Teie uurimisprojekti ja Eesti Statistikaameti seisukoha täpsemaid detaile teadmata, saab Andmekaitse Inspektsioon anda vaid üldised selgitused ja ülevaate kohalduvast regulatsioonist. Eesti tuleb isikuandmete töötlemisel teadusuuringutes järgida isikuandmete kaitse üldmääruses (GDPR) ja isikuandmete kaitse seaduse (IKS) §-s 6 sätestatud nõudeid. Kui uuring põhineb eriliiki isikuandmetel, tuleb uuring eelnevalt kooskõlastada asjaomase valdkonna eetikakomitee poolt (IKS § 6 lg 4).
Andmekaitse Inspektsioon kooskõlastab andmesubjekti nõusolekuta toimuva isikuandmete töötlemise teadusuuringutes ainult kahel juhul:
- 1. kui uuringus töödeldakse eriliiki isikuandmeid ning puudub asjaomase valdkonna eetikakomitee (IKS § 6 lg 4).
- 2. tegemist on täidesaatva riigivõimu poolt poliitika kujundamise eesmärgil tehtava uuringuga (IKS § 6 lg 5).
Muudel juhtudel ei pea isikuandmete töötlemist teadusuuringutes eelnevalt Andmekaitse Inspektsiooniga kooskõlastama.
Seega oleks teil otstarbekas konsulteerida oma partneri Eesti Statistikaametiga ja selgitada, kas või millisesse kategooriasse OECD uuringuprojekt kuulub. Seejärel saaks inspektsioon vajadusel anda konkreetsemad juhised.

Thank you for your letter.
Without knowing specific details of your research project and the opinion of Statistics Estonia, the Estonian Data Protection Inspectorate (EDPI) can only provide a general explanation and an overview of relevant legislation. In processing of personal data in Estonia you must follow General Data Protection Regulation (GDPR) and paragraph 6 of the Estonian Personal Data Protection Act. The processing of special categories of personal data in research must be approved by the ethics committee of the relevant field (§ 6(4) of the Personal Data Protection Act).
According to regulation of Personal Data Protection Act the controller must acquire prior approval of the processing of personal data for research purposes with the EDPI only in two cases:
- 1. if special categories of personal data are processed in the survey and there is no ethics committee in the relevant field (§ 6(4) of the Personal Data Protection Act).
- 2. it is a study conducted by the executive power (government agency) for the purpose of policymaking (§ 6(5) of the Personal Data Protection Act).
In other cases, the controller does not need to apply for prior approval with EDPI.
Therefore, it would be useful for you to consult with your partner Statistics Estonia and explain whether or to which category the OECD research project belongs. The EDPI could then issue more specific instructions if necessary.

I hope you are well.
We are currently conducting an OECD research project that relies on the EUROMOD database provided by Statistics Estonia through their remote server environment. For this work, we require access to personal data of special categories—specifically variables related to health and disability benefits—in order to analyse income and employment dynamics.
Our counterparts at Statistics Estonia informed us that access to these special‑category variables requires prior permission from the Data Protection Inspectorate before they can be made available to us. They advised us to contact you to initiate this process and to confirm whether AKI approval is required for our study.
We would be grateful if you could let us know the procedure to follow, as well as any documentation or forms we should prepare as part of the application.
