From your answers we have seen that we should make another important distinction on how a suspensive effect may come into force before the review body in the second level review:

two more brief questions, this time a view to the suspensive effect in light of the ECJ decision from 18 January 2024 on Cross/Brno (ECLI:EU:C:2024:60):
If possible, your input would be very valuable for current national discussions regarding these two aspects:
