The generation of synthetic media (such as images, video and audio, either as deepfakes or for legitimate purposes) is not new. However, fueled by the fast-expanding availability of digital input, such as social media posts, pictures and videos, and technologies such as generative AI, such synthetic media has become increasingly realistic, accessible and widespread. Synthetic media presents both significant challenges and exciting opportunities. On one hand, it can raise serious concerns about misinformation, manipulation and identity theft. On the other hand, it can enable powerful applications in film, accessibility, and virtual communication, allowing creators to generate lifelike avatars, restore voices, or preserve historical figures in interactive ways. As such, there is increasing awareness of the need to mitigate the risks and maximize the opportunities. At the heart of this are legal prohibitions and rights, including IP rights. However, the frameworks for protecting a person’s voice, image and style and protect against unauthorized replication vary across jurisdictions. In response, some voices have called for a greater role for IP in regulating synthetic media. The twelfth session of the WIPO Conversation will serve as a global platform for diverse stakeholders to gain a deeper understanding of synthetic media and examine the existing framework of legal and intellectual property rights, as well as relevant legal restrictions. The session will offer insights into the practical challenges surrounding contractual agreements and disputes related to voice, image, and likeness rights, highlight how different jurisdictions are addressing these issues, and explore potential future approaches. This session is a natural follow-up to previous sessions of the WIPO Conversation and in particular:

 the ninth session on IP and training data, looking at AI inputs and the impact of

training data on the IP landscape,

The agenda will include a sharing session aimed to exchange on current practices and proposals between Member States and IP Offices in the area of IP and synthetic media. Additional time will be available for open floor interventions. The twelfth session will be held from 10:00 to 18:00 CET over two days in a hybrid format, at WIPO Headquarters in Geneva, complemented by Zoom and live webcasting. The webcast will also be recorded and available for later viewing. The session will be open to the public and bring together the widest possible set of stakeholders in an open and inclusive process to raise awareness and share knowledge and views. La Oficina Internacional de la Organización Mundial de la Propiedad Intelectual (OMPI) presenta sus atentos saludos y tiene el honor de invitar a los representantes de sus miembros y observadores a asistir a la duodécima sesión del Diálogo de la OMPI sobre Propiedad Intelectual (PI) y Tecnologías de Vanguardia, que se celebrará los días 28 y 29 de octubre de 2025.

La generación de medios sintéticos (como imágenes, video y audio, ya sea como ultrafalsos o con fines legítimos) no es nueva. Sin embargo, gracias a la disponibilidad cada vez mayor de datos digitales, como publicaciones en redes sociales, imágenes y videos, y a tecnologías como la IA generativa, estos medios sintéticos son cada vez más realistas, accesibles y generalizados.

Los medios de comunicación sintéticos presentan a la vez importantes retos y extraordinarias oportunidades. Por un lado, pueden plantear graves problemas de desinformación, manipulación y usurpación de identidad. Por otro, pueden ofrecer importantes soluciones en el cine, la accesibilidad y la comunicación virtual, permitiendo a los creadores generar avatares realistas, restaurar voces o preservar figuras históricas de forma interactiva.

Por ello, cada vez hay más conciencia de la necesidad de mitigar los riesgos y maximizar las oportunidades. En el centro de todo ello se encuentran las prohibiciones y los derechos legales, incluidos los derechos de PI. Sin embargo, los marcos para proteger la voz, la imagen y el estilo de una persona y evitar su reproducción no autorizada varían de una jurisdicción a otra. En respuesta a ello, hay quienes reclaman un mayor papel de la PI en la regulación de los medios de comunicación sintéticos.

La duodécima sesión del Diálogo de la OMPI servirá de plataforma mundial para que las distintas partes interesadas profundicen en el conocimiento de los medios de comunicación sintéticos y examinen el marco jurídico y de derechos de propiedad intelectual existente, así como las restricciones legales pertinentes. En la sesión se expondrán los desafíos prácticos que plantean los acuerdos contractuales y los litigios relacionados con los derechos de voz, imagen y personalidad, se destacará la forma en que las distintas jurisdicciones abordan estas cuestiones y se explorarán posibles enfoques futuros.

