Suhtlesin sellel teemal ka Kliimaministeeriumi Ringmajanduse osakonna nõuniku Kelli Seppeliga, kes tegeleb patareide ja akude valdkonnaga. Et olukorras ka ise selgust saada ja regulatsiooni üheselt mõista, saatis Kelli päringu Euroopa Komisjonile.
Lühidalt, uus akumäärus hakkab kehtima nii ühekordsetele kui laetavatele e-sigarettidele ehk alates 18.02.2027 peavad kõikide e-sigarettide patareid olema eemaldavad ja asendatavad lõpptarbija poolt.
Lisan siia ka Euroopa Komisjoni inglisekeelsed vastused, mille põhjal saab ettevõttele vastata.
Yes, Article 11 applies to any product incorporating a portable battery which is placed in the Union market. The date of application of Article 11 is 18/02/2027 (there is a possibility that this date will be discussed with the Member States in Council as part of the environmental omnibus discussions).
After 18/02/2027, portable batteries in products will need to be removable and replaceable by end-users, as per the general obligation in Article 11(1), unless one of the derogations in Article 11(2) or 11(3) are applicable, which is not the case for disposable e-cigarettes. Therefore, the most likely scenario is that manufacturers of those products will have to redesign them to make the portable batteries inside removable and replaceable by end-users.
The Commission is not considering or planning any derogation applicable to disposable e-cigarettes. Rather, the Commission is trying to raise awareness of the importance of the separate disposal of waste portable batteries incorporated into products on account of the increase in fire incidents at waste treatment plants across the EU. End-user battery removability facilitates separate disposal.
Article 11 will only become applicable after 18/02/2027. Therefore, disposable vaping devices placed on the market incorporating portable batteries which are not removable by the end-user at not in breach of the obligations in Article 11 until that date. That is without prejudice of product bans that certain Member States (Belgium, France, Ireland) may have introduced as part of their national legislation in the pursuit of public health and environmental objectives.
Your understanding is correct. For the product categories listed in Article 11(2), portable batteries only need to be made removable and replaceable by independent professionals (as opposed to by end-users). E-cigarettes (both with reusable and disposable cartridges) are not included in the existing list, neither in the new list included in the draft delegated act under preparation. That means that portable batteries in those products need to be removable and replaceable by the end-user. The reason why the applications related to e-cigarettes were not assessed in detail by our consultants was that because of the large number of applications received, we gave them instructions to focus on other candidates products which were more likely to be granted a derogation.
