Dear Members of the CDNET,

In accordance with its terms of reference, interested civil society organisations may apply for observer status with the CDNET, in line with Resolution CM/Res(2021)3 on intergovernmental committees and subordinate bodies. As a general rule, upon their request to the Secretary General of the Council of Europe, observers are admitted to steering committees on the basis of a unanimous decision by the steering committee.

In January 2026, the Secretariat informed the CAI, with Permanent Representations of Member and Observer States in copy, of the Terms of Reference of the CDNET and the possibility for civil society organisations to apply for observer status with the CDNET. The Secretariat underlined that the Council of Europe welcomes and promotes the widest participation of civil society, in line with the Guidance note on Civil Society Participation in the Intergovernmental Work of the Council of Europe (CDDEM(2024)14), as Observers.

Several civil society organisations subsequently submitted requests for observer status, including organisations that had observer status with the CAI (former CAI civil society observers), as well as new civil society applicants with no previous observer status in the CAI.

On 30 January 2026 and 10 March 2026, consultative meetings of the former CAI Bureau and the Secretariat of the CDNET took place, including on the procedure for admission of civil society observers. The following approach, in line with Resolution CM/Res(2021)3, was agreed:

• * Former CAI civil society observers that have applied for admission as observers to the CDNET be admitted by written procedure prior to the first meeting of the CDNET (15-17 April 2026).

• * Request for observer status from civil society organisations that have not been previously admitted to the CAI as observers would be examined at the first meeting and that online or in-person presentations be organised for these organisations. Members of the CDNET would then take a decision in camera in accordance with Resolution CM/Res(2021)3. A separate e-mail will shortly be circulated to the entire CDNET setting out the details of this procedure.

Against this background, please find enclosed a table listing the former CAI observers that have applied for observer status with the CDNET.

Please note that, pursuant to Article 8.A (Observers) of Resolution CM/Res(2021)3, the admission of civil society observers takes place on the basis of a unanimous decision by Members of the CDNET (Council of Europe member States). 

We would therefore be grateful if you could send us any objections to the admittance of any civil society organisation listed in the attached document by 25 March 2026. In the absence of objections, the listed observers will be admitted and invited to the CDNET.

The Secretariat would also like to take this opportunity to recall that some member States have not yet nominated their delegations. As several decisions requiring a vote by member States will need to be taken in the period leading up to and during the first meeting of the CDNET, including in the context of the present written procedure, delegations concerned are kindly invited to submit their nominations as soon as possible.

Conformément à son mandat, les organisations de la société civile intéressées peuvent solliciter le statut d’observateur auprès du CDNET, conformément à la Résolution CM/Res(2021)3 relative aux comités intergouvernementaux et à leurs organes subordonnés. En règle générale, à la suite d’une demande adressée au Secrétaire Général du Conseil de l’Europe, les observateurs sont admis auprès des comités directeurs sur la base d’une décision unanime du comité directeur.

En janvier 2026, le Secrétariat a informé le CAI, avec les Représentations permanentes des États membres et des États observateurs en copie, des termes de référence du CDNET ainsi que de la possibilité pour les organisations de la société civile de solliciter le statut d’observateur auprès du CDNET. Le Secrétariat a souligné que le Conseil de l’Europe accueille et encourage la participation la plus large possible de la société civile, en qualité d’observateurs, conformément à la Note d’orientation sur la participation de la société civile aux travaux intergouvernementaux du Conseil de l’Europe (CDDEM(2024)14).

Plusieurs organisations de la société civile ont par la suite soumis des demandes de statut d’observateur, y compris des organisations qui disposaient déjà de ce statut auprès du CAI (anciens observateurs de la société civile du CAI), ainsi que de nouveaux candidats issus de la société civile ne disposant pas auparavant du statut d’observateur auprès du CAI.

Les 30 janvier et 10 mars 2026, des réunions consultatives entre l’ancien Bureau du CAI et le Secrétariat du CDNET ont eu lieu, notamment au sujet de la procédure d’admission des observateurs issus de la société civile. L’approche suivante, conforme à la Résolution CM/Res(2021)3, a été convenue :

• * Les anciens observateurs de la société civile du CAI ayant sollicité leur admission en tant qu’observateurs auprès du CDNET seraient admis par procédure écrite avant la première réunion du CDNET (15-17 avril 2026).

• * Les demandes de statut d’observateur émanant d’organisations de la société civile qui n’avaient pas été précédemment admises comme observateurs auprès du CAI seraient examinées lors de la première réunion du CDNET et des présentations en ligne ou en présentiel seraient organisées pour ces organisations. Les membres du CDNET prendraient ensuite une décision à huis clos, conformément à la Résolution CM/Res(2021)3. Un courriel distinct sera prochainement diffusé à l’ensemble du CDNET afin de préciser les modalités de cette procédure.

Dans ce contexte, vous trouverez ci-joint un tableau listant les anciens observateurs du CAI ayant sollicité le statut d’observateur auprès du CDNET.

Veuillez noter que, conformément à l’article 8.A (Observateurs) de la Résolution CM/Res(2021)3, l’admission d’observateurs issus de la société civile intervient sur la base d’une décision unanime des membres du CDNET (États membres du Conseil de l’Europe).

Nous vous serions reconnaissants de bien vouloir nous faire parvenir toute objection à l’admission de toute organisation de la société civile figurant dans le document joint au plus tard le 25 mars 2026. En l’absence d’objection, les observateurs listés seront admis et invités à participer aux travaux du CDNET.

Le Secrétariat souhaite également profiter de cette occasion pour rappeler que certains États membres n’ont pas encore désigné leurs délégations. Étant donné que plusieurs décisions nécessitant un vote des États membres devront être prises dans la période précédant et pendant la première réunion du CDNET, y compris dans le cadre de la présente procédure écrite, les délégations concernées sont aimablement invitées à soumettre leurs nominations dans les meilleurs délais.
