Dear President,
Please kindly find below the request for information from Mr Christophe Soulard, First President of the French Cour de cassation, addressed to your attention. The request concerns the filming and broadcasting of court hearings.
“Since the 22 December 2021 law for confidence in the judicial institution, it has been possible to film and broadcast hearings for a reason of public interest of an educational, informative, cultural or scientific nature. The Cour de cassation has its own system for broadcasting on the same day as the recording, at the initiative of the First President.
This system was implemented very quickly at the Cour de cassation, in March 2023. Initially, only the Cour de cassation's plenary assemblies and mixed chambers were concerned, given the interest and diversity of the legal issues examined.
Filming these hearings is an opportunity to show how the Court works in practice. More generally, the aim is to raise public awareness of the judicial process.
However, this process must be accompanied by procedural guarantees. The rights of the parties are respected: their prior opinion is sought, as is that of the Advocate General. None of the persons recorded can have their image or identity identified if they have not given their consent before the start of the hearing.
The Court de cassation is currently carrying out an initial assessment of this system and would like to review its protocol. We would therefore like to know :
- Do you film your hearings in your courts? How do you authorise filming? Who authorises it? How do you select the hearings to be filmed?
- What process is put in place to guarantee the rights of the parties? Are opinions sought? Who obtains these opinions (court registry, civil servants, judges, etc.)?
- Is a form filled in beforehand? If so, can you please send us the model?
- How do you proceed in the event of a refusal?
- Do any of the judges in your courts refuse to be filmed?
- What is your experience or feedback on broadcasted hearings?”

Nous vous prions de trouver ci-dessous la demande d’information de la part de M. Christophe Soulard, premier président de la Cour de cassation française, adressée à votre attention. La demande concerne le filmage et la diffusion d’audiences judiciaires.
« Depuis la loi du 22 décembre 2021 pour la confiance dans l’institution judiciaire, il est possible de filmer et de retransmettre des audiences pour un motif d’intérêt public d’ordre pédagogique, informatif, culturel ou scientifique. La Cour de cassation bénéficie d’un dispositif propre permettant une diffusion le jour même de l’enregistrement à l’initiative du premier président.
Ce dispositif a été mis en œuvre très rapidement à la Cour de cassation, dès mars 2023. Dans un premier temps, les formations solennelles de la Cour de cassation que sont les assemblées plénières et les chambres mixtes, compte tenu de l’intérêt et de la diversité des questions juridiques examinées, sont les seules concernées.
Filmer ses audiences constitue une opportunité de montrer comment la Cour de cassation travaille concrètement. De façon plus générale, il s’agit de mieux faire connaître le processus judiciaire auprès des citoyens.
Pour autant, ce processus doit être accompagné de garanties procédurales. Il se fait dans le respect des droits des parties : leur avis préalable est recueilli, comme celui du procureur général. Aucune des personnes enregistrées ne peut voir son image ou son identité identifiable si elle n’y a pas consenti avant le début de l’audience.
La Cour de cassation est en train de réaliser un premier bilan de ce dispositif et souhaiterait revoir son protocole. Ainsi, nous souhaiterions savoir :
