Subject: Appointment or reconfirmation of EU Member State members and

EEA Country observers to the Data Policy Committee

Your Excellencies,

Regulation (EU) 2023/2854 (Data Act) (1) confers implementing powers on the

Commission for the adoption of implementing acts, in accordance with Article 291(2) of

the TFEU. For this purpose, the Regulation provides that the Commission shall be assisted

by a committee (the ‘Data Policy Committee’) within the meaning of Regulation (EU) No

182/2011 (2).

The Data Policy Committee was already established by Regulation (EU) 2022/868 (Data

Governance Act) (3).

Following the above, a number of implementing acts need to be adopted by the

Commission in accordance with the examination procedure referred to in Article 46(2) of

the Data Act.

(1) Regulation (EU) 2023/2854 of the European Parliament and of the Council of 13 December 2023 on

harmonised rules on fair access to and use of data and amending Regulation (EU) 2017/2394 and

Directive (EU) 2020/1828 (Data Act)

(2) Regulation (EU) No 182/2011 of the European Parliament and of the Council of 16 February 2011 laying

down the rules and general principles concerning mechanisms for control by Member States of the

Commission’s exercise of implementing powers

(3) Regulation (EU) 2022/868 of the European Parliament and of the Council of 30 May 2022 on European

data governance and amending Regulation (EU) 2018/1724 (Data Governance Act)

Considering that the Data Policy Committee was last convened in 2023, you are invited to

update the information on your representatives to the Committee by confirming the current

representative(s) or by appointing new representative(s).

EU Member States are kindly requested to communicate the names and contact details of

their appointed member(s) of the Committee to [email protected] within 2

weeks of receipt of this letter.

Similarly, EEA countries are kindly requested to communicate the names and contact

details of their appointed observer(s) of the Committee to the same address within the

same timeframe.

Indicatively, the committee will likely be convened in April 2026.
