendations addressed to your authorities. Please note that the completed reporting form will also be published on the website of the Istanbul Convention. I remain at your disposal for any questions concerning the reporting form or other matters related to the monitoring of the implementation of the Convention.
