ANNEX 1 EXCHANGE OF PRODUCTS This Annex covers the automatic mutual exchange for Internal Reference Use Only of copies of Products produced by the Participants. 1. Copies of New Charts, Sailing Directions and Nautical Publications
1.1. The ETA will provide the BSH with the following Products at no cost:
1.1.1. On request a copy of any Estonian chart, preferably in digital form. 1.1.2. On publication of a new edition ENC EE110000 and updates. 1.1.3. Notifications on the availability of new charts or new editions in digital form will be
sent by e-mail to [email protected].
1.2. The BSH will provide the ETA with the following Products at no cost:
1.2.1. On request a copy of any German chart covering waters of the Baltic, preferably in digital form.
1.2.2. On request a copy of BSH’s books covering waters of the Baltic, preferably in digital form.
1.3. Additional copies will be considered on request. 1.4. Participants having a Notices to Mariners Internet Service will give the other
permission to copy at no cost. 1.5. Participants will notify timely each other on changes in the number, schemes, scales of
the charts exchanged. 1.6. If necessary, lists of charts and publications exchanged may be modified by mutual
agreement. 2. Restrictions
2.1. Products supplied under the terms above may not be copied or otherwise used in the compilation or reproduction of new Products except as specified in the succeeding Annexes.
2.2. Products supplied by one Participant to the other may not be supplied to or used by a Third Party without the written permission of the supplying Participant.

ANNEX 3 THE USE OF PRODUCTS AND DATA AS SOURCE MATERIAL IN RE- COMPILED CHART PRODUCTS
This Annex covers the use of nautical Data of one Participant in preparation of Products by the other Participant. It also covers the situation where a Hydrographic Office of a Third Party is the Producer Nation of an INT Chart covering the water of one or both Participants and which is adopted by one Participant. 1. Charts to be used for re-compilation 1.1. The ETA grants permission to the BSH to use the ETA Products and Data as listed in
sub-paragraph 1.1 of Annex 1 for re-compilation of the charts published in Germany and their further conversion into digital form.
1.2. The BSH grants permission to the ETA to use German Products and Data as listed in sub-paragraph 1.2 of Annex 1 for re-compilation of the charts published in Estonia and their further conversion into digital form.
2. Principles 2.1. Where one Participant has charts covering the other Participant’s Waters, it will seek
to avoid creating new Products wherever possible, adopting International (INT) Charts or national charts in preference where these charts are appropriate for international navigation, and compatible with the remainder of its series.
2.2. Where it has been jointly determined that one Participant will re-compile a chart or charts from the Products and Data belonging to the other, the latter Participant will ensure that Notices to Mariners and other relevant updating information is supplied to the re-compiler immediately it has been promulgated, in the interests of the safety of navigation.
3. Acknowledgement 3.1. Any re-compiled Product must bear full official title of the Hydrographic Office which
has re-compiled and published it, copyright logo, the year of the copyright origin and Source Data Diagram.

3.2. Where a Third Party nation is the Producer Nation for an INT Chart covering the water of one or both Participants and which is adopted by either one or both Participants the appropriate acknowledgement in Annex 2, paragraph 3 will be used.
3.3. Acknowledgements will be added to charts at their next reprint. 3.4. Re-compiled charts must bear the statement:

ANNEX 4 CO-PRODUCTION OF PRODUCTS BETWEEN PARTICIPANTS This annex to the Bilateral Agreement between ETA and BSH covers printing works that BSH will undertake for ETA. 1. The chart(s) and number of copies to be printed will be determined by an official letter
of order, that ETA will send by e-mail
2. The detailed financial arrangements described in Appendix 2 of the Bilateral Agreement do not apply to works performed by this Annex. The financial arrangements applying to the scope of this Annex are listed under the clause 3. Technical Specifications of this Annex.
3. The Technical Specification, prices and terms described below is in force from year 2026 until year 2029 (including).

Conditions: The price does not include VAT or any other taxes or dues in Estonia.
The price includes colour proofs.
Terms of Delivery: DDU Tallinn, Estonia The charts will be delivered on a pallet. ETA manages the transport of the printed samples from Rostock to Tallinn and takes over all costs arising from.
Time of Delivery: 6 weeks, counted from the day of receiving the pdf-files.

Terms of Payment: 100% of the value of delivered charts, to be paid against corresponding invoices within 30 days from the date of reception of the invoice. In case of overdue payment, an interest rate of 18% per annum will be charged.
Other conditions: All steps of production are done in safety classed premises by safety- controlled employees. All spoilage is shredded and recycled.

APPENDIX 2 DETAILED FINANCIAL ARRANGEMENTS 1. Product prices One Participant may not sell Products containing Material, which is the Copyright of the other at a recommended retail price different from that of equivalent Product within its own national series. 2. Royalty Levels
2.1. Royalties levied shall be based on revenue from sales, that is the wholesale price of the Product to a national agent, and will exclude that agent's mark-up, post- age, customs duties, and taxes. The level of payments and royalties due for each are set out in the appropriate Annex.
2.2. Royalties levied by each Participant will be based on the proportion of an individual Product derived from the Participant's source Material, and the numbers of copies of the Product sold by the other Participant within the Accounting Period.
3. Settlement If applicable, at the beginning of a new calendar year each Participant will set out in an auditable account, Revenue accrued and royalties due for each Product sold, and payments due for Exchange Materials for the preceding year. Each Participant will forward the due amount for invoicing in EURO to the other side by the end of February at the latest. The invoices to the other side will have a due date not less than 28 days. 4. Free of Charge Items The exchange of free of charge items will be reviewed periodically by both Participants to ensure equality.
