Thank you for your inquiry regarding herbal heated products in Estonia.

According to the Estonian Tobacco Act, your product- — a nicotine-containing herbal heated stick that does not contain tobacco- is considered a product related to a tobacco product, as it imitates the use of tobacco (Section 31(1)(1)).

Flavour ban:
From 31 January 2026, flavoured heated tobacco products will be banned in Estonia. Herbal heated products that contain nicotine but no tobacco are not currently subject to this ban. Future legal changes may still affect them.

Key requirements:

• * Packaging must bear a tax stamp (Section 1(2)).

• * An activity notice must be submitted before selling the product in retail, wholesale, or catering (Section 18).

• * Distance sales to Estonia are prohibited (Section 31²).

• * Restrictions apply to promotion and sponsorship (Sections 25 and 26).

Additional requirements:

1. 1. Excise duty must be paid to the Estonian Tax and Customs Board under the Alcohol, Tobacco, Fuel and Electricity Excise Duty Act.

2. 2. Labelling and packaging must comply with the CLP Regulation (Reg. (EC) No 1272/2008), Title III. The label must match the safety data sheet (section 2.2).

3. 3. Poison centre notification via the ECHA portal is required if the product is classified as hazardous.
