Ms Christine ROGER Director-General Directorate General - Justice and home affairs (JAI) Council of the European Union Rue de la Loi 175 B-1048 Bruxelles Council Framework Decision 2005/214/JHA of 24 February 2005 on the application of the principle of mutual recognition to financial penalties - notification from Estonia With reference to Articles 2(1) and 16(1) of the Council Framework Decision 2005/214/JHA of 24 February 2005 on the application of the principle of mutual recognition to financial penalties, Estonia gives notice to the General Secretariat of the Council as follows, amending the previous notification sent on 30.09.2008: 1. In accordance with Article 2(1) of the Council Framework Decision 2005/214/JHA, for Estonia the competent authorities will be as follows:
- where Estonia is the issuing State: according to article 50875(1) of the Estonian Code of Criminal Procedure, the certificate of imposition of a monetary penalty or fine is issued by the court that imposed the penalty or the out-of-court proceedings authority that set the fine;
- where Estonia is the executing State: according to article 50872(1) of the Estonian Code of Criminal Procedure, recognition of the decision is decided by the district court that serves the locality of residence of the convicted person or, in the absence of such residence, by Harju District Court.
In accordance with Article 2(2), whether Estonia is the issuing State or the executing State, the central authority for the administrative transmission and reception of the decisions is the Ministry of Justice and Digital Affairs. Where Estonia is the executing State, the decisions, together with the accompanying certificate should be sent to the Ministry of Justice and Digital Affairs either by e-mail ([email protected]) or by post to the following address: Justiits- ja Digiministeerium Suur-Ameerika 1 Tallinn 10122 Estonia 2. With regard to Article 16 (1) of the Council Framework Decision 2005/214/JHA, Estonia declares that it will accept only certificates drawn up in, or translated into, the Estonian language.
