Dear members of the Network, Dear colleagues,

We are contacting you following our debate in Copenhagen about the forthcoming publication (early 2026) of the number of the first instance review decisions in the next year edition of the Single Market Scoreboard. Since we want to be sure that we publish correct data, we would like to share the input with you for the last check.

Please find enclosed 3 documents:

1. 1. Detailed description of what should be counted among the first instance review decisions. Please read it carefully and let us know any questions you may have. The description takes into account the debates in the past, so it should reflect some of your national specificities, but if you still identify a case that is not covered, please let us know. If you cannot provide data as indicated, please let us know in order we include this information in the “disclaimer” that will be published together with the data.

2. 2. Document containing “disclaimer” on the data. Please insert your disclaimer only if your data do not cover some of the decisions as indicated in the first document.

3. 3. Table with data for 2023 and 2024 for your check and possible correction.

The number of the first instance review decisions will be presented together with the proportion of the first instance review decisions on the number of calls for competition from your respective countries taken from TED (you don’t need to give us this number). Therefore, there will be two graphs per year, absolute numbers + relative numbers.
