Firstly, apologies for the delayed response. It took some time to consult with our legal department. Below you can see responses to your questions.

 

1. 1. Can we submit our offer as a renewal of the existing Meltwater contract signed in December 2022, with only commercial updates (term, products, pricing)?

Response: You may not submit the offer as renewal of the contract.

 

2. 2. Can you please confirm that submitting the offer on this basis would not be considered a disqualifying factor?

Response: The tender must be submitted in accordance with the requirements; non-compliant tenders will be excluded from further procurement proceedings.

 

3. 3. After contract award, would you be open to negotiating contract terms, or do all terms need to be final at the tender stage?

Response: The contract will be concluded on the basis of the draft contract, and no material amendments will be made thereto.

 

4. 4. Can the agreement be concluded by accepting Meltwater’s General Terms and Conditions as they are, or by renewing the existing contract under the same terms?

Response: The contract will be concluded based on our draft contract, and the existing contract will not be renewed. Should you have critical conditions that are a prerequisite for the use of the system and are aligned with the documents provided in our invitation, you may outline these terms in your tender (provided they do not contradict the requirements set out in the invitation to tender). However, your standard terms and conditions will not become part of the procurement contract.

 

5. 5. Is it acceptable to submit the offer using order confirmation? 

Response: Any format that fulfils the requirements set in tender documents is acceptable. Please also consider the requirements set out in Annex 2 when submitting your offer.
