ÜRO inimõiguste perioodilise ülevaatuse vahearuande esitamisest

Austatud kolleeg Eesti esitab ÜRO inimõiguste perioodilise ülevaatuse (Universal Periodic Review UPR) käigus kolmanda inimõiguste aruande oktoobris 2020 (https://www.ohchr.org/Documents/HRBodies/UPR/UPR_3rd_cycle.pdf) ning aruande arutelu Inimõiguste Nõukogus toimub 2021. aasta jaanuaris-veebruaris. Eesti esimene inimõiguste ülevaatus toimus 2011. aastal, teine 2016. aastal, aruanded esitati 2010. aastal ja 2015. aastal. Kuna inimõiguste ülevaatuseks tuleb aruanne esitada iga viie aasta tagant, siis on üha enam riike järginud head tava ja esitanud vahepealsel perioodil vahearuande inimõiguste ülevaatusel tehtud soovituste täitmisest ja edusammudest inimõiguste edendamisel soovitustes märgitud valdkondades. Inimõiguste Nõukogus 2016. aasta teise Eesti inimõiguste perioodilisel ülevaatusel tehtud soovituste täitmise vahearuanne tuleb esitada 2018. aasta lõpuks. Eesti aruanded ja vahearuanded on kättesaadavad Välisministeeriumi kodulehel https://vm.ee/et/tegevused-eesmargid/inimoigused/eesti-upr ning aruanded koos soovituste ja teiste asjakohaste dokumentidega ÜRO inimõiguste ülemvoliniku kodulehel https://www.ohchr.org/EN/HRBodies/UPR/Pages/EEindex.aspx. Inimõiguste ülevaate aruannete ja vahearuannete koostamist on juhtinud Välisministeerium ning sellesse on kaasatud asjassepuutuvad ministeeriumid ja kodanikuühiskonna esindajad. Välisministeerium on alustanud 2018. aasta vahearuande koostamist ning koondanud kirjale lisatud tabelisse kõik eelmise aruande arutelu ajal riikide tehtud soovitused. Tabelis on ära märgitud, kas Eesti on soovitusega nõustunud (142 soovitust) või selle tagasi lükanud ning teadmiseks võtnud (39 soovitust, mis on välja toodud kursiivis). Tabelis on Välisministeerium ühtlasi toonud välja soovituse täitmise ja teema eest vastutava ministeeriumi.

Välisministeerium palub, et ministeeriumid, vajadusel koos oma allasutustega, vaataks üle nende pädevusse kuuluvate soovituste täitmise ning teeks tabelisse vastava märkuse – kas soovitus on täidetud või kas soovituse täitmiseks astutakse vajalikke samme, milliseid meetmeid on võetud ja milline on soovituse täitmise kavandatav ajagraafik. Teave peaks olema lühike ja konkreetne, mida saaks esitada tabeli vormis, kuna pikemalt ja sisulisemalt käsitletakse kõiki soovitusi juba 2020. aastal esitatavas Eesti kolmandas aruandes. Palume samuti üle vaadata Eesti poolt tagasilükatud soovitused ning võimaluse korral esile tuua edusamme inimõiguste edendamisel ka nendes valdkondades. Palume ühtlasi tabelit täiendada, kui viited vastutavatele ministeeriumitele pole asjakohased, vajadusel lisada allasutused, kes vastutavad soovituste täitmise eest. Lisaks tabeli täiendamisele palub Välisministeerium lühikest ülevaadet, milliseid edusamme on tehtud inimõiguste tagamisel soovitustes käsitletud valdkondades ministeeriumi haldusalas.

Välisministeerium palub tagasisidet hiljemalt 28.09.2018. Välisministeerium täiendab tagasiside alusel tabelit ning koostab selle juurde lühiülevaate inimõiguste edendamisest soovitustes käsitletud valdkondades. Seejärel saadetakse informatsioon arvamuse andmiseks õiguskantslerile, võrdõigusvolinikule ning kodanikuühiskonna esindajatele.

Lõplik vahearuanne edastatakse ministeeriumitele uuesti kooskõlastamiseks. Välisministeerium planeerib aruande ÜRO-le esitada 2018. aasta detsembris.
