FORMAL ACCESSION AGREEMENT

between

the Ministry of Justice of the Republic of Serbia, represented by the Assistant Minister of Justice, Ms Jelena Deretić

and

the Academy of European Law in Trier (ERA),

represented by its President, Mr Jean-Claude Juncker and its Director, Mr Jean-Philippe Rageade

Art. 1 The Grand Duchy of Luxembourg, the State of Rhineland-Palatinate, the City of Trier and the Association for the Promotion of the Academy of European Law established a Foundation named the Academy of European Law Trier on 22 June 1992. The German federal states acting as one patron, the Federal Republic of Germany and the Sparkasse Trier acceded to the Foundation in 1994. Ireland acceded on 27 October 2000, Poland on 22 January 2001, the Hellenic Republic on 30 July 2001, Spain on 28 December 2001, Portugal on 24 June 2002, the Italian Republic on 25 July 2002, the Netherlands on 21 October 2002, the United Kingdom of Great Britain and Northern Ireland on 31 October 2002, Hungary on 6 March 2003, Sweden on 28 April 2003, Finland on 20 October 2003, Austria on 17 December 2003, the Slovak Republic on 9 March 2005, the French Republic on 28 June 2005, Scotland on 29 September 2005, Cyprus on 21 December 2006, Malta on 18 April 2007, Slovenia on 25 May 2007, Romania on 12 July 2007, the Czech Republic on 6 March 2008, Bulgaria on 25 October 2008, Croatia on 25 September 2009, the Republic of Lithuania on 30 November 2012, Denmark on 20 October 2014, the Republic of Latvia on 20 December 2016, the Kingdom of Belgium on 6 September 2017, the Republic of Estonia on 11 October 2018 and the Republic of Albania on 20 November 2023. The objective of the Foundation is to establish and operate the Academy of European Law Trier. Its task is to enable individuals and authorities involved in the application and implementation of European law in Member States and in other European States interested in close cooperation with the European Union to gain a wider knowledge of European law, in particular European Union law and its application, and to make possible a mutual and comprehensive exchange of experience. The Statute of the Foundation is annexed to this Agreement.

Art. 2 Pursuant to Art. 5 para. 1 no. 2 of the Statute, the Republic of Serbia will become a member of the Foundation with immediate effect.

The Republic of Serbia will contribute to the assets of the Foundation in the form of a single donation of €50,000 (fifty thousand EUR). This donation will be paid in five instalments of €10,000 each, the first due before 31 March 2025, the others to be paid annually before 31 March of the subsequent years until 31 March 2029 to an account indicated by the Foundation.

Art. 3 The Republic of Serbia will have a seat on, and voting rights in, the Governing Board of the Foundation pursuant to Art. 7 of the Statute.

Art. 4 The Republic of Serbia will enjoy the same preferential treatment in view of all services offered by ERA as the other members of the Foundation, in particular as regards judges, prosecutors, civil servants and parliamentary officials from Serbia attending events organised by ERA and in view of events organised upon the request of the authorities from Serbia.

Art. 5 This Agreement shall enter into force on the date of signature. Signed in four copies in Trier on June 14th 2024. Члан 1 Велико војводство Луксембург, држава Рајна-Палатинат, град Трир и Удружење за промоцију Академије за европско право основали су 22. јуна 1992. године Фондацију под називом Академија за европско право Трир. Немачке савезне државе као један покровитељ, Савезна Република Немачка и Шпаркасе Трир приступиле су Фондацији 1994. године. Ирска је приступила 27. октобра 2000. године, Пољска 22. јануара 2001. године, Грчка 30. јула 2001. године, Шпанија 28. децембра 2001. године, Португалија 24. јуна 2002. године, Италија 25. јула 2002. године, Холандија 21. октобра 2002. године, Уједињено Краљевство Велике Британије и Северне Ирске 31. октобра 2002. године, Мађарска 6. марта 2003. године, Шведска 28. априла 2003. године, Финска 20. октобра 2003. године, Аустрија 17. децембра 2003. године, Словачка 9. марта 2005. године, Француска 28. јуна 2005. године, Шкотска 29. септембра 2005. године, Кипар 21. децембра 2006. године, Малта 18. априла 2007. године, Словенија 25. маја 2007. године, Румунија 12. јула 2007. године, Чешка 6. марта 2008. године, Бугарска 25. октобра 2008. године, Хрватска 25. септембра 2009. године, Литванија 30. новембра 2012. године, Данска 20. октобра 2014. године, Летонија 20. децембра 2016. године, Белгија 6. септембра 2017. године, Естонија 11. октобра 2018. године и Албанија 20. новембра 2023. године. Циљ Фондације је оснивање и рад Академије за европско право Трир. Њен задатак је да омогући појединцима и органима који су укључени у примену и имплементацију европског права у државама чланицама и другим европским државама заинтересованим за блиску сарадњу са Европском унијом да стекну шира знања о европском праву, посебно о праву Европске уније и његовој примени, и да омогући међусобну и свеобухватну размену искустава. Статут Фондације је у прилогу овог Уговора.

Члан 2 На основу чл. 5 ст. 1 бр. 2 Статута, Република Србија постаје члан Фондације са тренутним дејством.

Република Србија ће допринети имовини Фондације у виду појединачне донације од 50.000 евра (педесет хиљада евра). Ова донација ће бити уплаћена у 5 годишњих рата од 10.000 евра по свакој, прва доспева пре 31. марта 2025. године, а остале ће се плаћати годишње пре 31. марта наредних година до 31. марта 2029. године на рачун наведен од стране Фондације.

Члан 3 Република Србија ће имати место и право гласа у Управном одбору Фондације у складу са чл. 7 Статута.

Члан 4 Република Србија ће имати исти повлаштени третман у погледу свих услуга које ЕРА нуди као и остале чланице Фондације, посебно у погледу судија, тужилаца, државних службеника и парламентарних званичника из Србије који присуствују догађајима које организује ЕРА и у погледу догађаја организованих на захтев органа из Србије.

Члан 5. Овај Уговор ступа на снагу даном потписивања. Потписано у четири примерка у Триру на дан 14. јун 2024. године.
