Dear European Commission Gas Coordination Group representative,

According to paragraph 11 of Article 78 (New natural gas and hydrogen infrastructure) of the Regulation (EU) 2024/1789 of the European Parliament and of the Council of 13 June 2024 on the internal markets for renewable gas, natural gas and hydrogen (hereinafter the ‘Regulation’), the Commission is empowered to adopt delegated acts in accordance with Article 80 in order to supplement the Regulation by setting guidelines for the application of the conditions laid down in paragraph 1 of Article 78 and for the procedure to be followed for the application of paragraphs 3, 6, 8 and 9 of Article 78.

Considering the aforementioned, the Estonian Competition Authority (ECA) would like to know if the Commission has adopted any delegated acts in order to supplement the Regulation. If yes, then where could they be found in a publicly available format. The ECA is especially interested in acts related to giving exemptions to new LNG terminals and any guidelines on the evaluation of the conditions for exemptions set out in Article 78 (1) of the Regulation. If not, then is there any information on when the Commission plans to adopt the aforementioned delegated acts.