Duodécima sesión del Diálogo de la OMPI: IA y PI: Propiedad Intelectual y medios sintéticos

C. 9284 2. Esta sesión es una continuación lógica de las anteriores sesiones del Diálogo de la OMPI y, en particular:

 la novena sesión sobre PI y datos de entrenamiento, en la que se examinaron los aportes de la IA y el impacto de los datos de entrenamiento en el panorama de la PI,

 la décima sesión sobre los resultados de la IA, en la que se estudió si los contenidos generados por la IA son susceptibles de protección por derecho de autor, y

 la undécima sesión sobre IA e infraestructura de derecho de autor, en la que se debatió sobre cómo catalogar los contenidos generados por IA y sobre la infraestructura técnica y las soluciones de IA escalables.

El orden del día incluirá una sesión de intercambio de opiniones sobre las prácticas y propuestas actuales entre los Estados miembros y las oficinas de PI en el ámbito de la PI y los medios de comunicación sintéticos. Se dispondrá de tiempo adicional para el debate abierto.

La duodécima sesión se celebrará de las 10.00 a las 18.00 (hora de Ginebra) durante dos días mediante un formato híbrido, en la sede de la OMPI en Ginebra, complementado por Zoom y la difusión en directo por Internet. Asimismo, la difusión por Internet se grabará y estará disponible para su visualización posterior.

D’autre part, ils peuvent avoir de puissantes applications dans les domaines du cinéma, de l’accessibilité et de la communication virtuelle, en permettant aux créateurs de générer des avatars réalistes, de restaurer des voix ou de préserver des personnages historiques de manière interactive.

De ce fait, la nécessité d’en atténuer les risques et d’en maximiser les avantages est de plus en plus largement reconnue. Les mesures légales d’interdiction et les droits juridiques, notamment les droits de propriété intellectuelle, sont au cœur de cette problématique. Toutefois, les systèmes permettant de protéger la voix, l’image et le style d’une personne et de la protéger contre toute reproduction non autorisée varient d’un ressort juridique à l’autre. Dans ce contexte, un certain nombre de voix se sont élevées pour demander que la propriété intellectuelle joue un rôle plus important dans la réglementation des médias synthétiques.

La douzième session du Dialogue de l’OMPI permettra à diverses parties prenantes dans le monde entier de mieux comprendre les médias synthétiques et d’examiner le cadre juridique existant, notamment les droits de propriété intellectuelle, ainsi que les restrictions applicables. Cette session offrira un aperçu des défis pratiques entourant les accords contractuels et les litiges liés aux droits sur la voix, l’image et la personnalité, soulignera la manière dont les différents ressorts juridiques examinent ces questions et s’intéressera aux perspectives d’avenir.

Douzième édition du Dialogue de l’OMPI sur la propriété intellectuelle et l’intelligence artificielle (IA) : propriété intellectuelle et médias synthétiques

Cette session s’inscrit dans le prolongement naturel des sessions précédentes du Dialogue de l’OMPI et en particulier :

 la neuvième session sur la propriété intellectuelle et les données d’apprentissage, qui a examiné les contributions de l’IA et les effets des données d’apprentissage sur le système de la propriété intellectuelle ;

 la dixième session sur les produits de l’IA, qui s’est intéressée à la question de savoir si les contenus générés par l’intelligence artificielle pouvaient bénéficier d’une protection au titre du droit d’auteur ; et

 la onzième session sur l’IA et l’infrastructure du droit d’auteur, qui a porté sur l’étiquetage du contenu généré par l’IA, l’infrastructure technique et les solutions évolutives en matière d’IA.

L’ordre du jour comprendra une séance d’échange d’informations visant à favoriser la mise en commun des pratiques et projets actuels entre les États membres et les offices de propriété intellectuelle dans le domaine de la propriété intellectuelle et des médias synthétiques. Un délai supplémentaire sera prévu pour les prises de parole.

La douzième édition du Dialogue de l’OMPI se tiendra de 10 heures à 18 heures (heure d’Europe centrale) sur deux jours dans un format hybride, au siège de l’OMPI à Genève, sur Zoom et en direct sur le Web. La retransmission en direct sera également enregistrée pour un visionnage ultérieur.

La session sera ouverte au public et réunira le plus grand nombre possible de parties prenantes dans le cadre d’un processus ouvert et inclusif visant à mieux faire connaître ces thématiques et à échanger des connaissances et des points de vue sur le sujet. Генерация синтетических медиа (например, изображений, видеороликов и аудиодорожек для дипфейков или в законных целях) — это не новое явление. Однако в силу стремительного повышения доступности цифровых входных данных, таких как посты в социальных сетях, изображения и видеоролики, а также технологий, например генеративного ИИ, подобные синтетические медиа становятся все более реалистичными, удобными и распространенными. Синтетические медиа создают значительные трудности и одновременно открывают огромные возможности. С одной стороны, они могут порождать серьезные проблемы, связанные с дезинформацией, манипуляцией и кражей персональных данных. С другой стороны, они помогают создавать мощные приложения для киноиндустрии, обеспечения доступности и виртуальной коммуникации и позволяют авторам генерировать правоподобные аватары, восстанавливать голоса и сохранять образы исторических личностей с помощью интерактивных методов. На этом фоне растет информированность о необходимости снижения рисков и максимального использования возможностей. В ее основе лежат правовые запреты и права, в том числе права ИС. Однако нормативно-правовые рамки для охраны голоса, изображения и стиля отдельного человека и защиты от их несанкционированного воспроизведения варьируются в разных юрисдикциях. В ответ на это некоторые призывают к повышению роли ИС в регулировании синтетических медиа. Двенадцатый раунд Дискуссии ВОИС будет служить глобальной платформой, на которой различные заинтересованные стороны смогут получить более глубокое понимание синтетических медиа и изучить существующую нормативно-правовую базу и права интеллектуальной собственности, а также соответствующие законодательные ограничения. На мероприятии будут обсуждаться практические проблемы, которые возникают в связи с контрактами и спорами, касающимися прав на голос, изображение и внешнее сходство, механизмы различных юрисдикций для решения этих вопросов, а также потенциальные будущие подходы.

Двенадцатый раунд Дискуссии ВОИС «ИИ и ИС: интеллектуальная собственность и синтетические медиа»

Данное мероприятие представляет собой естественное продолжение предыдущих раундов Дискуссии ВОИС, в частности:

 девятого раунда об ИС и обучающих данных, в ходе которого рассматривались

входные данные и влияние обучающих данных на ландшафт ИС;

 десятого раунда о результатах работы ИИ, в ходе которого был затронут вопрос о возможности охраны сгенерированного ИИ контента при помощи авторского права;

 одиннадцатого раунда об ИИ и инфраструктуре авторского права, в ходе которого обсуждалась проблема маркировки сгенерированного ИИ контента, а также техническая инфраструктура и масштабируемые решения в области ИИ.

В повестку дня включено заседание для обмена информацией между государствами-членами и ведомствами ИС о текущей практике в области ИС и синтетических медиа. При этом будет выделено дополнительное время для комментариев в рамках свободной дискуссии. Двенадцатый раунд будет проходить в течение двух дней с 10:00 до 18:00 по центральноевропейскому времени (CET); он будет организован в гибридном формате — в штаб-квартире ВОИС в Женеве, с использованием платформы Zoom и прямой трансляции. Трансляция будет записана, а запись выложена на сайте ВОИС для последующего просмотра. Мероприятие будет открыто для широкой публики: на площадке Дискуссии встретятся представители самых разных заинтересованных сторон и в рамках открытого и всеобъемлющего диалога обсудят проблему и обменяются мнениями и накопленными знаниями.
